Notice of intent to escalate my complaint to regulators.

 

 

Dear Sir/Madam,

 

This letter is to advise that following my repeated attempts to seek resolution of my account disputes with yourselves,you have continually shown a lack of regard to the procedures that you are required to follow in accordance to guidance laid down by the OFT and therefore I feel justified to take my complaint to regulators.

Specifically I draw your attention to the following;

 

1.Despite informing you in writing that I disputed alleged debts on my account namely £.........

in letters to you sent by me on...........................

you have continued to pursue collection of this.

Your attention is drawn to the OFT guidance on debt collection practice in particular;

 

Physical/Psychological harassment section 2.5 sub h

"ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment "

 

Deceptive and/or unfair methods section 2.8 sub i

"Failing to investigate and/or provide details as appropriate when a debt is queried or disputed possibly resulting in debtors being wrongly pursued"

 

2.8 sub k

"Not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

 

You should,as holders of a consumer credit licence,be seen to be upholding conditions and standards laid down by regulatory bodies it is my thoughts that you do not appear to be operating within these conditions.

 

I shall now be forwarding a complaint to both Trading standards and the Financial Ombudsman and will provide them with information which clearly shows that I have repeatedly sought to resolve matters in good faith.

 

Finally I note your comments of ..........in which I was informed that my account will be/could be closed.

The FOS take a serious view of banks closing accounts as a result of account holder disputes/for reasons that cannot be explained to show that closure is justified.Recently a number of banks have been fined for such actions.

If such action is enforced I will apply to the FOS for a compensation award to be made against yourselves.

 

I trust this clarifies my position.If you are in any doubts as to the seriousness of my complaint or my resolve to have my complaint dealt with to my satisfaction,I suggest you pass this letter to your legal department forthwith.

I got a letter Saturday dated the 6th from Moorcrfot Debt Recovery Ltd saying the abbey have instructed them to collect my "overdue debt"

 

It say I have 7 days to submit payment in full (so till 13th) otherwsie leagal proceedings will be taken gainst me...

 

I sent, the letters to the abbey previously as some of you have advised... where do I stand now?? what are my options??

ACCOUNT IN DISPUTE

 

Dear Sir/Madam,

 

Your ref:

 

 

Thank you for your letter of **DATE**, the contents of which are noted.

 

 

I am disputing the total value of these debts with **BANK** due to unlawful and unreasonable charges. As such, therefore, I consider this account to be in dispute and no further action or payment shall be made until this matter is resolved.

As per OFT guidelines Section 2.8k "not ceasing collection activity whilst investigating a reasonably queried or disputed debt."

 

This process may take some time, due to the Office of Fair Trading's test case, but I will try to expedite this issue as a matter of urgency.

 

Consequentially any legal action you pursue will be averred as both UNLAWFUL and VEXATIOUS.

 

After taking advice, I am of the opinion that your continued pursuit is in violation of the Administration of Justice Act 1970 section 40, Protection from harassment Act 1997 section 3 as well as breaching a number of the OFT Collection Guidelines.

 

I reserve the right to report your actions to any such regulatory authorities as I see fit.

You have 14 days from receiving this letter to contact me with your intentions to resolve this matter which is now a formal complaint.

 

I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you would prefer to do this than merely respond with standard letters and leaflets.

 

I would appreciate your due diligence in this matter.

 

I look forward to hearing from you in writing.

Yeah my claim is on stay for the bank charges...

 

Hadn't heard anything from the abbey after my last letter for ages till this from Moorcroft Debt.

 

guess this means they must of put a default on my credit score too...

check your credit file with experian, they shouldnt do, but we all know that they shouldnt do stuff but they do, if they do file at court you counter claim for your charges and removal of a default

Hey guys,

 

I just got something through out of the blue.. Its the first contact I have had from Abbey since they frooze their action against me..

 

The letter is labelled a Transaction Summary Statement and it has a notice date on it that appears back dated to 15/08/2009. Along with a balance due.

 

At the bottom of the letter it has in a a box "Dispute Resolution".

"If you have a problem with your agreement, please try to resolve it with us in the first instance. If you are not happy with the way in which we handled your complaint or the result, you may be able to complain to the Financial Ombudsman Service. If you do not take your problem with us first you will not be entitled to complain to the Ombudsman. We can provide details of how to contact the Ombudsman."

 

Does anyone know what this letter means, or is about?

Hi,

 

I have recieved a similar 'statement' this morning, with a figure of £314 as the 'balance'. Does anyone know what these statements are, I haven't heard from Abbey for about 2 years, am I in 'credit' by this much as the figure does not show as a minus figure.

 

Any advice would be great?

I too have received one of these. It has a statement opening balance & net balance of £1290.

My situation is that my abbey account got passed over to a debt collection company. They were demanding £2580 and I agreed to pay them three monthly installments of £430 to settle.

The balance they are quoting is the amount I paid the debt collection company but it's also the amount that was 'discounted'. I do recall them saying abbey would not be able to pursue me for the remainder if I stuck to the agreement.

I do have an unfair claim charge against them but I don't think its anything to do with that.

I have no idea what agreement they are referring to in the letter. As far as I am aware my account with them is closed. I tried the number supplied but got a next to useless recorded message.

Thanks for the reply, have you tried ringing the Abbey to see whether the balance figure on the Transaction Statement is 'credit'? I have tried to ring them this morning but I have no longer got my card so I can't enter the 16 digit card number and the automated line redirects me elsewhere.

 

Has anyone managed to actually go into a branch to discuss this with the Abbey?

 

I would be interested to know why the 'statement' shows £314 (with no minus before the figure) this implies I may be owed this money???

Received a 'follow on' statement. Still haven't been able to talk to human about this.

Any chance you can scan in whole letter? (obvioulsy with your private details erased)(I would mine but I dont have a scanner)

Maybe somone out there like Bankfodder that knows what they are talking about can have a look and let us know what they think??

Tiggywinlke2009 has scaned her copy of this letter which we all seem to be getting, does any one have any idea what to do? This must be shabbys new tactics, I recd all my bank charges back in 2007 after my claim was transfered to the Mercantile Court in the Strand a wk before my case was due to be heard. I thought I would be cheeky and asked for cost which i recd, while I was negotiating I asked the woman I was dealing with to confirm the status of my acc which had a default of £818.27 this also happens to be the exact amount on the letter I recd today. She told me to contact my local branch who told me my acc was closed with nothing outstanding. I had no further contact from abbey till today, over two years later. These people are something else, so all this time I have been blacklisted by Abbey. Please advice I am in a kick arse mood.
