I have a mint credit card (RBS) who subscribe to the banking code which clearly states that -

 

"We will help you use your account or service by sending you regular statements"

 

I have not received any statements by paper or any other means including electronic for over 12 months. Would this be worth complaining to FOS about?

The only man who sticks closer to you in adversity than a friend is a creditor.

 

Debt Collection Charges

 

There is no legal basis for a creditor or a debt collection agency acting on its behalf to claim collection costs from a debtor unless there is an express provision in the original agreement.

 

Without such provision, collection charges cannot be demanded as a debt due under the agreement.

If you've not recieved any form of statement for over 12 months on an active account, I would think you have every ground for making a formal complaint to the CC company and the FOS. If you've asked for statements and not recieved them, you have grounds for complaint under the Data Protection Act.

Abbey - over £4k - Court claim issued & AQ filed ('Tish vs Abbey'). Alloc'n Hearing 21 Sept - Claim stayed 29/8/07.

Cap One - just under £2k - WON (just over 2k!)('Tish vs Cap One')

Cap One - just under £1000 - WON (just over £1k) Nov 07 (JimmyBoy vs Cap One)

Lloyds TSB - £3.5k - Court claim issued, defence rec'd and AQ filed; Alloc'n hearing 7th Sept Claim stayed 29/8/07! (JimmyBoy vs Lloyds')

MBNA - over £1k for mis-sold PPI - WON - approx £1500(IpswichWitch vs MBNA . . .)

Hi, Can i ask how you got on with this? My husband has the same senario with a Lloyds credit card and they finally admitted the other day that they placed a 'statement hold' on the account at least 18months ago.
