      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I sleep with my dugs every night (in the snoring sense)! All three of them:D. Usually one on the bottom of the bed and one either side but when OH is away I have all three on the bed, and our old cat under the covers next to me. This weather it has been a three dog night.

Yep we have central heating too but dogs are much better!! Mine are not small either - one German Shep/Welsh Collie Cross and two Dalmatian/Foxhound Crosses.

Ocht, I'm only jesting.

 

 

Tired tonight H-c. I'm clearing up after the tradesmen who are fitting my dble glazing: stoor everywhere and the job's not done yet.

 

There are holes right through from the bedrooms to the outsdide allowing the cold air to rush in.

 

Does anyone on this thread know if the foam used to seal around the windows is the same as the stuff for cavity wall insulation? My asthma has been really bad and there's loads of that foam bulging into the room. I still haven't slept because my breathing was so bad through the night.

Well, that may be true, Rooster UK, but I'm Scottish first and foremost. However, a body doesn't have to be the same as me for me to like them. I rather appreciate the diferences.

 

LOL! Heck, if everyone was the same as me, I think I'd have to emigrate planet fashion coz I find me difficult enough to live with and I got little choice.

 

BUT, I know Scots who do hate the English or think they do (doubt they know them all). I've also experienced English folk with little time for the Scots. Most Scots are reasonable and I have to reitterate that I received a tremendous amount of warm hospitality when I lived in England, even in London: welcomed into families who asked me to treat them as my own.

 

I don't like, black folk, I don't like French folk, I don't like yellow folk, I don't like gay folk. I don't like Germans, I don't like Greeks, I don't like thin folk, I don't like fat folk.

 

I LIKE NICE FOLK and don't care where they're from or what their colour or size: it's the hearts and characters that concern me. Never liked anyone because of their religion, their nationality or their shape/size: only because they were appealing as folk.

Love your "sharn yarn", Rory. It was always the "sharn" was mucked oot o' the byre in Orkney where I was brought up. In later years I had a friend called Sharon but my dad insisted in calling her Shairon. She kept correcting him and I did advise him that it was really annoying her.

 

His reply, "Maggie, dear, I could never bring my self to look a woman in the face and call her cow sh**".

Prejudice is a funny thing. I am lucky that I was born into a generation that didn't really care about what colour, religion or whatever people were. And I truly hope I am bringing my kids up in the same way. My late Dad, who was Scottish through and through, had reasons to distrust most people - to my disgust as a teenager, but then he did fight in WW2 as well.

 

But you can understand why modern prejudices come about - people abusing the benefit system I think is the main issue. One of my best friends is Indian and she saved me from being expelled from school as we were caught smoking together and the school were too afraid of the repercussions if they expelled her:D. So they couldn't expel me either!
