I Recieved The Same Reply From Llyods But At The End Of The Letter They Say This Is The Banks Final Response. Do I Still Send The Lba Or Do I Go Srtaight To Claim And If I Do Send Send Lba Do I Change The Wording As They Have Responded To My First Letter.

I'd think the original moneyclaim total. You could always phone the court to check.

i think the fee is based on the original moneyclaim amount, though not 100% sure. my claim is over £1500 so i had to pay an additional £100 which i did yesterday when i returned my allocation questionaire to birmingham county court

well I sent my AQ back yesterday to the court for the original claim amount of £1485.41. I guess the interest is a matter from SC & M at a later stage.

 

sent AQ back to SC & M today, both by recorded delivery so at least I can check that they arrive.

 

now the waiting game............. again! the only thing keeping me going is knowing that it should all be worth it in the end

Moo. I'm waiting for the postie in the morning.....I won't hold my breath..sechiari supposed to have sent me the letter Friday.. I'm guessing it's about the "stay" from the courts, but I'll post on here as soon as I get it.

had some bad news yesterday. I was one of Farepak's customers, lost £400 of shopping vouchers with them going bust, all my christmas spending money. absolutely gutted, so relying on this money to come thorugh even more now

oh no, I didn't hear about the Fairpak news...swines..it's always the little people who lose out..........

 

since the bank not letting me have my income support last Xmas etc.... this year I decided to "shop early" so since September I've got the odd pressie so if it goes pear shaped the kids will still have some goodies......it's bloody hard, isn't it..if only they knew what "real heartache" is..eh..!

 

I just want everyone on here to get their just deserts, and whatever the settlement means to each individual, we know that the "little person" got justice, if only after the event..in the end...we deserve a break for all the tears we've shred..

Im coming up to it now cos my AQ's had ot be back for tomorrow, so lets wait and see what I get!!

 

they has been some talk about the government trying to get something sorted with the retailers consortium to try and give something back to the thousands of people who have lost money.

 

As for the company's administrators, all they have said is we will probably only get a percentage, and it could be as long as 9 months!! not holding my breath on that one!

looks like i am at the same stage as yourself and freebird, so i will keep watching your threads to see how your doing.

I sent my AQ back to birmingham county court on 9th october,and i recieved a copy of the AQ from Sechari clarke and mitchell, which i noticed says they cant attend any hearings etc for the month of october. They requested a copy of my AQ, but in my haste to get it back to the court i forgot to take a copy of it! Dummy!

Not sure if this will be a problem or not so i was thinking of sending them a letter confirming receipt of the AQ and providing them with a draft of the info contained in it which was basically the text from jonni2bads's guide to compeltion of the AQ, as described by Michael earlier in this thread.

I got my AQ back from SCM today, saying they want a stay of a month and are not available for October or November!! Grrrrr!!

 

Will have to wait for the court date to come through now, and then I shall start with the letters!!

definately freebird, just caught up with your thread, and nice one that they have finally offered, but you stick to your guns girl and dont let them impose conditions on you!!

 

Quick question, my 28 days for AQ were up last Tuesday (24th). I have received SCM AQ back, but had nothing from the court. Will I get a letter stating what happens next? And at what point did you start to negotiate with SCM after the date was issued? Straight away?

No. no one said when to start negotiations but I figured that as Lloyds were asking for the whole month of October to negotiate settlement then I would initiate these negotiations and contact them asap on the 1st.........I sent the first letter 29th Sept so they would get it, but don't forget their inward mail goes through their "clearing dept" so they mightn't read it for a few days !

I've been faxing lately as they get it straight away.

Even though I had the verbal offer a few weeks ago via the telephone conversation..they still havn't confirmed it in writing and the 2 letters they've supposedly sent me are still "on their way !"

I'd phone and fax if I was you.....

Is your contact Mr. Thomas? if so just keep trying he's always "out"

thanks freebird, where can I find who is dealing with the case at SCM? The AQ is just electronically signed with SCM, no name??

 

will I need to ring the court to see if a date has been set? Or will they send me a letter? With it being a week tomorrow after the deadline for the AQ's, I was sure I would have received something by now.

 

As for farepak, not much hope. Had to put a claim in, which my agent has done. They have said we might get back something, definately not all, and it wont be before Christmas, some people even saying it would be 9 months before we would hear anything?! :o not holding my breath in the slightest, and I'm not a patient person at the best of times, but had plenty of practice with this bank thing!!!

I had a reference number from them and MFT was in it and that's Mr. Thomas so I gues the best thing would be to give them a call and ask who's dealing with your case and are they in? nothing like taking the bullet by your teeth and speaking with them there and then ! You can also phone the court for guidance re timing of court date or pending stays, they'll probably tell you more than Sechiari.........

Pits re Faipack, bloody swines..God I hope you hear asap re the claim............

The letter attached to the AQ has the reference with MFT in it, so looks like im dealing with the same person..........................

well I've just phoned my court, and they say that it has gone to the District Judge, so as soon as he has decided upon a hearing date, he will get in touch.

by the way, things are looking up on the farepak front. Theyve set up a charity fund with Tescos and sainsburys to help those who lost vouchers (thats me!) so I might get something before Christmas. All this, and my hubby did his first day at work as a permanent employee yesterday as well!!! Things are looking up!

 

just need SC&M to play ball and it will be a very merry Christmas!!

well, i got a letter from the court today, saying SC&M have had a stay granted until 6th December. We now have until 18th December to reach a settlement. Im hoping that this means I'm gonna get something before xmas, but not holding my breath.

 

1st phone call to SC&M tomorrow i think.
