I have just worked out that since 2002, LlydsTSB owe me £2983 + Interest in charges.

 

I have used the letter titled: "request for payment of charges"

 

To what address do I need to post this too?

 

I will keep you all informed of my progress. I am an avid Forum occupier and tend to over communicate :)

I am starting this as a new thread, so that I can clearly see my own timeline and you guys can also keep track if you wish to do so.

 

I have sent the standard letter from your library (many thanks for supplying this). Plus I have emailed 'contact.us@lloydstsb.co.uk' and 'contact.us@lloydstsb.com' with the same letter.

 

The financial information I provided on the "stock" letter was obtained from LloydsTSB great Online service. This only goes back as far as July 2002 however. As I had obtained just less that £3000 (without interest) back to this date, I decided to put the claim in for that.

 

I have also requested via the DPO that I have my records going back 6 years using the stock DPO letter supplied by your good selves.

 

In preparation in what is to come, I will try and get down to the county court to watch a couple of cases, to prepare myself for the worst.

Let us know how things develop.

 

Take a copy of the McNamara sound file in the library and the transcript.

Please do check the trancript against the sound file as this has not been done and let us know if there are an errors.

This recording is very compelling evidence against Lloyds and would be of very great assistance in your case.

I have sent the letter to the bank (please see LloydsTSB sectione for full details). I do have a question however about the letter. Are these amounts the correct ones to give:

 

A. Amount of charges paid over 6 years

B. Amount of interest as generated by the spreadsheet in the Library

 

or

 

A. Amount of charges paid over 6 years

B. Amount of interest the bank has charged in Overdraft interest

 

???

This question has come up a few times and I'm getting confused.

 

If the bank takes a charge from my account, then as long as my account remains overdrawn they are charging me interest on that charge.

 

In this case can i ask for the charge back plus the interest they have applied on the charge?

 

However should i clear my overdraft do i claim the interest they applied on the charge up until i clear my OD and then at 8%?

 

Or do i forget the interest they have charged and just ask for 8%.

 

It seems that they are applying unlawful charges then getting between 18% - 30% interest on these charges, do the calculation and if you don't clear your overdraft thats a hell of a lot of interest, in fact far more then the original charge in some cases.

It probably should be refunded and there is nothing to stop you asking for it. Quantifying it is another matter. To do so you would need to track your total balance and charges balance on a daily basis and calculate interest daily (using the prevailing rate at the time) on a daily basis as well. Someone was going to prep a spreadsheet to do this but it's a really messy calculation.

Personally, I would stick to the outlines of this forum. Anything outside of it may hinder your request for your charges back.

 

Things I am claiming back:

 

+ Overdraft Excess fees (started at £20, then £25, then £30 as go)

+ Returned Direct Debit (£25 a go)

+ Returned Standing Order (£25 a go)

+ Interest on the above charges at the time they charged me (by using spreadsheet)

 

That is all.

I am going to telephone the bank and try and get this charge back via telephone tomorrow. I will also record the call on my mobile (mp3) and if I can legally share it with you all, I shall.

ok, I have called the Helpdesk (In India) and informed them that I am recording the call for training and monitoring purposes, the lady said that that was fine. After I explained I would like my charge for £30 back, so said she would have to pass me on to a specialist.

 

The specialist was from the personal banking team in the UK. I again said that I was recording the call for Training and Monitoring purposes and he was like, "yeah sure, no problem".

 

OK, so I explained that I would like the charge back and he said, I can't do that due to the terms and conditions of your contract. I asked if the charge was automatically applied to my account, and he said.....wait for it.... "yes".

 

:)

 

He said that it was a case for the financial Onbudsman. I informed him that this goes beyond that as it is illegal to charge me £30 under UK law and that the charge was punitive. I asked for a manager, but they don't get in until 09:00. So one will call me back at 09:00.

 

That gives me time to look at what UK laws apply.

 

This is like a mini dry run of the court procedings :)

I have spoken to:

 

Personal banking team

Central collections Dept

Concerns department

Local Branch

 

I have issued the statement "I am recording this for training, monitoring and legal reasons" and they have all said, "yes, ok".

 

I will edit the mp3 before uploading.

 

They all informed me (and was recorded) that no manual intervention had occured in charging me and it is purely an automated process. The personal banking person (bless him) even clarified this for me :D

 

The upshot so far, is that:-

 

Indian Call center could not do anything

Passed me to Personal Banking Dept

 

Personal Banking Dept could not do anything

Passed me through to Collections Dept

 

Collections Dept could not do anything

Passed me through to Concerns Dept

 

Concerns Dept could not do anything

Passed me through to Local Branch

 

I am now waiting for a call from the Branch Manager.

 

They all seem quite confidant of the charges etc, etc. Once I start stating that they are breaking "Common Law, Statue and Recent Consumer Legislation", that is when they stat to say, I will just pass you on to another department.

Branch manager just called and said that the £30 is going to be paid back to me, but she also said to make me aware, that it is because I am a valued customer, blah, blah, blah.

 

I did have to spend nearly an hour on the phone however.

sent reminder email on 17/4/06

called abbey on 19/04/06 to remind them:rolleyes:

sent another email on 26/04/06:mad:

Approx charges £2500

received £500 refund in dec 06

sent LBA

Capital one- sent DPA letter 17/03

Sent prim letter for charges of £260 14/04

Received a refund £109 awaiting further refund of £151

Settled IN FULL

Barclay card- Sent DPA letter 17/03 sent reminder 14/04

received info claiming £120

settled in FULL

I must admit, I managed to hang up once, when the Branch manager phoned. I was too busy fumbling and trying to listen to her introduce herself. I guess the best way would be via hand free.

 

Also, if you call them, they graciously give you all of that gibberish via an automated response first, so that give you time to press the button. I did practice first by calling my landline and going through the motions. :)
