  3. Hi All, I had a default from advanced payment solutions and I was told that the default notice was sent via email which I didn't receive so I am guessing it went into my junk box. I have tried to have it removed but was told that it was legally put onto my credit file. My questions are: 1. Is there anyway that I can get this default removed? 2. If I pay of the debt which is around £30 will this improve my credit file and will that prolong the date that it will drop off of my account as it is due to drop off in two years. Have been ignoring my 6 Payday loans and 4 other debts for several months now, the other companies don't appear to have put disproportionate amount of interest on to the debt but my Toothfairy loan has gone from the original amount of £300 up to £1438 since I took the loan out in late July and I get this email from them every 5 days: We are writing to give you formal notice that ToothFairy Finance Ltd - ToothFairy Pay Day Loan has legally assigned the rights of the above debt to Marshall Hoares Bailiffs. This means that Marshall Hoares Bailiffs Limited now legally own this debt.   5. Hello all, I apologise in advance if this is not the correct forum for this problem and hope that someone can point me in the right direction. The problem is I am being harrassed for an energy bill that I do not own. In June of last year (2015) due to my husbands ill health, we closed our business down. The energy was supplied by Opus Energy and up until we closed, the bills were paid monthly by DD. To cut a very long story shorter, Opus were advised, the meter readings were given and I forgot about them a few months later they started calling saying that there was an outstanding debt and my bills were not being paid (I had cancelled the DD when I closed the business) I explained to them again that I was no longer trading and sent them the readings again. It all went quiet again for a few weeks then they started again phoning me saying the bill was getting bigger and I needed to pay it or they would disconnect the supply. In the end I just ignored the calls as it was starting to get me down and I was extremely frustrated they didnt seem to get it that I did not owe them anything, there was in fact a new tenant in the premises. over the past 9 months they have continued to phone me most days, usually 3 or 4 times a day from different phone numbers leaving messages saying they were going to disconnect the services. i just ignored them all. I then got a letter saying that they were instructing advanced collection systems to collect the money and I started getting phone calls from them. I explained the whole story to this woman and I told her that I was seeking legal advice against them for harrassment . I then at her request got a letter from my ex landlord confirming when I vacated the premises and I gave her the meter reading I had. I also told her to pass on the message to her client to leave me alone and that if I heard from either of them again I would sue them. I have heard nothing from her I have today had a phone call from a Bluestone Credit Management regarding the debt which apparently is now £3,500. I havent spoken to them but they left a message. I am at my wits end with this. I really just dont know how to deal with it. My ex land lord confirmed that there had been 2 tenants in the premises since I had left and neither of them had registered for energy. Any help would be so appreciated.
  6. I received an email from cash plus asking to contact them. I did as requested, and spoke to a gentleman called 'Zwelli' who proceeded to ask an uncomfortable line of questioning. I was asked where my money was coming from, and I explained I have a business PayPal account and that all the payments made into the account are electronic payments which can be accounted for. Every single penny has documentation to show how it was earned and where it came from. This gentleman insinuated it could be money laundering - impossible as 99% of all money deposited was electronic payments made by BACS transfer from PayPal, and each PayPal transaction can be accounted for. I emailed a piece of information to them that they asked for, a url link to an advert posted online. Although I asked for confirmation that this was received, the email was not acknowledged. The following day, I suffered further humiliation when I found my card had been declined and I could not withdraw money from the ATM. I phoned the following day, but head office were not available as it was a weekend. I phoned the following Monday at 9am, only to be told by all staff that head office refuse to speak to me and will contact me in due course, with no set time frame or any information or reason to why my account was frozen. Them simply cite 'technical difficulties'. This has lead to literally hundreds of phone calls from myself in an attempt to pressure them into giving me answers but they refuse. They refuse to reply to my emails, and they refuse to talk to me. I obtained the head offices number and when I attempt to speak to them they divert me back to customer services who then tell me the same thing "head office are citing technical difficulties and won't speak to you". Either that or they are rude to me, tell me not to call them anymore and hang up the phone. The department dealing with my case refuse to talk to me at all and when I get put through to them they immediately put down the phone on me. Apparently they held a meeting to discuss the fact I won't stop calling them. This piece of information slipped out of one of the staff I spoke to on an unrelated department, the finance department. Yet still they will not call me and will not reply to my emails. I have now obtained the CEO Rich Wagners email address, and emailed him directly, he also will not reply to my emails. I have tweeted him on twitter, he doesn't reply. I tweeted the company and they blocked me. They currently have £1500 of my money, I can't use my card or log into my account, and they won't even speak to me to resolve this issue. I have offered to provide all documentation for every penny that went into the account - no reply. I don't feel I need to provide any information as I am entitled to my privacy, but I am willing to do it if needed. It is only a prepaid master card for people with bad credit history, not like I should have to jump through hoops when it's an account with no benefits. They will not let me close the account either. I only had this account as I had a poor credit history and my financial situation improved dramatically. Once I resolve this and have it closed I'm going to try and open a proper account again. However this does not help with the situation I'm currently in. In conclusion I am a sole trader, and without access to this money I am now sitting at home unable to work. I need the money to purchase stock and run the day to day operations of my business. I have explained this to the department handling my case and to the CEO Mr Wagner, but they do not care, I get no reply. It is bad enough they blocked my card and account and are withholding my money, but the fact that they refuse to even speak to me is the most frustrating thing. I have never, ever dealt with customer service as poor as this, and have told them I will be contacting media outlets and the financial obudsman. I do hope if anyone can help me that they please get in touch. I have found that they did the same thing to an 82 year old woman, froze her account and wouldn't let her close it until a journalist Tom Hazell contacted their CEO. I'm sure others must be having problems with this company and I would like to unite with those people to have Advanced Payment Solutions practices scrutinised. What they are doing to me is just plain wrong.
  7. Good morning all, Thanks for your recent help with my Lowell/Carter/Frederickson/Coop issue. I'm still waiting on the outcome. While dealing with the above, I requested a copy of my CRA file from Noddle and discovered that I have a default account with APS Ltd for £178.00. Date of default is 31/08/2012. Now APS did a prepaid credit card which i applied for ages ago and used for travel within Europe. Basically load required funds and use it instead of my main bank card. I suspect the charges are either a delayed transaction, or charges/interest of some sort. My questions; - Judging from my recent experience, how do I find out who currently owns the debt? Is there a template letter I should use and what am I asking for? Current owner? Total amount? Statements? CCA? - I haven't heard from APS at all! I wouldn't have known if I didn't check my file. What can I do about this? - I am volunteering to resolve the issue. In your opinion, can I negotiate a lower settlement figure or am I better off paying the whole thing? Would paying a lower figure affect how the settlement is recorded with the CRA? Apologies for the lengthy post.
  8. Hi, A newly opened Yoga places is offering a limited number of yearly memberships if they are prepaid in full. I been there lots the last month, I really like the place, it is convinient and the deal is great. Now the snagg, it must be prepaid in full, now I am being clever so paying it on my credit card for extra protection. I know I am going to use it so it pays of to get it BUT playing devil's advocate what are my consumer rights for a refund if I have an accident in lets say 6 month time and can't use it, or get evicted (not planning to but landlords are sometimes crazy) and move too far away. Could not find aything covering this in their T&C's and the girl on reception seemed very new so she couldn't answer. The nearest in the T&C's were this; "2.10 Subject to any statutory right of cancellation, payments for Memberships and Classes are non-refundable unless otherwise stated in these Terms and Conditions." So ignoring them and from a purely consumer rights perspective what are my rights to a refund if I have to cancel due to moving or for medical reasons? Is medical reasons and moving statutory rights? Hi, I recently received a letter from student loan company claiming that I owed them x amount on a student loan etc. I last deferred the loans at the beginning of 2006 so thought it was now statute barred. Just to be sure I sent them the 'prove it' letter to see what they would come back with. I waited a couple of weeks and heard nothing but then received a phone call from Link Financial Outsourcing claiming they were now dealing with the debt and could I confirm details etc. I just asked them if they could send any information through the post which they agreed to. Yesterday I received a demand for payment from them with the usual DCA threats on it and was all set to send them another prove it letter and then the statute barred on if necessary but decided to read up on Link. I've now discovered that the debt doesn't become statute barred until six years after the end of the last deferment which means it won't be SB until the beginning of next year. I've never made a payment on the loan and the last written contact was my deferment in '06. Any advice on my next move would be greatly appreciated. Thanks
  10. reading around I think I'm screwed but... I was in a rush today and I was collecting some pre-booked Advanced Single tickets for a trip next week using one of the self service ticket machines at the station and I printed them all but had to run for the train I mistakenly thought they had all printed when I got on the train I noticed too late that only the outward single had been printed not the return single... I spoke to the train conductor (It's a small off shoot of a larger train network so has conductors) who said he would phone the previous station when he got off at the next one and ask if they were still there I also phoned the lost property number and left a message with my contact details how screwed am I if they aren't found? would it make a difference If I just said they didn't print? after all I really don't know if they did or not Many thanks in advance.
  11. hi all, i am currently paying csa at £400 a month for my daughter who is 18 and in full time non advanced education, she only does 2 days week and not sure how many hours that entails as the training farm she attends are being pretty cagey when it comes to giving me details, i think its 9 till 3. should i be paying, as the csa guide lines state that the child does a minimum of 12 hours per week not including dinners, and also is the farm recognised by the secretary of state as being equal to a school or college, any help would be great, thanks.
  12. With all these adverts for PPI claims and asking for bank charges back, I was wondering if anyone knew if I could claim back mis-sold membership charges. I will explain my partner who is disabled with both physical and mental disabilities was contacted by HSBC over 12 Months ago, unfortunately I was not there to intervene on his behalf and he was upgraded to an Advanced Account at a cost of £12.95 per Month. After I found out recently about this I was angry and have now booked an appointment at the bank for next Tuesday. I feel the account was upgraded under false pretences as he is currently disabled he would not be able to take up their free Travel Insurance, he does not drive and therefore does not need their free break-down cover either. The only benefit he could take advantage of is their special rate if he goes OD which he has done several times and still been charged £12 for them authorising card payments when there is not enough money in the account and NO Overdraft Facility. Do we have a right to ask for the membership fees back? Any help would be gratefully received. And if anyone has a link that could be shared where I could print out his rights would also be helpful. Thank you
