  1. Hello all, I apologise in advance if this is not the correct forum for this problem and hope that someone can point me in the right direction. The problem is I am being harrassed for an energy bill that I do not own. In June of last year (2015) due to my husbands ill health, we closed our business down. The energy was supplied by Opus Energy and up until we closed, the bills were paid monthly by DD. To cut a very long story shorter, Opus were advised, the meter readings were given and I forgot about them a few months later they started calling saying that there was an outstanding debt and my bills were not being paid (I had cancelled the DD when I closed the business) I explained to them again that I was no longer trading and sent them the readings again. It all went quiet again for a few weeks then they started again phoning me saying the bill was getting bigger and I needed to pay it or they would disconnect the supply. In the end I just ignored the calls as it was starting to get me down and I was extremely frustrated they didnt seem to get it that I did not owe them anything, there was in fact a new tenant in the premises. over the past 9 months they have continued to phone me most days, usually 3 or 4 times a day from different phone numbers leaving messages saying they were going to disconnect the services. i just ignored them all. I then got a letter saying that they were instructing advanced collection systems to collect the money and I started getting phone calls from them. I explained the whole story to this woman and I told her that I was seeking legal advice against them for harrassment . I then at her request got a letter from my ex landlord confirming when I vacated the premises and I gave her the meter reading I had. I also told her to pass on the message to her client to leave me alone and that if I heard from either of them again I would sue them. I have heard nothing from her I have today had a phone call from a Bluestone Credit Management regarding the debt which apparently is now £3,500. I havent spoken to them but they left a message. I am at my wits end with this. I really just dont know how to deal with it. My ex land lord confirmed that there had been 2 tenants in the premises since I had left and neither of them had registered for energy. Any help would be so appreciated.
  2. Back in 2010, when i was young and stupid, i bought a car on finance for £19k with Santander Finance.. I became unemployed a few months later and defaulted on the monthly payments a few times. The debt was then passed on to Bluestone credit management. Up until now, i've gotten away with paying BCM only £10 a month, however i'm hoping to join the armed forces soon and i'm worried about how things will play out because BCM like to contact me via phone call for a "review" every 6 months and it's likely i'll be away when they phone up. If they found out i'm a single male with no dependents in the armed forces they'll want a huge chunk of my salary. This debt is the only thing that's putting doubt into my mind regarding a new career and a fresh start. Is bankruptcy an option? I could wipe the slate clean and start a fresh?
  3. Hi I have just joined the forum and I am hoping to get a bit of advice. I did a VT on my car 04 April, all my payments were up to date with no missed payments. The car was inspected and was found to have £40 of paint damage which I accepted. However they are trying to charge me £1664 for excess milage. I have so refused to pay this amount, but as a gesture of goodwill I offered then 1/3 of this which was £550 but they refused. However they have now passed this on to Bluestone who said they will accept £832 to settle the amount. Have Bluestone any legal course to recover the money from me, despite me not agreeing to the excess milage? Had a lady call me this morning, I must admit she was very charming & nice but I guess that is there job to get you to pay. Not sure what course of action to take! I said that I will go to court and dispute this, then she said if I don't pay then Bluestone will take me to court blah, blah, blah. I have been strong up to now, but can feel myself starting to buckle! Shall I hang in there? Thanks for your help
  4. I have or had car finance through Santander where I paid monthly for 3 years then have the choice of giving back the car, exchanging it for a new one or paying £3-4k to owe the car outright. Due to a few problems, I missed a couple of months payments. Contacted Santander and made a partial payment. After that, they took no further monthly payments due to being in arrears so the arrears increased. Due to my own stupidity and factors in my life, this eventually increased to five missed payments or just over £1500 with charges. At the end of August / beginning of September, a couple of phonecalls were received from a company in Sheffield called Bluestone. Had to Google them as I had never heard of them. As I won't speak to or give out any information to random people phoning up, I had no idea who they were or what they wanted. Midway through September, I received a letter from Santander, dated 2nd September, than was nothing more than a statement and said I'd been charged £25 or similar for missing a payment and my arreas were over £1500. Contacted them using the 0845 number on their letter, which after 10 secs of silence, gave a BT recorded message saying the number had not been recognised. Took an hour after that of going through automated systems that wanted hundreds of key presses, account numbers I never had etc before I was able to speak to someone. They informed me the account had been sold on to Bluestone. Neither party had at any point bothered to inform me in writing of this. I tried to make a payment but Santader refused point blank and said I had to contact Bluestone as it was nothing to do with them anymore even though they had sent a letter after Bluestone had contacted me. The following afternoon, an agent from Bluestone arrived at my parents house (where I am residing at present) whilst I was at work and left a note saying to contact him about car finance. A few days later, he returned again whilst I was at work. On contacting him, he said that he was acting on Bluestone's behalf and needed to meet face-to-face to discuss matters. Nothing could be put into writing as he would only see me personally. Due to my working hours, he could only see me during the times I was at work (not actually at my workplace but somewhere like home). He did mention 12pm on the 1st October, which whilst not great for me, may be do able if my work commitments allowed. At 8:20am the following 3 days, Bluestone were ringing me up. The first time they had no record of me speaking to the person but then it suddenly appeared on their systems. The following day "no we haven't spoken to you before" etc. I then sent off the letter requesting they do not telephone me and respond in writing only. Yesterday, he turned up again, apparently at the request of Bluestone, once again whilst I was at work and left another letter which caused more embrasssment. I contacted him this morning and the same thing. He had to see me face-to-face, couldn't get to me until 12-1pm at the earliest and I even tried to compromise by saying that I would come to the Sheffield office etc (he apparently has things to do in the morning, works from home in Chesterfield which is just down the road from Sheffield, and would have had to collect things together first). As we couldn't reach a compromise, he said he would contact the office and get back to me shortly. A few minutes later, he was back on the phone saying that the office were due to start legal proceedings as of Monday and were drafting a response to my letter. Any ideas what to expect or to do?
  5. Some advise please... To cut a long story short, I had a tax bill that was over £3k and tried my hardest to pay as much off when I could. I got it down to the point when all I owed was just over the £1k mark... Though I believe in keeping on track with Hmrc, times were hard and I struggled with the last £1000 and therefor HM passed the remainder off to Bluestone credit. I had a letter at the weekend from Bluestone and to my disbelief they'd slapped an extra £600 on the balance that I owed to the taxman - no break down on the letter just to pay this total immediately! I would like to know is this common practice for this DCA to add their cut, are they collecting on behalf of Hm or have bought the debt for peanuts as most most DCA's do with credit type debts? Of course I'd like to knock on the tax mans door and give him the money i owe but the not the P*** taking extra thats been slapped on top for a bottom feeder! I know not to ring a DCA and plan not to, whats the best way to takle this lot, would a letter be the best bet, I want to know why its jumped from £1000 to £1600 - should they give a me a breakdown and can I contest againts paying their "extra" cut?
  6. When I went to sell my property a year ago I had to pay for a HIP which was financed through Close Brothers. The £623.85 was paid by direct debit on the 1st July 2011. Last Friday, over a year later, I had a hand delivered letter from Marstons HCEO stating that they were there to collect on their behalf £623.85 plus their costs (which added together came to over an additional £650) totalling over £1250. When I called to queery this I was advised that a CCJ had been put against me and I hadn't made any attempt to pay .When I contacted Close brothers they put me through to their "legal dept" Bluestones CM. I have sent them a copy of my bank statement which proves that the payment had been made but they have yet to respond despite calling and emailing them for updates. My primary concern is their incompetence at not acknowledging a payment that had been made Secondly they have raised a CCJ without contacting me or making me aware of how to pay. I am sure this will have an effect on my credit rating. Thirdly, I am now receiving threatening letters from their HCEO for a debt that had been paid when requested. My wife is at home alone with our young children during the day and we are concerned about the children playing in the garden in case these people come back. I will be complaining to them directly and the FOS once this has been resolved but I am not sure how to go about this. Any help would be gratefully received
