  1. Hi everyone I found out this year that my father (who I'd never had contact with) had died over 2 years ago, and had left me £25,000 in his last will and testament (I have a copy of the will from public record). However, the executor is my brother (who I've also never met) who inherited the majority of the estate, and after some difficulty in getting a response out of him, he has responded saying that I was removed from the will as a beneficiary. The copy of the will that is on public record does have codicils on it, but they do not relate to the money I've been left. My brother has now stopped contact, and I'm unsure of what the next step is! The document is a high court document from the district probate registry at Oxford, but there is no contact details for anyone other than the executor (my brother). Any advice please on how to proceed?
  2. I was caught stealing at tk maxx today. It was a very foolish thing of me I admit. Something that costed £7.99 and I didn't want to pay for it as I had already purchase worth £70.01 at tk maxx and didn't have enough money for what I wanted. I took of the security plastic tag off the box and put the item in my bag while I got busy with my daughter as she was crying and kicking a fuss. I continued to checkout with all my other items amounting to £70! Then left the premises. A security came running down the stairs and spoke to me saying I believe you have something in your bag which you haven't paid for. I said ok let's check I opened my bag and saw the item then remembered I put it in my bag. I forgot about it as I spent nearly 2hours in the store looking for lots of things. He escorted me to the back security room and asked me to place everything not paid for on the table. I then placed the only item that was in my bag worth £7.99!! He asked me did you steal the item. I said I didn't mean to they were so rude and shouting. He then said look I'm calling the police and I cannot wait for that woman to tell me. Then I was obliged to say I stole it so that he doesn't call the police. Then he cut off the phone and said to me if I admit I stole it I said yes and started talking again he was angry saying that I'm fed up now I'm calling the police cause you're not ready to tell me. Then said that how are you going to explain to your partner if I call the social services because you stole £7 your daughter got taken away!! I stayed quiet and didn't wana say anything so they don't call the police. Now reading other threads I guess there will be a letter coming for me to pay for god knows what because the item was left un damaged. Shall I tell my partner I'm scared. I do not work to pay off any money to anyone. Please help me. They took my ID CARD with my details on it . And forced me to take my provisional license out of my wallet to show my address.
  3. Hey peeps, Just wondering if I could be entitled to working tax credits? From the info put into the calculator it says I am entitled but how I make the earnings might been seen as not like a normal "job". So since mum passed away, I have been all over the place, trying to figure out what I can do next. As far back as 15 years ago I was involved with the "paid to read/click" scene (Around the time when E-gold "bubble games" were a thing). That scene has now completely vanished. Soon after, I moved on to doing online surveys. A year or 2 ago I started taking them more seriously, putting a lot of time into them and reaping the rewards for my efforts. This topped up my carers allowance nicely. Looking at stats, in 1 year I earned around £900 cash paid to my PayPal account and nearly £500 in amazon vouchers. In the last 2 weeks I have earned almost £50 in PayPal cash and £20 in Amazon vouchers. So it is quite a nice earner. I know now I have the potential option to be on ESA, but with everything it involves including assessments, it's too overwhelming for me at this moment in time. Would earnings gained this way entitle me to working tax credits? If so, would this be classed as "self employed" ? Thanks
  4. We have had a disasterous refit of our shower, and are suffering leaks and noticed some cracked grouting too. We have been in touch with Citizen's Advice Bureau and the first thing they said we needed was a written report from a professional to explain what the problems are and how to put them right. However we are struggling to find a professional who is willing to put pen to paper to give us this. Reasons cited include they don't want to get involved in a legal battle, the repercussions for them going against some dodgy plumbers. Can anyone suggest how I can get a plumber willing to do this sort of report? Hope someone can help.
  5. If you've been enjoying Tesco's Clubcard Boost events, where you can double the value of your points and the like - bad news - the last one is imminent, as the supermarket are scrapping the scheme. The last boost will be held from 16th May until 26th June, so don't dither. The idea is to make these schemes easier to understand, and to make Clubcard points simpler. Clubcard Boost events have given the opportunity to swap points online or in stores, in multiples of £5 for £10 vouchers which you can spend in specific departments. However, over on their website, they've said that these events will be axed after they'd heard customers requests to make the whole Clubcard system easier to digest. Tesco said that they recognise that the scheme 'needs to be simpler to understand and easier to use'. Instead of sporadic boosts, now, savings will be offered throughout the year. All the information you need about this, can be found over at Tesco, here. http://www.bitterwallet.com/high-street-news/tesco-axes-clubcard-boost-events-may-will-be-the-last-one-91829
  6. Hi All, I have a HSBC finance credit card, I was hoping to take a loan out but i havent paid this credit card of £2800 since it was defaulted in Feb 2012. I am being rejected for any application but this is the only default on my account. I was wondering if I make an payment arrangement or settle the account will it make any difference in applying for a 25k loan which is very much needed at the moment? I understand a default is on your credit score for 6 years however, as I have not paid anything at all on this HSBC credit card since 2012 so if i start paying something or offer a full and final settlement will this help me now or will it make no difference whatsoever. is there anything I can do with this account to improve my chances of a loan or is it best not to chase them if they are not chasing me. As usual all your help and time is very much appreciated!

  8. Have been appointed the executor of an estate and am in the process of applying for probate. The will is fairly straight forward with just two named beneficiaries, so once all the assets have been identified, it shouldn't take too long to wrap up. However, one fly in the ointment turned up ranting and swearing to the point that the police were called. The two main points of contention were: The Black Sheep had not been notified of the funeral. Nothing was bequeathed to the B.S. (the will specifically stated that he was to receive nothing). His parting shot as he was escorted off the premises was that he would seek to contest the will. I suspect the deceased had anticipated this as a statement from her GP is included declaring that, in his opinion, there was no evidence of mental impairment. As there has been no contact between the B.S. and the deceased for over twenty-five years (not even a Christmas or birthday card), I don't see there is any grounds to contest the will. That said, I have come across a few (questionable) solicitors advertising a 'no win, no fee' service: I suspect the indemnity fee would be quite steep if they decided to take on a case. Aside from having to challenge a caveat if one is lodged before probate is granted, what are the prospects of any legal proceedings holding up probate ?
  9. I'm having a really frustrating time with my direct line at the moment regarding an accident I was involved in on a duel carriage way roundabout. I was in the inside lane going forward onto the 2nd exit. He was in the outside lane and needed to take the next exit. As the roundabout was full of traffic it seemed like he was running out of time to get into the correct lane to take his exit. there were cars bumper to bumper behind me but a gap appeared between myself and the car infront. I was going around 25mph at the time following the flow of traffic. Next thing I knew I heard him accelerating really hard and he flew past me just as I was passing his intended exit. He clipped my car and scratched his car from front to back as he scraped the side of my car. He ended up in the lane he was heading for and I stopped on the verge of the roundabout. to me, he obviously found himself in the wrong lane and about to miss his turning, He took a risk to get through the gap and to do so he had to accelerate to twice the speed of moving traffic. He misjudged it and casused damage to both cars. Ok so what my problem is that the insurance company - Direct Line - is representing both parties. Apparently the third party is not accepting liability and is saying it was my fault for obstructing him and because I wasnt taking the immediate turning I was infact in the wrong lane and therefore liable. I messaged the guy, who gave me his numner at the scence of the accident and asked him what he think happened. He told me that the insurance company told him that he was not liable because of these facts. He actually didn't know who was liable until they told him that I was! Ive been told by direct line every time I call that its looking like it might be a 50/50 settlement which isn't right. theyre telling me this without actually having seen pictures of the damage or a full complete statement from the third party or myself! I understand that insurance companies try to save money and time by just automatically ending cases like this on roundabouts as 50/50. They tell me that theyre acting very professionally but honestly I really don't believe them. they've told me that the damage evidence doesn't really matter and that its his word against mind which would mean we are equally liable. But what gets me is that his word was influenced by his insurance company which is also my insurance company! basically I know he was in the wrong. He drove aggressively and dangerously and he took a risk that didn't work out. I wont back down on this as I don't want to have to pay the excess and lose my no claims bonuses and also raise my premium. most of all its the principal. has anyone had this before and if so did you take the decision to another body and challenge the insurance company?

  11. Today (6th April 2016) marks the official beginning of the 2016/17 tax year, which brings with it a raft of changes to pensions, tax and savings. Here's a guide to what you need to know. https://uk.finance.yahoo.com/news/handy-guide-tax-010447129.html?cache=clear

  13. He says what others are thinking but are afraid to say. This sums his thinking up completely. We should all take note (especially Germany) of what he is quoting here:
  14. A retired guy sits around the house all day, so one day his wife says “Joe, you could do something useful, like vacuum the house once a week”. The guy gives it a moment’s thought and says, “Sure why not. Where’s the vacuum?” Half an hour later, the guy comes into the kitchen to get some coffee. His wife says, “I didn't hear the vacuum running, I thought you were going to do the vacuuming”? Exasperated, Joe answers, ”The stupid thing is broken, it won't start. We need to buy a new one”. “Really?” she says “Show me - it worked fine the last time!” So he did… (Click Here)
  15. This feels a little awful as my mother is alive and kicking albeit in her 90s but I have never dealt with a will - everything was in joint names when my father died so there was no "estate". There will be little when my mother does "go home" as she delightfully describes it but I would rather sort it out liaising with my brother to ensure there are no debts! (He is abroad) I have just read an article which says you do not need to use the solicitor named as the executor but feel I know so little about this and wonder where I would start. I wonder if someone could help just so I know the first steps and am not anxious when (she says she will live to 103) we get to this point.

  17. The onwards and upwards march of the ad blocker continues http://www.bbc.com/news/technology-35460785 Once again, like most of you, I hate the intrusion of ads while I'm trying to use my computer or my telephone. On the face of it, these ad blockers should be welcomed by all consumers. However, the people who will really be laughing are the banks, retailers, debt collectors, payday lenders et cetera who will be pleased to see the Consumer Action Group struggle and have difficulty paying its bills so that its very existence is endangered. This forum like tens of thousands of small hobby and enthusiast forums all over the world count on the small amount of advertising revenue to keep their heads above water and to pay their bills. We have hundreds of thousands of people who come to us every year and either simply benefit by reading all the advice and all the experience on this website or who actually get involved in discussions and ask the questions and get the help they need to stand up to the bullying and unfair treatment which is handed out every day by the companies that we all have to deal with. If this forum goes out of existence, those hundreds of thousands of ordinary individuals will lose and the companies that treat them so badly and which dominate them every day will win. If you have a choice, please don't use ad blockers – not only for this forum – but for all the small websites everywhere and for all the ordinary individuals who use them – everywhere – for every kind purpose. If you feel that you do have to use ad blockers, then maybe you should consider making a donation to the site – maybe not just once, maybe on a regular basis. We do our best to help you – but we can't do it alone. We need you to help us
  18. Hi, I have just received a CCJ and all I got back from the courts was a letter telling me that the creditor sent the court a letter after they had received my admission and offer of monthly repayment, and that they had complained that the offer was too low. The court has now ordered that I pay a larger amount each month and that the first payment should be paid to the creditor by the 22nd of this month which is a week before I even get paid. I won't have the money by then and it's also more than I was expecting. Will the bailiffs come if I pay a week late? Or do you think the creditor will allow me to make the payment on the 29th if I explain my situation? I do feel like it is a bit unfair as they have decided that not only do I have to pay more than I offered, I also have to find it in just over a week. Any help would be much appreciated.
  19. We rent a house, and as part of the tenancy agreement the landlady agreed to pay the council tax for the property. Well for one reason or another she didn't pay it, and the council obtained a liability order for over £2500 dating back to the date we moved in. We had received letters from the council, which we forwarded onto the Landlady in the expectation she would pay the outstanding amount, but due to financial problems she never paid the bills, and as you would expect the council in the end obtained a liability order. We received notificaton from Ross and Roberts that they would be attending ( as you would expect ) to get the money paid. I got straight on the phone to them and explained what had occured. How the Landlady should have paid it, but didn't. I have to say the woman on the phone was absolutely wonderful. remarkably helpful. Whilst she accepted it wasn't our fault, as she rightly pointed out, the bailliff could only deal with the liability order in our name and we were responsible to get it paid. She gave us two weeks grace so we could get in touch with the landlady and see what arrangement we could come up with, but as stated, we had to ensure that money got paid. I immediately made a couple of payments to show good will, then got in touch with the landlady and made arrangements whereby should Ross and Roberts agree, we would pay it over a set period. The same woman agreed instantly to our proposal, and as long as payments were forthcoming she would suspend bailliff action. I explained our financial situation basically over hte phone, and she actually suggested I reduce what I proposed by £30 a week, so as to ensure that we didn't leave ourselves short over the winter period. I was sat open mouthed at how helpful she was. We made the payments on time, barring one week when the day we were supposed to pay, happened to fall on Christmas day, and I just got a very polite phone call from their office saying they understood that due to Christmas the payment would most probably be late, and to remind me to pay it as soon as I could, so I would stay within the terms of the agreement. Once we got to the last 2 payments, they rang us again, telling us how much was left, and telling us to ensure that we didn't pay too much as the final payment was less than all the others would have been. I've dealt with bailliff companies in the past and found them to be downright obstinate and refuse point blank to listen, but in this case, Ross and Roberts were absolutely fantastic and helpful. So for a change, heres a thumbs up to a bailliff firm for being considerate and downright helpful.
  20. The EU has barred the NHS from checking the qualifications of EU doctors and nurse, that means thousands of European doctors and nurses will be able to practice in this country without checks on their qualifications. These new rules in the EU, mean they will be given electronic passports’ which will automatically allow them to practice in hospitals and GP’s surgeries. Europe will issue these passports to nurses, midwives and some other medical staff from January 1st, and doctors in two years’ time, without checking their qualifications or whether they have lied or been suspended. Also they will not be tested on their ability to speak English, because this would impede their ‘freedom of movement’ rights. So if you ever become ill, I would suggest you try the vets after all they will most likely be better qualified than your doctor.
  21. hi been trying to claim back ppi on a credit card with midland bank/hsbc now since 2013 . i have no statements left but can produce some paperwork for 12 months they denied i had a cc but re searched by hundreds of phone calls and eventually they agreed i did have one but no ppi was on it . the cc was from 1986-2003 and did have ppi and went to metropolitan collections in the 90s the debt was fully paid up. hsbc said prove it or go away, i tried the insurance root for the policy number with axa who tell me the credit card number is the policy number and insurance is inhouse with hsbc. hsbc said not with them . so did a sar which was waste of time 7yrs of transactions of banking. eventually enquired with dataoffice and dc sent out by mistake copy of card details, start and end dates customer/card account numbers. i have asked for the past two years for them to confirm that ppi was on card from day one but they will not answer this question, i went down fos route which was fast tracked due to health but they wont or cant get hsbc to answer it either. i am at a total loss as what to do now should i just give up as the stress of this has not helped my illness. this is the short version of this sorry tale the first time i have ever e mailed anywhere so opologies if a bit rubbish.
  22. Well I had a business debt, I had written to the supplier several times as they hiked up the price on what was agreed when it was invoiced. Recently a bailiff they transferred the case to turned up - He had a camera filming me, he did not tell me this was happening or ask if he could film? I asked why - he said for security? as if a small elderly person against a big 6 foot ex army bailiff could become violent - I am not talking about a lot of money here but I want to know how these people that are there to terrify you should be treated. There had been no court papers served and had there been I would have happily gone to court and defended the case. This man suggested I would have to pay his large charges on top of the outstanding balance. He said coming pre court he was doing me a favour!! I thought high court bailiffs could only come threatening/intimidating once court action had been completed? these people are on television apparently - if ever there is a next time I want to know how to respond to them and share this with others so we are all prepared!
