  1. Can anyone offer some help regarding a visit from HCEO yesterday evening. I have an unpaid water rates bill for £1214, then received a notice from the courts (without any warning from water company that it was going court) that a HCEO would be attending my property. They came last night when I was out and left a letter with my mother saying they want £1214 plus 8% interest and £932.14 enforcement stage fee. My mother's car was on my drive and as she had no proof with her that the car was hers they have listed this is goods taken into control. I have every intention of paying this debt (but not the fees) and am returning to work in a couple of weeks. I can offer them £50 per week to clear this debt but will definitely not be letting them into my home! Any advice as to my next actions would be appreciated. Should I contact the water company, What will happen if I deny HCEO entry but pay weekly direct to water company? Will they eventually give up and pass the debt back to water company?

Came home to a letter and notice from Marston Bailiffs. original client was thames valley magistrates court, who issued a fine to my husband from DVLA as they did not receive logbook information of new owner. This has escalated from a £40 fine to Marston claiming they have a warrant of control and will force entry for an outstanding sum of £620.00. Could someone please let me know if they are allowed to force entry for a warrant of control and how on earth did the debt reach £620? Please help as I have no idea what to do.
  3. MMF are trying to collect on 2 accounts, both Payday loans. I have sent several requests to MMF asking for proof of my liability to the alleged debt plus a full breakdown. MMF have continued to ignore my requests and have continued to send emails and letters with their usual threats of court and doorstep collection. I sent a recorded letter on Monday 26th November and was received and signed for by MMF on Tuesday 27th November telling MMF that ALL Communication MUST BE IN WRITTING by post, and no telephone, e-mail or text contact will be tolerated, Furthermore I expressly state that I have no wish to make any appointment for any agent, representative or employee of MMF Ltd to visit my home, should such a visit occur the person will be invited to leave failure to do so and will result in their removal using any necessary means. I have requested a full explanation and proof of my liability for this alleged debt along with a full breakdown of the alleged debt and MMF have failed to provide any data in this regard; therefore I do not acknowledge any debt to MMF Ltd., or any company you may claim to represent. I have also sent an email to Baranby Page & home visits with the same information which has been read... Fast forward to this morning whilst in the shower I heard a knock at the door and Ignored it. Through my letter box was 2x letters from MMF, hand delivered. The leter states "I have now been instructed to visit your property to discuss repayment. I am your local MMF Doorstep Agent and although disappointed that I could not meet you today, I am constantly in your area and a revisit can be booked. Why are these people ignoring me?
  4. My spouse had a text message from Capita stating that they had appointments available in our area this week and asking to phone them to book an appointment. Not sure why they did not phone? The number is a "0808" number. Is this genuine and is the number a free phone number? If it is genuine, it reads as if they want to do a home visit. Can they insist on a home visit as don't really like strangers in the home at any time? The visit will be in connection with the Lower Care DLA being received and renewing it. My spouse is retired and has been for a couple of months.
  5. Hi ppl, I hope you can help or give advice in some way. I'll input some history and hope I can get it sorted. I was out of work for two years at my previous address and was able to get ctax benefit, visited CAB and they told me to offer a payment of £50 a month as I had no other income other than JSA, which was accepted by the council. Unfortunately over the months our house got repossessed, but I fought till the end thanks to help from you good folk on here and the site team. We lost the house, but I managed to get off the JSA and start my own small business (still with relatively low income), but I had made a positive break from the benefits. I informed the council that I could carry on making the payments, but they issued a liability order but still accepted the payments. This payment has continued for some time.............but unawares to me, I didn't realise a CTAX debt accrued over and above the £50.00 per month. They have now issued another liability order and told me they can no longer accept £50 as there is now an account of £7000 up to and including March 2015. I have rang them and asked where do I go from here.......and they have told me to visit CAB as I have a mortgage shortfall of £137000 ( another story) which I obviously can't pay. They said I should go down the Bankruptcy route as their amount would be included ??. Firstly, I don't want to enter the bankruptcy procedure as I now run a small business (which I've started from nothing) with a Lloyds Business Account and bankruptcy would obviously affect this....... ....and I don't want to cough up £700 to go bankrupt. I told the council if I had £700 I'd put it towards the tax to which I was told....... .." there are charities that can help you pay for bankruptcy". " Contact CAB and get back to us and we will put a hold on the liability order". In the event of having to go Bankrupt, I would rather the mortgage Company force ME to go bankrupt.... ..which brings me to my situation; I've read other threads on here that pretty much state, nothing can be done to obtain the shortfall out of me.. .perhaps you would be so kind as to advise what could/would happen in my situation. 1) We were repossessed in October 2012. 2) I am not employed, but self employed so court cannot go for attachment of earnings. (read this on forum, so don't know if true or not) 3)There is no CCJ at present against the shortfall. 4) We have no assets or savings and in rented accommodation. 5) There is no physical way of obtaining the shortfall or even offering payment plan........as I can't even afford council tax at moment. 6)I have not admitted to or acknowledged any shortfall or made any payment. I've read on here there can be various actions the lender/DCA can take.. ...either writing it off if there are no assets or monies to pay back (If I write a letter explaining this, am I admitting liability?) or they can go the CCJ route... .but again, if there is no money they simply can't have it ??. I've read a few threads that say just sit tight. THEY JUST CAN'T GET MONEY YOU HAVEN'T GOT, whether it be a shortfall or otherwise. The council obviously want me to go to CItizens Advice, but I don't want to open a can of worms with the Lender/DCA if I can sit tight. Would really appreciate any advice you could give me on this situation. I'm no longer a worrier, just want to go about it in the correct way. The dca/lender is something I can handle...but the council want me to find out about bankruptcy and get a debt officer involved. I now have all my cc's on hold and not paid a bean since 2008, so a few months and they will be statue barred. At the moment I am simply not earning enough (between my wife and myself) and cannot afford the CTAX...........but worried that they will go down the bailiff route. I had enough stress with the repossession and now have it again. Any advice as to what route I should take or what answer I should give the council would be greatly appreciated. I rang them a couple of days ago, so I'm sure they are awaiting an answer. ( I have continued to pay the £50.00 ) Thanks, Taz11
  6. Hope I'm in the right place, I'd appreciate some help here please. Today we received a letter from our Local Authority informing us that they'll be visiting our property in a couple of weeks 'as part of their service' which they say will include an inspection of the property to make sure it is in good condition. They will also be 'asking' if they can take our photograph, which they say is part of the council's initiative to restrict fraud. They say the photo is optional, though I have just read on their website that new tenants, if they refuse to allow them to take the photo, will not be housed. We have been here for many years so we're not new tenants; our rent and CT are paid on time and up to date, the flat is kept clean and tidy, and we have never had or been the subject of any complaints or issues. The Tenancy Agreement states: 11.1 You must allow us and our contractors access to your home to: • inspect it to check the condition and any works needed • carry out works of repair, maintenance or improvement to your home. This appears to be the only mention of access. Recently we gave the LA contractors and surveyors access to the property to carry out roofing repairs, so it's not like we have anything to hide. We have already decided to refuse them permission to take our photograph. Their own leaflet on the subject states that (unnamed) external companies or agents they employ can have access to this - and we find this unacceptable. We are just wondering whether we have any legal obligation to let them in to conduct this visit, which we feel is completely unwarranted and intrusive. Many thanks.

I have been getting lots of calls ( recorded message ) to my cell phone , lots of emails & a text message to my phone informing me of a substantial discount offer from MMF over the course of about 4 months now , none to which I have replied as far as I am concerned I have no debt , checked my credit report & there is nothing on there either , but today they called my parents home phone ( how they got that I don't know ) again a recorded message along the lines of press 1 for a home visit etc , etc , now my parents are in there late 70's & in a fragile way & anyone calling on them will get them in a right state , my question I have is are MMF in there right to call at my parents home even though I don't live there ? I live & work away outside the UK . They are starting to freak me out how they got my parents number , it's an ex directory by the way & now I am panicking in case they call at the address
  8. Hi. Motormile have ignored all my emails to them so I took the details from their website and set up a standing order for £5 per month. I missed a payment last month so I emailed them to say I'd pay £10 next month to make up for the missed payment. I then received the following email - 'Thank you for your email on 19/11/2012. Due to the fact that you missed your payment there is a broken arrangement now, hence, further collections activity will incur on the account. MMF have reviewed your account and here are a few options for you to avoid any further legal action: Offer 1: we will accept 60% of the balance - £115.35 Offer 2: we will accept 70% over 2 equal instalments - £67.29 per month Offer 3: we will accept 85% over 4 equal instalments - £40.85 per month The above offers are available on the proviso: · The payment is made via debit card · The first payment is received in November · The payment plan or settlement figure to close the account is set up for a date in this month by Friday 23rd November 2012. Please fill out the below details in order to setup the arrangement, Please note that default interest may be added to the account which you will be liable for until a valid payment plan is put in place. Card type: Card number: Valid from: Expiry: Last 3 security digits: Date of payment: 28th November 2012 Amount: Whatever offer you accept Failure to email me back in regards to which offer you accept then your account will be transferred to the litigation department for legal action and you will get an unexpected visit from one of our doorstep agents for which there is an additional charge. Also, by setting up a standing order without agreeing something with us is not a payment plan.' So it appears that because I missed a payment, they now think they have the right to theaten me by phone, email and at my own front door. Any advice on how to respond to this email would be appreciated. Thanks. Paul.
  9. My son has recently returned to live with us. It transpires that he has a court fine which he has not paid. We found out about this when he collected a "Removal Visit" letter from Collectica at his old address. He rang Collectica and offered to pay £100 (which I offered to lend him) and then further instalments. This was declined, and he was told that he needs to pay the entire amount by tomorrow morning. I told him to email Collectica to put the offer in writing - which he did. I've been reading this site for information, and it seems that collection agencies/bailiffs have different "powers" when collecting unpaid fines. I'm a little uncertain about giving them his new (our) address. Also, I have no idea what happens next. Any suggestions regarding what can be done would be gratefully received. It goes without saying that I have issued a severe verbal beating to my son, who is now motivated to deal with the situation and has hopefully learned a lesson. How can we deal with this? We can't afford the full amount of £475.00 (which includes nearly £300 of fees) at present. Thanks in advance for any advice.
  10. My wife claims the lower rate of care due to osteoarthritis. The DWP wanted to do a home visit on Sunday. We are not 1005 sure it si the DWP as they do not even ask any security questions to confirm your identity. As it happens we are away on "holiday" in the UK and will not be available to end of July 2014. This is the third phone call she has had regarding the issue and has told them on all occasions that we are away until end of July and asked them to make a note of it. Are they allowed to make home visits on a Sunday and to keep phoning or harassing people.

  12. Good morning all...... Just need a bit of quick advice. I had for the 3rd time in a month had a visit from Bristow and Sutor regarding Council Tax, we have never let them into our home at any point. And as I understand it they cannot force entry. However the letter pushed through the door mentioned The Tribunals, Courts and Enforcement Act 2007 schedule 12, after reading up on this can they gain a warrant to gain entry? or are BS just pulling things out of the air in hope of gaining entry by peaceful means? The letter said I have to make contact by Tuesday otherwise they are coming back and what that is supposed to mean I'm not sure. But to confirm again BS have never gained peaceful entry into our home. All advice is most welcome.
  13. Hi Guys Any advice / help would be very much appreciated. A few weeks ago i returned home to find a hand posted brown envelope from a field representative from Scotcall asking me to phone him urgently on a mobile number. I have also had numerous phonecalls from Scotcall to my work mobile number which are becoming more frequent. As i didn't know what the debt was for or who for i ignored them. Tonight i was at work but my wife returned home from the weekly shop to be approached by a man from Scotcall asking for me, she explained that i wasn't in and didn't know when i'd be back. He once again left the same card and left. Am i right in thinking they are not allowed to do this, for one it was dark and my wife wasn't best pleasede to be approached by a big balding man wearing a high-vis jacket in an obvious attempt to look official. This time he had written the debt details on the card, its showing as £806.11 on a TOPMAN storecard which i had years ago (for my sins). This is an old debt that i stopped paying a few years back as with interest the debt just wasn't coming down. For example i think the original debt was for about £300, i paid £20 per month for over 2 years and a few years later the debt is now over £800. I appreciate that i stopped making payments but how i see it i've probably already paid back the original debt amount, its just the interest and lack of payments has now ramped up to a stupid amount. Where do i go from here ? Any help would be very much appreciated,
  14. Hi, I'm new here and so apologies if this has been asked before. I have searched the forums for info on Motormile but have a few questions that I couldn't find exact answers to. Any help will be appreciated. recieved an email informing me that they have purchased a debt and I now owe them the outstanding balance. I actually don't have any problem with that. I do owe it and if I can work out a payment plan then I'll pay it. Questions I have though are this: 1) How likely are they to visit my 'home' address? From there website I can see that the closest doorstep office they have is around 70-80 miles from the address they are likely to have. I live abroad so I don't have any worries about them turning up but it's possible they have my parents address on file. Although the most recent address they should hold is somewhere else. Are they likely to visit 'older' addresses? And travel 80 miles hoping I will be in? 2) Does anyone have a working email address for MMF? Seeing as I am normally out of the UK I can't phone, have no postal address here and I need to email them to offer a payment plan. Or at least seeing if I can get a reduction and then pay the balance..... Thanks.

Hi, I use to have a royalmail account for posting items as I had a shop on ebay, i would send 500 items a month but 30 of them items would go missing and I would have to send replacement items out again. I have disputed the bill with royalmail but all they keep on saying is i need to pay the bill before they can issuse any refunds. I have refused to pay my bill of £2100 I sent all my items recorded the ones that have gone missing are still showing as in transit, I have proof of posting of the none deliverd items. the cost of all the items I have lost the double costs of postage add up to more than what royalmail are asking me to pay where do I stand if they attempt to take me to a civil court.   16. I am currently on ESA in the wrag group after migrating from Incapacity Benefit. My health is not good and recently when i visited my local Jobcentre Plus office for my ESA work- focused interview with my personal adviser she advised me to apply for Personal Independence payments due to my condition. She said this would help me financially and also i would not have to struggle to attend any more interviews with her. I applied for PIP by telephone and then a massive PIP claim form arrived. I have had difficulty trying to complete this form(ESA50 is nothing compared to this monster). I telephoned them to say i was having difficulty completing the form. I have now received a letter saying an adviser is coming to visit me at my home address. They say they are coming to assist me with the form and to discuss benefits i am already receiving or may be entitled to, plus to provide information on further services. Has anyone else been through this procedure or can anyone offer any advice please? I hate claiming benefits in this current social climate and am very suspicious(rightly or wrongly) of DWP after all the problems i have had with them and ATOS whilst claiming ESA. I do not know if i have done right by applying for PIP. Should i have applied to go in ESA support group? Will they stop my current ESA payments if i fail on my PIP application? The whole thing worries me so much. Can anyone help please?
  17. I had a letter from bristow and sutor as I owed council tax to the value of about £200, I spoke with them and said that I could not afford to pay £40 per week as they were asking me to. They told me to wait until a bailiff came round and I could arrange a payment plan over a longer period of time. Unfortunately having had them round for a previous debt, I am fully aware of the visit charges that can be incurred, I asked what would happen if the bailiff attends while I am not in as Im not sat in the house all day! I was informed that the bailiff would leave his number and I could contact them and see if they were able to come back and if not I could make the payment plan with the office and would not incur a visit fee. A bailiff attended yesterday and I was not in, he did not leave his number just a letter telling me to call the office and that I owed £47.21 which included a visit charge of £24.70. I called the office and asked why this had decreased and the council had told them I was owed council tax relief. When I explained what I had previously been told, the lady told me I must have misunderstood and that there was no way I had been told all of the above on the previous call and that I should take legal advice if I don't want to pay the charge! I'm very annoyed as I know what I heard and don't know where to go from here! Please help!

Hi, I received a letter in the mail from Capital Resolve this morning on behalf of their client (Greater Anglia train service) requesting payment of £62.60 This all scales from a charge around £4.20 last year for an unpaid ticket due to their on-board card machine refusing my card (there is no ticket machine at the station to buy before hand) And my account with more than enough money for the purchase as I had to withdraw later in the day to get home (from the same card that was refused) I explained this in a written letter with receipt proof to Greater Anglia (or whoever deals with payments) and told them that I was refusing to pay as it was there problem resulting in me not buying a ticket, and not my own. (to which I never received any reply) Is there anything I can do to fight this, should I just ignore it? Should I offer to pay the original price of £4 something? Thanks for any help or advice you can give for this as I feel charging over £60 for what is essentially their own fault, is a bit over the top.

Hi, I had a home visit today from a customer compliance officer, I won't go into detail what the visit was about but after about 20 minutes of discussion he left saying the case would be closed. I don't know if it is just me being paranoid after reading other people horror stories but I am just wondering if the case will actually be closed or if he was just saying that so he didn't have any trouble. Has anyone else been in this situation and can shed a bit of light please??
  20. My husband and I have done all we can to settle any debt incurred while he was out of work. Now we have received more than 1 letter from UMS in connection with a 'debt' to HFO Capital Limited, which I can't recall offhand. The letter shows large, purple letters stating: PROPERTY VISIT before saying they have been instructed to organise a visit to our property to collect the full balance due or make arrangements for this 'long-overdue' debt to be repaid as quickly as possible. I've just drafted a CCA letter to send and was just wondering what else I need to do or be aware of. Do I need to keep my house door locked?
  21. on jan 4th i recieved a letter of atos for assesment on the 9th jan, letter dated 18th dec. 6th of jan i rang atos requesting a home visit.said i needed a fax o my dr to confirm this. 7th jan dr surgery rang atos and said a fax will be sent in a few days and they told her they have canceled my 9th jan appointment. 8th jan dr rings me and said they have sent a fax outlining my disabilities and not to worry. 9th jan i get letter of atos for assement in exeter 28th jan. dated 7th jan. irang atos outlining the above, lady said i must atend 28th appt.i said how can you send a appt before you have read the fax. i then got o its just arrived today. she said to me that they will request my file back from exeter and asses again and they will be in contact with me. i said so i dont have to go to exeter on the 28th, she said no i dont. my worry is that are atos to be trusted on this as we have all read the horror stories. and ive got a funny feeling i will recive a letter benefits stopped failure to attend assesment on the 28th. is there anything else i can do. thankyou.
  22. Intro info-threads have been merged to give background to the issues. Basically its only £230 but its the principle + need a new van so this would really come in handy towards that. Wrote asking for the money back they declined, wrote again threatening court again a big fat no and a copy of the ombudsman book. They state that complaint has now been closed. Should I now put in a claim with the small claims online or is there a way of encouraging them to pay otherwise? I gather egg dont tend to do refunds. All are £16 standard default charges, dont know if this makes a difference? Any advice on my best route would be much appreciated

This lot have been harassing an employee where I work for a Wonga loan from 2009 which was repaid but apparently there was interest outstanding and charges have been continuously added till the amount they are chasing now stands at almost £1,100 (apparently just over £200 was owing in 2009). Despite several carefully worded emails being sent to them - they have not responded (no surprise) and this morning intimidating texts and voicemails were received stating that an agent would call at their house unannounced to asses their living standards. OP got angry and rang MMF "doorstep team" - spoke to little smart$$e who advised that they were perfectly within their right to come to the door and assess living standards - OP advised they were recording the call and the MMF guy had a bit of a splutter - he was then advised that the police had been informed about the threat and if they continued to harass then OP would be happy to let a county court judge look over the charges and decide the outcome. Parting shot from MMF was - we WILL be sending someone to your home no matter what you say .........
  24. Hi all I have just got back from the school run to find that an Enforcement Officer from Andrew Wilson has been. They left a notice letter in my door. I was over paid by my old job and was taken to court, I filled out the form to ask to pay in instalments and sent it back to the company dealing with the overpayment. I have not received anything from them or the court to say anything after the court hearing??? First thing I got was this letter from enforcing the debt and further charges by the enforcer. Can anyone help with this?? Do I need to call the debter or the court to try and solve this as don't want to deal with the enforcement officer
  25. My son had a visit from two officers from TV licencing he did not have a licence in place and told them that he froze it back in September because he was going to Scotland which he did. He contacted them a few weeks back to reinstate the licence and was spoken to like a criminal, the guy was most unhelpful and demanded payment eventhough he asked for a payment card, he did not have any cash in the bank as he is on JSA. The guy was so rude my son put the phone down on him, being a hot headed person. Hence the visit, they asked for his reasons which he explained and they seemed to be quite understanding. But I have my doubts as they read him his rights and gave him a Tv payment card. Do you think it will still go to court? Any advise would be greatly accepted. Not sure where to post this? mashmallow
