  1. the debt has now been paid by my landlord, do I now need to issue a money claim against royal mail in order to get my money back as it has been a number of months they had issued the warrent
  2. I submitted a counter claim with my defence I paid the £80 fee, then I moved address I telephone the court to advise them I had moved but I never received any correspondence until the bailiff turns up today.
  3. The debt is about a business account where royal mail failed to deliver parcels that I posted with them then I disputed the invoices as I had been put out of business by royal mail due to all the lost items totalling to over £3000 in which I had to fold my business. it was a forum 55 notice of seizure from the bailiffs which was issued from a district registry in Croydon
  4. hi, I need some advise please, a while ago I posted this http://www.consumeractiongroup.co.uk/forum/showthread.php?384184-Royalmail-trying-to-take-me-to-court&p=4160465#post4160465 today at approximately 07:30 a bailiff knocked on my door demanding payment or he was going to break into my house seized my goods and take my cars. the bailiff then continued to threaten me with police, he then walked in through my front door he then decided to go straight to the bedroom where my 3 month old premature baby Is I told him to get out of there as there is a baby in there, his response was "so I don't care" with my girlfriend saying your not taking anything and my self telling him to get out the house, as he walked past me he nudged me in my side just at the front door. this has been reported to the police and I have made a statement. my landlords across the way came over wondering what all the fuss was about and after some explain to them they offered to pay the sum of £4600 the bailiff was wearing a body camera so this would of caught what he was doing in the way of assaulting me. my question is now as my landlords have now paid the debt does that now mean I have no means of taking it back through the courts in order to get my money back as the sum in which the debt was is completely wrong. thank you for any help

Good Afternoon, Would anyone be able to help me out with understanding a Northhampton court order, in July 2013 I made a county court claim againts our old landlord as they did not return our full deposit back to us. Today I recevied a letter in the post from the court to say the case is being transferred to the landlords local court, but in the court order it says application to strike out claim must be heard on notice to claimant. Can anyone confirm to me that from what the court is saying they are looking to strike the claim out of court or does it mean they have got an application from the defendent and it will be going to a hearing

Thank you for your reply, the court hearing was for a civil regarding her and her mother entering my property and stealing a number of items. all the accusations she was making have been concluded by a police investigation as no evidence, she is only make these up so I can't see my child. For an injunction would it be the same application as a money claim throw the county courts?
  7. all the allegations that my EX did were a deploy so I couldn't get 50/50 custody of my son, I have Facebook messages which my EX has wrote to people saying she will do anything to stop me having Custody. I haven't tried legal aid yet but I wasn't sure if they would do it.
  8. I can get statements from people who she has spoken to and Facebook status and emails which she has sent to me I also have a letter from her legal aid family solicitor stating what she has said. I have paper work from solicitor confirming that all allegation have been investigated and no further action is being taken, it was verbal spoken in the court room but my grandparent were present along with the judge
  9. yes I lost my job because what she was saying I am unable to use my solicitor as the credit limit has been reached, I was going to act on my own to keep costs down.
  10. Morning Everyone, I need a bit of advise on a matter regarding defamation from a EX. Me and my EX split up in March 2011 we had a 3 week old baby, she was using the child to her advantage as a weapon so I decided to involve a solicitor and put an application in to the courts. just before the first hearing in July 2011, my EX decided to make numerous allegations to the police in may 2011 which ended me being on bail until May 2012. in May 2012 all these allegation we concluded ludicrous and no further action was taken but in the mean time I had lost my Job and my EX had been telling people I had done this and that and none of this was true. I also had a court hearing with my EX on the 6th of November this month and in the court room she was still making allegations about me even after the police have concluded there investigations. I had racked up a solicitor bill of over £16,000 and I had to move house due to the harassment that my EX had caused with people on my road. I have done some research on the internet about defamation, Slander and Liable and all what my EX has done fits into all categories. My question is how do I take this throw the courts as I want some of my solicitor fees back also It caused me financial losses due to losing my job, I also want some sort of injunction imposing against her. Any help would be appreciated
