  1. Hi I have a debt of around £500 with Marisota which by my reckoning is made up entirely of their £12 charges. Can you still reclaim charges or has it all been stopped? Anyone had any success with this company, they go by other aliases such as jd williams, simply be etc thanks
  2. I'm not sure if this is the correct forum, but I hope it is. I had a mortgage from 2000-- 2010. I was declared bankrupt in 2010. A very close friend ( he was like a brother to me). purchased my house in his name thus clearing the mortgage. This enabled my family (wife and 3 children) to carry on living in our house. We were very lucky to put it mildly. My question is as the mortgage is paid in full, can I claim back the charges for the 10 years that I had the mortgage? If so how would I go about this. Any advice would be much appreciated.
  3. Hello all, I was told that I can reclaim £18 and £15 Late Payment and Over Limit charges on my old Natwest Credit Card account from more than six years ago. Natwest say that because the charges are so old I cannot claim as the Limitation Act prevents it. However a friend says that as I didn't learn about reclaiming these Natwest charges until 2011, Section 32 of the Limitation Act 1980 could entitle me to claim; “the period of limitation shall not begin to run until the plaintiff has discovered the fraud, concealment or mistake (as the case may be) or could with reasonable diligence have discovered it.” In that respect I paid the charges mistakenly thinking they were lawful, the bank deliberately concealed their true nature. It was a random conversation in 2011 that led to my being alerted to the possibility of reclaiming. I still have statements from 2000-2003 showing the individual charges which total approx £250 when you include 8% flat court rate interest. The correspondence so far: August 2011 - I sent in the claim. Natwest replied “you have no valid claim as the OFT confirmed the timescale is a maximum six years. ……..as the account was closed more than six years ago we no longer hold information on the account”. Sept 8 2011 - I quoted section 32 of the Limitation Act and enclosed copies of the statements showing all the charges. Sept 2011 - Natwest reply "unfortunately you are only able to claim back charges dating back six years; these time periods are limited by law. This includes late payment and 'over the limit' fees". Aug 13 2012 - I read some forums then wrote to Natwest re-stating section 32 of the Limitation Act. Aug 21 2012 - Natwest reply, "thank you for contacting us again with your complaint. We are unable to address your claim for a refund as the account has been closed for more than six years. We therefore no longer hold any information on file. The 6 year time period to which you refer applies to the length of time we are obligated to hold on to a customers information for. As this time period has elapsed we no longer have this information. For the purposes of the FOS this letter may be considered as the Bank's Final Response." Natwest's seem to have dropped their time-limit objection. They claim they no longer have the information but this is not true as I sent them copies of the statements in September 2011. Please can I have some advice on my options now to pursue the matter. Should complain to the FOS, send Natwest a Letter Before Action or something else? Also can I claim contractual interest rather than a flat 8%? Thanks in advance for your help.

We had a mortgage with Kensington until we remortgaged in around 2004, before sending off a SAR could someone confirm the 12 year rule, i.e. Can we only claim the charges in the last 12 years? or Do we have up to 12 years to claim the charges for x amount of years before the account was closed in or around 2004? Can anyone enlighten me or point me in the right direction?
  5. Hi there I wonder if anyone can help. I have got a list of my bank charges from HSBC and in total this amounts to just over £2000 over an 8 year period mostly for unauthorised overdraft fees and a few unpaid direct debits. Some of the charges for the overdraft fees amount to £150 a time. I was not aware at the time that I could reclaim these and I am currently in a DMP and have been out of work and working on a contract basis on a lot less money than I was on - I wrote to HSBC and asked for the fees to be repaid, they said they would not repay these and sent me information about managing debt. They referred me to the recent court case in 2007 about the legality of the charges and the subsequent outcome in the banks favour. They state that their charges are fair and within their Fair Fees Policy. They state "we do not charge if the increase in borrowing is £10.00 or less. We never charge customers more than the level of the highest excess overdraft during the relevant charging period, rounded down to the nearest £1.00. Only one fee will be applied per day up to a maximum of £150.00 in any one monthly charging period". However, if they are putting charges of up to £150 each month, how is anyone supposed to get out of the mess they are in, these fees, in my case snowballed and added to my financial difficulties. I sent a complaint form to the FSO and have stated I am willing to file a claim in the court to retrieve this. I stated my financial hardship and that the fees were the catalyst of the problem as they kept racking up each month, making the situation worse. I have heard back from the FOS this weekend to say they are siding with HSBC as the fees were "fair". Should I go down the court route and what is the success route - and also, how much will it cost going via the court? I usually wouldn't bother but the total amounts to over £2,000 I feel that this is excessive. Any help, advice, direction on this subject would be greatly appreciated Thanks in advance.
  6. I have finally received SAR details re ongoing PPI claim with RBS Mastercard and after reviewing various statements noticed quite a few late payment fee charges for £20. I am sure I can reclaim these and if so can anyone kindly point me in the right direction as to what spreadsheet I need to use to calculate refund ?
  7. hi all need some advice to help a friend out, my friend made a claim for a refund ppi from hfc in 2012. this claim was accepted and he was offered £1200 but due a break up of marriage and serious health issues he never returned acceptance form, I am trying to help him get back on his feet both physically and financially, would he need to start his claim again or is it a lost cause now .

I am going to be putting in a claim with Vanquis for the charges and ROP that they charged while I held the card with them, I have looked and am finding it difficult to see if there are any recent(ish) claims that have been won so I can try and swat up on the likely tack. Anyone know of any claims that have been won against Vanquis?
  9. Hi We've had a second mortgage with GE Money which has now come to the end of it's term. However - we've struggled to keep up with the payments - gone into arrears and then caught up. We've had in the past councillor visits which we didnt ask for (and were a waste of time as they are not true counsellors) - had some legal threats which we've recovered from. Now though, although the loan is at it's end the fees they've added on and interest etc now means we owe them about £5k on an original £15k loan over 10 years. which we are paying back at £200 per month. For each month we were in arrears they charged us £40. Plus interest so if we took 2-3 months to recover it soon added up. Now we are in a difficult position and face another 2 years of repayments. 1. Can I reclaim/get them to write off the fees charged 2. reclaim/get them to write off the additional interest. How do I go about this? What is the legal position of them pursuing a claim against us for the current outstanding balance? Can we simply refuse to pay? Especially as we have fulfilled the payments on the original loan. We also have another loan with them which has about 2 years to go and our main mortgage with halifax with about 5 years to go - both have had fees imposed. Any help appreciated as this is a major drain on us Thanks

  11. I have a sofa with BH and I am interested in reclaiming the Osc and DLC that I am currently paying . I know I have to send SAR but what do I do next , send a claim letter requesting refund back? Can someone guide me to all the template letters I will need ..I did my bank charges some long time ago, is it the same way? All I'm seeing on here is people saying send SAR but not what to do next after having received all the info back from head office Thank you
  12. Hi Guys, Could someone please have a look at this attached spreadsheet - I am not sure what I am doing wrong. The 8% interest isn't adding on, and I must have made a mistake somewhere, but for the life of me can't figure out what it is. Also - my understanding is that you can claim the 8% up to todays date, when it comes to the contractual interest it has to be thill the account closed. If this is correct how do we show this on the spreadsheet? I am assuming that the total CI tallied up to todays date and not the last transaction/statement date. Got a few of these spreadsheets to fill in and wanted to make sure I was using it correctly! Cheers peeps!

I took out an unsecured personal loan in the amount of £10k with Northern Rock in June 2006 and since October 2008 have been on a reduced payment plan with them - monthly payments should be £204.00 and I am now paying £110.00 pcm. I have maintained these payments religiously but did receive a phone call from them last week stating that they could put a charge on my home if they so wished. They also informed me that the PPI I had on the loan does not cover me for anything as I have a mental health problem and so cannot claim. There was a payment of £2,480.60 Loan Protection on a statement that I received from them this month - the only statement I have ever seen regarding this loan. Currently my balance on this loan - according to them - stands at £8,820.99p which I don't understand either - seems like I've not paid anything off. I want to reclaim the PPI from them but do not want to "muddy the waters" a nd end up with them putting a charge on my home - it's recently been paid off and I need this PPI money to buy my husband an electric scooter as he cannot walk. Any advice on what to do would be appreciated.
  14. Hello! After several weeks of reading threads and really useful posts on here and other forums I am almost ready to submit a claim to Lloyds for the PPI I paid on several loans from them. Before I do this, I would like to be able to calculate how much I ought to be expecting them to offer me as a refund and have tied my brain in knots trying to do the sums. I wonder if someone on here might be able to assist me please? There are 4 loans in total which all had single premium PPI on them. One was a standalone loan which I took out, paid back at the set rate and then paid off early. The other three ran consecutively and were refinanced. All loans were through Lloyds and each loan was paid off automatically as I refinanced them. 1. LOAN 1: Loan was £10,000.00 (£11,397.60 after interest) PPI was £1,332.72 (£1,518.84 after interest) 36 month term. Settled after 26 months. 8.7% APR The loan was paid off early and for which I received NO rebate for the PPI. Therefore I would imagine that I paid the full PPI amount plus interest when I settled the loan and therefore should expect to receive the total cost of the PPI plus the interest that was added onto it (£1,518.84 + 8%)? 2. The other three loans were consecutive loans that were refinanced to put a little more cash in my pocket each time. This is where I get confused about exactly how much PPI I paid. Below are the loan amounts followed in brackets by the "after interest" figure. Underneath each loan is the PPI amount that would have been charged if I kept the loan for the full term. LOAN 2: Loan was £7,500 (£8,238.24 after interest) PPI was £668.62 (£734.40 after interest) 36 month term. Settled after 10 months. 6.2% APR PPI Rebate: £321.58 Settlement figure at close: £5,867.62 LOAN 3: Loan was £12,261.24 (£14,065.92 after interest) £5,867.62 paid off old loan. £6,393.62 in my pocket PPI was £2,193.67 (£2,516.64 after interest) 48 month term. Settled after 15 months. 6.9% APR PPI Rebate: £912.31 Settlement figure at close: £9,555.86 LOAN 4: Loan was £13,612.56 (£17,233.20 after interest) £9,555.86 paid off old loan. £4,056.70 in my pocket PPI was £3,625.39 (£4,551.00 after interest) 60 month term. Settled after 13 months. 9.7% APR PPI Rebate: £2,227.04 Settlement figure at close: £12,085.41 I would also be grateful for any pointers regarding the letter I should send to the bank. Specifically in terms of how I should word my grounds for complaining. After all, I signed up to the PPI loans and cannot recall what (if anything) was discussed but would presume I signed the paperwork. I know that hearsay complaints are being rejected so I would be keen to hear suggestions about how to best word the letter. Do I only need to mention the magic words "single premium policy" to get a refund or will I need to argue my case in more detail as to WHY the single premium is unacceptable to me?   15. Hi there, I thought i would ask on here as everyone was so helpful before when i had a problem with my bank. I had PPI insurance on a credit card from Bank of Ireland starting from around 2007 for about 3 years. I do remember at the time as it was my first credit card i had no clue and i recall on the phone the lady being very pushy about me taking it out and of course i was that desperate at that time to get the card that i agreed to it. I do remember it was a hefty amount over the years as i held quite a large balance on the card. I had another with Aqua credit card which again i felt pressurised into but besides from that if i had have been out of work my employer would have paid me adequate sick pay anyway so it was pointless money i was paying. I did try and cancel it on the phone a few times as i was entering into a debt management plan. This never happened and it was maybe the third time on calling that i got it cancelled. Again it was quite a hefty amount every month. I am considering now trying to claim this back from both Bank of Ireland and Aqua. I know there is so much information on it here and apologies for coming on to ask something so trivial but i wanted to know is there much information i would need before starting this claim. i do have both account numbers and a rough estimate of when i took them out. Is this enough to use to send a letter or should i be sending the questionnaire initially. I dont have any policy details etc only the account numbers of the credit cards and i know there was defnitely ppi on both. Has anyone any advice on where i should start with both of these? I do know that as i am on a dmp at present that the money if was successful would go off that but i wouldnt mind that. I really just want to get the ball rolling and im not great at these types of things so i would be very very grateful if someone wouldnt mind helping me out. Thanks very much in advance
  16. Hi CAG I've tried searching but no luck, apologies if there is a thread on this. I'll try and keep this short. My contract with vodafone came up to the end of the 24 months today. I requested cancellation 30 days ago and that's all dandy. I looked through some of my recent bills lately, and I've noticed that I've been paying £5.50 extra a month for an extra 1gb data. Now I never actually told vodafone to add this on, I did enquire about it way before they added it on (because I was hit with heavy charges for going over my 500mb allowance) but decided not to as the value at the time wasn't very good. So I called vodafone 2 days ago, 1 to request a PAC serial for my new PAYG sim, and 2 to enquire about the bolt on, and whether I'm entitled to my money back. I discussed the matter with a customer care colleague, telling her I never requested this and I should be entitled to my money back (I've been paying this for about 8 months). She first said they add that one for me to stop lots of charges, then said calls are only recorded for 60 days (surely that's their problem?) so it can't be proved. I did disagree as I haven't signed a contract based on this. She then said because my contract is being cancelled they would not be able to credit my account, and that it would need to be reinstated before they could do so. I said I have 1 more payment with them due to go out on X date, suggesting I should just cancel the Direct Debit which would just about cover it. She agreed I should do this, I asked if they would try to take the payment as I didn't want a default, she said no, they will send me an email with a bill. I didn't get this so I had to call again, received the email later, but it's got a bill attached from November and doesn't address anything I've discussed. So does anybody know if legally I'm entitled to my money back, and whether it would be a good idea for me to cancel the direct debit? Thanks in advance (sorry it wasn't very short)
  17. At LBA stage, but can't seem to find any threads at all to compare with. Account is zero balance, not defaulted, huge credit limit, very healthy. 14 default charges 2006 - 2011. 2 x £20, 12 x £12. Have sent initial approach with list of charges, and very quickly got the get lost and bother the FOS, dispute is closed letter. Need a little help now guys please...

I put a claim in to Barclays for a business loan I took out back in 99 which had PPI attached to it, I was and still am self employed so reclaiming on the grounds that i would never have been eligible to make a claim, today I received a letter from them informing me my claim has been rejected as they can't find any evidence the policy was mis-sold and that the letter is their final response to my complaint, they also enclosed a leaflet explaining I can refer my complaint to the FOS. After reading on here using the FOS could take up to two years is there another step I can take?
  19. Hi We had 3 PPI offers from RBS re a Credit Card starting at £NIL, then £100, then £900. Is there any way of trying to increase the claim even more? or would you accept the 3rd offer made? Thanks Mark

I've just found this line in another thread : It was not until I pointed out that she was RENTING the items until they were paid for, they were obliged to repair or replace with an equivalent item before the rental term expired Does that mean that even without OSC they HAVE to repair/replace should it become faulty, within the time that the agreement is being paid for .. essentially saying OSC is a waste of time (and hence why it can be reclaimed). On a side note, my partner bought a "Used" Fridge Freezer, was told she HAD to have OSC (Mis-selling!) and the thing was dented and knocked to hell. Also she bought a "NEW" tumble dryer (and it says on the contract NEW), but what was delivered was a shop-floor model, complete with no manual, wrapped in film and had the sticker ripped off the inside of the door frame. They weren't bothered that it was a shop-floor model, simply stated that "within 14 days it's still classed as new" despite the fact I questioned them on the fact what if some kid had spat inside the drum ... it's not beyond the realms of possibility. I shall name this fantastic store as SKELMERSDALE in Lancashire. On two hits have they screwed my partner over.
  21. Hi Guys, Mid May I sent a reclaim charges letter and spreadsheet to Coop Bank claiming CC charges to the amount of £2605 levied on the account over 13 years. Today I received a reply and cheque from Coop for £794 as their final response. They claim that to go back more that six years is against the Limitations Act 1980 and any charges incurred prior to May 2007 are outside of the six year rule and therefore statute barred. Is this the case or are the Coop telling me a load of bxxxxxks and should I just accept their cheque and shut up or persue the other £1800 pounds. Looking forward to your replies.

Hi this is my first post and I am asking for any help regarding my claim of 6 years against GE Money who have repeatedly refused to accept any responsibilty for the selling of PPI when we took out a loan in September 2004. They state that it was Portfield Finance that sold the insurance to us who are no longer trading. We contacted GE by telephone to make the initial loan request and had never had any dealings with Portfield. A single insurance of £1280.00 was included with the sale of the loan. My husband was self-employed at the time and looking into the small print the insurance would not be suitable for him and it didn't even cover me. Eventually GE sent us a copy of our application form on Portfield headed paper which showed 2 fraudulent signatures for myself and my husband. When we questioned this with GE their response was that our correct signatures were on their credit agreement which meant we must have been aware of the PPI and if we wanted to take the matter further in relation to the signatures to call the police! After 6 years of trying we are at a loss now as to what we can do with regards to our claim hence this request for help. Can anyone suggest anything or should we just call it a day after all with Portfield no longer trading we are at a loss as to what to do next. Thanks
  24. MBNA have confirmed to me that they only have page 1 of my application form from 1993. They have nothing else relating to my application. They quote the Carey case and say that not having all the paperwork is not an issue and that I must continue to pay. I do not want a bad mark on my file but surely I can reclaim all the charges and interest and ask them to stop all interest and charges from this point on? What is my best course of action? thank you.
  25. Hello. I've been reading many posts about reclaiming charges/fees/interest added/mortgage exit admin fees from mortgage lenders including accounts that were settled some time ago so I thought I would send a SAR request for this mortgage account which was settled early switching to a remortgage with another lender. The only details I have are; the account number, the settlement figure paid (I do not know if MEAF or if early repayment charges were included in the settlement paid) and the date it was paid. I do not know the date the mortgage began. I can not find any address for Platform Home Loans for me to send the SAR letter to? Can anyone help? I don't even know who owns Platform? Thanks for any help or information.
