  3. Hi Between myself and my partner we've had 5 parking notices from a problem with a railway car park. In all cases we have paid a fee using the app but a couple of problems: 1. Due to poor internet connectivity and busy trains we were unable to pay whilst on the train - we got to work to try there but after distractions forgot to pay BUT paid on the day and before we returned to the car. However due to the way the app works it charged the off peak rate and wouldnt allow a backdated payment on that day - we even phoned but they said couldn't be done - but we made sure we paid. Every other day we use it (3-4 per week) we have a good history of paying the right amount 2. My partner paid a fee on the app but selected the wrong vehicle So a combination of user error - and poorly designed system we couldnt / didnt pay the correct fee - the difference is appx 70p My partner has appealed to her 2 because they were for the wrong car so her car didnt have a valid ticket - my car was at home - but they got their fee on the day On the ticket machine the fee is £4.00 on the day - we paid £3.70 on the app - both facing fines of £100 each - escalating to £170. I'll post all the details here shortly using the questions but what are my options? I've read up on Byelaw 14 - no real financial loss - and were prepared to go to court as the difference in what we paid and what was due is minimal. I also had another fine for my car on the same day as my partner. I have proof I paid (which I've now sent them) and my partner also paid (it's one of the tickets described above) because she used the default car on the app. So even though 2 x tickets I still got a fine and intend to use that in defence of the other fines that their system is flawed. If we had failed to pay I would have fewer issues but we did our best on a system designed to trap you Advice greatly appreciated

  5. Brill I've just prepared a letter for statements. I've dug out some going back to 2011 as a start but I dont have them all. Looking at what I have got there are entries for: Admin fee: £40 Additional Interest: various amounts over £25 Direct Debit Recall: £25 Additional Interest SI: various amounts around £10 Debt counselling: between £50 and £90 I've started adding the admin fees to the spreadsheet. What charges can I consider to claim back? Are all of these valid? Thanks for prompt responses.
  6. Hi We've had a second mortgage with GE Money which has now come to the end of it's term. However - we've struggled to keep up with the payments - gone into arrears and then caught up. We've had in the past councillor visits which we didnt ask for (and were a waste of time as they are not true counsellors) - had some legal threats which we've recovered from. Now though, although the loan is at it's end the fees they've added on and interest etc now means we owe them about £5k on an original £15k loan over 10 years. which we are paying back at £200 per month. For each month we were in arrears they charged us £40. Plus interest so if we took 2-3 months to recover it soon added up. Now we are in a difficult position and face another 2 years of repayments. 1. Can I reclaim/get them to write off the fees charged 2. reclaim/get them to write off the additional interest. How do I go about this? What is the legal position of them pursuing a claim against us for the current outstanding balance? Can we simply refuse to pay? Especially as we have fulfilled the payments on the original loan. We also have another loan with them which has about 2 years to go and our main mortgage with halifax with about 5 years to go - both have had fees imposed. Any help appreciated as this is a major drain on us Thanks
  7. Hi My wife and I have got behind on our credit cards with Capital One and we have now defaulted and off to a debt collector. In the past there was a lot of chatter about claiming back credit card charges and I know the courts have ruled against bank charge claims saying they are fair ish Is it possible for me to pursue a reclaim of credit card charges against Capital One, even though they will say their fees are low and reasonable and can I attempt to claim them all back. If I can then I'll start reading and getting my debt paid off with the charges they owe me! Ta
  8. Hi all, Without going through all the ins and outs I've recently fallen foulf of my gas supplier - (estimated readings etc etc) and have a bill of £800. They've installed a prepay meter and were paying back an agreed amount each week which seems normal practice. What is annoying me about this arrangement is the current rate for the gas supply which appears to be much hgher than "normal" customers. Surely there must be some legislation or similar that should stop a company discriminating against it's customers in this way. I am a trapped customer. I'm assuming I can t switch supplier whilst I owe this company so i'm stuck with them. They insist on a prepay, no choice for me. They get the money up front and the debt prepaid without any further managment by them so why should the gas rate be much higher. Is there an ombusdman or OFT I can take this up with

  10. Hi I have 3 defaults I'm looking to try and get removed and wonder how I stand. 2 relate to O2 (2 x contracts) and were noted on my credit file over a year ago. The accounts have been paid and noted as settled. However I still have these contracts and still continue to pay my monthly amounts - I even got a new phone on one of them a few months back. How do I stand in getting these removed to at least show the current payment history? The other is very similar. It's a long standing credit acct. I've been paying regularly per the statement. The default again was over a year ago but not in trouble since. The credit file entry shows the default and the current balance. Any advice appreciated Thanks Wicket
  11. I've just got off the phone to barclaycard and was told something I don't quite believe... I was told that not only do they share information about me to CRAs but they also receive an updated credit score each and every month from the CRA. Now, I know they will do this when I apply but I'm very certain I did not give them permission to continue to do so each month. Surely this is a breach of my rights under the DPA? They're going to send a copy of the terms and conditions. This can't be right can it? This has made my mind up to now claim my charges off them too. She also explained that I can request my statements under the DPA but they only need to supply them back to May 2004 - if I want more I have to pay more for them.....surely that's wrong too?
