  1. Hi all, I'm trying resolve this issue with PCN I have received recently from Athena ANPR Ltd for overstay at Lidl. The overstay was 14 min. 35 sec. Arrived at 09:43:43 and left 11:28:18 = duration 1:44:35 Shops opens from 10AM Sunday. Short story, it was Sunday just before 10AM and I saw ppl outside Lidl so I thought it might be open. Parked my car and there was just a queue in front of Lidl..., so went for a walk, as this was my first stay in Mablethorpe. Off course I did forget to take my swimming shorts with me, so spend bit longer in Lidl, looking for shorts. Few days later got this PCN. I think this isn't fair as if you look at the time the shop opens and the time I have left the parking is just within 90 minutes. Normally I don't spend this much time inside the shop. Do you think I have a chance to get this PCN canceled ? Just want anyone's thoughts before I do appeal. 1 Date of the infringement 01/07/2018 2 Date on the NTK 04/07/2018 3 Date received 07/07/2018 4 Is there any photographic evidence of the event? Yes. Driver and occupants not visible though. 6 Have you appealed? {y/n?] post up your appeal] No. Here's the question: do I have to appeal to Athena and Lidl ? and what would be the best way to appeal, by post or email ? Also is there a template how to appeal, this will be my first time. Do I have to write my story or just complain how unfair they threat the customers ? 7 Who is the parking company? Athena Parking 8. Where exactly [carpark name and town] LIDL Mablethorpe - High Street, Mablethorpe LN12 1EH Appeals Body says the IPC. The occupants of the vehicle did shop in LIDL on the said day. So I got my first ever PCN today, through the post. 1 Date of the infringement 24/06/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 28/06/2018 3 Date received 30/06/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Yes 5 Is there any photographic evidence of the event? Yes 6 Have you appealed? {y/n?] post up your appeal] No Have you had a response? [Y/N?] post it up 7 Who is the parking company?ParkingEye 8. Where exactly [carpark name and town] Lido (1) in Margate, Kent For either option, does it say which appeals body they operate under. It says BPA on the letter. It was just getting dark when I entered the car park, and it was packed (we were there to see a show). I honestly didn't see any place to pay for parking, nor did I see any signs that I needed to pay. I had a blue badge which was displayed clearly and the correct time was set. Not entirely sure what to do with this! Any advice about how to proceed would be appreciated.   4. Hi all, Just received (through the post) a letter from Civil Enforcement Ltd. The letter states I was parked in a hospital car park at the beginning of June. Apparently, I failed to display a valid ticket. My issue is, on the day in question, I was in the works van approx. 200 miles from the hospital. My car, which I use on the weekend was parked up, at home, 100 miles from the listed hospital. There is no photos of my supposed car parked in the hospital car park. The letter isn't even on headed paper, only found out the company name from the address on the back!! Where do I stand with this? Can I appeal and ask for photographic evidence?? Thanks for any advice!!
  5. Hi Received letter from DRP (Debt Recovery Plus) to pay £160 for unpaid PCN from 14.4.18. I've never received a PCN from UK Car Park Management Ltd before, so this is the 1st time I've seen anything! Just called DRP to get more info - they have photos, say I exceeded maximum stay (or may not have paid). I remember being surprised on the day that it has changed at Brighton Met College to the new system, lots of people that day had confusion, couldn't pay by phone (there's no cash option) or was told carpark full, which it clearly wasn't. I have phone record on that day, but that's all but think we may have had similar situation where it said full and we put notice in the windscreen to say this. They asked if I moved recently - I did in Oct, but did update my address with DVLA, etc. Again this is the 1st I'm hearing from them. They just said on the phone I have no right to appeal or dispute, to pay £160 or further action! Any advice would be appreciated - should I ignore, should I contact UK Car Park Management directly instead...? Many thanks,
  6. i'm asking on behalf of a friend who is a wheelchair user and had to attend homerton hospital for her daughters appointment. they drove around looking for a BB parking space and couldn't find one and as the appointment time was nearing they parked on St Barnabas Terrace. they are newham council residents and and unfortunately hackney council seem to follow different rules, in newham they can park in resident only bays etc with a BB. they did not realise that they can not park in the business permit holders only bay with a BB and i know ignorance is not a defence but this was the first time they had ever travelled to hackney to attend a hospital appointment at homerton hospital. there were only 2 bays which they could see for BB holders and they were in use and being in an unfamiliar area they did know where else to look for valid parking. just wanting to know do they have any chance at appeal or not, thank you very much.
  7. Help Required I have received a Pcn fine from a private car park in Blackpool NE Parking Ltd. I have received a letter from above company on the 17.12.17, Saying that was parked incorrectly and not within the parameters of the bay, they have supplied a photo of my vehicle with one wheel on the white line of the car parking space (not actually outside of the bay) they also have a picture a parking ticket on the windscreen of the car. Which wasn't on there when i returned to my vehicle. The fine relates back to 22.10.2017. I have responded to the company by email To whom it may concern. I have today received a notification of a fine issued by your company stating that my vehicle was 'not parked correctly within the markings of the bay and it also stated that I had been issues a penalty notice at the time. my vehicle is on the white line (which is not outside the parameters of the bay.) this was only one wheel as shown by your photographs. you photographs also show a yellow package on the window screen however there was no notice on my car on my families return to the vehicle (if this was the case I would have contacted you prior to the letter I have received today.) I feel this is an unjust letter / fine that I have received. I will also endeavour to seek further advice if this matter progresses. Response from NE Parking Ltd Thank you for your email we received on 17/12/2017 Unfortunately you are out of the timescale to appeal you were given 28 days To appeal from the day after the pcn was issued to the vehicle which Was (22.10.2017) The amount which is now payable is £100.00 I have replied saying how do you respond to something which you where unaware you've received. Can anyone help me and tell me where I stand with this. Thanks
  8. Hi All, Firstly, this isn't strictly a PCN issue but it is related to one, so I'm not sure if this the appropriate forum and please let me know if not. My vehicle was clamped on 30th June and I discovered this and spoke to the bailiff on 1st July. I've submitted TE7 & TE9 forms to TEC so this should all be resolved this afternoon. However, I am going to make several complaints about the bailiff's actions as he was not only extremely rude and unprofessional when dealing with me, but also probably broke the law. Some background info: I called the bailiff (MO) on Sunday afternoon (01/07) but he didn't answer; he then called me at 10pm Sunday evening to discuss. During this conversation he told me the vehicle in question had been clamped previously and I had cut it off, telling me that because of this the vehicle would be towed immediately if I didn't pay the outstanding balance. When I contested this and asked for info his response was along the lines of "I dunno, that's just what the system says" and refused to give any further evidence. I was pretty incensed by the accusation so told him it was utterly false (exact words) and he hung up on me, refusing to answer again. Today I called him to get the PCN number then did my relevant homework and called him back to let him know I'd submitted forms with TEC and he should hear from the issuing authority by the end of the day. I asked him to give me his full name and registration details so I could submit a complaint about his behaviour last night and he outright refused, saying he didn't have to. When I told him he was legally obligated to give me his information he got increasingly angry and doubled down. He said he would show his certificate when releasing the vehicle but would not give details to me - to which I responded by saying we both know that will never happen as he will most likely quietly remove the clamp and then be gone. I eventually gave up with no information. I checked his name on the immobilisation certificate then checked the Certified Bailiff Register and found his full name and the court / company he's registered with, so am going to submit my complaints there first. My most serious complaint is that his attempt to extort me into payment by claiming I had removed a previous clamp (let me just state - I hadn't) is a violation of The Fraud Act 2006 Section 2 and his refusal to provide any evidence for this, despite it being "on his system" is also a violation of Section 3. So my question is this: who do I report this to and how? I'm currently drafting a complaint to Hertford County Court (where MO is registered) with all of this included, but would like to take this much, much further so he never attempts this stuff again. Having never submitted any kind of criminal charges before I have no idea where to start.
  9. Good Afternoon All, Just wonder if I have this all wrong ?! I appealled a TFL PCN, Appeal was rejected and the rejection letter stated I had 21 days to pay at reduced rate of £65 from the date of the letter of rejection which was 11th June 2018. ...' if you pay the penalty charge within 21 days from the date of this letter you may pay the discounted amount as full and final settlement...' I calculated from the 11th 21 days I could pay by the 2nd July at the very latest? I went to pay the fine today and it has increased to £130 ! Have I miscalculated the dates/wording? surely the 1st falls within 21 days from the 11th July? As it is a Sunday and no one is available at TFL to talk to I thought I should pay it and hope they can refund as if I didnt pay then tomorrow am sure they would say I missed the 21 days...am now more than broke.. Am I right to think I had until 2nd to pay or have I misinterpreted the letter? Many thanks

  11. Greetings everyone, I work in a small office in Hove where I pay for a car parking space. I have a permit which I display in the window of my car. I have received parking charge notice from Uk car parks https://www.uk-carparkmanagement.co.uk/aboutus/legalitiesmanagement Now the badge I was displaying was valid from May 2017 it has no expiry date on however I have I have been giving a new permit to display in my car which I forgot to do! I pay £70 per month for this space and have had it for 20 months. What is the best course of action? PS Apparently, they take drivers to court Thanks
  12. Hi, question - how long is a warrant of control issued for an unpaid council PCN valid for? I thought it was 12 months but the relevant bits of CPR 75.5 have been struck out (I can't post a link as I'm new, but if you google CPR 75 you'll find it) so I think the law might have changed. Any ideas?
  13. Hi, My husband rents a black taxi and I have just received a PCN dated 14th June for a contravention that occurred on 12 Feb! I am about to ring the taxi firm as I'm not 100% sure that he had this cab at the time (he has to swap them when they have to go in for repairs etc) but isn't 4 months a bit of a long time?? this is from TFL
  14. Hello CAG members I wonder whether anyone could help? I recently received a parking charge notice from G24 that refers to a date roughly three weeks into May for the car park outside B&M Stores in Falkirk (Scotland), with an issue date a week after. The car park is free but timed seemingly to 2 hours and in this case a 20 minute overstay has been flagged. I haven't as yet responded. Although I own the car, the driver, a gentle and vulnerable person who pays their taxes and wouldn't bother a fly, could easily have picked this letter up before I did, which really bothers me. And as I'm dealing at the moment with same person being bullied in bereavement by the BBC licensing people, I'm really not a happy bunny right now. Unfortunately the forum won't let me post the notice as an attachment or link. Then further down it says: I'm not very familiar with law stuff so obviously I'll be having a search around the forum but my initial questions for now are: - Is this really enforceable? - As of 2018, do they really have the right to get my details from the DVLA?   15. Dear All, I am new to this and i would need your precious help. My car was parked inwalmer street in manchester and the driver bought a valid ticket from the machine. Upon shutting the door this ticket has fallen on the floor without the driver realized that. On return the drivers find on the windscreen the penalty charge as "as no ticket displayed". The driver tried few times to call the number on the ticket in order to talk to an operator but the number rings out. Once at home the driver send proof of the valid ticket to SIP through their website and for an appeal against the charge explaining the circumstances. After a week the appeaq was rejected and been advised to pay GBP60.00 instead of the original GBP35. Advised to appeal to IPC if unsatisfied. Replied to several email but SIP said they will NOT reconsider the decision. What do you suggest to do now? Should the driver contact the IPC? Please your help is needed Thanks sandrofio

There are two official bodies, the BPA and the IAS. If you are unsure, please check HERE Yes, IAS If you have received any other correspondence, please mention it here NO I went to the hospital for a scan, I thought it would be quick and paid parking for an hour but I overstayed by 33 minutes. When I asked the guy at the Radiology reception, he told me that if I was to go back to my car to add some money to my parking ticket I would lose my place in the queue!! Now CPM wants me to pay £100 or £60 if paid within 14 days. Please advice if you can! Thank you!

BPA I was wondering whether anyone would be able to help with a Parking Charge Notice I have received. I have read through a few posts on here and I'm hopeful I could not pay this charge but would appreciate anyone's advice? I was in the Magistrates court (as support not accused) all day from 9am to 5.10pm. During the day the only car parks I could find that were available were for 3 hour limits and after using two in the morning I went to one on Wellington Street in Stockport for the afternoon. I paid for the maximum 3 hours parking but unfortunately after lots of waiting the case I was in finally got seen at 4.40pm but was eventually adjourned (long story), This made me late for the car park but I thought nothing of it as I didn't have a ticket - I thought I had struck lucky. However I since received a PCN in the post and was wondering if anyone could help. The car park is only a small one and I managed to get the last space. I did drive round he tight little car park to check spaces and this tight one was the only one left. The Entry time was 13:51 and Exit was 17:16

Where exactly [Carpark name and town] did you park? Centertainment Sheffield Hi there, me and my girlfriend went to the cinema last night in Sheffield. As we got into Sheffield we noticed there were really bad traffic around the centertainment area. We managed to get into the car park for Cineworld and it was absolutly jam packed. There was an event going off somewhere nearby and people were using the centertainment car park (as its free) and leaving the area. The cinema was dead so the majority of cars there were infringing the rules by not staying within the area. We drove around for half an hour and was late for our movie trying to find a parking bay. We found a little area, safe section unused by the walking public and unmarked as all parking bays were taken up. We didnt obstruct anyone or cause any danger to anyone or cost anyone any money. I was outraged at the fact that everyone was using the parking bays and not even going to the cinema. They want £100 for some reason, £60 if I pay up within 2 weeks.

Having a few issues with Civil enforcement LTD They got my car in a pub car park in the east riding of Yorkshire where you have to go in the pub to let them enter your reg plate but this wasn’t made clear in the pub. I received a letter first letting me know about this parking charge when it stated that I hadn’t paid at the discounted rate of the first letter. Never received the first letter at all - so been trying to get out of this ticket Wrote to Civil Enforcement limited and they told me it was tough as they sent the letter and didn’t matter if I had received or not Tried appealing the ticket with POPLA but couldn’t. as Civil Enforcement limited wouldn’t give me a code to appeal the ticket. So POPLA wouldn’t entertain me So went one above and then Emailed BPA but they said they didn’t get involved in disputes such as this but I learnt that Civil enforcement LTD pay a membership to them I then got a letter from the solicitors on the behalf of Civil enforcement LTD. They have offered me a payment plan of an extortionate rate of £236 for been in this car park for 12 mins :mad2: Is there any way I can get out of this, Happy to provide more details if need be Thank you in advance
  20. Hi - I hope the community of CAG may be able to help. I had received a PCN by a CEO. Here is a timeline of what had happened: -received a paper PCN (stuck on window) on the 19/2/18 for parking in a suspended bay as there were scheduled tree cutting maintenance going on. I definitely missed the sign. Car was towed to adjoining street. -sent a representation to council, with proof of posting, on 27/2/18. Below is my representation sent to them -did not receive a response from the council regarding my representations. -receive an NtO today (4/5/18) - below is the NtO received. -I also checked the website for pictures of the alleged contravention online, but NOTHING. Nor were the pictures sent with the NtO - usually the last page on the NtO from what I gather, contains the pictures, but in my case, the "page was intentionally blank. Do I have a good chance of appealing? Were the council supposed to respond to my informal representations? Pictures have not been provided despite asking in my reps and checking on website - is this a procedural failure? Thank you, Jay NtO: ****START**** On 19/02/2018, my vehicle **** *** was issued with a Penalty Charge Notice for the reason (code) of 21 – “parked wholly or partly in a suspended bay or space”. This should be cancelled as there ought to be a grace period of 10 minutes by virtue of Civil Enforcement of Parking (England) General Regulations 2015. As can be seen from the PCN, observation started at 08.05am and PCN given at 08.08am. Under the 2015 regulations, the PCN should have been given at 08.11am at the earliest. This was not the case here. Also, the photographs that should be available on the website, are not found when clicking on any photograph link. The very last time I tried to check photographs were on the 24/02/2018 just before 10pm. Please see appendix 1 and 2 of exactly what I faced. By law, these photographs should be taken by an approved device and be available to view. Unfortunately, ‘upto 3 days after the contravention’ for pictures to be available stipulated on Newham’s website, is beyond that time frame. For the reasons above, I look forward to receiving notification that the Penalty Charge Notice has been cancelled within 28 days. ****END**** NtO_SusParkingBay.pdf
  21. HELP!!!!!! Please ....... My 16yr old son went through a bus lane back in November 2017 on his motorcycle, the first we knew about it was when we received an notice of enforcement totalling £175 through the post from Marston’s on 29th March 2018 but the letter was giving us until 25th March to get in touch for a payment arrangement. We rang them and explained that this had been received after the date to come to an arrangement and this is the first time we had known about the fine. They were most unhelpful saying that the full amount needed to be paid to stop further action. I asked for evidence of the offence and they did not have this and suggested I speak to SWindon Bpurough Council. This we did and also they were inhelpful saying this was now passed to marstons who were dealing with it now. We explained that had we received the PCN’s we would have paid the priginal fee of £30. They had no photographic evidence as there files were now closed on this and everything was with marstons. We filed an out of time order with the TEC had no response and now we have a removal notice today for £408. My son is on full time education does not work as he helps me at weekends as I e just been diagnosed with cancer. He has no way of paying this and marstons will not accept an arrangement they only want full payment. I’m happy to pay weekly to stop this action if only they’d listen. My son no longer has the motorcycle as he sold it to use for tools for his college. Can someone please help or advise. I know the usual keep doors and windows locked but I need a solution to the problem.
  22. Hi, I am looking for some guidance. My partner who has a private hire cab stopped outside a restaurant and went in looking for a customer (not realising that it was in fact a loading bay). Came out to find a ticket on the car. The PCN states that the offence code is 02 'Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force'. This is under s78 civil enforcement of parking contraventions under the traffic management act 2004. The time the contravention was observed was only 1 minute. I am just wondering if he has any grounds to appeal this. The time was 17:52. We will go past and look at the signage tomorrow but this is what is showing on google street view (realise this may have changed since).
  23. Hi, can someone advise whether the signs advising of a clearway should be clearly visible in the photographic evidence provided??? I just had a pcn, I was parked (engine running) for moments on a verge, in front of a clearway sign, but not after it. the sign is not in the photo plus all double yellow lines are all broken. does the clearway start AFTER the sign or infront of it too? my car was stopped directly in front of a sign but not after it

Whilst parking for my case against WY Parking (which I won), I return to my car with a PCN attached (FML) I paid (confirmed money has left my bank account also) using my debit card - The ticket machine gave 2 tickets (both saying DISPLAY THIS WAY UP ON DASHBOARD). I took the ticket showing my parking fee more clearly to claim for costs.. Still displayed the counterpart though.   25. Hi! My wife shopped at Lidl and where in and out for 54 minutes. car park says its "FREE" to park for 1 hour 30 minutes if you registered your vehicle. We have been shopping at this Lidl for years and we never have to scan anything for parking so she did not scan the receipt as she wasnt aware and its probably something new. so after a few days we got a Parking charge notice (PCN) with a heading saying that its a "CIVIL PARKING CHARGE NOTICE" and they are asking us to pay £90 (or £45 if paid within 14 days). I believe that my wife did no parking contravention nor parked there illegally. she was a paying customer and she was well within the allowed parking hours. should we appeal and give them our details or should we just ignore it like what other people have done. please give some advice. thanks
