Hi, I parked in a loading bay for what felt like no more than 15 minutes and received a parking ticket. See images attached. I couldn't see any signs that clearly displayed the time allowed or the terms and conditions. Is this legal? Please let me know if you need any information and thank you CAG in advanced!

Hi All, Any help would be greatly appreciated on how I appeal this parking Charge, I paid for the days parking via the PayByPhone app but selected my previous vehicle in error (same make and colour in list with similar number plate!). Hi All. The SIP and Euro carpark are both right next to each other. I bought a Sip ticket on my first day parking and parked in the euro car park side. Was parked here for 5 days. Made this mistake on the Monday. Then bought 4 Euro car park tickets for 15,16,17,18 of August. I have retained the ticket for all 5 days. It's a confusing area to park. The Euro car park is on the left of the big Sip car park. This is where I parked. Whilst parking for my case against WY Parking (which I won), I return to my car with a PCN attached (FML) I paid (confirmed money has left my bank account also) using my debit card - The ticket machine gave 2 tickets (both saying DISPLAY THIS WAY UP ON DASHBOARD). I took the ticket showing my parking fee more clearly to claim for costs.. Still displayed the counterpart though. Hi, the driver parked at Walmer Street car park on 8/4/17 and went over the parking time by 20 mins. After 28 days i received the 'Notice to keeper', which after reading online i ignored and any further correspondence thereafter. Unfortunately it is now being taken to court. My argument was that I did not receive any photo of the parking as i or any other driver of the vehicle couldn't recall parking at the relevant car park. I have a court case on 27th February 2018 and just received the Witness statement from Gladstones Solicitors. I have attached a few of the pages, please can someone advice on what i can do. I do notice from the photos the ticket that was purchased states 'Wilmslow Road' which is acknowledge in the statement but the case mentions 'Walmer Street', can i use this in court as my defence? if there is anything else that i can use so i can prepare before the case. Oh dear, I have spent from 8 am this morning till 3 pm at Manchester Eye Hospital. I parked in a Disabled Bay, correctly displaying my blue badge. I could not drive because of the eye drops which were not wearing off - giving me extremely blurred vision, so at 12 noon my daughter came to pick me up until my vision improved. At 3 pm she drove me back to retrieve my car only to find a Parking Notice Enclosed stuck on the windscreen. When opening it it states that 'Blue Badge Not Displayed'????? I find this rather odd as my badge was clearly displayed. My daughter went inside to challenge the 'parkie' guy only to be told that had gone home for the day. We took pictures of my car parked in the disabled bay, clearly showing the hospital in the background with my badge displayed. I really don't know what to do as I am loathed to give them any of my details..let them buy then from the DVLA if they want to go that far. It is not clear who the company is?? Back of ticket just repeats PARK SOLVE in big blue font. Parking notice states who to pay it to: Civil Enforcement Ltd. Do they not have to make it clear who the company is? I looked up Park Solve on companies house and there accounts so far show only £46 in the bank with a few addresses of a South African guy with lots of different companies..very weird. Any advice would be helpful as I have to return in a few days for more treatment. As an aside, there was a car parked nearby with at least 8 parking notices on it..wow, must have got a job lot. Do they not take photos of the offence as I would love to see my car without a blue badge displayed to back up their claim as this would be a miracle.

Hiya guys, Missus had parking ticket in June this year and did nowt with it. Now has a letter which says Final Letter Before Action from UKPE saying they require £100 for breach of contract. I have dug out what she got but cannot scan and post it. offence 24-6-16- Notice to keeper dated 14-7-16 received on 17-7-16... Any advice would be appreciated. Thanks

Hi all, A 78 year old good friend was due to fly back home to Austin, Texas, via Houston on Wednesday. Singapore airlines would take him to Houston and then United were due to take him to Austin. His flight were cancelled so I contacted Singapore and they agreed to pay for BA flights tomorrow from Manchester to London and then on to Austin, which is great. However, they have refused to reimburse him for his accommodation and food costs. Is this correct, please?

havent been on here for a long time but here goes My father in law took a loan out in 1990 with consumer loan company ( now defuncked) for £50k interest only. the loan was fully repaid after 5 years and transfered onto another loan ( Repayment) which had a charge on his property. After quite a few years when the loan had gone down to about 10k I took the paperwork down to a solicitor who told me that although the loan agreement was not legal the fact that it was over 25k meant that he could not claim against C/ loans. He started to get calls from CEO asking if we wanted to make a small paymet to clear the dept. At this point I smelt a rat as I have never known a bank to except a lesser amount. Just as we were about to start sniffing as to why they were trying to do a deal Consumer loans then disappeared. Last year he got a letter from manchester building society saying they had taken over the loan and they wanted to arrange a payment plan. I took some advice verbally from a solicitor to say that they were probably time barred and that unless we acknoledged the dept they would not be able to claim. but that didnt get over the fact there was a charge on the property that needed lifting. three letters later the last one threatening legal action with a copy of an agreement dated 1990 and for 5 years makes me think A they dont have a legal agreement and are trying it on and hoping we are stupid enough to pay them. B dont realise that maybe we have a potential claim. The fact that they have sent this agreement says to me there is something fishy going on. Somepnes thoughts please.

Hi all, I started this thread following a post on Ginger's thread located in this forum (unable to post links yet). I have the same situation: 1) I sent a standard letter asking for the basis of the invoice and offering to go through POPLA as court is unnecessary. 2) Got an "appeal rejected" letter despite not actually appealing, rather just requesting information and offering to resolve the matter. 3) Got further letters from ES Parking and then one from Gladstone. I didn't bother wasting my money on postage sending a reply as I saw from every other person that they just ignore it anyway. I have a couple of weeks to submit my defence. I'm expecting to win, naturally as these guys are nothing more than low life cowboys. Any advice on what my defence should consist of? I was thinking of the following main points: 1) The driver was not identified and ES Parking refused to help in identifying the driver despite my request for information. I am only the registered keeper of the vehicle so why should I be liable? 2) The fee is not a genuine pre-estimate of loss (I have previously won a case through POPLA on that grounds) 3) I offered the claimant the option to resolve this through POPLA to avoid court and my offer was simply ignored. 4) My original letter (sent by recorded delivery) requesting information on the basis of the invoice was simply ignored with subsequent letters making unfounded demands for money 5) The invoice itself is baseless as ES Parking are just contractors, they don't own the land. That's the crux of it, is there anybody willing to help me in terms of adding extra points and the wording which will go into the defence? I'm also looking to make a claim for loss of earnings due to attending the court case should they go ahead with it - any help with that would be much appreciated. Many thanks all

Hi there, I (like many others) am in the same situation as Ginger - handed a PCN from ES for parking /stopping in the Spinningfields area. Letters of complaint / information requests have been ignored, Gladstones involved and the case referred to County Curt Business Centre. I'm pretty anxious and have never dealt with anything like this before. I am seeking some urgent advice as I returned from holiday to find the county court claim and now only have 2 days to respond... I obviously want to appeal and thinking along the lines of (pls forgive the lack of legal terms etc) : I am disputing this claim for the following reasons : 1) I have written to ES Parking and their legal representatives (Gladstones) several times to ask for more information and complain about their imposed fines. No acknowledgement or response has been received. 2) No evidence of wrongdoing / an offence being committed has been provided. They have sent me a photo of the front of a car - it is not evidence that an offence is being committed as you can only see the front half of a front end of a car in the photo (not the location or that the car is stopped). In the photo you can clearly see the two hands of the driver at the steering wheel, which suggests that the car was being driven at the time of taking the photo (i.e. not parked). 3) The charge they have applied is excessive, disproportionate and not commercially justifiable. Was £100, then £150, now £227. The original £100 is excessive and the subsequent increases and escalation to court whist ignoring my requests for more information and letters of complaint is wholly wrong. I suggested to ES parking that the original £100 charge was excessive and outweighs any cost to the landowner - I have asked for a breakdown of actual costs and subsequent increases. (No acknowledgment or response received). 4) The photo evidence provided is time-stamped with a different time to that of the alleged offence (the photo was taken at a different time to that of the alleged offence). Moreover as per point 2 - the photo is not evidence of any offence being committed. Their letter states that "the 'period of parking' to which the charge relates is the period immediately preceding the incident time" (the photo evidence is taken after the incident time). (the incident time is 12:00, photo is time stamped at 12:03) 5) There was no/insufficient signage on site at the time of the alleged offence. I have asked ES parking to confirm that there was signage on date of alleged offence - no response received. There is now signage onsite (months later) however this signage is inadequate as it's too small (roughly A4 size with lot's of very small text written on it), it is difficult to read from any distance and certainly cannot be read from a car, let alone a moving vehicle. There are no signs or anything to suggest that you are leaving a public road and onto a private one (the site of alleged offence is Manchester City Centre) - this is very confusing, perhaps deliberately so. It is not clear that the signs are referring to the road - it looks like they are referring to the adjacent pedestrian areas in front of some flats / offices, not that they are referring to the road - which you would assume was a public highway. 6) There were no road markings at the time of the offence to suggest that parking was prohibited (can evidence via google maps). 7) I have a 24/7 365 day a year parking space in my office underground car park at the site of alleged offence (so I have no reason to park outside, when I have a space inside). This can be evidenced if required. Does the fact that both drivers hands are at on the wheel in the photo provided suggest that the car was being driven into work car park ? (if indeed the photo was even taken at the site of alleged offence). 8) I have asked ES Parking and their solicitors (Gladstones) for more information to confirm who is the legal landowner and that ES Parking has their authority in this matter and also to confirm that the road where the alleged offence took place is in fact a private road. I have also asked for full details of the alleged offence and how long the car was parked for. No response or acknowledgment received. It is just not credible or fair that ES Parking can send members of the public a picture of half of the front end a car, showing only that the drivers hands are at the wheel and not the location where the photo was taken or that the car is illegally parked (or even parked at all) and demand payment of £100. They have not provided any details or evidence : - Of any offence being committed. - Details of the offence and how long the car was parked for. - That the vehicle was on site at the time of offence. - That they have authority from the landowner to pursue costs. - That actual costs to the landowner have occurred. - That the site of alleged offence is not a public highway. - In addition the time of offence is not the time the photo was taken. With the above points in mind, you write back to ES Parking to ask for more information and to contest their parking charge, they ignore you and ramp the costs up to £125, a further letter from you is ignored and then costs ramped up again to £150, you write again, which they ignore and then escalate the matter to a court. I believe that this demonstrates that ES Parking are operating in an aggressive, predatory and disproportionate manner which is designed to bully and intimidate innocent members of the public in order for them to obtain money. Are points 2 and 4 valid ? I'm (very obviously) a lay person but I'm hoping these are important from a legal perspective. Hi guys, I received a parking ticket last week in Manchester, I am not too sure why but have an idea and wanted to run it by you. I was viewing two properties parked on street for an hour. The first house had 10 parking bays outside it, all were full, I went 20 metres round the corner, parked up and went back to the bays to the nearest ticket machine and bought an hour. I came back 50 minutes later to a ticketed car. I have been on the MCC Parking site and appealed it as I am not sure why, there was no full explanation save for "Parked without clearly displaying a valid pay and display ticket or voucher". I had a ticket, it was clearly displayed and even had the correct reg. number on it. HOWEVER... I am a bit concerned that the ticket I paid for has NCP on it and it is the council fining me. There was nothing that I noticed (not to say there was nothing) that warned that the two parking areas were owned by two different "companies" and that one is not valid on the other. The online details shows a number of photos including one of the "Pay at machine" road sign pointing to the opposite direction to where I paid for my ticket - the one I went to however was nearer and in the same road as opposed to the one it was pointing to. If this is the actual problem, is this really wrong and should I just pay the £25 now whilst I get 50% "discount"? Also, is this a usual problem that many others come across? I have never heard of it before and therefore not considered checking which machine is correct. Annoyingly, I paid by far a higher amount for "parking" with NCP that with MCC! Appreciate your help! I have just received a PCN for "Being In Bus lane During Hours Of Operation" on 8th Jan 2016. I don't dispute that I was in Bus Lane but what I do have an issue with is I did not know when the hours of operation were. I turned left from Redvales Road in Bury onto the main road towards Bury and was immediately in Bus Lane. I was going to post a link to to Google Streetview but have not posted 10 times so cannot There is bus lane to the right in same direction about half a mile to a mile away which has hours of operation of 7am to 10am and 4pm and 7pm and I thought it was in same times. Turns out I was wrong and hours of operation are 7am to 7pm (but the sign is on main road to right of junction!!) Now on main road there was a car turning right so I stayed in bus lane and then as soon as I went past the other car I moved into the non bus lane as I was turning next right. Do i have any grounds to appeal or should I have known immediately that because I had never seen any signs stating hours of operation that I should have not gone into bus lane at all? I cannot attach a copy of PCN as i have not posted 10 times. Thanks in advance Stephen Fisher

Hi, We parked in an SIP car park in Manchester but, because we parked in a really narrow spot, I put the parking ticket in the back window (the one facing outwards) so the attendant would be able to see it properly but they gave me a PCN anyway and said it was because my ticket was not displayed. I wrote and complained that I had a valid ticket (which I sent them as proof) and that I had displayed it in the back of my car (and told them why) but they rejected my claims and still want me to pay the fine. What should I do? The PCN was also issued at 7.52pm and the car park became free at 8.00pm so a £100 fine seems a little extortionate too! Thanks

My daughter is being prosecuted for being on a Greater Manchester Tram 'not having a valid ticket enabling her to do so' - Reg 4 (1) (a) Greater Manchester Metrolink System Byelaws She had a pass, ( left at home in error) and can prove it , but was too late responding to being issued with a 'Standard Fare' ( GM equivalent of the penalty fare) Does anyone know if 'having a ticket' must mean physical possession at the time? Hi, 3 friends and I visited Manchester over the weekend (Saturday and Sunday, 5thand 6th October). We parked on the SiP (Simple Intelligent Parking)car park in the centre of Manchester. When we arrived we went to the ticketmachine and it was, at the time, out of use as maintenance was being carriedout on it (the machine was open and it looked like the battery was beingreplaced). There were two SiP employees on hand. One was working on the ticketmachine, the other was manually issuing tickets to customers by taking theirmoney and writing out tickets. We wanted the 24 hour parking option which was shown on their signs as beingan £8 charge. We arrived at 12:50pm on Saturday 5th October and paidthe guy £8. He wrote at the top of our ticket “6.10.” and underneath that hewrote “12.50”. He told us this stood for 6th October, 12:50pm. Wewere happy enough as this is the 24 hour period we had paid for so we clearly displayedit on the dashboard and left. We returned the following day at around 10:45am, giving us just over 2 hoursremaining of the 24 hour parking period we had paid for. It was at this pointwe noticed we had a parking fine on the windscreen. We had a look at the fineissued and obviously weren’t very happy, to say the least! At this point therewere no SiP employees on the Car Park so we were unable to talk to anybody andchallenge it. We did speak to a couple of staff on neighbouring car parks andthey weren’t able to help us. The guy on the next car park up told us to “ringup and challenge it. They’re normally really helpful”. We returned to our carand rang the number on the sign. We were informed by voicemail that we couldn’tdo anything by phone and that we would have to write to them if we wanted tocomplain. At this point we also saw another customer on the car park who hadpaid their money into the machine but no ticket was issued to them. It wasdawning on us that this company might not be the most reliable in the world….. Upon examining our parking ticket closer we noticed that the guy who issuedthe ticket had written “£4” in the fee section. We hadn’t noticed this at thetime, and we definitely did pay the £8 fee for 24 hour parking. This is backedup by the fact the guy wrote “6.10.” and “12.50” at the top of the ticket. We have written a letter and sent it to SiP today informing them the fine hasbeen issued in error and that we are not paying it. Is this likely to be the end of it? Any advice given is appreciated. Hi, Posting on behalf of a friend who received a PCN for the above 'contravention'. I posted on another forum and got no response so thought I would ask here. My friend parked in a bay and did not park fully within the bay due to there being lots of broken glass on the floor towards the rear of the bay, a ticket was purchased and displayed as required. When returning to the vehicle he has received a PCN for not barking fully within a marked bay and confronted the traffic warden to ask why, as there was clearly glass on the floor and he had tried to avoid parking on this. He was not obstructing the road in any way as it was a roadside parallel bay and he had not reversed all the way in so he was partly in the bay and partly on DYL. The traffic warden said that he should have found another space to park in - there were no others free and my friend had a work appointment to meet. The ticket has been appealed but thought I would come on this for advice as my friend has said he is prepared to take this to court. He is of the belief that should a judge look at the case common sense should prevail? He has taken several photos and has retained the ticket purchased on the day. Any opinions/advice welcomed. Hi, I recently had some insurance work carried out at my house by Rapid Support Services. They're a company based in Manchester. Our insurers approved our claim for some water damage from the bathroom. We were going to use our local builder who we've used in the past and we understood that the insurance cover had a £60 excess which we would have to pay to the builder. Rapid Support Services sent us a quote via our insurance company. In this they quoted us for the work being done with £0 (nothing at all) excess to pay. Obviously this was cheaper than the £60 we'd have to pay our builder so we opted to use Rapid Support Services instead. The work was completed and they did a good job on the plastering. The were a few grumbles elsewhere, but nothing major. Time passed and all of a sudden Rapid Support Services have decided they want the £60 excess from us. This is despite them quoting us £0 excess and stating we didn't have to pay anything. We chose Rapid Support Services over our regular builder based solely on this quote. Today I have received a County Court summons for £60 from Rapid Support Services. As someone who's not got any defaults, CCJs or any other credit issues this has caused me some great distress and upset. It's also upset my wife too who was almost in tears when she opened the summons realising it could seriously damage our hopes of moving home, which we are currently doing. As we were quoted nothing to pay it seems wrong that Rapid Support Services can suddenly demand £60 from us and put us through this stress and misery. I therefore intend to contest the issue in court and I've also complained to my insurer. I am also considering cancelling my insurance policy based on this incident and I have written to them advising them as such. If I challenge this decision in court it will be the first time I have done anything like this. I am concerned about what will happen. In the case that I lose will the CCJ stay on my record for 6 years? And in the case that I win, will anything show of the CCJ at all? I feel badly cheated and stressed now. I don't want to lose our new home because of Rapid Support Services, but they're insistent that we owe them £60. Help?

I definitely want to appeal this as the picture shows my car in the bus lane for only a few metres before turning left into the car park. What are the rules on this? I have tried to look up the Traffic Management Order for this bus lane but Mcr council don't have any on their website. I have read somewhere else online that the bus lane is supposed to have a break in the solid white line where the junction is?Is that correct? This specific bus lane has no break in the solid white line. Hope someone can help!

Hi all First post, was looking for some assistance if possible. I recently received a PCN in Manchester City Centre (Code 05) having left my vehicle in a parking bay and wanted your opinions on whether I have grounds for an arguable appeal. I used the 'pay by phone' system for the first time as I had no change on me. As it was my first time I had to register my card details and then speak to an operator to set a PIN. I was then put back through to the automated system to pay. I followed the process and left my vehicle believing that I had paid to park in the correct location and having paid to park beyond the 20:00 (!) point at which payment is no longer required. I returned to my car to find I had been issued with a PCN at around 19:30. It seems to me that either (a) 'Pay by phone' have screwed up my registration/payment; or (b) I have made a mistake in inputting either the location or my payment details. I am currently awaiting a call from the 'pay by phone' people regarding whether they can identify any fault in their systems - I can guess the outcome of that... Anyway, if I have made an error in inputting my details do I have any arguable case? Also, is code 05 the appropriate code? N.B. - To date no payment has been taken for parking. The price would have been circa £2. Many thanks in advance.
