  1. Hi, I am looking for some guidance. My partner who has a private hire cab stopped outside a restaurant and went in looking for a customer (not realising that it was in fact a loading bay). Came out to find a ticket on the car. The PCN states that the offence code is 02 'Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force'. This is under s78 civil enforcement of parking contraventions under the traffic management act 2004. The time the contravention was observed was only 1 minute. I am just wondering if he has any grounds to appeal this. The time was 17:52. We will go past and look at the signage tomorrow but this is what is showing on google street view (realise this may have changed since).

Hello I would like to make a claim against several private hire companies in London on behalf of myself and other drivers and am looking for advice, after Uber lost their case and 19 drivers won their case me being one of the dr leighday.co.uk/News/News...-Tribunal-find judiciary.gov.uk/wp-cont...s-20161028.pdf Should i issue county court claim against the other private hire companies ( many drivers will qualify for reduced or no county court fees as their hourly pay is so low) or issue claim in employment tribunal? Thanks for any advice. I would prefer to use the Uber case and county court claim action to try and get the money asap as some private hire companies have gone bust (bounce, karhoo etc ) and some big ones insiders say are short of cash.
  3. Need info on regarding a PCN on shared use taxi rank. On TSM chapter 5 7.43, it states that LA will need special authorisation from Dft on use of diagram 650.1 (no stopping except taxis). But the new TSGRD 2016 which came on force since april this year, there's a para stating: Confused with the wording but is it to say that LA will not need authorisation from Dft? Thinking of contesting the PCN as it's a non-prescribed sign (650.1) but noticed the new changes. Caught out in Aldershot station road. Pay parking until 7PM and taxi rank from 8PM .   4. I booked a coach journey with Terravision from Manchester to Liverpool Airport. Pickup Manchester: 14:40 Arrives Liverpool Airport: 15:30 We were informed at around 14:50/55 that the coach would be 55 minutes late and that all buses throughout the day were actually around 30 minutes late. What annoyed us is if they were aware in advance that buses were running late all day long, then why weren't we informed? or a notice placed in the waiting area? so we could seek alliterative transport such as another bus company/ train and so on. This left us no alternative but to order a taxi costing £80!!! to get to the airport on time. Who is to blame here? and who can we seek compensation from?

Hi i'm a taxi driver and was on the lookout for a new 8 seater cab with wheelchair access as my current vehicle was ready for the knackers yard and after shopping about decided to use a company call cab direct. I ordered a peugeot eurobus with them on 27/7/2015 on finance and paid £1000 pound deposit. I felt after speaking with salesman on the phone that things were a little rushed by him and he didnt quite explain things but i assumed with them being suppliers to the taxi trade and after looking at the pictures of vehicles on their wesite that they would know what they were doing. When i recieved the paper work for the order it was clear that he hadnt explained a great deal to me on the phone because i dicovered that the cab wouldnt have basics like handles to hold on to whilst getting in and out and a step to help people whilst getting in and out. So at this point i questioned the seating as the cab needed specific seating comply with council regulations. The seating and types of seats were described to me by the salesman on the phone the best way he knew how and it sounde like he was describing what i wanted and what i had seen on their website so it was on with the order and wait for delivery. Fast forward to 17th september and the vehicle was at my door being delivered. I was shocked as the vehicle was nothing like any pictures on their website, wasnt like anything i was expecting or had ever seen in 15 years of taxi driving and was not like i felt they described it to me. My main bones of contention were that there was no partition between the drivers front cab and the passenger section in the back ( a big safety issue for me due to previous experience ) the middle row of three seats (which are removeable ) would have to be totally removed from the vehicle and stored away from the vehicle in order to fit in a wheelchair passenger which isnt practical at all. I refused the vehicle and it was taken back to cab direct and they then told me the would do their own investigation. Thay came back to me and said the type of vehicle i was expecting was the sr or srx model how ever the sold me the sx model. They said they could see the website was mis leading how ever pictures on there are for illustration purpose and this is stated on there website. The pointed me toward the download brochure on their website to tell the difference between models how ever i dont ever recall being told on the phone which model was sold to me and after going through all my paper work i cant find anything stating the model type. That being said after looking at their brochure and if i had known the model type im still not sure i would of being able to distinguish that there was difference between models and there are no pictures in the brochure that resemble the vehicle the supplied. Thire stance is they supplied what they believed they were asked to supply so the fault is with me. I believe that the goods were mis sold to me as they were not adequately described and are not fit for purpose. I asked to cancel under sale of goods act but they were having none of it and told me sale of goods only applied to goods bought for cash and since the vehicle log book is registered to me and the finance company have paid them then this is an issue for me and the finance company to sort out. I rang the finance company and informed them yesterday and im waiting for them to ring me. Where do i stand on this from a legal side of things ? Sorry for long post and any help/advice is greatly appreciated
  6. Hi, I started my own taxi company approx. 1 year ago and I am a one man band, very recently I reversed into a fence when I was dropping off a fare. I went to see the owner of the property, who was a lady, and I offered to replace the damaged fence panel. The lady said, o.k., that's fine, it was probably rotten anyway. I went back the following day to get the fence panel measurements (2 pieces of wood 6" x 71"), but later that evening I received an email from someone else claiming to be the owner of the property saying that he can't shut his gate, which is approx 15' away from where I hit the fence, and saying that he want's my insurance details so that he can get the fence repaired professionally as he has received advice from his neighbour who is a carpenter, to say that there is serious damage to the structure to the stockade of the fence. I am more than happy to repair the damage that I have caused to the fence but this person is definitely trying to pull a fast one. I spoke to my insurance company today who advised me to get pictures of the fence, which I have done, and it shows that the fence is seriously rotten, and tied together with string in several places to keep it together. The only post that isn't broken is the one that the panels that I hit are attached to. I'm not really sure where to go with this now, as I know that the damage that I did to the fence is very minimal but the person in question seems to want to try to claim for a new fence out of this. Do I go through my insurance, as excess is quite high and this will also impact on my no claims bonus? The person doesn't want to be reasonable about this and seems to want to get as much as possible out of this. I' not even sure who the person that it sending me emails about this is, he claims to be the property owner but both times that I have been there there has only been the same lady present and she doesn't seem to know about anything that the person sending the emails has said. Can anyone help me to decide what to do next please?

I used to use Uber shortly after it launched in Manchester, but have found that their service recently has gone downhill and is less good value (nearly always get surge pricing and the drivers are often late or rude). I've been onto their website to deactivate my account and remove my payment information - but have found there is no option to do so. I can add as many credit/debit cards as I like, but once they're on uber's system there's no way to remove them, despite Uber's help pages claiming otherwise! I've tried this on multiple devices/web browsers, all with the same result. I've tried contacting them on twitter and through their website - though I'm still to hear a response. Short of cancelling my card, is there anything else I can do? Has anyone else had any luck trying anything similar? Cheers, Dracion E: I apologise if this is the wrong place.

  9. Hi All, We had booked with my wife on Wednesday night a taxi to drive us from Putney to Southend airport on Thursday morning. My wife said on the phone that we had a plane to catch at 11:15 and that we wanted to have plenty of time (because we are travelling with a little 8 months old baby) so we asked to be there at 10am for safety. The taxi company told us to be ready at 8am, the fare would be 75£ The driver picked us on time and got stuck in a lot of traffic in london area At some point we asked him if his GPS was right, stating that we would approximatively be at the airport around 11am He said in an unclear manner that it was impossible to do this drive in 2hours time in the morning, that the taxi company must have got it wrong,that usually it costs more than 75£ for such a drive so we get what we are paying for ???? And finally that he is not the one to schedule pickup times After discovering that we would miss our flight and there was no other flights that day in Southend we had to tell him to stop and told him to stop us by Liverpool street instead to take a train to Standsted airport to catch another plane He did the change, charged us 20£ for the drive (cancelling the 75£ for the initial drive which never happened) and we booked new plane tickets for the family Result: one holliday lost + 340£ for the new tickets I have tried to call the taxi company many times these last days, they always say that the manager will call me back but he never does...I guess they just think I will firget about it but we feel we have lost a lot of money unfairly. We don't drive in London and have no idea of the time it takes to go to Southend airport,why did the company which makes a business out of these airport drives didn't tell us to leave earlier ?? Another strange thing: when I first called the company to say there was a problem , they said that the pickup time on their system was 7:10 am which would have been fine ! Do you think I can claim for a compensation or bring the case to court? Thanks for the help! ; ) Jerome
  10. I received a court summons for unpaid car tax. I am so stupid! I got the car end of October and I was meant to pay for car tax, but kept forgetting. Anyway the car broke in November and has had lots of issues that I have taken it to places to get looked at and haven't taxes or sorn it. I did receive a letter in November for a fine, but I was so stressed out I completely forgot about it until today. I understands am guilty and will plea this, but I am worried about if I would go to prison or how much the fine could be. Can I do anything to prevent this going to court if I paid the initial fine? Please help
  11. Sent to me in an email.... We were dressed and ready to go out for a Dinner & Theatre evening. We turned on a 'night light', turned the answering machine on, covered our pet budgie and put the cat in the back garden. We phoned the local Taxi company and requested a taxi. The taxi arrived and we opened the front door to leave the house. As we walked out the door, the cat we had put out in the yard scooted back into the house. We didn't want the cat shut in the house because she always tries to get at the budgie. My wife walked on out to the taxi, while I went back inside to get the cat. The cat ran upstairs, with me in hot pursuit. Waiting in the cab, my wife didn't want the driver to know that the house will be empty for the night. So, she explained to the taxi driver that I would be out soon. "He's justgoing upstairs to say Goodbye to my mother." A few minutes later, I got into the cab. "Sorry I took so long," I said, as we drove away. "That stupid bitch was hiding under the bed. I had to poke her a$$ with a coat hanger to get her to come out! She tried to take off, so I grabbed her by the neck. Then, I had to wrap her in a blanket to keep her from scratching me. But it worked! I hauled her downstairs and threw her out into the back garden! ..............She'd better not mess in the vegetable garden again!" The silence in the Taxi was deafening.
  12. Hi all, Yesterday I booked a taxi to take me to the train station and specified the time for it to arrive. The taxi arrived 15minutes late and as a result I had to watch my train pull away from the platform when the taxi arrived. This resulted in me having to buy a new ticket, close to £100. The taxi company have described the situation as 'unfortunate' but do not accept responsibility. I was told the taxi would arrive at the time I had requested and in my mind entered an agreement. The train fare is substantial enough for me to feel I should go to Small Claims. Am I right to do so? Really appreciate your help.

Hi all, earlier today I got a parking ticket for £70 whilst I was parked on a Taxi Rank, strange, seeing that I drive a taxi, the Council Parking Warden said that because I was not in my Taxi,( I had nipped out for a pee) he could give me a ticket. The sign next to the Taxi Rank says "No stopping except Taxis at anytime" it does not mention anything about the Taxi needing to be attended. I know that I am supposed to be by my Taxi and available for hire if I am on a Rank, but that is a matter for the licensing officer and not a parking offence I hope. Has anybody got experience of this, or knows the parking law and can help please. It is not a red route, and there are no other restrictions in place, just a normal Taxi Rank. Many Thanks

Hi there, i discovered this forum and just need advice re buying a duff taxi. vehicle is 2 months old, faulty steering box, which being a safety issue, vosa inolved, vehicle off the road, and tfl suspended 313 taxi drivers licence plates. My questions are: if a manufacturer goes broke and i have 4yrs of finance left to pay on vehicle, can i legally back the vehicle, informing the finance company, blackhorse, that the vehicle is not fit for purpose, so cancel aggreement?. this being a last resort!...And can i request a suspension of monthly payments until vehicle is repaired ?. The vehicle is supplied on dealers preferences plan, which means lower payments initially over 4yrs term, with ballon at the end ,trade in for new cab, or walk away. Any advice will be very much appreciated, as i have had to rent replacement cab @ £600 month, to be able to keep working, and this is gonna stretch finances if it carries on, many thanks

Hi I recently applied for a taxi badge licence , I passed the medical and the theory , but when it came to sending over my badge I received a letter starting I need to go to a tribunal and explain my criminal record and driving fines and penalties. At the tribunal I explained about my speeding fine an SP30 and an IN10 which came up to 9 points and my criminal convictions one of which I was 17 , I am now 28! They sent me out of the room and only took 3 mins to decide I shouldn't have the license and that I was an unfit and untrustworthy candidate to hold the licence of which I feel cheated . I know at least 3 taxi drivers with worse on their criminal record that have been granted licensed. I paid over £250 and wish to appeal. I have already been provisionally approved for a job at my local firm. I can't afford solicitors. Can someone help me , I need advise. I only have 21 days to appeal.
  16. I had stopped in a taxi rank in London whilst I was waiting for someone, although I did not know it was one. In my defence, I have always seen cars parked there (in fact there were 2 at that moment and in the 5 years I have lived in the area I have never seen a taxi there) and as I was approaching the box was faded, the signage was a few metres further up (and it was night time), so I really had no idea. I stopped behind another car. Whilst I was waiting a black taxi pulled up next to me and angrily shouted "oi, move!". I obviously had no idea why he shouted and to be honest got a little freaked out, to the point where I took out my phone in case I need to call someone. He then parked in front of the car in front of me, got out and spoke to them. Don't know what happened but a few minutes later the car drove away. As they drove away the taxi driver was standing there with a little machine of some sort in his hand, typed something in and then began taking pictures of my numberplate with a camera. I drove closer to him and asked what he's doing and he began asking (shouting more like) if I can read and that I'm parked in a taxi rank. When I told him I didn't know, he kept shouting he doesn't care, swearing, took a few more photos and then drove off. I was wondering what he is going to do with the photos and what that machine was. Do taxi drivers have the power to send off such things so the council can issue the fine? I will pay the fine if I get one. I was in the wrong and ignorance does not excuse me from the ticket, but I still would rather avoid getting one at all!! I do plan to complain about the taxi driver once / if I get a fine. His behaviour was aggressive and threatening and completely unneccesary. Thank you!
