  1. Hi there Not sure if my case is a one off, but thought I'd share to make people aware. I had been paying Motormile Finance on a repayment plan. I then got my Experian file in March and they hadn't updated it to reflect my payments since August 2014. They claim it was a technical fault and have subsequently moved the 2 entries from my credit file To be fair to MMF theyve been very good and honest about the issue and haven't proved difficult. If you've a debt with them your paying it may be worth a check...
  2. Hi All, Well now debt free regarding Payday lenders however still having an issue with Motormile clowns, i had a loan which was owned by gothia who entered a default on my credit file on 05/04/2010 and marked settled on 14/07/2013 £1004.00 However Motormile have also entered a default for the same debt as follows default date 30/04/2010 £1,774.00 ( started on 1/3/2010 £1,004.00 ) they have also listed a default for an old minicredit debt which was also repaid Started on 23/10/2012 current balance £528.00 Default on 30/11/2012 £390.00 I have wrote and wrote and wrote, i have reported them to OFT but now completely cheesed off, i have not had contact from MM for over a year now yet they still refuse to amend my credit report. What action can i take now or just wait until the 6 year hits andd they drop off my report. Are Motormile still trading ?????? any help would be great :mad2:
  3. Hi, I have posted here before and have had the best help from everyone here and am now wondering if I could get just a little more. Motormile Finance have added 2 defaults to my credit file, both for payday loans, I have only just realised as I haven't been checking my credit file on a regular basis recently. 1 of the accounts was supposedly Default in 04/2012 but has only been on my report for 4 months and the other was supposedly Default in 10/2009 but has only been on my report for 3 months? The plan was to issue a CCA request, do I need to issue a CCA request for each one? Also, does anyone have anything else they can shed any light on about these people and how I should go about handling them?
  4. Hi I am in the process of clearing most of my debts since leaving step change in august. However, I can't seem to get on with these. I borrowed 300 from Mr lender 18 months ago. I have maid payments of 70 pounds to them via step change and then they gave the debt to MMF. They have been horrible and I paid them 15 pounds in October to stop them hassling me. Anyway, I have sent several letters of complaint to Mr lender and also the guy that owns it but nothing. MMF want 654 pounds off me. I see from my credit file that Mr lender is marked as settled. There is nothing on there belonging to MMF. I sent a cca and got an unsigned copy of an electronic agreement. Shall I just ignore MMF and pay Mr lender the original amount plus one month interest etc or ignore them completely. Since leaving step change i have paid off over 1700 pounds and got over 6500 written off. I now owe less than 8k for the first time in 11 years. Thanks to all of you.
  5. Hi Guys, I'd like to start by saying thanks for all the help from everyone here over the past 5 years or so, as much as i've never posted on here before, i'm an avid reader, and have managed to get myself from £30k debt to debt free (or so i thought) in that time just by readying this forum. I've had a bit of a weird one come through to me over the past few days and i've scoured the forum for something similar but have been unable to find it, hence the first post. I've been contacted by MMF with regards to a debt that i know nothing about. They claim that 5 years ago i took out a payday loan and didn't pay it back with Pounds Till Payday. i've gone through everything i have in my emails and everywhere else, and i have absolutely no data about it at all. i replied to them through email to tell them this and to ask for more information and received the response below: Dear Mr xxxxx Reference: ....... Debt balance: £658.90 Debt: Pounds Till Payday - Payday Loans We refer to your recent communication and detail below the loan that was taken out in your name, together with the bank into which the funds were deposited: Lender: Pounds Till Payday - Payday Loans Type: Payday loan Bank: abbey A/c no.: xxxxxxxx Employer: ndt inspector Declared income: Loan Date: 17/09/2009 Original Due Date: 25/09/2009 Orig loan value: 500.00 Loan interest: 149.90 Refinance Fee: 0.00 Late Direct Debit fees: 59.00 Amount Paid: 50.00 In a very small number of cases, it is possible there has been identity theft. If after reviewing the information above, you can confirm that you did not apply for the loan and that the bank account is not yours, then you can report this identity theft to the police. Please visit Action Fraud at actionfraud.police or call them on 0300 123 2040. Once you have reported this to Action Fraud you will be issued with a Crime Reference Number. Upon receipt of this please call us with the information. If, however, these details allow you to recall taking the loan, we would be happy to talk to you about accepting instalments or offering a lump sum settlement discount. Collections activity has been placed on temporary hold, pending your reply and we look forward to hearing from you. Yours faithfully Collections Department Motormile Finance UK Limited Main: 08008 876876 I then responded with the following: Sharon, Thank you for your email. Please can you send me some contact details for pounds till payday along with a reference number that they will recognise, as i need to discuss certain aspects of this with them before anything else. Secondly, please can you advise if your company are acting on behalf of pounds till payday or if your company has purchased this debt from them permanently and if so, when was it purchased. Once i have the above information i will be able to contact pounds till payday, following from that i will need to contact Santander (Abbey) and request bank statements to be posted to me. As far as i’m aware, there is a 28 day turn around on statements that are this old. Then added on to that the postage to Australia (unfortunately Santander will not step in to the 21st century and use email like the rest of the world). Please be advised that this account with yourselves is now under query, therefor i would appreciate it if you allow the above investigation to be carried out before your company considers even thinking about putting a Default on my credit file as i am very aware that they do without a second thought. Please can you confirm the receipt of this email. Kind Regards And received the following back: Good morning David , Thank you for your email , I do not have the contact number for Pounds Till payday I can give you the reference number please find as follows ...... Also MMF are the legal owners of this Debt and was instructed on the 09/05/2014 . Regards, Sharon Administration Clerk Motormile Finance UK Ltd (MMF) The above emails were all on the 15th of May. Since then, i have had 12 emails (maybe automated) threatening doorstep collection, defaults and everything in-between. they all come through at 1-2 o'clock in the morning, which is fine for me right now, as i'm away with work in australia, so its mid morning. The thing that i can't quite understand is: I've never been previously contacted about this by either them or anyone else. i check my credit file religiously once a month, and this isn't on it and never has been. I no longer bank with santander and haven't for years. so getting hold of a statement from them is going to be pretty difficult. I have no idea where to go from here, i've recently paid motormile my final debt (£950) which was for a wonga loan that definitely was mine. Can they default me for something from 5 years ago that has never been previously reported to a CRA? Long one i know, sorry for the babbling, but this company annoy the life out of me. Thanks Dave
  6. Hi, I had a loan from Mr Lender in June, I rolled the loan over five times but when it came to paying the whole thing off in one go I couldn't afford it, I missed the payment on 19th December 2013. I set a payment arrangement for three months to pay the debt off, I made the first payment in december with the next one being due at the end of January which I didn't pay and made no further payments. They sold the debt to Motormile Finance in march and I am still to hear from them. I've checked my credit file and it shows a record of the Mr Lender account, it shows as closed and settled on the 19th December and MMF now shows as the new owner of the debt. The problem is that on the entry from MMF it shows that the account closed and defaulted on the 19th December 2013 even though I had set a payment arrangement with Mr Lender and made the first payment to that in December with the next one not due until the 31st January 2014. The ICO rules state that if you enter into an arrangement to pay with a creditor then this will show as an arrangement to pay and this will not show as further arrears unless the arrangement is broken. As I was in an arrangement to pay and I have clear proof that I was then the default date is totally wrong, this to me says that the whole default is flawed and must be removed from my credit file. Can any one please help with views on how I should deal with this, should I approach Mr Lender or MMF? Should I ask that the default be removed permanently? I'm guessing that they would just change the date of the default on my credit files but wouldn't they need to go through the process to default me all over again before they could do that? Any views would be appreciated. Thanks
  7. I paid Motormile around seven months ago for an outstanding payday loan debt. I have since been chasing them to get my Experian credit report updated. I have phoned three or four times per month and sent countless emails as well as having Experian contact them direct for confirmation, but nothing seems to work with them. Is there any way of sorting this out? I assume they are legally obligated to inform Experian about this being satisfied, heaven knows they weren't backwards about coming forwards when the balance was outstanding at the start of the year. Any advice would be much appreciated.
  8. My partner and I have both received a letter from BPO today (24/09/2014) claiming we owe £272.25 and £278.93 respectively to a company called Motormile Finance. Neither of us have any clue what it is about and do not owe anyone any money. Are these con artists trying to get money out of the unwary or mislead and trying their arm with us. I find it strange we should both receive demands on the same day for very similar amounts. Help and advice would be greatly appreciated.
  9. Hi My husband has started to receive letters from debt collection agencies one of them being BPO. He doesn't know what this is for so I presume first step is the CCA ? Thanks Skop
  10. MMF are trying to collect on 2 accounts, both Payday loans. I have sent several requests to MMF asking for proof of my liability to the alleged debt plus a full breakdown. MMF have continued to ignore my requests and have continued to send emails and letters with their usual threats of court and doorstep collection. I sent a recorded letter on Monday 26th November and was received and signed for by MMF on Tuesday 27th November telling MMF that ALL Communication MUST BE IN WRITTING by post, and no telephone, e-mail or text contact will be tolerated, Furthermore I expressly state that I have no wish to make any appointment for any agent, representative or employee of MMF Ltd to visit my home, should such a visit occur the person will be invited to leave failure to do so and will result in their removal using any necessary means. I have requested a full explanation and proof of my liability for this alleged debt along with a full breakdown of the alleged debt and MMF have failed to provide any data in this regard; therefore I do not acknowledge any debt to MMF Ltd., or any company you may claim to represent. I have also sent an email to Baranby Page & home visits with the same information which has been read... Fast forward to this morning whilst in the shower I heard a knock at the door and Ignored it. Through my letter box was 2x letters from MMF, hand delivered. The leter states "I have now been instructed to visit your property to discuss repayment. I am your local MMF Doorstep Agent and although disappointed that I could not meet you today, I am constantly in your area and a revisit can be booked. Why are these people ignoring me?
  11. Hi, Just when i thought i was getting my credit file sorted out i noticed today on my credit file that motormile finance uk ltd have put a default on my credit file for May and June but not July and August. To be honest I have never heard of them, the details are below. I am immediately concerned that a company can just put a default on your credit file without even calling or writing to you? is that legal? its really made my credit score drop dramatically. Very damaging indeed. Before i engage the company i wanted to ask anyone if they could help me write the best letter possible so that i start my communications with them correctly. The details of the alleged debt are below. the debt was registered at an address i used to live at 3 years ago but i do not recognise the debt or the company or the amount at all. The info on my credit file is as follows; Motormile Finance UK Limited Account opened: 2nd May 2011 Last updated: 1st June 2014 Current Balance: £189 Default Date: 31st May 2011 Reported until: May 2017 The credit history on my account has a a BIG 'D' on May and June of this year (2014) no defaults before that and none after. The address is incorrect as my address during this period is different. the company have written me a standard letter by post to my existing address which clearly they got from the register. I have NEVER EVER received any bill previously from anyone or company for this amount before. I really need to get the default removed as i feel that its very wrong for a company to be able to put a default on your file without even writing to you first. Any help i would be most grateful.
  12. A couple of weeks ago, I received a message on my home number from MMF saying that I needed to contact them urgently regarding arranging a home visit. My partner rang them to say they had the wrong number and not to call again. Nothing since. Today, I got called into the office at work because they had left an automated message at work for me!! We have rung again and told them to take that number off their system. MMF did buy an old payday loan debt I had but I paid that and it is showing as paid and cleared on my credit file. It is possible that they've bought another debt off someone like Lowells but I have no knowledge of this if so. They have not written to me or emailed me on the matter so I am in the dark. What should I do? Should I call to see why they're trying to contact me? Should I write and tell them to write to me if they want to correspond? I don't like speaking to DCA's but it's embarrassing to have them call me at work.
  13. Hi all. This site has been so invaluable in the past, and is currently providing me with key information about a partners debt, that as soon as I received a letter from the above company, I thought of coming on here for advice immediately. I received a letter from MMF some weeks ago, out of the blue, about un unpaid payday loan. I knew that this was not taken out by myself and presumed it was a case of mistaken identity and wrote to them to advise of this. They replied with the information regarding the account, dates, amounts and the account number of which the loan was paid into. This made everything a little clearer, as this was a debt taken out by my ex-partner, on or around the time of the break up. The account number was hers as I remember it, and it certainly had nothing to do with me at all. Now the break-up wasn't really the easiest for either of us, there were lots to sort out, and in the last 18 months I've found my current girlfriend, super happy etc etc. I don't really want to drag up an old mess and report this to the Police (at MMF's request if I felt the details were incorrect) and I don't want to contact her to get the thing paid, mainly because I know it wouldn't get dealt with. It is on my credi file (shamefully I havent checked my credit file for some months), and I wanted to get this whole thing cleared. The amount of the debt outstanding now is £424.50, the original debt was £125 (original loan amount). I have explained this in a letter to MMF, everything I have advised before, explained that I know and knew nothing of the debt and that I can prove of which account number and sort code I had at the time (same as now), and that I had nothing to do with the account number in question. I also offered to pay the amount of £125 in full and final settlement, providing that I wouldnt be chased for any further monies, it wouldnt be passed onto any other company and that any default registered against me in relation to the debt be deleted completely. I have received a letter today, that doesnt acknowledge my letter (sent 22.5.14, their letter is dated 25.5.14), threatening me with the fact that the account is to be sent to their Home Collections Division within 5 days, and offering me a settlement of £385.25 (great discount). What would you advise of my next move in relaiton to this matter? Eagerly awaiting your input and advice. Tiny.
  14. Hi. Motormile have ignored all my emails to them so I took the details from their website and set up a standing order for £5 per month. I missed a payment last month so I emailed them to say I'd pay £10 next month to make up for the missed payment. I then received the following email - 'Thank you for your email on 19/11/2012. Due to the fact that you missed your payment there is a broken arrangement now, hence, further collections activity will incur on the account. MMF have reviewed your account and here are a few options for you to avoid any further legal action: Offer 1: we will accept 60% of the balance - £115.35 Offer 2: we will accept 70% over 2 equal instalments - £67.29 per month Offer 3: we will accept 85% over 4 equal instalments - £40.85 per month The above offers are available on the proviso: · The payment is made via debit card · The first payment is received in November · The payment plan or settlement figure to close the account is set up for a date in this month by Friday 23rd November 2012. Please fill out the below details in order to setup the arrangement, Please note that default interest may be added to the account which you will be liable for until a valid payment plan is put in place. Card type: Card number: Valid from: Expiry: Last 3 security digits: Date of payment: 28th November 2012 Amount: Whatever offer you accept Failure to email me back in regards to which offer you accept then your account will be transferred to the litigation department for legal action and you will get an unexpected visit from one of our doorstep agents for which there is an additional charge. Also, by setting up a standing order without agreeing something with us is not a payment plan.' So it appears that because I missed a payment, they now think they have the right to theaten me by phone, email and at my own front door. Any advice on how to respond to this email would be appreciated. Thanks. Paul.
  15. I've just seen an email from Motormile Finance which I suspect goes beyond being dubious as far as regulator guidelines on debt collection go and into downright illegality. Our home visit team has been scheduled to visit you in person to deal with the outstanding balance of £673.00 that is due to MMF. Our team of Recovery Agents will regularly be attending this postcode with a view to visiting you. Visits can be scheduled between 8am and 8pm Monday to Saturday. We would invite you to contact us to arrange a mutually convenient appointment, to avoid causing you any potential embarrassment that may arrive out of an unannounced visit to your home address. If you do not contact us then we will be left with no other option than to visit your address until we do meet with you. Whilst MMF is always committed to helping their customers reach an amicable solution, if we cannot agree a suitable repayment plan then w e will have no option than to report our findings to our Solicitor who may take legal action against you in your local County Court and thereafter take enforcement action against you. This will inevitably increase the size of the debt due from you. Also this will affect your ability to obtain credit in the future. This email is a genuine attempt on MMF's part to help you resolve this problem without the need for legal action. This issue is not going to go away and needs dealing with. Your options are: Complete and return the payment form attached. Contact our office immediately to arrange a repayment plan that is suitable for both parties. Contact our Home Visit Department to agree an appointment, option 1 on our telephone tree. A quick read of the law: http://www.legislation.gov.uk/ukpga/1970/31/section/40 40 Punishment for unlawful harassment of debtors. (1)A person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under a contract, he— (a)harasses the other with demands for payment which, in respect of their frequency or the manner or occasion of making any such demand, or of any threat or publicity by which any demand is accompanied, are calculated to subject him or members of his family or household to alarm, distress or humiliation; Not a lawyer but they would seem on seriously thin ice with this. Specifically mentioning embarrassment alongside saying that they will 'regularly be attending this postcode with a view to visiting you' and 'be left with no other option than to visit your address until we do meet with you' doesn't strike me as being too clever. What are your thoughts, CAGmeisters?
  16. Hi, I have just been alerted by Equifax that Motormile finance have added a credit account to my file. I have never heard of them until now, on reviewing comments on this forum I am now worried. Spookily someone at my old employer as just advised me that an automated phone call from them has been received at least twice a day from this company. I have checked their website to try and contact them however it is closed for maintenance. I have disputed with equifax and they are going to contact MMF on my behalf but seemed unconcerned so I have emailed them for more info. CAnt seem to locate a phone number anywhere I have worked hard to repair my credit history, what should I do next?
  17. Hi all, Been a while since I posted, seems you forget so much if your not on here So today I get an alert from Equifax that there is a new account on my credit file, when I go to have a look at this new account I find its Motormile. I had no recollection of ever having anything from these or dealing with them, so I have done a little digging and oh dear I seem to have a bit of a problem on my hands. I had a payday loan with Pounds Till Payday probably over 6 years ago, I reckon it's most likely statute barred but anyway, Motormile have been emailing my old email address which only by fluke I looked at and the emails have been going into my spam folder. As for any mail, well I moved house over a year ago and even then I had no mail from Pounds Till Payday or Motormile, so no contact whatsoever. As much as I hate to admit it, I don't even think I ever made a payment to them either, this was a long time ago and my mindset is a lot different now to what it was then. I certainly don't advocate taking out any kind of loan without paying it back. Looking back through the emails I couldn't say how long I have been getting them for as my junk empties after so long and there is so much other rubbish in there if I hadn't recognised the name I'd have ignored them. There is a plethora of Legal threats, Door Step Visits, Ones asking me to set an appointment time etc What is the first step I should take here, I do reckon it's SB'd so should I fire off the SB letter? Looking at a few other threads its seems these guys don't respond to emails, so is there an address I can send the letter to? Cheers Steve
  18. Hi All, On 19 May 2014, I received an email from MotorMile Finance chasing a debt which I believe will be statute barred in November 2014. The email states that they note that I have not responded to their previous communications (never had any!), and that my continued default will shortly be reported to all three major credit reference agencies. The email also states that the file is now being prepared for a notice of default to be issued and then for a Doorstep Agent visit to my property to try and resolve the matter amongst other things.... Basically, the loan was from a pay day loan company at a time of a money crisis within my life. I have not paid the debt and not heard from the payday loan company since November 2008. Now I have received the above email and also another one which states - "We note that we have not heard from you in response to our earlier communications. Your file is shortly scheduled to be transferred to one of our Home Visit Divisions. We are happy to try to resolve this matter without conducting a Doorstep Visit and would ask you to contact us by telephone or email to discuss repayment terms. Please note that if we do not hear from you, then you will be visited to assess your personal circumstances with a view to passing your account to our Legal Department. We would, lastly, advise that if you are able to make a lump sum settlement offer, then we would be willing to allow a 25% discount on the outstanding balance and to waive the default costs and interest that have not yet been added to your account balance." I am currently in a position whereby at the end of next year, my credit file will be completely clean - no CCJ's showing and all defaults will have dropped off. I cannot afford to get a default or indeed another CCJ. I have checked my credit report and there is no mention on there anywhere of this pay day loan, nor any default showing. What is the best course of action I can take with this? I have read up on another forum about MotorMile Finance UK Ltd and can see that people have had major problems with the company and that they aren't reliable and/or knowledgable. I also do not want them showing up at my property, however, I no longer live in the property where the loan was taken out. But the only other property is my parents, so I do not want them turning up there, especially when I don't even live there myself. Could someone please advise on what I should do? Many Thanks, B_E_G xxxx
  19. Hi all today i was successful in getting TWO yes TWO defaults removed from my credit file. Please see below my story, this show that with persistence and not being bullied can work, if anyone is having issues with this company then give it a try, this was all done via email. Its long but certainly worth a read I received an email from MMF stating that they had bought the debt from another company. I had not received any default notices/letters for this debt so i emailed asking for details. This was the first reply Dear John Balance £326.00- Wage Day Advance Payday Loans Good Morning, Thank you for your email, I hope you are well, I am Samantha your account Manager. Please email me back confirming your details below to allow me to take payment So i replied........ Hi samantha, I wish to make an offer to resolve that will suitably please both parties. I do have an outstanding balance on the account, as you are fully aware this is made up primarily of charges. However, a default to you and no payment will not achieve much and so I therefore write to try and resolve matters amicably, that will suit both of us long term. I propose to offer a full and final payment to settle and close this account to the value of 50% of the original amount totalling £163.00, which will take into account and absorb, a lot of the charges that have been added to the account throughout time. The alternative is for me to place the account formally into dispute and demand s.10 CCA (1974) is brought into play (cease & desist) whilst I reclaim all unlawful charges combined with all costs. I shall then look at the legality of the assignment of debt; the issuance of a default notice and the agreement (prescribed terms) and between them, i'll probably be able to counter sue and litigate over unenforceability. To confirm, I am more than happy to settle as much as 50% of the total amount owing so long as you can agree to, and ensure that, the following actions will be carried out •The Default Notice will be removed •The Status of the account will change from “Defaulted” to “Settled” •The Current Balance will appear as £0.00 •The Default / Delinquent Balance will be set to £0.00 •There will be no date in the “Defaulted Date” field (as it will be removed) •There will be no date in the “Date Last Delinquent” field on the report •This will apply to all 3 Credit Reference Agencies, namely Experian, Equifax & Call Credit If you're happy with my proposal, please respond confirming each of the above points on official letter headed paper, confirming the exact amount owing and I will send my payment details by return. Failure to agree will result in more formal papers being sent, by return. I look forward to your response. she replied.... Dear John The lowest amount of a settlement figure I can offer you is £260.80 giving you 20% discount You actually borrowed £240.00 on the 28/02/2013 and agreed to pay back the fixed interest of £70.80. When you agreed to the terms and conditions you agreed to pay back £310.80 by 25/11/22013. As it wasn’t paid back breaking the loan agreement Wage Day Advance Payday Loans put on £103.20 default charges and £12.00 failed direct debit fee Which they are within their rights to do when the terms and conditions of the loan agreement are broken. You have paid back £100.00 As £163.00 would be less than you borrowed we cannot close it down for this amount. Thank you Sam I replied..... Hello Sam, Thank you for your reply, I am happy to pay the amount you stated with the deduction of 20% however could you confirm in writing and via email that the below points will be completed please? •The Default Notice will be removed •The Status of the account will change from “Defaulted” to “Settled” •The Current Balance will appear as £0.00 •The Default / Delinquent Balance will be set to £0.00 •There will be no date in the “Defaulted Date” field (as it will be removed) •There will be no date in the “Date Last Delinquent” field on the report •This will apply to all 3 Credit Reference Agencies, namely Experian, Equifax & Call Credit Kind Regards john she replied..... Dear John I have had a response from a manager – We are unable to remove a default that was legitimately there. This would be classed as falsifying a credit file and could lead to irresponsible future lending. We will however show this as fully satisfied which will start to repair your credit file. This will be better than it remaining outstanding and collections activity continuing. Basically we will show the balance is settled in full at a 0 balance , but a default can’t be removed once it’s on I’m afraid, All 3 credit reference agencies will be informed on the 15th of the month after its paid and it will then take them 6-8 weeks to update their records. Thanks Sam I replied...... Hello Sam, Thank you for your reply, I have to disagree with what you have stated as i have recently had a default notice removed from my credit file from another company as unsubstantiated. On looking through my paperwork and letters I do not have a recollection or evidence of ever receiving such a notice, and I therefore require you to substantiate this data at your earliest convenience. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. 2. You must supply me with a signed true and certified copy of the original default notice 3. Any deed of assignment if the debt was sold on I would request that this data is provided to myself within the next 28 days, if you are unable to provide this data then I must insist that it is removed from my files as unsubstantiated. On thinking further on this matter, it has been brought to my attention that a satisfied default does not mean anything in the eyes of lenders and sadly will make no beneficial change to my credit rating. regards john she replied..... Dear John I have requested the original credit agreement to be sent to you by e-mail , have you received this? The default is registered by the company you took this out with Wage Day Advance not ourselves there is no way this can be removed When you default on a account on your credit file all you can do is make payments to improve this, a default cannot be removed. Thanks Sam i replied...... Hello Sam, I have not received this as of yet, also i have not received such a letter of default from Wage Day Advance either. I request an original signed copy of the default notice as without this the debt is unsubstantiated. I would like both the original credit agreement and original default letter sent to the address stated in my previous email. You have 12 working days to supply a copy. After 12 working days the agreement is unenforceable without a court order until the agreement is produced. After 30 days, if the agreement has not been produced then the lender (Wage Day Advance) has committed an offence under the legislation contained within section 77 (1) and section 78 (1) of the Consumer Credit Act 1974. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974. Kind Regards john she replied..... Dear John You should get the copy of the credit agreement by e-mail either today or tomorrow it’s been sent for you I passed this to a compliance manager , he has spoken to wage day advance and agreed to remove the default for you If you can pay the £240.00 to clear the account I have been advised to tell you we can answer yes to all of your questions. Thanks Sam i replied..... Hi Sam, Thats great news however i would need that please in writing from Wage Day Advance stating that they will remove the Default Notice and: •The Status of the account will change from “Defaulted” to “Settled” •The Current Balance will appear as £0.00 •The Default / Delinquent Balance will be set to £0.00 •There will be no date in the “Defaulted Date” field (as it will be removed) •There will be no date in the “Date Last Delinquent” field on the report •This will apply to all 3 Credit Reference Agencies, namely Experian, Equifax & Call Credit Many thanks for your help thus far Kind Regards john she replied..... Hi John We own the debt now so you wouldn’t get it in writing from them as we are the legal owners It would be in writing from ourselves I’ll get you the Notice of assignment of debt sent to your e-mail also Thank Sam i replied..... Hi Sam, Thats great thank you, If you could also send me a scanned copy via email for my records that would be greatly appreciated. Kind Regards she replied..... Dear John I can’t do anything until its paid I’m afraid , as soon as you pay the settlement figure My colleague can make arrangements to get the default removed we can’t do this while it’s still outstanding After its closed we will credit and close the account to show its fully satisfied, get you a letter of satisfaction sent out and remove the default For you also get that sent out to you None of this can be done until its paid and closed Thanks Sam. i replied.... Hi Sam, I will need a letter in writing stating that you will do this please, I cant simply go on the word of an email. If you was to in turn not remove it i would not have a leg to stand on. Im not asking it be removed before i pay, just that you send a letter stating that when i do pay it will be removed. Many thanks she replied.... Dear John I have requested this for you from Admin by e-mail and post, should be with you asap The default will not be removed until its paid The offer is only open for the next 24 hours Thanks Sam i replied..... Sam, unfortunately i wont have the funds until the end of this month, i can send my card details so you can take the funds on the last working day? Kind Regards she replied.... Sorry John We wouldn’t be able to hold this until the end of the month. i replied.... Hi Sam, To make you aware i still would need an original copy of the default letter that was sent, as i have not received this and did not receive it originally then this debt is still in question and no interest or action can be taken on a debt that remains under investigation. I have emailed my legal advisor from trinity legal services and explained the situation. I agree to pay the debt but can not until this month ends. Plus as stated I will only make payment once a written and posted letter is received. If you cannot accept this under the same conditions for the end of this month then sadly i will not pay the debt at all and will send all correspondence to the relevant legal authorities and get them to investigate the debt further as i have no recollection of any past correspondence and this most likely will result in the debt being removed without payment. This certainly is not beneficial for yourselves. So please inform me as to whether i can pay in 17 days and under the same conditions or whether i need to cease all communications and send all relevant information to the appropriate authorities. Many thanks john she replied.... Dear John I have spoken to a manager , he is prepared to still give you the discount and remove the default If you pay at the end of the month on the condition you provide your debit card details to set this up. Also yes you will still get the information you have requested. Kind Regards I replied... Hi Sam, Many thanks, i will get the card details over to you in the next 30 minutes, can you please take the payment on the 31st May. i just received this email also? Please contact Motormile Finance regarding your outstanding account on 0113 887 9900 quoting reference M295150 Is it possible to pay this and get it removed also, its for a mere ?68.00 regards john she replied..... Dear John This one is a national cash advance with ?68.00 outstanding As a good will gesture I will get this written off for you and e-mail you a letter of satisfaction , The other account will all be dealt with as soon as its paid , I have set up the plan for you. The default will be removed from your credit file within 15 days of payment Calls/action will stop on both accounts in 24 hours. :)

  21. I understand you have decided to revoke your doorstep licence In relation to your notification of your revocation of the doorstep licence regarding our intention to send an agent to your home to discuss the debt. I can confirm that we are fully aware of this and we ensure that we fully comply with the Financial Conduct Authority (FCA) guidance regarding debt collection and visits by agents. You are not correct in your assertion that, under FCA rules, we can only call at your home if you agree to make an appointment. The debt is not reasonably disputed or deadlocked, and we are giving you reasonable notice of the timing of the intended visit. In law, a creditor is in a different position to a postman or a member of the public asking directions. When you took this loan, you impliedly agreed that the creditor could communicate with you to discuss repayment. You do not have the contractual right to revoke that agreement until the loan has been repaid. Please contact us on 0800 9961103 and quote reference M to arrange a repayment plan for the outstanding balance, or to discuss a settlement. Our collections department is available between 8am and 8pm Monday to Thursday, 8am to 6pm Friday and 9am to 2pm Saturday.
  22. Can anyone please give me advice on this company. I took out a payday loan with Wageday Advance years ago which i thought id paid off. I recieved an email from Motormile saying that the debt had been passed on to them and that i owed over £200 i asked them to send me the credit agreement with amounts paid. They sent me the agreement but not the amounts paid. Since February they have bombarded me with emails phone calls & text messages whilst i am at work. I am willing to set up an arrangement of £5 a month and have sent them emails regarding this but they have ignored everyone i have sent. I am now getting calls messages at work threatning to come to my home unannounced I have told them i will contact the police if this happens but they are just ignoring everything i send them what else can i do ??????
  23. My son lost his job last year and was paying nearly all his dole money to Amigo Loans as they wouldnt accept a reduced payment he has now got a part time job, is still paying Amigo and wants to start paying some other bills that have got missed because of being unemployed and Amigos lack of understanding. He has been receiving calls from this company MMF daily with threats of house visits from Mike on some occasions not all. I have recently started keeping a log of all calls and any names that are mentioned like the infamous "Mike". I've only been able to start this recently since buying an answer phone but the calls are daily Monday to Friday now and all come from the same number 01133 510050. In March we actually had a visit by someone from Winterhill Chase who had been instructed by MMF to visit. My Son wasn't available and so I was just handed a letter from the caller. This week we have emailed MMF telling them that no communication other than by post or email will be accepted and no appointments will be made for visits. A receipt for this email was received but just an automated reply. My Son also offered to start making payments but we are unsure if to start making payments as Winterhill Chase say the payment has to be made to MMF and the reference number for this account is not the same as any reference numbers mentioned in the recorded messages, and we have no paperwork with any of the other reference numbers mentioned. We have contacted MMF through their website and asked for any and all information held in my sons name also repeated that no other contact should be made other than in writing and any visits will result in the report of trespass. We are waiting for any response to this contact. My question is who do we report MMF to for their practice of threatening and harassing phone calls, I have seen the OFT mentioned in some of these forums but on looking at their site they no longer exist as of 31st March 2014 we have told MMF we have reported them to the relevant authorities but we don't know who they are now but want to report them to show them we are not bluffing.
  24. Hello everybody I hav'nt had to use cag for a while now the Mmf have sent me a threat o' gram saying I owe wonga £900 odd quid. First the last entry on my bank statement back in 2010 was for - £670.62 and that covered the £520 I stupidly borrowed the month b4. Can anyone advise me on what I should do next to gat these mugs off my back, any help would b much appreciated
  25. I took out a loan of£500 with Mr Lender on 22/05/13. The loan was automatically rolled over 6times. Under increasing financial hardship I cancelled the Continuous Authorityon my debit card on 30/10/13. At this point I had paid £997.50 to Mr Lender. I have subsequentlyreceived numerous e-mails from Mr Lender demanding ever-increasing amounts ofmoney. Their website states that "We will suspend interest andcharges if you are unable to pay what you owe us in full but give us arepayment plan which is reasonable and acceptable to us, or after a maximum of60 days after non-payment." although, curiously, the loan agreement doesnot... On 13/01/13 Mr Lender e-mailed to say that my balance hadincreased to £1207.50 On 07/02/13 Mr Lender e-mailed to say that my balance hadincreased to £1609.12 I attempted to access myMr Lender account online in order to view a detailed statement of account, onlyto find a single screen requesting repayment of some other unfathomable amount(again, with no breakdown of charges/interest) beyond which I could notprogress, effectively denying me access to detailed information of my ownaccount. The debt is now being"dealt with" by Motor Mile Finance, who are demanding £1609.12(which, if paid, would bring the cost of a £500 loan over x months to over£2600). No breakdown of charges or interest has been provided by MMF. MMF's latestcommunication via email states: "DearMr ---- --------, TRANSFER TO HOMEVISIT DEPARTMENT OurRef: M------- Mr Lender Payday Loans Debt Value: £1,609.12 Your file has now been passed to the Home Visit Department and aDoorstep Collection Agent will shortly be instructed to attend your property. The default will be registered with all 3 credit reference agencies in ourmonth end report. If you wish to prevent this registration, contact us to accept one of thefollowing offers: - Payment of the debt over monthly instalments. - A substantially discounted payment in full and final settlement of thedebt. Contact us NOW before it is TOO LATE: 0113 887 3869. If we do not hear from you the default will be registered at Experian,Equifax and CallCredit and this will make it difficult for you to obtain creditnow and for 6 years. Yoursfaithfully, DoorstepCollections Dept MotorMile Finance UK Ltd. 0845 2418729:Telephone 0113 8873869:Local 0808 1686913:Freephone" In addition, I have justsigned in to an email account I haven't used or given since 2009 in order toretrieve my CAG login details, to find numerous MMF emails with titlesincluding "Notice of Assignment", "County Court Action","Doorstep Assessment" etc etc. Why are they serving these"notices" to an email address I haven't used for 5 years when theyhave my current email address and home address - and are these"notices" considered "served"? 1)Clearly I have had adebt with Mr Lender, however I will not acknowledge a debt of any amount to MMFwithout an adequate (or indeed any!) explanation of what it actuallyrepresents. Therefore I dispute the debt alleged in their email. 2)I do not wish todiscuss the matter via text, phone, email or on my doorstep. 3)I do not particularlywant a default on my credit record. My attitude is that - if a default isapplied - MMF/Mr Lender won't receive a penny from me as they have effectivelyremoved all incentive for me to pay (i.e. by stuffing my credit rating for 6years, whether I pay them or not). I therefore need towrite to MMF to ask for proof of the debt, with a full breakdown of EVERYTHING,to dispute the debt whilst awaiting "proof" (thus preventing anyenforcement in the iterim), to avoid harassment/doorstepping, and to preventincorrect and damaging information being recorded on my credit file. My questions are, howmany template letters is that?(!), and where are they please? I've scoured theforum but there seem to be variants all over the place, some of which areout-of-date, or not directly applicable. I defer to the more experienced topoint me in the right direction. Thanks in advance!
