  1. Someone has kindly driven into my car in the office car park. I am hoping that there is evidence available in the form of CCTV so that I might find the culprit and deal with the situation appropriately, but looking at the photo attached, does it look as though new wing/door are needed or that the damage will t-cut out?
  2. Hi Everyone, About 3 weeks ago I bought some vitamins with a total value of £37 off Ebay from a US seller on the 1st November which was fully tracked to my door. A week ago I realised it hadn't turned up yet, so checked the online tracking only to find that it showed the item as being delivered on the 12th when it most certainly was not. I complained to the Ebay seller and got not reply, and when I lodged an Ebay dispute, they ruled in favour of the seller because the item was marked as delivered. I complained to Citipost about this who said they contacted Yodel who they subcontracted it out to who said that the item was delivered to my address at the time stated and that they have tracking location information from the driver to prove that, although I don't quite know what that proves, other than than he was at my location, especially as I live in a 21 storey tower block with 126 flats. Citipost are absolving themselves of responsiblity by saying: "you may or may not be aware that we are a mailing house only and as such have no control over any courier group your seller decides to utilize with his contractual partner." Yet I am a bit confused as to how they can claim this as the tracking information leads me to Citipost's tracking site, not Yodels, which on the tracking info is the subcontractor. I could swallow the £37 but it really is a matter of principle and I am absolutely furious about this, especially as Citipost scores a dismal 2.9/10 in their Trustpilot reviews. I would have no hesitation in taking them to the small claims court if I had a case, but I don't know if I do, because how do I prove that is was not delivered? But the fact that they are saying it was leaves me with no other comeback. The only thing I could use as proof that I don't go around making false claims is the fact that a few weeks ago, I lodged another missing claim for an item with another Ebay seller which turned up after the seller had sent a replacement, and the second it did, I contacted the seller to pay for it, proof of which is contained within my Ebay account. Does anyone have any advice on what I could do in this situation? Thanks.

Trying to help a friend of mine who has got himself into a bit of bother He is an events manager, and runs events for a venue The venue pay him and he in turn puts the nights on/ pays the acts etc, he has never had any form of contract with them - not sure if that makes a difference- he ran 5 shows so far all of which he was praised for the quality of etc A few months ago he was contacted by an agent of a big name act who offered to supply him with some very decent acts to try new material out - at a higher level than he was currently, he put this to the venue and they paid my friend to organise/ promote it, they also paid for a range of 2016 shows. The total of which came to £13500 The issue he had was at the same time baliffs etc have been visiting his home demanding money, he used the above money to pay them and as a result does not have that money anymore. He then discovered that the agent that promised the acts and he had the agreement with was doing so without the acts behalf - he contacted an act who had no knowledge of it - he contacted Action Fraud and has a reference number for it Fast forward to a month later and he has had an email from the venue to say they are going to both the police and civil routes to recoup the money as he has not used the funds for the intended purpose He is in a position that he can repay in full within 3 months which they have rejected Now obviously I dont for a second believe he booked it fraudulently and the fact he went straight to Action Fraud I believe shows this but have they got a case against him with regards to him spending the money on the baliff company , if the shows had gone ahead he would have been in a position to pay it all as planned by the time the nights came along
  4. I never get a cold. Worked outside most my life and always thought as i do not mix with many people that is why i have never been struck down. But my throat is sore,my beak is running and my eyes are streaming,so i have taken to my nest. For a few days at least. It must be a strong one to catch the owl out. I have just wondered how it is in your area.Are you struck down by the virus from hell. Many maybe are laid low as perhaps a cold virus is running rampant Have you any remedies wise ones out there.Even my ears are itching. Good grief it may be a door that gave it to me,can you believe such a thing. Or maybe a supermarket trolley. Everything may be contaminated.Putting protection on. Oh,it is to late i am contaminated already. From a scientist at Cardiff University. Have you caught the virus and who gave it us.Who was the little devil who caught it first. And how did they catch it.There is a question to answer for the wise ones out there. OOPS I hope it was not me,going undercover in my nest.Pulling twigs over me and some down feathers.
  5. i have a question i know someone who has never paid council tax he lives with his grandmother last 20 years rent free food free everything free he does not work and he has no respect for her. she is 89 . i would like to tell the council but i know he will just get her to paid it !! she has dementia, and does not no what she is doing. would the council hold him accountable for the recovery or his poor grandmother ?
  6. On Aug 21 2015 I purchased a 2009 BMW 730i Ld privately (not from a trader or dealer). It had been advertised on Autotrader with a full 9 page HPI Check. I paid £12,500 by way of £12,000 bankers draft to the seller along with £500 cash. On 28th October a woman knocked on our front door saying she was from Bow County Court and wanted to speak to my wife in regards removing our vehicle in respect of a court order she held. The court order was from a finance company to the owner previous to the seller I purchased the car from. Transpires that the previous owner sold the car to the seller we bought from in July 2015 with finance of £7,000 still owing to the finance company. Our seller sold the car on to me within 1 month with what appears to be a forged HPI check stating there was no finance on the vehicle. The seller didn't register the vehicle as he said that because he was selling the car on so quickly, he didn't have time to register it. The 'Bailiff' who we later found out was a Collection Agent for the finance company said that she was removing the vehicle immediately from our front drive. She said that if we tried to prevent her from taking the car then a truck would come to lift the car off of our drive. My wife and I simply couldn't understand this was happening to us and has caused us huge distress. Concerned by her threat to forcibly lift the car from our drive, I phoned our solicitor (who doesn't specialise in matters of this kind) and he spoke to the collection agent saying that under section 27 of the Hire Purchase Act 1964, where a motor vehicle is subject to an HP or finance agreement, while the vendor does not own it and has no right to sell it, a private purchaser who buys the car in good faith without notice of the HP or conditional sale agreement obtains good title to it and that the collection agent therefore had no entitlement to our vehicle. Whilst I was speaking to Mr Lucas, the agent asked for the car key so she could take down the vehicle mileage. At that point I said I was calling the police as we had good title to the vehicle and she had no authority to remove it, especially from our property. I went into my house to call the police and a minute or two later looked out of our front facing window to see the vehicle was gone. A number of questions. 1. The finance company is now in possession of the vehicle, does this section 27 of the HPA 1964 require them to return the vehicle to me and if they refuse what are my options? I don't have the money to seek a solicitor to take out an injunction preventing them from selling the car / return the car to me. 2. If they refuse the car I don't have the money to issue proceedings in the court for the £12,500 I paid for the car in good faith, again, what are my options? 3. My car is probably worth about £13,500 as I spent £1,000 on repairs last month. The outstanding finance I understand is around £7,000. Do the finance company have the right to pocket the difference and is there anything I can do about this? 4. The collection agent falsely represented herself to us and our solicotor as a court bailiff, do we have redress against the collecion agency We now have no car and no money to purchase another one, it is all very distressing.

  8. I have to start at 9am and end at 5pm, but the bus doesn't arrive near the shop til 9..46am and last bus is around 4pm. I have never been to this town before, and don't know the bus routes. I have been suffering from travel sickness and have been to the doctor about my diareah(sorry, but the doctor said that was normal to go to the bathroom every few minutes). I have an appointment on Monday to pick up travel money and have to be there by 2pm. From March to June of this year I was volunteering at a charity in my home town. I am wondering if I should apply to a charity shop in town? But this woman (who was dressed like she was going out to a party) said that SEETEC only ran a few shops. Can I refuse this placement due to it being in a part of the county where I've never been? There is no way I am able to get to the placement in time, I'll be late. And according to the letter if I am late it can effect my benefits.
  9. Hi all, I wonder if anyone can help. Today I have found out that my ex who we split 4 years ago but still have a joint mortgage on the old property we shared has increased the mortgage to include the arrears he is in. I do not contribute to the house in return he doesn't pay anything for the children. I am livid, is it my understanding that this is some type of fraud because he would have to sign to increase the loan amount. I am anxious as I want to get my name off the house but he keeps telling me that in 12 months it will be fine. I really fear that my credit rating will be effected by this in the future. My understanding is we are both jointly responsible for the debt. Any legal advice would be appreciated Yours Marie

  11. Myself and three other students currently occupy a privately rented property in Southwark, London. The flat is pretty run down and we seem to have been stuck with a landlord who doesn't want to shell out any money despite the fact that we are paying £145 a week each! As soon as we moved in we noticed the washing machine door was bent and didn't catch properly, so we immediately informed the lettings agency who informed the landlord on or behalf that it was damaged, however he declined to have it looked at or repaired. After one initial breakdown that I managed to repair it packed up for good 02/10/15, so I immediately got onto the lettings agency again who informed the landlord that day that the washing machine had totally broken and there was nothing we could do about it. A couple of days later, instead of taking our word for it he sent a repairman round who took one look at it and said it was beyond repair and would have to be replaced, which was communicated to the lettings agency that day. After several more days we had heard nothing more on the situation and with mounting piles of washing I again contacted the lettings agency who said that the landlord was ordering the white goods (the engineer also recommended replacing the freezer) that evening - 12/10/15. After hearing no word from the company for three or four days I emailed them again, to which they replied that they would chase up the landlord. Now finally after weeks of pestering the landlord has finally ordered the goods to be delivered this Sunday (25/10/15). We have gone over three weeks without a washing machine simply because the landlord was too lazy to sort out a replacement despite being given several reminders, and we have had to pick up the cost of that. The house was furnished with white goods as part of our tenancy agreement and it is the landlord's responsibility for their maintenance, would we be entitled to ask for compensation? As essentially the landlord has failed to provide a service that we have been paying a huge amount of money for. All help would be appreciated, Cheers!
  12. The Aurora Borealis - better known as the Northern Lights - has been visible over parts of the UK. Can you believe this. First of all the Super Eclipse Blood Moon now a chance to see this. In one year.Maybe a month. I am so happy i could sing, dance.Spin around and may just do one or all of these things. Believe there are chances to see it for the next few weeks. Now i know there are many photographers in these rooms on the CAG. Who can take a fine picture. If any of you whether mobile or digi camera sees this Aurora in the skies over the next few weeks could you post a picture.   13. help! i made a payment to Haven holidays which was my last payment to them of £389, today I logged in to check the account and noticed that they payment is no longer pending!! but been put back in the account. I'm Wondering whats going on?? this was to pay the holiday off, I'm now scared that because this has't left my bank that they will cancel my holiday. Ive logged into Haven and my account says that it is all paid.
  14. Lots of other companies come here to help their customers but Npower won't. This is the company which has been investigated by the regulator and which is being regulated again, which has been criticised in court, which has been criticised in the House of Commons, which has been fined by the regulator - which has had its competence to hold a licence questioned in the House of Commons, which has sacked its CEO, which is faced with fallen profits, which is the most criticised Utility company in the UK - whihc has promised to address its problems and its attitude to customers - and they refuse to come to a forum and dela with their customers directly. What a rotten company Npower is. What a crappy shambles.

  16. After some research on here I now know the true horror of what Vodafone have done to me. To cut a very long story short my Vodafone account was closed early and paid up by me in June (so I thought) PAC code transfered all done. Goodbye Vodafone - hurrah! Get a letter in September saying I still owe £90odd . I have contacted them on many occasions saying please can I have an invoice so I can see why you think I owe this? Athough promised each time nothing received, next I get mail from debt collection and then black mark on my (previously perfect) credit history - Just as I'm apply for a mortgage! Thanks Vodafone!! they can say I owe them something , not produce an invoice to back this up and then ruin my chances of getting a mortgage with absolute and complete impunity! On the advice of my mortgage broker I paid the o/s amount to minimize the damage. When I did this I was told i could speak to the team that placed the marker against me as I wanted to explain it was paid late because vodafone did not supply me with the information required to resolve the dispute and therefore please remove it. After the amount was paid I was put through to sales! When I called back to try once again the line was dropped after 50 minutes . I just dont have to time to spend many more hours on the phone to receive empty promises. So even after paying an amount that im not sure I owe I still have got nowhere in clearing my name . Its shocking and I cant think of any other industry where people could behave like this and get away with it.

Hi to anyone that can help My Fiance and I have been awaiting her Decree Absolute to arrange our wedding and it has come to light that her previous marriage of 10 years wasn't lawfully carried out due to an administration error of the Registry Office. We have been told her case is to be heard before a DJ this week to confirm that the marriage wasn't legal, and that the registry office will send out a form to complete regarding compensation that will go before a DJ to award compensation accordingly. Does anyone know how much compensation is awarded in these matters and what can be taken into consideration at all?? Many thanks Hadituptohere

Not sure if allowed but wondered how many of us had pets, any sort! lol I have 2 rescue dogs, a Dalmatian & a Weimaraner ( Grey ghost ) The Dalmatian was badly abused and kept in a cage 24/7 and was just about scared of everything when I got him, he did not even know he was supposed to be a dog. He has come a long way in the 6 years since I got him apart from him not tolerating other dogs ( he was attacked by a dog when he was a year old ( b4 I had him ) and nothing was ever done to help him get over it ) so he can not be let off his leash as he thinks all dogs must die :/ He get on with the Weimy and in fact was bought up with another dog but any other dogs are a no no, have tried several things to help him but nothing has helped, he was also kicked in the head by a horse. He will be 10 in September, the Weimaraner is 11 in July but thinks he is a puppy as this breed never grow up!, I got him when he was 5 I have pictures but not sure how to put them on a post,
  20. I've recently completed payments for an agreed amount with a DCA on a debt that went to court and we decided upon a discounted payment schedule. The debt is finished as far as I am concerned but Im now wondering whether I can claim the historic PPI charges applied? If so, who do I apply to, is it the original lender or the DCA? If its the original lender is there any time limit issue because they haven't dealt with this for quite a few years.

Hi i have had a similar experience with a child minder She took me via MCOL to a county court over a debt the claim was struck out but now she has instructed bailiffs.(correction -a dca - DX) What I need to know is if the claim was struck out how come she can instruct bailiffs , has she broken any laws in doing so and can i now counter claim?
  22. I purchased a Sony LCD 40 inch TV from Preston Sony Centre, the store closed about 2 years ago. The TV failed just before the expiration of the 5 year warranty.Ii contacted the parent company Sony who told me to take it to the nearest repairer to me. The TV according to the repairer can't be repaired economically as the part is no longer available( although Sony say they will have parts available for 7 years) therefore the whole screen would have to be replaced. The repairer cannot get the parts from Sony and Sony keep telling me that they are looking for the warranty. This has now been going on for a couple of months. i didn't receive a third party warranty certificate to cover the 5 year warranty when I took delivery of the TV only the standard Sony warranty paperwork. Preston Sony Centre was a franchise operated by a company by the name of Willo who have now gone into administration. I have tried on two occasions to contact the administrators to try and find out who the third party insurer was , however I have had no response todate. Is this a lost cause or can anybody offer some useful advice. If so it would be much appreciated. thank you
  23. Hi there my credit card company "Capital One" have taken me to County Court and i have received the response notice. The total is over £1,600 and includes bank charges and interest. 1. Is there any way to get off this? It is a few years old? 2. Can i counter claim or defend for bank charges? 3. How do i find out if i paid PPI and can i defend or counter claim for them? What is the best thing to do? WorriedAnnie
  24. Hello, I entered a DMP 12 years ago which still has another 8 years to go. Most of the debts defaulted me over 6 years ago so the records have fallen off my credit reports although I am still paying them through my DMP. The remaining debts I am attempting to get removed. Due to family issues money is very tight at the moment and I am starting to begrudge paying my DMP as I feel that the DCA's have probably had more money off me than they paid for the debt. I also regret not going bankrupt or simply not paying as either way I wouldn't have these payments hanging over me now as the bankruptcy would have ended long ago or the debts become statute barred. I wanted to "do the right thing" but now I am wondering what would happen if I simply stopped paying my DMP now (after I have hopefully got the remaining defaults showing backdated and therefore removed from my record). Could the DCA's get a CCJ ? If they did would it show on my credit report given that the debts have already fell off ?

Hi there I live in England and need to take the Bank of Scotland to Court for a Money Claim of around £35K; I put in my claim to the CCMCC and the forms have been returned stating that I need to accompany the Claim Form with Form N510. The form can be ticked in about 8 different places, but you can only tick 1 ! I've tried understanding which one to tick, but some are REALLY similar. Could someone please tell me which one? Many thanks
