  1. I was contacted by CreditResourceSolutions about money I owed from an unpaid payday loan about 6 months ago, I know I owe this money and that's fine. That's not why I am confused. I was speaking to Kelley from CRS about a payment plan over 5 months which was fine with me and we set it all up fine. However I asked her to cancel my plan and start it a month later (25/10/2014) and she emailed back confirming that's fine. However a payment was taken out of my account from a company called DebitFinance who gave me the reference so I looked it up on their website and it says they are acting for CRS but when I contacted CRS they said no payment had been taken! Now they aren't replying to my emails and queries and i'm confused as to where the money for the first payment has gone!
  2. Hi Guys, Have received a copy of my ESA Decision Makers score sheet, on it she has put the following statement under the heading below! Can anyone understand what it means! :s Limited Capability for Work Related Activity Evidence to support the opinion that the person does not meet any of the descriptors for limited capability for work related activity "The condition history, physical examination, mental state examination and medical knowledge of the condition does not suggest there would be a substantial risk to the mental or physical health of any person if they were found capable of work related activity." What does that mean, I have been put in WRAG but don't get any money as I have already had 365 days of Contribution based ESA. I scored 6 for mobilizing and 9 for Standing and Sitting. Stupid thing is went to WRAG and she told me to go home and that she would phone me.
  3. Hi I was wondering of you could all help me make my mind up about this. Same old story.............. Had statements back, worked out £1563 owing. Letter sent, then 2nd letter. Cheque received for half - £781.50. Returned cheque stating no deal and cheque returned back stating their position was unchanged and feel free to contact their legal department. So my quandry is whether or not to go through with it. Do I need the £781.50 now? Well, it would be nice, but not dire. Full claim with interest is £2002 ish - that would be nicer. YB seem to be the worst bank to deal with - the most aggressive (or should that be arrogant!), bullish, and intimidating. If I take action, from reading previous threads, it will take me 6 months. I have a parachute account open and ready. If I start proceedings and they start playing silly idiots like withdrawing my overdraft without notice, I shall be annoyed. If they close my account without notice, I shall be fuming. If I accept the cheque and go away quietly, I am £1k plus down If I accept the cheque and they still close my account and withdraw my overdraft - I shall be committing myself to the asylum. I read the threads on MSE which give me dutch courage and go through long periods of "lets do it!" "hmmmmmm - 2K! what a nice holiday!" Then I read the more detailed thread on here and I think "you are insane - take the cheque and run - it's £781.50 I thought I had lost forever" I know I should have destroyed the damn cheque - then it would be job done. Please supply dutch courage and tell me its worth it and don't let them win - or tell me I'm ahead and quit now before it gets nasty! Help!
  4. Hey guys n gals, I'm not quite sure if this would be the place to ask about this but ill just go ahead and ask anyway. I've recently been "harassed" by a debt collector firm known as BCW. Buchanan Clark and wells. They've been harassing me over a "missed" payment. now the problem is, the money is there and it has also been there since I put it in for the specified collection date of the 12th of each month. I am completely confused as to why it isn't being taken by them. I have no outstanding payments other than them and the internet company I am with. I also have all accounts in order, nothing is out of date or in the red. The direct debt has also not been cancelled as I haven't cancelled it nor have I even attempted to. So im completely confused as to what's going on, f urther more every time I attempt to ring barclays I ring them then about 5 minutes into explaining what's going on their end of the phone just goes dead so they aren't much help. can someone explain this too me? these debt collectors are quite frankly starting to annoy me. thanks in advance.
  5. I am a 53 year old woman.live alone, working 20 hours a week on minimum wage. get a small amount of tax credits ..Pay full council tax and only get £19 of my rent........after i then pay all my other bills and monthly bus fares I know i was definatly better off on benefits... However i need to work for my sanity Back to the original question I suffer with Restless leg syndrome and take Topamax and Zopiclone... Do i qualify for a perscription excemption certificate and if so how do i apply.. At the end of the month i have barely enough to eat let alone get my percription, but without them i would be in trouble!! And i wear glasses and have a nhs dentist that i am happy with both of which i would be unable to affored were i not helped in some way... Thankyou for advise.
  6. Hi All, I had a loan with the Rock in 2001 In 2006 this was sold onto another firm (just over 4k left), it did go through a period of default and reduced payments. Trying to figure out this bloody document, please take a look as I can't seem to get the figures to add up on the sheet to work the interest for the PPI claim. It states 8.5% APR over 4years, but for the life of me I can't get it to work out - it seems a complete mess? Once I figure out the correct figures, do i apply this APR to the PPI amount for the 4years, then 8% up until now ? Thanks all
  7. Please forgive me in advance if this post seems long and confusing but I'm in a bit of a Pickle. Back in April I bought a car with no tax but full MOT, the guy I bought it off said that on the day he'd lost the V5, even though he'd advertised the car for sale with this information included. (He'd recently moved and it had got caught up in the paperwork) He'd promised to send the information to me by post if he found it, in the meanwhile we applied to the DVLA for the new Log book to the car. Straight away after getting the car home we phoned the police to notify them that the car was sitting outside our house, but not used on the road, as we planned to sell it on once we had the log book. We then phoned the DVLA and done the same thing, notified them that the vehicle was there untaxed but MOT'D and insured (as we have traders insurance because we buy and sell cars) Everything was fine. Ok, so here's where things get interesting. It's now July, and today i got a knock on the door. When i answered it i come face to face with a man i'd never seen before, asking about the car. It turns out the car used to belong to this man (in his words) and the car itself had been sold for scrap. He told me that the DVLA had been in contact with him, telling him that the car had been abandoned, in my street, and giving this man (a total stranger) My address, even though the car is not yet registered to us. So he took it upon himself to come see it and us in person to warn us that they were threatening to clamp it. I then went and contacted the guy i bought the car off, who told me he had no idea it was sold for scrap. I contacted the DVLA They told me it hadn't had any history of scrap notified to them. So my question is. Should i be weary of this man? When he was told we would go and question the DVLA who still hadn't sent out the log book to us, he started to panic and said there really wasn't anything to worry about so there was no need. Uh... hello? You just said they'd been sending you threatening letters because it had supposedly been abandoned. Furthermore, the car has passed through five different hands before reaching me from the sounds of things. Now im in a pickle because i don't understand how this man got my address, I have PTSD so im in hell of a state over it all, because i frankly do not answer the door, but today i had to. Is this something the DVLA would do? Shouldn't the DVLA deal with this stuff themselves? No notice has been put on the car, i have no word to go on other than this mans. I asked him for the letters he'd been getting with regards to the car and he told me he didn't have them on him. Can someone help please :/ I'm on the phone to the DVLA again in the morning. AGAIN.
  8. Hi. I just have a question regarding ESA. My husband had spinal surgery in October and has been on ESA since the end of September. He has received a letter saying he has to attend a medical on the 13th February but thats the day he is due back to work and all being well he will go back that day. Do I ring and tell them that he is back to work that day and they should cancel the appointment for the medical? Many Thanks
  9. my friends family member passed away last year in january and after going to visit my friend she was paying the dead members electric bill, i was confused so asked why, she said that there is a charge for the meter on a weekly basis and that she had to pay it. I did not know they could do this, the estate has been left to my friend so i wondered if it is because she now legally owns the estate though no one is living in it and it is up for sale. the bill is 84 every 6 months
  10. Hi does anyone know the latest on the situation re old Egg Card agreements and the use of the phrases "approved limit" and "individual limit" instead of "Credit Limit" as per CCA?? I have looked about on the forum and there's a link about a Cardiff test case, but it doesn't work. Best Kittiebelle
  11. Hi My wife works for a home care company where she goes to different clients houses ,she uses her own car and the company offers no petrol allowance, her calls for the day are relayed to her by way of a work issued tablet so essentially our home is her start base ( no carer uses the office). can my wife still claim mileage; allowance starting from home and how easy is it to claim..she has never kept petrol receipts and mileage would be a rough guess. Any help would be appreciated thanks.

    Confused

Hi everyone, i have been searching the forum for a while for an answer but could not find one. Can bank charges still be claimed for? I maybe wrong here but if someone is in financial hardship and is in danger of losing their home, on that basis can historic charges be reclaimed. Thank you
  13. Hi Wonder if someone could just advice me if what I have received from UKCPS of Leeds is classed as court papers - in which case I obviousy need to reply; or if I should just ignore. Parked on private land in evening when very small shopping mall connected closed. No charge for authorised users to park here. Was sign saying private parking. Have ignored previous letters; but recent letter (25th April) states as heading '14 day Notice before the matter is issued into Court'. since charge is still unpaid they are now at the beginning stages of issuing a Court claim and that this will happen after 14 days. they are required by law to deal with this process by 'Pre Action Conduct' and 'Practise Directions'. "The court's powers to impose sanctions for failure to comply with the Practice Direction means that ignoring this letter before claim may lead to UKCPS starting proceedings and may increase your liability for costs. etc. to avoid further action I should just pay up £125 within 14 days of date of letter. Is this just talk (lots of use of the word 'may' and letter, supposedly from their legal department, is very poorly written) - or is it actualy connected to court procedure - and if so, should I give full details requested in '14 Day letter' attached such as reasons why claim is not accepted, whether I intend to make a counterclaim, etc. Certainly think even initial charge for parking was more than loss incurred so was not planning to pay. Would really value any advice. First posting so I hope I have done this right : !
  14. A friend of mine started work a few weeks back on a 0 hour contract, and has since done only 4/5 hours a week. His first payslip has him paying tax on this amount, is this right? I will copy the important bits own here leaving personal details out. Basic Pay (1) 4.50 8.0300 36.14 Holiday Pay (1) 0.54 8.0300 4.34 PLUS PAYMENT 6.73 1.0000 6.73 Deductions PAYE Tax 6.40 National Insurance 0.00 Plus Premium 7.74 So basically, on 47.21 wages, he has paid £6.40 tax, and something called plus premium or £7.74...his actual wage comes to £33.07 for that week. I dont really understand the holiday pay part either to be honest. Its one of the most confusing payslips I have ever seen
  15. Hi, i am an ovo customer and out of curiosity wondered if they could give me a better quote, so i went to the website and typed in what i pay them each month but put that i was a british gas customer, guess what? they say they will save me £334 per year! anyone else tried this? i'm going to ring them later to see why they are giving me a lower quote, are they legally obliged to lower my bills after claiming they can with their online quote? Any thoughts anyone?
  16. Hi all - I've successfully claimed from MBNA for missold PPI - incredibly easy so I thought I'd have a go at Barclaycard. I submitted SAR and got 6 years of statements showing my PPI active from 2006 - 2007 when I cancelled it (I realised it was a pointless expense). However I noted PPI has been on the account since 1989. Now initially BC turned down the complaint so I went to the FOS and strangely they've caved in as soon as the FOS process was started. I've received a letter from the FOS telling me I will receive an offer by the 4/1/13 however I'm not sure what a fair offer would be - ie will it only be for the year I can show PPI payments or should it include the payments back to 1989? As I can't prove how much I paid can I be paid an amount based on a average yearly balance etc and do barclays keep records like that? Thanks all
  17. Hi I have just looked at my credit file (Experian) to find four defaults One default is with Mbna credit card which I settled and now shows satisfied and dated 30/11/2010. The second default is with Arrow which is for the same amount and date as the Mbna account, surely you can not have two defaults from two companies for the same account. The Mbna account is full of information about payments and dates. The Arrow information consists of 5 lines with no information only that the default balance is exactly that of Mbna! If I pay off the other defaults will that improve my credit score or just not bother and stick it out for upto six years. And lastly after six years your defaults are removed from the Experian list (and the other dcas) do you still have to pay the outstanding amounts of the Defaults
  18. Hope someone can help with this please. Why would a company that has a full order book, starting new people on a weekly basis, and free of any debt to the banks etc, put some existing employee's on a tupe list and is it normal practice for this to happen, and is it legal. This has happened to me before, but that company had been bought over by a larger group, which is not the case here. Any views on this welcome thanks.
  19. Hi all, I will be brief with my question. At the beginning of this year I started getting letters from a company called Marlin chasing me for an alledged debt in my name. I disputed this and sent the standard prove it letter. They sent further letters until I finally said that I was raising a complaint and then gave up in June of this year with a letter of apology. In August I then started receiving similar letters from a company called Advantis, they are being far more stubborn and even managed to get hold of my mobile number (I have since changed numbers). They sent additional details stating what the alledged debt was for also stating when the last payment was alledgedly made. Apparently the alledged debt was for a bank loan taken out in 1992, the last alledged payment received was December 2008. I have again disputed this debt and have now had a threating 'recovery action' letter. I sent them a copy of the original complaint letter that I sent to Marlin telling them that I do not aknowledge any such debt. Their response was as I had replied that they were taking that as confirmation that I am the person they are looking for. I the 90's I did have debt problems and also had CCJ's, all of which have been paid and cleared. Nothing at all shows up on my credit file and I really do not believe that this is my debt. I had a full and final settlement on one of the CCJ's but do not have the confirmation letter any further. I also do recall cancelling a direct debit many years ago for a payment because I no longer knew what it was paying and assummed that if it was important somebody would contact very soon, nobody did. Does anybody have advice on what I should do? Even if is this were my debt would it be considered statute barred by December this year?
  20. I have an OD with Santander of which nearly half is made up of various charges. I complained and eventually got a final response. Over the next few months I sort of ignored it all and Moorcroft started calling/writing to me. I then put in a complaint to the Fos (within the 6 months, they have replied, I disagreed and sent back my points) Meanwhile Moorcroft asked for the Fos reference number so I gave it to them along with a summary of my complaint. I have now had two letters from Santander , first saying they need more time, the second saying they can not resolve it within the 8 weeks and I can go to the Fos. There is a different reference number on these letters to any I have seen before from santander/moorcroft/Fos. They are also using a variation of my name that they have not used before but is on another account that moorcroft have. Should I just ignore them and let the fos do their stuff or tell them they are thick and it is already with the fos Any thought I am minded to leave well alone
  21. I purchased a petrol strimmer on 13 August from a catalogue, but it does not work, and I have never been able to use it. I have been told by the catalogue that I cannot return it, and they have referred me to a third party to get it repaired. This is proving to be a long winded process and am getting increasingly frustrated. I thought that if a customer bought a product that is faulty, they could send it back to the catalogue within 6 months. Is this correct?
  22. I have just received my award letter from the DWP and I have been automatically placed into the support group of ESA on contributions based. I was swapped over from Incapacity Benefit. I am slightly confused over my award. It says that I will get £71 per week, plus the support group payment of £34 on top. However, when I checked the benefit rates, it says that I should have been awarded £14.80 also extra for an enhanced disability premium, but there is no mention of this on my letter. Do I contact DWP over this? Confused.

  24. Hi I am hoping to get som e advice, please bare with me though as I am totally new to all this. My partner has been suspended from work following a preliminary investigation, the investigation began on August 21st when an anonymous letter was received by his Area Manager claiming he had been for want of a better word skiving work and coming into work with a hangover. His area manager immediately accused him of lying, prior to any investigation and removing him from incentive (bonus) in effect punishing him without giving him any opportunity to defend what he was being accused of. He was questioned at length regarding his whereabouts over 1 1/2 days in July, specifically 4 hours one afternoon, and 2 hours when he came home due to a Migraine. He can account for his wherabouts for the 4 hours on the afternoon, despite the maliciousness of the letter accusing him of being elsewhere, the evidence they have produced in a screen shot of my partners Facebook page!!. Being accused of a hangover was actually a Migraine, and the only thing he did wrong regarding that was that he didnt follow procedure by letting area manager know, but he did let his colleagues know. Roll on lasr week when he was again called in for a second meeting, beleieving that as he had accounted for his whereabouts that the investigation would be finalised and there would be no case to answer. The second meeting was drawn to a conclusion by the investigating officer, who then adjourned the meeting and told my partner that he had to consult HR as he was thinking of suspending him. My partner was shocked and upset, he has worked for the company for 5 years, is in a senior management role and has an exemplary record. He was suspended at the reconvening of the meeting, he was so upset as he has done nothing wrong apart from the minor indescretion of not informing his manager that he was going home ill. Today a full 6 days after suspension he has received his letter advising that he is suspended for "unauthorised absence, intimidation of staff and breach of trust", apart from having to wait 6 days, none of these were mentioned verbally by the investigator, he merely said he was suspending him "to protect the business" I am stunned to be honest that they have invetsigated on the basis of an anonymous letter and a Facebook page print off! For his part he hasn't been sat around doing nothing, eventhough we weren't sure of the content of the suspension letter until today, he has been collecting specific policies, and has been putting together a statement and his own evidence that challenges every aspect of what was in the investigation notes , the only bit he can't skirt around is that he SHOULD have contacted his Manager when he went home ill. I don't really know what I can do or say to advise him
  25. Hi, As requested I've migrated here to try and sort out my PPI claims. It's taken a bit longer than I thought as other events got in the way. However, My wife and I are making a start on inputting our data, but are completely confused as to which of the spreadsheets to use. We have identified that the Barclayloan made us pay the PPI up front so it is therefore the Statinsheet v 101 that we must use. But which spreadsheet do we use for catalogues and credit cards where we paid monthly PPI? These accounts are no longer in use, and there are 10 of them. Hoping you can point us in the right direction, Thanks.
