  2. Hi everyone, I'm new here and after some advice. I was made redundant from my job last September through no fault of my own and been signing on ever since. However, before Christmas I had an appointment with my advisor at my local job centre and gave me details of a job to apply for but 2 weeks ago I received a letter saying that they are going to stop my job seekers allowance from the end of January to the middle of march. I have since appealed the decision in writing but when i went to the job centre today I had to fill in another form and explain again. I know it was my fault for not applying for the job, but I always complete the booklet and attend the job centre on a regular basis to sign on. Any advice? Thanks Louise
  3. Hi Bakatcha, The reason why I am contacting you is connected with my own dilemma with INGEUS!! I have been out of work for sometime & it's tough. The job centre has placed me on a mandatory work program with INGEUS & sadly it's lasted longer than expected. My advisor is using unorthodox ways to find work for me and somewhat intrusive. My advisor thinks it's a good idea if he watches me use the computer when I search/apply for jobs and he also wants me to possibly visit INGEUS on a daily basis. He also thinks it's a good idea if he applies for vacancies without me performing this task and I strongly disagree with that! He even suggested that I sit down with him & log onto my email account so he can check all the jobs I apply for each week, unacceptable in my opinion and I wondered what you make of this.
  4. Hello - I'm new to the forum. I come across the site after searching for ways to sort my defaulted account so thought I'd post up a summary of my situation to see what advise you can give me. It has been around 3 years since this started so fees and owings may be a couple of pound out. Everything started after being a couple of days late with car repayments. I was charged £40 each late payment by the car finance company and then circa £60 by Lloyds because it went over my overdraft. When I eventually went over my £100 overdraft after paying the car payments, to approx £125, I had a phone call from Lloyds offering a monthly payment agreement which consisted of £10 per month (£4 was fees). I paid the £10 for the month and then got another £60 charge from Lloyds. I immediately phoned up to which they said that this is for the month before making the agreement. So I agreed and carried on paying the £10 a month. The month after, I got another £60 fee. I definitely did not owe this. I rang up and discussed this to which they said I owe them this for whatever reasons they gave. I had already paid the £10 that month but told them I will not be paying the next month. What is the point in paying £10, which is actually £6 off my outstanding balance and £4 fees when I will only have to pay £60 more fees. 1 step forward 2 steps back. This obviously then entailed more fees to which Lloyds offered another agreement. I agreed another £10 per month agreement as it was the only way I would ever pay off what I owed. I paid the £10 and then got another £60 fee for after the agreement was made! Back to square one. I didn't pay the month after, more fees were applied, we then agreed a third agreement for £10 a month. In my head it was the only way I was going to get out of this situation. My frustration was huge but what could I do?. I spoke to a different person every day who has no clues or notes about what has been going on the past months. Wires kept getting crossed. Admin errors kept getting made and I basically kept getting shafted. Guess what happened next? Same again! I then went to the bank manager of my local branch who said she couldn't deal with the people on the phone but did anyway. After her being on the phone for over 2 hours she said there are wires being crossed due to dealing with people in India and England and their databases don't seem to be synced up. After more time of me saying I don't want another agreement and would prefer to be took to court......... another £10 per month agreement was made . Yep the same thing happened 2 months after. Since then I have sent letter to an address in Birmingham I was given but have had no reply. The debt has been passed to numerous debt collecting agencies but when I explain what has happened it always gets passed back and then sold to someone else. What can I do? The account has defaulted at £518 which I only noticed when I signed up to Experian 2 months ago. I was hoping to get a mortgage next year but that is obviously not a possibility now. I was also never sent a letter telling me I have that default against me. I was thinking sending a letter to the highest person possible but what use would that do me? I've been fighting this for years but keep going round in circles. Sorry for the long post which doesn't give a lot of details. I have copies of my agreements but have no proof of any of the phone calls. I would really appreciate some advice... anything to keep my sanity. Thank you.
  5. Hi All I heard that Cheque Centre had gone out of business? I had a payday loan with them a few years ago (xmas 2013) for about £300 that then became over £500 with their added interest. They took £200 from my account before I contacted my bank to prevent them from being able to take anymore money. I then stopped hearing from them for a few years, however they started contacting me a few months ago demanding the outstanding balance. My experian credit report is showing the debt as settled and not defaulted - I did say this to them when they called but apparently " I'm wrong" - I'm not stupid I can read what my report is telling me. I'm just confused now as they vanished and then came back demanding the money, also why would my credit file say its settled? Is there a way I can fight this or even get it wiped off my report?   6. Hi - I have just received in the post a claim form from County Court Business Centre issued on 13/08/15 for an alleged debt for Shop Direct from Lowell Portfolio. The form has no official stamp and does not have a signature only a typed name IAN MARSDEN which it says is the claimants solicitor, who are Brian Carter Solicitors. Is this form genuine? I have never received any proof of this debt. I have just tried the contact number 0300 123 1056 and it just rings (its Saturday). There is something on the form that says I should go online to moneyclaim.gov.uk and it also gives me a password. HELP!!! Sharon PS : FYI you helped me out with a Lowell claim quite a few years ago and they wrote back to say that they would be writing off the alleged debt of +/-£2000, so your advice most definitely does work!!!
  7. Hi, I am looking for some advice on how to proceed with a claimform I have tried my best to complete the CAG template (below). Name of the Claimant ? Cabot Financial (UK) Limited Date of issue – . 13 Jan 2016 What is the claim for – 1. By an agreement between Capital One & the Defendant on or around 13/07/2004 (the Agreement) Capital One agreed to issue the Defendant with a credit card. 2.The Defendant failed to make the minimum payments due & the Agreement was assigned to the Claimant. THE CLAIMANT THEREFORE CLAIMS 6000.00 What is the value of the claim? £6,000 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Credit Card When did you enter into the original agreement before or after 2007? Before (2004) Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. (Cabot). Were you aware the account had been assigned – did you receive a Notice of Assignment? No Did you receive a Default Notice from the original creditor? Yes, September 2010, giving me 28 days to clear arrears, I wrote back saying I couldn’t and sent I&E etc. Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No, not to my knowledge. I tend to keep all financial documents sent to me and I can’t find anything from either Cap One (other than above) or any DCA. I’ve had a couple of cards with “Confirmed resident” stamped on them in 2012 and 2013. A few months ago, Experian showed the default dates as October 2010. Why did you cease payments? Feb2011 What was the date of your last payment? February 2011 Was there a dispute with the original creditor that remains unresolved? Yes, PPI claim of £1300 from 2004 to 2006. I got nowhere with Cap One, so went to the Ombudsman (FOS) in 2011. In July 2014, they rejected my claim and I registered with the FOS that I disputed their findings as I didn’t feel that they had fully addressed the points raised in my complaint. As their findings were final I have not done anything with it since. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt management plan? I Wrote to Cap One in October 2010 into early 2011 chasing a response. They eventually wrote back saying that it had been passed to Friedrickson DCA and they were no longer dealing with it. I also wrote to Cap One about the PPI and they rejected it, hence the reason for going to the FOS. I wrote back to Friedrickson telling them I was disputing the amount with the FOS and have heard nothing from them since. Based on previous answers and advice on the forum, I will send the CCA request to Cabot tomorrow, presumably, I'll also need to send the CPR 31.14 request to Mortimer Clarke for further information as well. As far as the County Court forms are concerned, do I just complete the Acknowledgement of service form and leave the everything else blank? Do I tick 1. Intend to defend all of this claim as, depending on what comes back from Cabot/Mortimer Clarke, I don't know whether I have a defence or not? No doubt, I will have more questions further down the line, but I want to get the County Court form completed as soon as possible (certainly well before their deadline of 1 Feb?). I've never been in a court in my life, so this situation is somewhat worrying to say the least. Thank you.
  8. Hi PCN challenge Yoda's! I have posted this over on MoneySavingExpert, will update both with responses if useful... Help! A friend who shall remain nameless recently received a PCN on his motorbike at the Aquatic centre from Gemini Parking Solutions. Here's the info: - he parked his motorbike next to the cycling parking outside the front of the centre, to get there he had to access this area, via a gravelled area which could in theory be deemed to be pedestrian walk area but he did not pass through the Gemini Parking Managed and ANPR fitted carpark entry nor did he enter their carpark area at any time -there are no signs saying do not park here - the ticket was issued in this area and the reasons given on the PCN are 'the vehicle was parked in a no parking zone' and in the other section 'parked on a public footpath' - he had on a previous occasion on asking the Gemini parking warden (who was not wearing any identification vest or name badge other than holding a parking ticketing device) be told to park in an area with similar coloured gravel and it would not be a problem. - this carpark is motorcycle (MC) park for free but no where is there a designated parking bay, so MC users have to take up a car bay, which on another occasion he was told not to do as he would incur a fine again from another unmarked warden. He wonders if the jurisdiction of Gemini is enforceable beyond the car park area and into the pedestrian area, which must be owned by the London Legacy Development Corporation who would have control of the area outside the designated Gemini parking controlled area? Should he wait follow advice as per your newbies thread and appeal before the 28 days expires, or should he respond within the 14 days to try and retain the discounted amount if unsuccessful at a later appeal date. It would seem on this thread that Gemini dont offer the reduced amount beyond the 14 day window [as per another website] that contained an uploaded letter from 2012 sorry couldn't attach link as new person.   9. this is for a friend who had a sanction this time last year for 4 weeks got his benefit back 2nd week in jan 2015 they was wondering does sanction reset after so long? like a year on form his sanction start date and end date? just inquiring as they are getting put on a course which the adviser told that if they didn't attend they would sanction him and they would get a 13 weeks as they had a 4 week sanction but told his adviser that his benefit money was paid on the 12th january. they don't want another sanction but wanted to know how sanction worked if they do get reset.
  10. Hi, I will try and cut a long story short!! I stopped making full payment on my Isme and Littlewoods account over a year agodue to the loss of my job, I have since had a baby who is now 6 months old and not working although my husband is. I contacted both catalogue companies advising of my situation and they couldn't come to an acceptable arrangement as we literally had no spare money so was offering £5 p/m on each account. At the time the balance on the Isme account was approx £2,000 and the Littlewoods one was £400. Both accounts went over to NDR which is understand is part of the company and again they could/would not agree to my offer - I still made a few payments of that amount anyway to show willing. Since then charges have been added to both accounts, the Littlewoods balance is now approx £700 and the Isme one is a whopping £3,800 due to interest and charges. Isme have now sold on the account to Capquest. I have had the initial letter from Capquest requesting full payment which I know is pretty standard. I'm not sure who will be taking the Littlewoods account yet but NDR managed to get a further sneaky charge on both account before selling them on. I was going to write to Capquest and advise of my financial situation and offer the £5 per month I have been trying to pay over the last year or so, I am guessing they will not accept this due to the balance. Can anyone advise if they may accept or if they will request a higher amount, also am worried about going to court etc. Can they add even more charges? I am so worried about everything and also about harrassment from them as have read a few things about Capquest - none of them at all nice. Lastly, a family member may be able to help me out a bit but couldn't afford by any means the full balance they say is owing, does anyone have an idea if Capquest may accept a settlement figure and if so roughly how much I would need to offer, do I need to pay low payment first before offering anything?   11. I've got some tenants running some sort of Pregnant Mother assessement centre, basically subletting the property on a residential AST. A lot of pregnant mothers have visited the property. As well as several large families. A confused pregnant mom was seen on the property, & then rushed off to hospital a couple of hours later. I've tried contacting ofsted, & they dont seem to care the tenants dont have the correct permission of the landlord. Can I get an injunction on the tenants or some other legal action, without having to file a section 8? I'm concerned about damage to the property, as well as the safety of the heavily pregnant mothers, as our building insurance doesnt cover business use of the property. Not to mention our mortgage contract.qq I'm also trying to contact the correct authorities, I'm contacting ofsted again, but I have no idea who to contact about the illegal planning permission granted to them. Does anyone know who I should contact about the illegal planning permission granted to them? & if I can get an injunction on the tenants or some other legal action, without having to file a section 8? As theyre subletting illegally, not to mention illegally dealing with vulnerable members of the public. Also because of the large number of families damage to the property. I'm based in London btw ... Thanks!!!

Someone who signs on daily like me when he was in on Friday he was given a date to sign back on again after the holidays and he said to me the adviser who signed him on said the office for the computers use is open to Wednesday if u would like to use them he said no he can jobsearch at home she said something back but he can remember what but was he wondering will anything happen if he doesn't go in to use the computers? Or nothing can happen due to not been given a letter or a mandatory letter to come in to the office? He would like some info because he doesn't want to be worried about having money stopped.

  14. Hi there, A few days or so ago I received a £60 parking charge while parked at the Metro Centre, Gateshead. The charge will be reduced to £30 if paid within 14 days. The ticket was received due to parking in a disabled bay apparently with no blue badge visible. My girlfriend is actually registered disabled due to arthritis and has a blue badge which we always use and we visit the Metro Centre approximately 4 or 5 days a week. On this occasion our 5 week old baby was restless and we quickly parked up in order to see to her needs inside. I`m not sure if I left out the badge or not, but when we returned back to the car we had a parking ticket, but the badge was on the floor, again not sure if I left it out on a hurry and it fell off the dash or not. As previously mentioned, the ticket was for £60 or reduced to £30 if paid within 14 days. Having looked on their website the pictures do show our car although I must admit the quality of the images are really crap. They have a pic of the signage which again is crap, blurred and pixalated. As most of you will probably know, the car park is owned by Metro Centre and offers free parking. I would like to challenge this so I would appreciate any input. Thanks in advance.
  15. my daughter is on jobseekers, she has a son who was 5yrs old last year, and as a result she was removed from income support onto jobseekers, no problem with that, she has to find work for 20 hrs per week, to fit around school times and within realistic travel time for same reason. She is now single through no fault of her own, she part time cares for me as well as being single mum, neiher of us have tried to claim any carers allowance after the fuss of my IB with Atos, its just not worth the stress if we can get by. She job searches online daily, attends the jobcentre to sign on, this is where I am puzzled, she has her appts for sign on days and updates them as to her jobsearching, she is on their website and they can check at anytime on her searches etc, so no need for the diary now. She has a job advisor who she has to also see, so this week she has an appt on Tuesday for job advisor then again on Thursday to sign on. This job advisor is doing her head in, its like continuing pressure, she looks for work on her behalf which isn't a problem, but telling her to apply for jobs she has no experience for even though it states on the ad it is necessary, and to keep reapplying for same job after 2 weeks, seems daft? my daughter cant do much more than she is doing with this daily job search. why is it necessary for this advisor? I may be wrong here but I am sure others on jobseekers don't have to have these advisor appts? Our local JC is a nightmare, twice she has been sent home after being told they had no record of her appt, or it had been cancelled, only to find later that she should have been there. She did complain and it got sorted. Am just wondering what the hell is going on lol Apology for rambling and if I am wrong on any points.
  16. I have received a Claim Form from the County court Business Centre. Northampton. issued 29th June. The fee is £175. Claimant Parkingeye. For parking 15 minutes overtime. The claimants solicitors name appears as 'signed' but this is a printed name its not a signature. The form has a circle with a crown on it for the court stamp, but it bears no stamp. Is this form legally legitimate. I notice it requires me to submit all personal details imaginable including my bank account balance. They want an acknowledgement of service. What happens if I ignore this unsigned for letter? Form says Judgement MAY be made against me. Don't they have they have to take me to a local county court for that or have they already done that with this form. My only mitigating circumstances are that I visited the shops but didn't buy anything then became ill with a migraine and had to take prescription medication and get a cup of tea until I felt fit to drive. The car park was virtually empty so I have not inconvenienced them to the sum of £100. Please advise me. Enough stress already for 15 minutes. Thanks

  18. Hello, I've done a bit of Googling and found lots of people in the same boat as me with Warranty issues from the Repair Centre, it's quite shocking! I have a hardware issue on my Sony Xperia z3 compact affecting the microphone/speaker and apparently a scratch on my screen has voided my warranty therefore Vodafone won't fix my phone without a charge of £144. I have sent the following to customer support, really hope that someone can help: As a customer that switched to Vodafone on the premise of their outstanding service, it's really upsetting that I have experienced such a poor level. I have been dealing with microphone/speaker hardware issues from my Sony Z3 Compact for the past two months - but it had gotten to the stage when it was affecting my usability of the phone. Speaker volume was very low, even at max volume which was an inconvenience, but the microphone issue has progressively worsened over the past two months, so much so people on the other end of the phone can hardly hear what I say. Therefore I thought it best to visit the nearest Vodafone store (Victoria Station, London) on Monday (11th May) to find a resolution. In store I was advised that the device was faulty and was still under warranty so had the option to send to the repair centre and have the device repaired free of charge. I was given a courtesy phone and informed that my device would be repaired and ready for collection on Tuesday (19th May). I received a phonecall at 17:06 this evening (14th May) which I could not take during working hours and a voicemail was left. The voicemail informed me that there is a scratch on the screen of the phone which voided my warranty and if I wanted the repair it would cost £144. Obviously upset, I attempted to call the number back but the office had closed being so late on in the day. As you can understand I'm a bit aggrieved by the situation as: 1) I can't think of any superficial damage to the phone, but can't understand how this would have a bearing on the device hardware. If it does have a scratch this may be superficial 'wear and tear' but again how does this impact the hardware so drastically? Also how does this invalid the warranty? This has to be the first and only time I have come across this for a product! 2) If there was a scratch, why was I not told this in store and that it has invalid my warranty?? I returned to the same store today (14th May) to ask and was told I should have been informed and that the device should not have been sent to the repair centre if this was the case. 3) The internal fault with the phone has been very disruptive to my overall service, and to be asked to pay £144 is quite shocking for something that has not been caused by me. 4) Trying to call instantly back moments later to find out the centre was closed could potentially delay the resolution and leave me without my phone for a unnecessary prolonged period. 5) It will be a week without the device, and it will come back as non-fully functioning even though I am under apparent warranty. Unfortunately poor service on all aspects and I am now starting to regret moving service provider. Many thanks, Ian

Hi All I would be grateful for any advice I have had to claim income support for the first time, I am a single Dad with 3 children 2 of school age and 1 pre school, I have been told I will have an interview every 3 months whilst I claim, Can anyone tell me what to expect, from the interview, So far it has been a nightmare trying to sort everything out, as everything takes so long, or departments not communicating as they should. As a result my land lord has given me notice to leave, as the housing benefit was messed up. (still not sorted) I do not intend to be on income support for long only until my youngest is at primary school full time, Thanks in advanced Leakie
  20. Hi all, I have just received a PCN from Smart Parking for "the alleged breach of advertised terms and conditions within GREENWICH SHOPPING CENTRE CHARLTON on 21 April". It arrived within the 14 day period of the date of the alleged breach. They are "invoicing" me for £70, reduced to £40 if paid within 14 days. The PCN shows two photos from their ANPR (?) system - one of me entering the car park, and one of me leaving it some 3 hours and 33 minutes later. The parking T's & C's allow 3 hours of free parking. The car park was only half full when I returned to my vehicle to leave. I have read many of the threads in this forum during the past 24 hours, including a recent one regarding Smart Parking Ltd and ASDA. All of the comments and advice that I have read are of great help. Could you please clarify my position, in your opinion, regarding the £40 fee, the 14 days, et al. NB - there is no mention of POCA 12 or section 4 (hope I have those correct), nor any mention of VAT on the "speculative invoice". Many thanks in anticipation.

Staff from the service which provides free legal support are holding street stalls throughout the city as part of the lottery funded research project. They hope tenants who have had problems with landlords will come forward and tell their story.   23. Hi all this is my tale of woe. Went to Bishop Centre Taplow. 21 Feb15 in the evening. Received yesterday (02Mar15) a parking charge notice from euro car parks. They were using cameras to capture entering and leaving times. My stay exceeded the 3 hr free parking time stay. I have been told according to the letter that under schedule 4 of the protections of freedoms Act 2012 they have the right to recover from the registered keeper so much that amount that remains unpaid. Needless to say I don't want to pay the £75 or even the 'considerate' 14 day discount of £45. There are signs in the car park which state the 3 hr free stay so do I really have any possibility of avoiding this? Any advice would be appreciated. kev
  24. Hello there, i need help with a notice from Excel parking. About 2 weeks ago i went to Peel centre Stockport , i stayed in car and my wife went into a shop. I was under the impression that as iam staying in car i dont have to buy a parking ticket ( i know its my fault as signs were there). But today i received a parking charge notice of £60 for 40 mins stay by Excel parking. Iam not sure as it looks unfair to slap such a big fine for 40 mins parking. This is my 1st parking fine in 14 years of driving i dont know how to deal with it. Please advise what to do should i make appeal against it or should i ignore this as someone told me that Parking Excel are not allowed to enforce this charge. Thanks a lot.

Hi, received a ticket from a muppet working for ANPR-Ltd in November, reason for ticket, "not displaying my clock with my blue badge" something I`ve never done at this car park since I was told I didn`t have to by a warden years ago, I always display my valid Blue Badge correctly though, I have of course ignored/recycled any correspondence I receive from them, then today I am in the same car park unloading my wife's wheelchair and I was parked right by the sign in the picture, it was the red writing that got me "Penalty Charges Apply For" so I read through them and came across number 4) Parking In A Disabled Bay Without Displaying A Valid Badge On the day in question I was parked in a disabled bay with my valid blue badge on display, so I had not done anything to receive this Penalty had I? It doesn't mention a penalty for not displaying a clock with a blue badge anywhere. I will just carry on the Ignore/Recycle routine, I would love them to take it to court though, I would have it thrown out in a second. I will let you all know what happens. Mal
