  1. I would like some reliable advice on my current bailiff situation. A bailiff recently turned up at my parents home, I own the house, they are tenants, with a tenancy agreement. The bailiff refused to acknowledge this and gained entry by placing a foot in the door and pushing my elderly father aside. He then took an inventory of their belongings and bullied my father into singing the inventory. During this time I spoke to the bailiff on the phone, advised him I was unaware of the money owed, was happy to pay and did not live at that address. Bailiff refused to acknowledge this and later returned to my parents home and threatened them with the police. The bailiff did not, at anytime allow my parents to read the warrant, behaved in a threatening manner throughout and were physically intimidating. I contacted the police who advised my parents to call 999 if they returned, contacted the bailiff company and attempted to explain it was not my dwelling, nor were my goods in the premises and my parents were third party. I have also had my father make an affidavit to that affect and spoken to the council. According to the bailiff company the bailiff will return to my parents home tomorrow and again attempted to gain access despite these steps. Any advice welcome, many thanks
  2. Hi. Im a newbie here. Im hoping someone can help, Ive got into a bit of a mess over a van hire. I hired a van through Northgate van hire about 6 weeks ago, I scraped a post that left 2 marks on the van, I pointed this out when it was returned, they advised that my deposit would not be returned for the moment. Ive been chasing them for ages about a receipt for the deposit, Ive had responses but they all basically say its in hand. Ive finally received a email from them saying they are keeping my deposit of £250.00 and they want another £750.00 of me. I didn't take out CDW damage on the van. I'm on a debt management plan, where do I stand with this. I'm hoping someone can help as I'm down about this. Thanks

Hi All just wondering if anyone would know what he waiting time is for an ESA Assessment, i have been claiming ESA since July 3 2014, and still have no sign of anything to do with this, i have phoned up on numerous occasions to be told its being looked at, but still nothing. is there anything i can do to speed this up or shall i just play the waiting game... many thanks Lets

  5. Thousands of Co-op customers who used their cards in the retailer's stores on Tuesday may have been charged twice, the chain has said. A Co-operative spokesman said a "processing error" had affected its food stores and petrol stations. Those affected will have their money returned directly to their accounts within the next 24 hours, he said. The Co-op has apologised and promised to reimburse people who have incurred charges as a result of the error. Not everyone shopping on Tuesday with Co-op will have been affected and customers who used their credit or debit cards have been advised to check their statements. The Co-operative spokesman said he was unable to say exactly how many people were affected. The retailer has 2,800 food stores and 200 petrol stations across the UK. Its customer careline number is 0800 068 6727. So check those statements when you receive them
  6. Hello good people, I'm receiving ESA, the higher element and am also living in a property supplied by my local London Borough costed as Temporary Emergency Housing since my break down in 2012. I've been offered a 'break', a holiday of sorts in Broadstairs on the Kent Coast next month for five days. No cash just a stay outside of town no remuneration. Although I've seen little activity regarding the Council, Brent, checking on my personal occupational life, in Haringey, I don't want to give the paying authority for my HB any excuse to cut me off at the knees! Help and advice would be welcome, Peter. PS should probably have posted under a pseudonym but I'm trying to stay above the radar.

Hi,after some advice please,i was involved in an incident at work on 12/06/2015.on monday 15/06/2015 I went to work at 8am,after being there for 10 mins or so the production manager appeared and said he needed a word with me about what happened friday. he asked me to go into the kitchen with him to discuss this.I told him what happened.he said he wouls write down what I'd said then look at the evidence,and would be in touch,he told me I was suspended until then.on the 17th I had a letter from him saying I was guilty of gross misconduct and my dismissal was immediate.and that I could appeal the decision.the date on the letter he'd sent was 15th.I wrote to appeal stating I didn't think they'd followed procedures,not informing me of my rights,investigation and decision being made by same person.not providing me with any witness statements to defend myself.Had an email today iviting me to a disciplinary hearing 01/07/2015.don't understand this if I'm already dismissed.
  8. We had a letter from Motormile finance saying we owe money on a payday loan . We are retired and elderly we have never taken out a payday loan We have reported it to the Police and our bank . We do not want to contact Experian credit check as we do not want to put our card details on line . We did reply with an email apparently this gives them more info to pester us very very worried
  9. I have been paying off a social loan I had many years ago at £1 per week. I am working but my finances are at breaking point & that is all I can afford. Now the DWP have sent me a letter saying they have contacted my employer & asking for them to take money out of my wages based on a percentage. (I feel this letter was a scare tactic to get me on the phone) I called up DWP to question this and was told although I was making payments there was no official payment plan in place, and they would not accept any less that £60 per month. Firstly how can the government take money out of my wages without knowing anything about my financial circumstances? Secondly how can they do this when I was paying the debt? Thirdly how can they force me to make payments that will cause me financial hardship? I cannot afford £60 per month. How can I reduce the payment amount? The woman on the phone would not budge. I am paying so many debts and trying to get my life back on track but they just keep piling on. I had a nervous breakdown due to debt a few years ago and am starting to feel again like I cant carry on. I take 1 step forwards 2 steps back.
  10. Hi everyone I am having a terrible time of late and this letter has just about done me! On Sat I received a letter from BW Legal dated 13/05/2015 on behalf of Lowell (I'm pretty sure they are the same company?) saying 'A COUNTY COURT JUDGMENT HAS BEEN ENTERED AGAINST YOU' 'On 17 April 2014 our client obtained a County Court Judgment against you in the sum of £420.50 in the Northamptonshire (County Court Bulk Centre) under claim number ********' Details of this judgment will be enterd in a public register, the Register of County Court Judgments, That information will then be passed to credit reference agencies which will have an adverse impact on your credit file' 'Unless the full amount of £420.50 is received in this office within 10 days of this letter, we will seek our Client's instructions to enforce the County Court Judgment against you' Have I got a CCJ? I have tried checking my credit report today but it says it is not available. I already pay Lowell £6 each a month off 4 accounts I already have with them. Why would I not have set payment up for this one as well? I don't remember receiving any letters saying I was being taken to court. It is for an old JD Williams Catalogue debt. I am 6 months pregnant, I lost my job in March and have no income apart from housekeeping money my boyfriend gives me, until my Maternity Allowance gets sorted out and I am back on anti depressants so I really don't need any more crap piling on top of me. Can anyone help me out with this situation and what to do next. Many thanks Lisa
  11. Hi all, wondering if some-one can advise on this. Last year after a catalogue of errors and muddles with my pay and holidays etc, something happened and I had a melt down on the phone to some-one in HR (sheers frustration at being fobbed off and not listened to). It took me by surprise..didn't realize stress had been building up, so I finished conversation saying something like..I'm going to see my doctor and if I am ill you (my employer- public sector) have made me ill. T hat was on the 29th July 2014. I did go and see my doctor on the 1st August, (mainly to let them know the score) and continued to work as normal (part-time, evenings and weekends). I'd made it clear my job was not stressful it was all the management nonsense with my contracts, pay holidays etc that got me down and stressed , as I had to sort it all out in my free time in office hours.. Within a few days a letter arrived from the Occupational health service telling me to attend a meeting on Wednesday the 10th. The referral had been made on the 1st August. just two days after my meltdown on the phone with HR. So, Several questions. (the referral was for stress). a)are employers allowed to ambush some-one with OH like that out of the blue without even discussing the problem properly or formally even letting me know me I would be referred. b) I wasn't even on the sick and had never been on the sick. Did they have to right to refer me, especially without asking?( I idid get sent a consent form, with the appointment letter, but that had warnings about how if I didn't go it might affect decisions my dept made about me. I was stressed, not thinking properly, signed it and agreed to go to the appointment but made it clear it was under duress. c) The appointment was for a Wednesday 1.30, at a place about 8 miles away..in my free time plus I was expected to get there at my own expanse. As it happens I was afraid of driving in case I had a melt down again in the car (basically a high anxiety attack..sobbing not being able to breath etc.) . I asked for Time in lieu as I'd have to go on the bus,.., which would take ages. HR said no way but eventually relented and offered to pay for a taxi. Should they give me TIL as well as the taxi? The OH report basically said I was fine, just having a normal reaction to intolerable management issues. I continued to work for two months, while a review of the muddle with my holidays etc. was carried out. There is more but I'd like to see what people think about this lot first. Many thanks

  13. Hi all! I hope someone can advise me here, I'm due to go to appeal for my daughters DLA and it is likely we will win (again!). My problem is i owe a large amount of money to the DWP and to the housing due to a massive over payment. I strongly suspect the backdated carers allowance, DLA and housing benefit will be taken off my debt so i wont receive the back pay? Am i correct? The Housing underpaid us recently by over £500 and that got deducted from our debt. I will get to keep the backdated tax credits i assume but i was looking forward to buying some specialist ( and very expensive!) equipment for my daughter to improve things Thank you for your help!

Hi all, My girlfriend has today purchased a car and completed an HPI check after paying the full amount (yes I know not great...) the HPI check shows that there is outstanding PCP finance from when the car was originally built. I spoke to the garage (Lookers Used Cars in Bristol) and they have assured me that they will get this removed and that the HPI check will be clear. They also mentioned that they "put" 3 months of finance on to the car when it is purchased and this has been removed. Can someone just confirm if this is correct? How could a garage end up with a car in 2015 when the HPI check shows the finance is outstanding from 2012? I would expect them to have access to Experian or something silimar so that they can run checks on when purchasing the car from the individual? Also, the V5 (and HPI) checks show 0 previous owners and it still has the ladys name and address who would have brought the car in originally. Is this correct? Thanks, yokkers.
  15. Hello, Just had a baliff from collectica at my door for my husbands speeding fine. We have been paying it off in weekly instalments, but missed the last 2 weeks due to my disability and husband having to stop work to look after me. He is now claiming Carers allowance for me. I told the baliff he doesnt live here any more to try and buy us some more time. The notice they left says that the FULL balance HAS to be paid in full or they will be removing goods and no further arrangements to pay will be accepted. Can we apply to them to get a deductions from benefit order to have it come out of my husbands carers allowance? would we be classed as vulnerable as our only income is from benefits at the moment? Any advice would be greatly appreciated, also if there are any template letters I could send, I would be greatful if someone could point me in the right direction. This is a real worry and as I already suffer from some mental problems, I fear this will only make me worse. Thank you.

  17. Hi all, Simple question really, it would seem that a pension I used to have (occupational) was with Tibbett and Britten group. The pension trustees apparently were wound up in 2012 as far as I can make out, but I still have around 8 years of contributions with this pension fund. What do I do ? How do I access my frozen pension funds from a fund that has been wound up ? This isn't my area of expertise, but I'm sure someone here is an expert

Hello all from this forum, Lets start back from 2012, on september 2012 I was going to complete 14 year living in this country and for the ones who think I am another foreigner trying to reach the easy life, i can assure you that I have done more to the english elderly than a lot who has bourned here and I am very well documented about that. but the matter is not that yet. Two months before I completed the 14 years life in the UK which would give me the right to apply to the ''leave to remain'' the prime minister, Mr Cameron changed the rules of 14 year to twenty two years, but gave the right for the ones close to complete the 14 years, we need to prove our good character and that we lived in this country 14 years or ''close'' uninterrupted and also be able to pass from the test life in the UK which I done, so with all my homework done and a dossier made by myself explain everything I had done in this country during these 14 years and with all photos you can imagine sustaining my claim, it was a matter of time as it couldn't be any better application as far the home office were concerned, so got all together with the solicitor application and I issued two cheques, one of four hundred something for the solicitors fee and another of nine hundred something for the home office fee, my account had all the funds in it just waiting to the cheques to be presented and one day before the closure for the applications to the home office, I had mine sent by my solicitor. After one month got a letter from the home office confirming the receipt of my application and that I should keep waiting until their decision, by this time I had all the monies laying on my account ready to cover the cheques I issued, and then first come the four hundred something cheque cleared without any problem whatsoever and strangely the home office cheque was taking too long to be presented until after a month I got the letter from Barclays stating they had refused to pay my cheque to protect my money as I didn't have a mandatory signature and making things worst the letter from the home office saying that my cheque bounced and my application was not considerate, it was like the impossible happened, i couldn't breath, I couldn't react to that news and after proving the solicitor it was not my fault we agreed to sent the home office another cheque with a explanatory letter from barclays proving i had enough funds on my account and after a couple of months I had my entire application sent back to the solicitor office still saying that my application it was refused because my cheque bounced and that was their final decision and since then my live become a hell, after spending so much with solicitor and having to move due to the home office threat of deportation and many other events related drove me and my partner to contemplate suicide every single day until now, we are suffering from a very bad depression which make us fell really numb for anything and wanting to die, everyday I think about taking my life, it is so bad that I got phobia to answer and make phone calls and also having depraved sleep. So if anyone could help me with some advice I would really appreciate and please believe me, if I had done nothing for this country I would really leave without a question, but apart of learning to love this country I gave my bit for some guys life which really made a difference on their lives and would again and again if needed.   19. Hey, currently sitting here with a stupid wonga loan, on a repayment plan. in arrears by 270 days at £320. Been amending my repayment plan almost every other month as I am unable to afford it due to loss of hours at work due to disability. When I took this loan out I was in a bad place, and only earning £350 a month, i believe that they should have refused me on the basis of my income. I phoned them and they said I would receive an email today or tomorrow(!) if my debt was being written off.. Been worrying about this all week. So, has anyone else been written to regarding this matter? I still havent, no post, no email... seems like they're trying to pull a fast one.. Infact, after I called them they sent me an email asking to do a survey with the chance to win £100! The cheek. Cheers
  20. My husband told me last week that he had been made redundant from his job of 6 years. I completed an online application for JSA yesterday and today he confessed that he had actually been dismissed for gross misconduct for continual poor performance and bring the company into disrepute. He is frantically looking for employment... anything he can get. Most advice websites I visit state that he will probably get his benefits sanctioned for potentially up to 26 weeks. We have no income other than my carers allowance (we have a severely disabled child, who needs constant care) and tax credits. We have a mortgage and insurance but will not be able to claim since he got dismissed. We are in a very difficult situation and I'm worried sick. I appreciate he deserves to be sanctioned but it's me and our two children that will suffer too. The CAB websites suggest that as a carer I may be able to claim Income Support rather than my husband claiming JSA. Does anyone know if this is correct. Thanks in advance...
  21. my sister in law worked for nearly 2 years at a local convenience store ,most of the time as manageress . 2 weeks ago the owner came in and said he had sold the lease to someone else and gave everyone 2 weeks notice . except my sis in law , he offered her a job at one of the other shops they own, today she did her last shift at the current shop . he has offered her 2 shifts (16 hrs) a week at another local shop and maybe more shifts at one further afield . But he has told her he has to finish her like the rest of the staff ,or they could take him to a tribunal and she would have to work for 2 weeks cash in hand @£40 per 8 hour shift . Then he can re-employ her but she would have to then work a week in hand . she doesn't want to loose her job she was working 40+ hours a week some times 16 hours a day with no break. which i thought was disguting @6.80 ph for a manageress . with manual labour involved carring stock up stairs (cases of beer etc) i think there's something fishy about the whole thing , the new shop keepers offered a job but only for 2 month while she trained up their family workers . is this even legal what he is asking ?
  22. Cabot purchased an old (circa 2010) credit card debt/default from RBS. A few months ago, having sent all communications to an address I left over a year ago, they won a CCJ as I had no idea this was in progress. Court has now sent me the attachment of earnings form ( this was handed to my old neighbours who I've kept in contact with , by the occupiers of my old house (rented property) as they noticed 'it looked legal'. That's how it got to me. The "must return by date" was 17th March but due to sending to my old address I didn't actually get it till 19th March. I returned it first class the same day as I didn't fancy 14 days in prison .. . which was the warning written boldly on the form as penalty for not returning. I did include a letter explaining why it was late as they had used an old address. My situation. I'm 63, self employed but haven't worked for over 2 years. I manage to live on an old occupational pension ... not exactly a huge amount but I can go out once in a blue moon so not quite on the bread line. I don't own a home .. rent takes up a big slug of my monthly pension money. I read somewhere there can't be an Attachment if you are self employed. It still said I had to complete the form even if unemployed. When I filled in the form my outgoings were same as income .. . however I assume most people filling in these forms will try to max their outgoings and I've no doubt court knows this. Any idea what happens next. I certainly can't afford any real big payments .. . if it was a few £'s per month I'd manage . .. but debt is over £5k, so I doubt they'd go for a few £'s per month. I have precious few assets . .. a 14 yr old car with over 200,000 miles on clock (worth about £500) is perhaps my biggest asset. Will the bailifs come knocking. Any advice or information would be most welcome.
  23. Hi there, I'm here seeking advice from anyone willing to help about my issue with my mobile network provider Tmobile. I've been using Tmobile for over 6 years now (3 contractst have passed) and frankly I'm not sure why I'm still with them. SIlly me. i've always taken on big contracts with the full package to avoid worrying going over the limit and I'm pretty much always pay more than I'm supposed to. When I was on £50/month I'd pay £80 and now I'm meant to be on £27 and I've not paid that one single time, always been more than that Now of course some of it might be me, I do have family abroad such as parents so I used to text them but I've completely stopped recently and I just don't understand why I'm still having to pay more. Their itemisation system is absolutely pointless because you can't tell what item actually is and it's pretty much impossible to track down and compare notes between their itemisation and the record of all my texts/calls on my phone. So that's my first issue, I feel like I'm being ripped off every month but can't quite prove it. I may be wrong and it may be all my fault but once again there's no real way for me to say, here's the evidence that you've overcharged me all along. Now my second and Main issue is that I've just recently found out from my dad that every time I texted him on his mobile phone in Belgium he would receive the text message three times in a row!!! I panicked and started asking other relatives abroad, someone in France said the same thing and I tested it out with my partners phone also the same. SO I'm fuming because it can only be down to Tmobile as I've tried it on different devices (Someone said they know for a fact it was also happening over a year ago and I had a different phone back then) and also on different networks. The sickening thing is that no one bothered to tell me thinking it wasn't a big deal but I'm now wondering how long has this been going on?! And the worst thing as mentioned above is that I can't actually prove it. I have screen shots but the itemisation system doesn't show you what the text message said. there will be a record of three text message arriving in one go but it won't prove that they all say the same exact thing. the fees out of my allowance should have normally been only a third of what they actually were. As I never call abroad and nothing else used to make me go out of my allowance (i can prove that) I'm very upset and I want to have a big chat with Tmobile I came on here first to find out whether I have any legs to stand on. Is there even a point in me bringing it up? Aren't they simply going to brush it off as a problem with my phone or as there is very little I can do to prove it they'll simply say they can't do anything about it? What would you recommend I say/do when I speak to them. I've clearly been overcharged because of this issue and I believe the blame lies with them. They're the one constant throughout all the years. The question is how much? I have no idea. Could be £50 could be £200 could be £500. I mean in 6 years I've probably paid over £1000 in out of allowance fees. (doing the maths just now seriously scared me ) so it could easily be any of those figures. I'm hoping to get some sort of compensation but I need help to figure out the right way to go about it. WIll I need to spend hours and hours collecting evidence (not even sure how) or should I just forget about the whole thing, there's no chance I'll get anything out of it.   24. I've recently bought a car, and after speaking to some friends a question has arisen about the receipt. When the car dealer wrote the receipt they put "spares or repairs" on the receipt, this seemed strange, as the advert said that the car was in excellent condition. When I asked the dealer why he had put this he said it was just a way of writing sold as seen. My friends seem to think that both of these are shady practices, that a dealer selling to the public cannot mark a receipt with sold as seen, and that advertising a car in excellent condition, and then writing spares or repairs on the receipt may be the dealers way of trying to absolve themselves of responsibility in the event that a problem arises with the car. Can you please advise if I should be worried about this? and what if anything I can do about it - I bought the car from a dealer rather than a cheaper private sale because I wanted some reassurance that I would be able to seek recourse in the event of an issue, and my friend seems to think that this may complicate that? I emailed the garage the following: Hiya, myself and my dad bought a car from you the other day. So far it is fine but I have spoken to people and I am not happy with the receipt that you gave me. I bought a car that was described as 'excellent' condition, the car is in excellent condition but you wrote a receipt saying spares or repairs. This is not the terms the car was sold under, I would like a new receipt to reflect this. Would you be able to post a receipt or should I come and collect one? And this was the reply: Hi Becki, We sell all our cars as spare/repairs unless you buy warranty from us, that's the reason our cars are better priced than others. If you are not happy with the vehicle or the receipt,please bring the car back within 48 hours so that we may re-advertise it. This is just out of curtsey as you were not fully aware of what spares/repairs mean. After 48 hours of this email your receipt will stand and the offer of refund will expire. Just to put it in perspective the retail value of your vehicle is £4200 according to Parkers but we sold it to you for £3400.   25. just got back from joke center.where i was told to start looking for charity work ,i did the mandatory 4 weeks work trial a few month back now she says i need more recent experience on my cv . even though i have a 35 year reocord of working. im nearly 60. i told her i think its my age why im getting no interviews ,she said its nothing to do with my age being nearly 60. what will happen if i dont get a voluntary job ,why should i be forced in to it at my age.
