  1. Hello Caggers, I have gained immensely from the advice on this forum...thanks for that everyone. I need help in removing a DN from my credit file please. The entry was made in Aug 2010 by Barclaycard for #492. I have emailed CEO using one of the sample letters on here and got a response from a lady called Judith Hayes. She has promised to send statements and records. She also mentioned that some of the charges are made up of PPI, Penalties and Interest charges.   2. Hi all! I made a half hearted PPI claim v Barclaycard circa 2 years ago. As I did not escalate then I was under the impression that I could not go to the FOS now. On another ( MSE) site mentions that I CAN go to the FOS but only if I complain to BC again first.. any thoughts? Thanks
  3. Just wondered if anyone can advise me on what line I should pursue. I am currently in the early stages of court proceedings on another thread for an Egg loan - which led to me reading other things on this site, particularly lots of stuff about Egg cards. Can anyone advise me on whether or not I have anything worth pursuing. Will summarise; In 99 or 2000 took out an Egg card online which ran ok for many years. I know I had PPI and account ran up and down to around £11k. A few years into the account i questioned the need for the PPI and they stopped it. (not sure of exact dates) Account balance eventually dropped to about £4k and last year i asked them questions about the PPI but was told I was wasting my time as the application was done online and i'd ticked the box! I got into financial difficulties early this year, did an 'income and expenditure exercise and offered each of my creditors a monthly payment pro rata. Egg ignored my letters for 3 months (but managed hundreds of phone calls, 3 further letters of their own, texts etc) and then issued a Default Notice! 6 weeks later they sent a further letter terminating my account and handed it to a DCA called DLC. They agreed to the monthly amount that i'd offered Egg within a matter of days!! I'm assuming that the debt was probably sold on. My question is this - Does anybody have an opinion on what I should be doing now/next? Should I be issuing anything to Egg or DLC at this stage or should I let sleeping dogs lie? Any advice gratefully received.

    MBNA SAR Address?

    Hi Guys Im trying to be proactive regarding some letters im receiving from Cabot but i cannot find a recent SAR address for MBNA? Does this one look current?   5. Hi, I took out a Goldfish credit card in 2003. The account had a balance of around £1000 which I was making minimum monthly payments towards. Goldfish then sold the account to Barclaycard when they merged. At this point I stopped receiving paper statements. I therefore called them on numerous occasions to try and rectify this and continued to make monthly payments of random amounts as I had no statement to refer too. I then received threatening letters from Barclaycard stating my balance was over £4000. I had not used the card and I had not received statements so I disputed this and told them I would not pay any further balances until this was resolved and they could tell me where these additional charges came from. No statements were ever received and then I received communication from a debt chasing company stating they had been appointed to retrieve the debt in full. I explained the circumstances to them and again tried to call Barclaycard. Barclaycard could now not even discuss the account as it had been closed on their systems as the debt was sold. Around 6-8 debt companies have since tried to retrieve the debt but each time I call them to ask for evidence they go silent. MKDR is the latest company to 'own' the debt and they issued a small claims court case against me in 2015. I submitted by defence and nothing happened. I called the court and they informed me MKDR had not proceeded any further with the case. The issue I have is that this seriously affects my credit rating and will do for another year. My credit report states that the account has been overdue since 27/04/2011 and if I am to wait 6yrs this will not expire until 2017. Is there anything I can do to challenge this in the meantime? I am certain no one has the statements I have been asking for for the past 5yrs. How can I get MKDR to either proceed or close the debt off? Thanks in advance Katie

Hi Guys a while ago I recieved a couple of letters from Barclay card in regards to a payment break plan, I threw away the first letter as I have never had a barclay card, after the second letter I called the number & all they wanted was my phone number which I refused to give, threw that letter too but now someone has said that they took over certain accounts & its basically PPI that they want to repay me, can anyone advise, I also no longer have the number to call.   7. Hello All, Today I have received a claim form from CCBC. Here is the fun part... It is from a credit card I had in 2000. Long story short, I lost my job, got in a pickle and ended up (stupidly) going to a "get debt free within 5 years" company. The company then left me in a big pickle after telling me they wont be able to get me debt free within 5 years (3 months before the 5 years were up) The last payment they will have had from me would have been around Nov 2008 - Feb 2009. I checked my credit history on Experian in August last year and this isn't showing? Any ideas? Do I reply? Will this risk sending things back to square one?
  8. Hello everyone, After splitting with my ex partner in 2008 I defaulted on my then Egg c/c. Since then I haven't made a payment or made contact. Egg was taken over by Barclaycard and they started chasing me via letters for payment. Recently MKDP have started sending letters demanding payment. They have threatened to send round a debt collection guy to collect payment, and gave me 14 days to settle. When this happened I found this forum and sent them a letter requesting the original credit agreement, as suggested on here. Today they replied saying they are unable to resolve my query ATM. They are conducting a review which may include liaising with my original creditor. What would be the correct next step please? Thank you in advance. Russ
  9. I have tried searching on this thread to see if someone else has posted this query before but have not been able to find anything. So apologies if this issue has been raised before. I recently made a complaint for the mis selling of PPI on my mothers Barclaycard which she had between 1998-2011. Now barclays has written to us with a final decision letter stating they are upholding the complaint and have offered £768.41 as a refund. I know that this is nowhere near enough the money my mother is entitled to as in the early 00s she was using the credit card like nobody's business and did actually run into a lot of debt because of this, but thankfully that has been payed off. On the final decision letter barclays have stated that they have been unable to accurately calculate the refund because their investigation has been unable to find any record of the premiums she paid. So they have used an average value for the premiums paid based on someone who was sold a comparable policy. They have said they are happy to to recalculate the refund if she is unhappy with it. How would I go about proving that this refund a lot less that what my mother is owed. I have read up on SARs is it true the banks can only go back 6 years for any statements? My mother herself has not kept any statements for the card. How can I go about disputing this offer if i have no proof of the payments made? Also I didn't get a chance to read the final response letter from Barclays until a week later but by then they already put the money into my mums account, does this mean that barclays see this as acceptance of the refund and the case has been closed? Any help regarding this would be much appreciated! Thank you.
  10. Hi, I received a claim form from HPH2 for a Barclaycard debt of 2002 for £7476. I sent MKDD two CCA requests but no reply and now the HPH2 has issued the claim. I have two questions which I hope you guys could help me with. 1. Can the HPH2 enforce a credit card agreement which was taken out in 2002? 2. They are claiming interest, if they are successful, then is the interest COMPOUND, or Simple? Thanks

Hello Everyone, I am new to this website so please bear with me if I am babbling on..aplogies in advance I recently stumbled accross my old Woolwich Opeplan mortgage statements from 2000, noticed Add Ins in the narrative and made a quick call to Barclays to see if this was PPI. The gentleman on the phone took the account number and replied "the bad news is No this was PPI on the mortgage however the good news is you did have it on a Barclaycard taken out in 1998" I was a little taken back but didn't let on, he proceeded to gie me the policy number and the last four digits of the card, advised me to fill out the questionnaire online and wait for a reply. A few days later I received a letter confirming no PPI on Mortgage and a second letter advising me that my claim was being investigated for the Barclaycard and I would hear within 4 weeks. Two weeks later and I got an estimated refund of £2056 I am very happy with that, although I am worried that I should ask for more details regarding the card, I cannot for the life of me remember applying for the card. ..I know i was working all the hours up the city but surely i should be able to remember this?! The letter says that they have estimated the refund amount as they have no records of any premiums that I paid, this has been calculated over 85 months, plus interest plus 8%... Any suggestions to what I reply back to them please Thank you

Hi, Been struggling financially the last few months after being made redundant from my job and I am unable to make the minimum payment on my barclaycard credit card (balance 12,000) as the salary in my new position is considerably less than before. I contacted barclaycard in writing as soon as i got into difficulty and arranged an alternative monthly payment of £30 per month. They reluctantly agreed to this and agreed that any interest and charges would be frozen but as the new payment was not enough the account would eventually go into default. I received a default notice for this account last week and when i checked my account I noticed that they have started adding interest and missed payment charges again. I've just written to them again asking them to stop the interest and charges and am waiting on their reply. I was just wanting a bit of advice on what my next steps should be. Do I just continue to pay the £30 per month and wait and see what happens? I haven't CCA'd them or sent an SAR request. Any advice gratefully received. kind regards
  13. Hi all, Have what I think a slightly odd situation with Barclays at the moment, appreciate anyone's thoughts. Years back I got into a dispute with Barclaycard, that ended with me being issued with a Default in December 2010. They then sold on the account to MKDP not long after, who hounded me for years, took me to court, but I saw them off. I recently checked my credit report and noticed that this same account had had all this time 2 defaults registered against my name, by both Barclays and MKDP. MKDP registered their default 30 days after Barclays, who did theirs 7 months after the Default Notice, so there was obviously an overlap of some kind. Naturally I complained to the credit ref agencies who said they could do nothing, so I complained directly to Barclays. They upheld my complaint, but their response still puzzles me. I'll quote:- '...I have been unable to locate any record of a formal demand being issued to you. In view of this we can arrange for the default to be fully removed, however we would have to replace the default data. As your account has been in arrears since that time, this is what would be reported. The default will be removed 6 years from the date it was registered, however if we remove this the account would remain on your credit file 6 years from the date it was settled. This could mean that it would impact you for longer.' Are they saying that yes, we messed up but ironically if we sort it out you will be even worse off? if the default is removed how can that make things worse? when would the 'settled' date be, when it was sold on to MKDP? bit confused by this one. Barclays have offered to change the date to match the (later) date of MKDP so only one default should show (not even sure if that would work). Any thoughts welcome. I'll decide if I should just let it run its course, or choose to pursue further. Thanks in advance.

Hi all, I used to frequent these forums years ago and was successful in getting money back from Nationwide who promptly closed my account (like they used to, dont know if it is still common practice) and helped others do the same. Around that time (2007) I sent a PPI request to B'Card, and they rejected my claim saying that I was not mis-sold PPI. Yesterday I received a letter acknowledging that they said that I wasn't missold PPI, but now saying that they have reviewed my case and agree that I was missold PPI. It says they will provide a refund, and they offer a refund of the premiums paid, as well as interest on the premiums paid, plus 8% statutory interest as compensation. They say they are unable to calculate because they cannot find any record of the premiums paid, so have worked it out as an average. They say that my PPI policy started on August 2000 and ended April 2001, and no ppi premiums were received after this date. (probably because I stopped paying - oops!) They have worked out that the total payable back to me is £210.67, based on £103 paid in premiums. I have several questions. 1) If I can't find my original documents (I've not even looked yet), can I send another SAR to get my statements and work out the correct amount myself? 2) When can I claim interest until? If they made a mistake in 2007, when they should have originally paid out, can I claim interest back until today? Or until 2007, when they originally said no? 4) Is it worth contacting a PPI claims company to look into this? 3) Should I just accept what they are offering and be done with it? (incidentally, it is £10 less than what I still owe on the account) Any help would be GREATLY appreciated! Many Thanks
  15. OK long story simplfied. --------------------DCA--------------------------- Barclaycard taken out many years ago. Credit card charges account for £900 of the balance. They then SOLD the debt of £3300 to Link. They have provided me with deeds of assignment to prove it. On 25/03/14 I requested the CCA from Link. On 31st March they replied stating that they did not have it and were requesting it from Barclaycard and would take 30 days to get this. Even by their time scale this expired 3 days ago. So I shall be sending the unenforceable letter and removal of default on Tuesday. -----------------Credit Card Charges Reclaim------------------ I did a limited SAR on Barclaycard them asking for transaction lists. They were kind enough to send me statements going all the way back to 2003. As a result on 15/4/14 I compiled a list of charges and lodged a complaint requesting the full charges and 8% interest back. Despite Selling the debt on to Link and contacting me at this address and sending me all the statements they claimed I was not who I said I was and closed my complaint and told me to go to the FOS. They did not even go through the process of trying to establish my identity. As a result I have submitted a complaint with the FOS on 29/4/14 Now here is my question. I know I am not obliged to accept the FOS decision. Can I now alter my claim and add restitution on top of my claim already if I take it to court? I was unaware of restitution when I submitted the claim. If I apply it it comes out more than the debt is worth.
  16. Hello CAGGERS!!!! I have made a claim against Barclaycards on penalty charges that occurred between 2007 to 20012. Given to directions from experienced BC forum members I managed to processed my claim to the CCMCC's stage so far by submitted a N1 form & POC. But I have received a letter from CCMCC states that; The defendant filed an acknowledgement of service on 6 August 2015. The defendant responded to the claim indicating an intention to defend all of the claim...... But what surprised me most and given to other people successful claims in the forum, I have never come across anyone mentioned of Tlt Llp, One Redcliff Street, Bristol, BS1 6TP as the solicitors acting for the defendants (BC). Then it shows that, this claim will go all the way to the court room and, as I'm waiting for 28 days before BC submit their defence. I need to be ready and well prepared for a court battle. Please, kindly your assistance on how to prepare a court bundles much needed and any advice based on your experience that similar to mine also needed. Thanks
  17. Hi All I had a DRO which I was discharged from in 2011. I had a barclaycard debt as part of this. So for the last six years, barclaycard have been reporting a default every month on my credit report incorrectly, negatively impacting me. I asked them numerous times 2011-2012 to sort it. They never did and I just could not be bothered to chase. I am now sending a final formal complaint before I go to the FOS. Would you say I could request some compensation too for the fact they have left it this long, it has negatively impacted me for years and they ignored me? Not sure if thats a basis for it..
  18. Hi I just wanted to ask if anyone has used the PPI claim complaints page offered by Barclaycard to make a PPI claim? They have an online form and an option to print out a large PDF form to fill and send. To me there seems to be a large number of questions they are asking including employment status at the time etc, which I can not see the relevance of. If anyone has used this I would appreciate it if you can let me know of your experience,
  19. I have had visa card for decades with largish credit limit of around £7000, very light usage, and always paid in full before pbd. The latest Card was issued in 2010 and I did not use it for any purchases but kept it for emergencies only, and was due for renewal at the end of July 2014. However, sometime in Feb 2014 they sent this surprise automatically generated note; “Would you like to keep your Barclaycard account open? We've noticed you haven't used your Barclaycard Classic card for a while and thought your account may longer be needed. That is why on 9 April 2014 we'll close your Barclaycard Classic account for you. This means any credit cards associated with this account will be cancelled unless you tell us otherwise. Don't worry, the other Barclaycard accounts you hold with us won't be affected.” The letter was sent by normal post, dated just “February 2014” and I ignored it because it looked like junk mail. When I found out in July that the card had been cancelled, BC at first verbally said they couldn't reopen the card with original credit limit because I did not appear on the electoral register, then in their final response they changed their story and said that they had issued a notice ending the agreement under the terms and conditions, and that my creditworthiness was not an issue. The FOS just lied about the whole thing in their non-investigation whitewash which I didn't accept. My new visa card has a mighty credit limit of £260! What are the legal viewpoints, breach of contract because no valid termination notice or something else, unfair relationship?

  21. ************************Hi need help urgently***************.... on 11th august 2015 around 2330 at night i received a text messages from barclaycrad to confirm some transaction my card, there were transaction that i had used on 10th and 11th to which i replied Yes( HOW WRONG WAS I) I was at home with my mother and a friend of my mother, i than received further emails and messages from barclaycard that my credit card was used for £3500 on virgngames.com (gambling site) also £280 was taken from my paypal account. i called barclaycard and reported it straight away it was around 0130 in the morning 3 minutes before the last transactions that was done on my account, barclaycard blocked, issued me a new card and sent me a dispute form to fill out and send it back. i did and got a full refund within 10 days, and from paypal. however barclaycard fraud team have now contacted me again few weeks ago and asking me to fill out another form which stated FRAUD DECLARATION FORM to fill and send it back, again i did and they wanted bank statement, prove of my passport payslip basically everything... .. i done that and it proved that i do not gamble. however barclaycard spokesmen was so rude and aggressive and was trying to pin it on me, saying all my details like mother middle name, IP address, Email verification and all my details matches and if i was drunk and did not know that i did it, REALLY!!!!! he called me and said if i was sure that i want to go ahead with this case, i said yes and he stated i would get a decision within 5days through he post, 8 days went pass nothing, i than get a call saying he and a senior investigation team want to come and see me face to face and speak to me and make sure there arent any misunderstanding, i have no problem and said sure lets meet, but i am worried of what might happen i have reported it to action fraud, spoken to Citizen advice bureau, spoken to police and not sure what to do, they are calling me after 3 months after initial fraud and trying to pin this on me now!!!! help what do i do, any advice about why the meeting as they are coming from north of england and i live in south of england and why the meeting?? they have treated me really bad as if i am the suspect!!!:-x:-x:x:|
  22. My partner recently received this. It's for a debt which was originally around £9000, but with interest/charges is now £9858. With the court fee the total amount exceeds £10000. POC: The claimant claims the sum of ****.** being monies due from the Defendant to the Claimant under a regulated agreement originally between the defendant and Barclaycard. The Defendant's account number was **************** and was assigned to the Claimant on 17/9/2012, notice of this has been provided to the Defendant. The Defendant has failed to make payments in accordance with the terms of the agreement and a default notice has been served pursuant to the Consumer Credit Act 1974. The Claimant claims the sum of ****.** and costs. The Claimant has complied, as far as is necessary, with the pre-action conduct practice direction. There seem to be no errors in the POC, unlike the other MKDP claim I'm dealing with. The credit card was taken out around 13/14 years ago and was originally with Providian, then Monument before passing to Barclaycard. Hopefully this might make locating the CCA (if it exists) more difficult. I've sent the CCA and cpr 31.14 requests off, along with a SAR to Barclaycard. Have also done the acknowledgement of service on MCOL intending to defend the claim. Any advice on dealing with this would be most welcome, especially anything I may have overlooked at this early stage and further down the line the defence. Having just been browsing some of the other threads on here I noticed someone being advised to write 'I do not acknowledge any debt to your company' at the top of a CCA request. Is this particularly important? Too late to alter anything now obviously but I'm wondering what the significance of this is, as surely that would be something that you would point out when submitting a defence.

And i do bank with Barclays Just had a new credit search on my credit file that i did not ask or authorise Exquifax say it is a credit broker company I realise this is probably a "Soft search" but who are these people, and more to the point why are they doing credit checks?? If this has anything to do with that Clearscore then i shall not be happy
  25. Hi All Little bit of advice please. I have received a letteri today from HPH2 Ltd stating an old barclaycard debt I have been paying to MKDP LLP for the last two years has been passed onto Robinsons Way who will now be managing my account. My question is, as I have not received any letter from MKDP LLP confirming this, should I contact Robinsons to arrange to carry on payments or should I wait to hear from MKDP LLP before making contact. Also will my monthly direct debiti be transferred automatically or will I have to set a new one with Robinsons. Dont want to contact them unless I have to. Also am I correct in thinking that the requested "income/expenditure" request is just that a request and I dont have to comply if I do not wish to. Thanks for any help/info on this
