Ive made it clear this can not happen as it is my rent money, and is needed ASAP! they have said now they cant find my account! Ive spoke to tax credits and all i get is well it will be returned if not used!! help!! best thing is they just said set up a payment plan or we keep the money
  2. Hi To cut a long story short, looked at my credit file last week and came across a santander account, registered to an address 2.5 years ago, where my children live and where my ex is. That was odd as ive never opened an account. i phoned santander. They stopped cards and internet banking. They told me to go in branch and supply identification and address etc to recover account. I did this has been done. I now have ownership of this account as of last saturday. They also gave me a statement, The statement reads that on the 15th of june a cheque was put into the account for 1048 The following three days 300 was taken then the remaining a day later. I have sent an email to their head office to look into it. My ex denies all knowledge but realistically the account was open there. ..the card went there.. .the pin went there. Im not poirot but i mean who else. Regardless the cheque. a sum of 1048 that sounds like a calculation not someone giving it to her and so it doesnt flag up on her bank puts it in that one. I think A cheque arrived in my name someone..opened the account said person put the cheque in said person took the cash out once clear. im fairly certain from something that cheque was mine My question is how to reclaim this. The way i see it, how was an account opened on an address ive not lived for 2.5 years? Id like some clarification of how to proceed if possible. Women are devious, but £1048 is not £2 so need to reclaim that
  3. Hi New to the forum but have reading through a lot of related threads and now i'm a little confused as what action to take (if any next). I have spend the last couple of years fixing my shambolic credit history, got myself into a right state back in 2010/2011 with debt totalling around £12k with various creditors, defaulted on everything and avoided by ignoring letters/moving, etc. Over the last 2 years I have been tackling them one by one arranging settlements and have a single creditor left totalling just over £4k. This debt is related to a Bill of Sale Agreement for car finance. I paid the agreed amount for nearly 2 years of the 3 year agreement before I defaulted. They ended up taking the vehicle and sold it at auction. I later found out that I could of contested them doing this since no Bill of Sale stamped by the court was produced. They also never provided me with an auction receipt to prove the amount the car was sold for. This was back in 2010/2011 but can't remember the exact dates. Fast forward to now i'm being chased by a DCA to pay the outstanding amount. They have sent a few letters which I have ignored up until now, letter essentially reads that if I do not contact them in 28 days then my account will be reviewed for legal action. Previous letters up until this have all been very nice. Considering the age of the debt, it's very close to being statue barred which could be why they are now looking at escalating. I have a default registered on my credit file from the DCA (not the creditor) dated 05/2011. I don't have any paperwork relating to the agreement or statement of the account so can't check if this date is true. So far I have not responded to any letters but I did call them around 6 months ago and tried to offer a settlement. They said they would call me back if they accept the offer but never did, nor have they attempted any other phone calls in attempt to recover. No subsequent letters have been in response from the phone call. So a few questions on this if I may:- 1) (In relation to SB) Have a shot myself in the foot by offering them a settlement over the phone? Haven't confirmed anything in writing. 2) What should be my next action? Continue to ignore or send a prove-it letter or CCA request? Any advice would be greatly appreciated
  4. Hi all i need help please with regard to a CCJ i received a claim form from the court with regard to some debt which was not even mine but it was report as fraud in 2008 for something credit by HFC accord to the lowel profolio. I have no idea what they want from me, even my name last name on that letter is one of my middle names, i have called them and advised them of this matter. i did not send in the claim form back to the court or rather missed that date, so now i filed for the judgment to be set aside in, hearing was today on the 11/08/2017 but the judge was only focus if the name on the letters is my name which is my first name and middle name but not my last name, the judge was completely on their side and not listening to what i have to say, that this was not my contract to pay and it was a fraudulent contract. now they have given me sometimes to submit a defense for the 27th.. my main focus is to get the CCJ removed one way or another even if i have to pay it to get it off my file, i am aware there is a 28 days,, What are my chances on getting the ccj removed or set aside and what is required of me on the defense sorry but this is my first time to get something like this or to be involved in one.
  5. Having successfully reclaimed PPI for son-in-law from both a loan and credit card from these chancers now I would like to reclaim the packaged account fees they fleeced from him over the years. Have all the information for claim from a SAR - appears to have have one for years with the fees increasing over the years - no letters or information in the SAR relating to benefits/selling process - was just told and accepted he need one - was very naive financially and has paid lots in fees over the years - all under control now with help from CAG. I would like to know which spreadsheet to use. In addition any links to threads or information relating to reclaiming would be greatly appreciated - have looked at the FOS case studies which are somewhere on the site. Thanks in advance, Intend.
  6. Hi Can someone tell me if Natwest still charge you to have mobile phone, travel insurance and breakdown cover on their Select Platinum Natwest Account for new customers? I've been a customer for years (formerly Advantage Gold) and I'm still paying £16 for these insurance and breakdown cover. I've never wanted the mobile phone insurance as my phones aren't that expensive. I've used the travel insurance once in about 20 yrs but I have used the breakdown cover a few times. I use online banking and I cannot see any information on how much the package will be or does it mean you will get these benefits for free if you open this account? I don't want to be paying for these benefits if new customers don't have to. Thank you in anticipation.
  7. Hello need some help with a CCJ letter received today from Mortimer Clarke, for what they say is a 2012 mobile phone account with EE that I can not remember ever having. I have had previous letters but not knowing what they were for just ignored them. It say I have 14 days to reply to the court letter or pay in full with their 75 pound charges on top what can I do. Regards Jdene

We recently made an PPI Claim against Halifax. and we got a letter back from them saying that my wife hasn't had any dealings with them no mortgages or loans. when she had a mortgage with them and PPI and also badly advised on a endowment policy. unfortunately we do not know the policy numbers and don't know how to find them anyone help with this please??? these started in the 1980's
  9. Hello. I had some loans with Wonga. I wrote formal complaint and after 7 weeks I get a letter from them. I'm due to refund. Now I live outside the UK and don't have bank anymore. I have sent them my nominee (friend) bank details and now they are saying that they can't transfer money to someone else. Is that correct? They are asking my bank account details in my country, but the thing is that I have some troubles with that. I had a small refund from them few months ago (technical problems as they called it) and it went to my friends account without any problems. I had the same situation with HMRC and it went well. Any thoughts?
  10. Hi I pay by monthly instalments for my car tax and I want to change my bank account direct debit details, so yesterday I cancelled the direct debit and will re-tax the vehicle on 1st August. I have now received an email from the DVLA saying I need to re-tax it. The payment for July has been taken out already. I read the gov.uk website (change accounts part) before cancelling the DD, which clearly gives an example: Example You pay by Direct Debit every month, but want to pay from a different account. You cancel the Direct Debit with your bank on 5 June. You can continue driving your vehicle until 30 June. On 1 July, you have to tax the vehicle again using a Direct Debit from another account. I just wanted to check that I'm doing it the right way right? According to the DVLA website I quoted it's all OK and I won't be untaxed. The email has unsettled me! I went to the link in the email to see about taxing it and it says it's still taxed and would be taxed again from 1st July if I continued, which obviously I don't want to do! Anyone else had this experience and can confirm I'm doing it the right way? Thanks.
  11. I have a bank loan that was on lowered payments for a while two months ago they wrote saying if payments couldn’t be put up again the account would be handed to an outside agency so I could be put on a long term payment plan. That was fine until I got a phone call from 1st credit asking all sorts of questions which I answered (never had dealings with these people before) assuming he was about to set up a payment plan but at the end of the conversation he said I would be taken to court unless I pay the whole amount (£3500) within two weeks. I told him I couldn’t pay it all and the most I could pay was £30 per month but he wasn’t interested. I got another letter yesterday from a solicitor company saying they were acting on behalf of 1st credit and if I didn’t pay the full amount in fourteen days then I will be taken to court. Any advice as to what I can do or what I should expect next? p.s. I am in Scotland Thanks in advance
  12. Good Afternoon, I am claiming income support for both myself and my wife since 2013,plus i am her carer. When i last worked was 2013, on this job i got an industrial disease (lead poisoning). I took the company to court, in the meantime the money we were receiving was not enough for us to live on. I was borrowing money off my brother-in-law from 2013-2016 which was anything from £50 - £70 per week (He is a welding supervisor), i was loaned the money on the understanding that i would pay all the money i owed him when my settlement came through. In 2016 i received a out of court settlement of £16,800, by this time i owed him nearly £9,000. I also owed a couple of credit card debts totaling £2,700. I went to my bank the day after it was cleared and drew out £16,000 and paid off the debt i owed my brother-in-law and the 2 credit cards. I also paid out £700 to have our 3 piece repaired, £750 to get a new rear fence erected and a front fence. all this money was paid out within 2 days of receiving the settlement. That being said after the above was paid out i think we had about £3,000+ left. Would the above have any impact on my benefits ?? I showed the compliance officer this morning my bank statements which shows nothing in my bank account the same as it was about 4 weeks after i got the settlement. I forgot to mention in my post named (bank account and the DWP). I was asked in a letter i received from the DWP, to attend the Unemployment Office and see the Compliance Officer. When i got there he asked me had i been working ? No i replied because i have not been working. Well he said we have been passed information that you have been working from december 2015 up until march 2017. I am 1000% that this is wrong, but cant help thinking that this is not about working but about the settlement i received in 2016. Has anybody had anything like this happen to them ,i would like to know what is going on here please.
  13. Hi, I am currently with the fos with a claim for mis-selling of account and o/d charges reclaim for financial hardship. The FOS seems to side with the bank and is asking for t&cs of the accounts I held at the time, Additions, Additions plus and Premier. The bank has lied about products provided on these accounts and I need access to welcome packs and terms of conditions for the said accounts. Any help would be appreciated. Thanks in advance
  14. Hi Ok i am trying to Re claim my accounts fees as they were missed sold to me. I have all my statements after i finally got my SAR request through. I am claiming back to 2006 when i was signed up to additions account without my knowledge. I have drafted this letter. Dear Sir or Madam, Account name: First Additions Account number: I have had the above account since 1st February 2006 but believe it was mis-sold to me for the following reasons. - I didn’t know I was paying and don’t remember ever agreeing to having this account. - I was upgraded without my knowledge. - I wasn’t told there was an alternative, free account. I am writing to request a full refund of the fees I have paid plus any interest owed to me. I have enclosed a copy of the schedule of account fee charges. I look forward to your response within eight weeks, otherwise I won’t hesitate taking my complaint to the Financial Ombudsman Service. Yours faithfully, Now i may need to change the last paragraph as going to the fos is a waist of time. So i believe the court route is required. Can someone tell me what the timings are before court action is this similar to bank charges. Thx Rob
  15. Hi. I changed my supplier Eon to British Gas last year. This left me owing Eon £100. I arranged to pay this off monthly which I did until two months ago. When I logged into my account to pay the last final payment of £20. I found my account had been closed. ????? So I was unable to pay the final payment. Since then I have been receiving mysterious text messages on my mobile to urgently contact this company ( sorry can't remember name at the moment because I delete them) and withheld numbers on my landline. I can only presume this is a debt collector but I am not acknowledging them until they write to me. C Can you adviseme on how I stand with this. Thank you
  16. Hello everyone, I have applied for current accounts with Natwest and RBS which have both been denied (even though I was originally accepted) I want to know why they have refused me as my credit file is in good condition, no defaults etc so do I need to send an SAR? if so, is there a specific template? Any help or advice would be appreciated.
  17. I also have another a few questions relating to another debt with Capquest! Shall I post on here or start a new thread? I feel cheeky for asking but am so grateful for your help, this ones not at claim stage yet just a letter threatening court action.
  18. Help please. I'd like to ask about Drydensfairfax but, can't see where to start a new thread.
  19. Hello all, I am hoping to get some advice as to how to proceed with my complaint regarding barclays bank charges on my account. My history: Since my original account was upgraded to a First Additions account in 2006 with a personal overdraft I was under the impression at the time that increasing my overdraft limit incurred fee's onto the account and was paying initially £5 per month until upgrading in 2006 with a larger limit for £11.50 per month. My account was upgraded again to £14.50 a month (additions plus), and i cannot recall if this was automatic or whether I was given an option at some point by a barclays staff member. I can assure you that I did not need any of the packaged services on each of these account; did not use any of the services provided as I wasnt even aware of them until finding out on online banking which is when I phoned barclays to remove all of them, as I was unable to over the internet - upon speaking to an advisor at barclays I explained that all I wanted was an overdraft and I wasnt happy that I was paying for services that I didnt need... He then referred me to the complaints department and after many weeks I have been given a lengthy questionnaire regarding an 'initial investigation' conducted by Barclays. I note in the questionnaire notes it states: "You held a non-fee paying account from July 2002, until you upgraded in July 2006 indicating you were aware of the account and that it was not necessary to pay a fee in order to have a current account" I would like to note that this account was opened with my Grandad at the time, as he introduced me to Barclays originally and I was merely present and not fully understanding of the circumstances. The investigation notes go on to say "You used your overdraft after you upgraded your account and this shows that you were aware that you had this facility as part of your packaged bank account". "You previously had an overdraft which you used before you upgraded in 2006. This shows that you were aware of the benefits of this account and that it is not necessary to pay a fee in order to have a current account with an Overdraft". The extent of the 'products & services' that were bolted onto these accounts were unknown to me at the time, and over the years bumped up the monthly fee's from £5 to almost £15.00 - I stress again that these services aside from not being disclosed to me, were practically useless for me in the circumstances that I was in and most therefore rendered useless. I feel that the response from Barclays indicates that they feel I should have known about the cause of these charges, without entertaining the fact that I was not fully informed about the product I was being sold. I wanted an overdraft with an increased limit, that was all. I really hope I can get some advice on how I should proceed with this case, do I fill the questionairre in and send it back? They have said they will proceed with the investigation using their information without me returning it either way... Thankyou in advance for your help. Jason
  20. I am in the process of getting all my ducks in order. I have an old hsbc current account opened in 2001. I had an agreed overdraft of £1250. In June 2010 I stopped earning and no money has gone into the account for 6 years. I cancelled all debits, but charges meant that I owe crica £1500. There is a default dated August 2011 and has now been sold on. I am confused about overdrafts as I have read a lot of conflicting data. Is is statute barred now or will I have to wait until next August? I am sure that there are a lot of fees and charges on the account, I have also been told that I may be able to reclaim package account fees, this may be cicra £500. Would this be opening up a hornets nest?
  21. I opened an account in 2007 with Lloyds bank whilst I was 16 years old and living in the south of the country with my girlfriend at the time. I then moved back to the north of the country but did not change my home address and all my mail was withheld from me for about a year. I had gone overdrawn on my account by £5.40 and did not know of this because my mail was being withheld and had no cause for concern. (I should have changed my address). September 2008 I received a letter from Lloyds TSB demanding I pay £479.03 of the £679.03 balance in full in a couple of weeks. Due to my financial situation I was unable to pay. In October 2008 I received a letter from a solicitors demanding that I pay the full amount £686.69 outstanding balance. They also state in the letter that if the payment was not paid in full I would receive a CCJ, which inevitably happened. I chose to bury my head in the sand at this point only being young and unable to make such a massive payment upfront. Later in January 2015 I set up a repayment plan of £5 a week to Lowel and managed to get the outstanding balance of £767.72 down to £162.72 thus paying £605. On my credit report it states that I have had a CCJ. What I am wondering is, what is the likelihood of reclaiming these charges? What steps do I need to take to reclaim? Will the CCJ be attached to my credit history permanently? Any other advise would be most appreciated.
  22. Hello I see that there are a few new threads on here regarding county court papers filed by the DCA companies I have jus received one in the post today from Arrow global with regards to an old 02 account for £473.53 Date of default 8/10/2011 This account will be statute barred in Nov of this year I now have to defend it, so what would be my best response please This o2 debt has been passed around a couple of DCA in the past 5 years and 6 months Thank you
  23. Looking at my info it is obvious I can claim PPI from banks etc below but I do not have account numbers for everything. I have not moved house and I have a pretty good idea of when various mortgages started/stopped and same other loans etc. Is it worth adapting the SAR with relevant years?
  24. Initially i was excited about having a new bank on the high street. They market themselves as different to the others and I fell for it. Now i'm stuck in a situation that's really running me down mentally. On Tuesday, I noticed that there were a number of transactions leaving my account for a gambling site I hold an account with that I didn't authorise. I spoke to their live chat who locked my account and asked me to report the transactions to the police and my bank as it was believed to have been hacked. I report the transactions to Metro Bank as soon as i could and spoke to the local police who gave me an action fraud reference number. The employee at Metro Bank was very polite and said he would investigate as soon as he could. Because the amount of money was quite substantial, I also emailed a customer service head I have had previous contact with. A few hours later i get a call from a man at Metro Bank who says "Well, I can see you gamble often". I then tried to steer the conversation back to the fraud and he says "I can contact them, but if i find out these transactions are yours then i'll be closing your account". I agree (I mean, i didn't make these transactions and i was very clear that I had used this site in the past). I shoot an email to the customer service manager again who emails back saying he has listened to the call and he was merely informing me of the process (He didn't really inform me, it felt more like a thinly veiled accusation but ho hum). Next morning i get a call from the same guy at Metro Bank saying he had heard back from the online casino and they have my name and address (Remember, I did tell them i had opened account with them in the past). They then say they have a record of my IP address that i use for Online Banking on their system. Again, I don't dispute this. He then asks me to explain why that might be. I indicated to him again that I had opened the account in the past. He then says that it sounded like an excuse, he believed i was trying to defraud the bank so he would be closing my account. I asked him why he wasn't listening to me and to speak to a manager, His response was that he had already spoken to his manager so there was no one for me to speak to. Again, I email the customer service manager asking for an explanation, He then sends over a final response saying he agrees with the commercial decision made to close my account based on the IP match and that I had gambling transactions in the past and he couldn't think of why someone would hack a gambling site account... Now, I understand how on the surface it would seem like a quite clear cut response. Usually you would expect someone to play against the house and get the winnings back into their account. But the gambling site in question specialises in Poker. Now, There are well known cases where poker players have had their accounts hacked and funds drained from their linked cards. How they do this is by playing on a table with another player and losing bad hands on purpose to transfer the funds into another account. To safeguard against this, The sites tell you to speak to the bank and to the police so they can open a fraud investigation and also lock the funds from the poker network. I've now had to open a case with the ombudsman and i'm in a panic as i don't have any money for my rent, nor do i have a banking facility anymore. I've gone and applied for an account with another bank as an urgent action but i'm still down a lot of funds and i do not have the facility to dispute the transaction if the account has been closed. The ombudsman reckon it will take weeks/months to have any kind of response. Does anyone have any suggestion as to where i can go from here? The gambling site in question has said they would co-operate with the bank should a fraud or dispute be opened. Unfortunately i've been feeling really low and anxious as a result of the disgusting treatment i've had from their staff. They were not professional in the way they were talking to me in any way. I've tried emailing the CEO about this and they've referred me back to the final response. Not to try an make this case over emotional but the depression experienced from this experience nearly got the better of me a few nights ago so naturally i'm very reluctant to deal with it any more but i know if i don't do anything then things will get worse for me. I would strongly advise that everybody avoid using Metro Bank for these reasons but i would welcome any suggestions on what i can do to speed the process up or anything i might be missing.
  25. RBS made me an offer of £2k for ppi from 2003 They said they would pay me by cheque. However, the other day I had a message saying "we have deposited the money into your current account. On checking this I found that they hadn't deposited into my account, but to their own holding account pending further investigations. I phoned the ppi office to be told that the loan on which I claimed the ppi had arrears and so they were investigating. However, I then phoned RBS credit management and they confirmed I had no outstanding debts, but then claimed they still need to investigate. If they suspected this, why did they agree that ppi was refundable and why can't they find any evidence. Really frustrating! I have to wait another 28 days now while they investigate. Anyone dealt with this before?
