  1. i have submitted a Acknowledgment of Service via MCOL Can anybody please advice on how to defend my claim and what steps i should take please? Thank you In order for us to help you we require the following information:- Name of the Claimant ? Lowell Portfolio l LTD Date of issue Date of issue 11/1/16 What is the claim for Particulars of Claim 1) The Defendant entered into an agreement with Vodafone under account reference ('the Agreement'). 2) The Defendant failed to maintain the required payments and a default notice was served and not complied with. 3) The Agreement was later assigned to the Claimant on 10/10/2011 and notice given to the Defendant. 4) Despite repeated requests for payment, the sum of £490.08 remains due and outstanding. And the Claimant claims a) The said sum of £490.08 b) Interest pursuant to 569 County Courts Act 1984 at the rate of 8% per annum from the date of assignment to the date of issue. accruing at a daily rate of £0,107, but limited to one year, being £39.21 c) Costs What is the value of the claim? 659.29 Is the claim for a current account (Overdraft) or credit/loan account or mobile phone account? Mobile phone When did you enter into the original agreement before or after 2007? I have no knowledge of the contract Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. - Debt purchaser Were you aware the account had been assigned – did you receive a Notice of Assignment? No notice was received too my knowledge Did you receive a Default Notice from the original creditor? No Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? No Why did you cease payments?   2. Hi I have had an account with NW for almost 10 years - most of which I was paying between £10.00 to £15.99 to bank with them using their Advantage Gold account. Is it right I am able to claim this money back or have I heard it wrong. If it is true, do I just write and ask for it back?
  3. Hi, I've been trying to despute my water bill with Welsh Water as I feel I'm being over charged. In a recent conversation with a representative I was told that my property was on the lowest tariff I am still paying more than my neighbors & friends in much bigger properties. I pay £32.00 per month but my neighbors are paying between £18.00 & £22.00 per month. Is there a higher complaints procedure I can go through to get myself heard as so far I've been met by unsatisfactory excuses as to why I pay more. Thank you for your time.
  4. I was looking into a ppi claim for a cc we had years ago. The last statement I have is sept 2006 with a balance of £1541, I phoned the bank to ask some details. They have told me the account must have been closed as they have no records of it and it must of been closed a while. Cue a panic on their end when I said we've been paying this monthly for the past 111 months. They've asked me to write a covering letter and copy of bank statement. What do I need to be putting in this letter??? I'm a little shocked that this has been going on for so long (dopey husband who never checks his bank statement)
  5. I have received the following response to my complaint regarding Barclays Additions Account You have held Additions on two separate occasions and Additions Plus. Please provide your recollection of each point of sale. I can see your account was downgraded in error from Additions to a fee free account with an overdraft. Please confirm why you requested the account be upgraded to Additions again. Please confirm why you took the Additions plus Please advise why you retained the upgrades. I originally took out the Additions account so I could have an overdraft. I knew I would always have an overdraft with Barclays and this was the only account I could have. Each time I would ring them to request more overdraft or they would suggest that I take out a loan to pay off my overdraft. I would always do as they said so I could to keep my overdraft. If they had told me that additions had been taken off in error during one of these phone calls I would probably agreed for it to be put back on. The same goes for upgrading to Additions plus (I am being so honest with you that when I am reading it back I realise how desperate I was then) They have given me 7 days to reply. Really I could do with help as to how I reply to their letter Thank you Chris

I've just discovered that my old (premier 50 currant account) was packaged and contained an element for ID protection, which, naturally enough, I would like to claim back. Is there a template or procedural advice that I might be able to use - please?
  7. Hello. I hope I have put this in the correct place, I am seriously in need of some advice. Over the christmas period, a number of payments disappeared from my bank account totalling over 400 pounds overall. The name on my statements was 'virtue fusion' and after checking it appeared they own a bunch of gambling sites, however I did not know which site the payments were made on, I sent an email to every site that is operated by this company. Eventually, after a bunch of no matches... I received an email back stating that the account was on a certain site. They told me my details did not match the details on the account (not surprising as the account was not mine) and advised I send in a bank statement to show the transactions. They also asked for my correct details and said they had now blocked the account. My father advised me to call my banks fraud department as they would be able to issue a refund for the fraud while the investigation by the company was ongoing. I did this and was told I would get a refund by 5pm that day. No refund arrived I called the next day only to be told the refund would now take 2 weeks. This wasn't fine as such but it wasn't a problem as my rent was not due until yesterday, which would have been the 14th day. However, still no refund arrives. I called back today and have now been told that I will NOT be receiving a refund at all as the company in question has my correct details on record (name, date of birth and address. All of which they asked me for in order to close the account). Now, how this means it wasn't fraud to start with, I don't know BUT, the company already told me they did not have my correct details and have obviously replied to whatever the bank sent them with the details that they told me I HAD to give in order to close the account on their site. I am now late with my rent and have no way at all of finding 400 quid from nowhere. My bank is refusing to help, while the company just keep asking for bank statements. My bank reckon its safe to send the company my bank statement but given they have deceived me so far anyway, I don't feel too safe doing so as I feel it could be used against me further down the complaint in some way. I also do not really see what good it would do as clearly they aren't willing to help me given whats happened so far. My question is, what now? I am completely screwed for my rent. No-one seems willing to help and large companies appear to be lying in order to retain MY money that has been spent on their site fraudulently. I am so upset over this it is unreal. I haven't cried in years but I have been crying ever since I hung up the phone to my bank, out of both frustration and worry. I have never had fraud on a bank account before ever, but I always assumed that if it did happen, the bank would be on your side. Apparently not. I am unwilling to just let this go as it is such a large amount of money to me and its the principle of it all too to be quite honest. There has to be something i can do about it all.
  8. Hi people I have a Orange/EE account listed on all my credit files with a balance of £489. I can see the account started in 06/2002 and is still marked as active nearly 14 years later. It also states it is FCS disconnected whatever that means! My problem is that i do not ever remember having a contract with Orange. I remember i was at University at that point and used to use a BT celnet sim card. Ive read something about debt being statute barred, dose this account qualify as statute barred? How do i go about sorting this out when i know nothing about it? Any help would be appreciated
  9. Hello and Happy new year everyone! After struggling financially with my benefits over the christmas period was saying how great it would be to have some money saved up from over the year to buy a few gifts and extra's at christmas. At the moment I have one account and no credit cards. Looking at my bank I might be able to open an online savings account where I could put £10 here and there away for christmas and emergencies. I am worried about applying for one though in case it triggers anything in regards to my benefits as I am currently on ESA in the support group. Can anyone advise me in this matter?
  10. I took a loan with Lloyds some years ago and the debt was passed to Lowell last year or so. They have been sending me letters I received court papers early December. I acknowledged them and spoke to them a couple of days ago as over Xmas I received a letter saying they would go for judgement if I didnt respond or pay by 6.1.16. I managed to get through to them yesterday after trying since Saturday. I was inclined to pay all the money ( with a loan from family ) as I have managed to clean up my credit file last couple years and dont want a CCJ. They said I could make an arragement to pay monthly and they would not get judgement. Is this true?
  11. Hi, I have received a final response letter from Lloyds in regards to claiming back packaged bank account fees. Lloyds are saying that because I applied online and there was no physical person to give advise then the onus was on me for checking the box to the t&c's. Admittedly, I did not read these however the reason I upgraded my account was because I thought travel insurance was included which apparently never has been on the Select Account. My question is, do I accept this response ? Many Thanks
  12. Hi, I think I'm in a similar situation. I recently received a letter from Cabot saying that they had bought an account that I held with LLOYDS TSB - Credit Card. The first letter was dated 19th November 2015. Subsequently I have received two additional letters the last being, I imagine, the same as above (parksey78), just a form wanting pesrsonal details and income/ outgoings. I genuinely have no knowledge of this account and I was therefore about to send the template letter regarding 'no knowledge' when I came across a similar thread suggesting that it maybe better to wait. I have two questions, the first is should I wait until I get something more substantial from Cabot as you have advised elsewhere and two what is the reason why you would suggest not sending the 'no knowledge' letter at this stage? Is it simply to avoid entering into any form of dialogue with them? Thanks in advance.

Hi just wondering if anyone can explain what these interest charges mean. i have my old additions account bank statements from 2003. along with many other customers i have incurred penalty charges. the monthly interest amounts don't appear to stay the same, for example for Aug 06 = overdraft interest debited £0.60 credit interest 0.10%. if over the overdraft limit 2.05% another example Sept 08 overdraft interest debited £1.1 credit interest £0.54 how does this then compare with 24.9% if claiming restitution?

Advice please Lowell had been chasing me for a Lloyds Credit card Debt. back in May I requested a CCA from Lowell, and eventual received a letter in September from Lowell's saying that the CCA was no longer available due to length of the time since the account was opened and that they were closing the account. Now they are defaulting on my credit file can they do this. ( I still have the letter from Lowell) I have put in a dispute with the credit file asking for it to be amended but they say Lowell are saying they have received no payments and the entry on my credit file can not be amended.
  15. Dear All, i really would appreciate help and advice on how to deal with my situation. I visited a country on three occasions from last year to date. On each occasion i notified my bank the dates i was going to be away and the country to which i was visiting so that the Halifax knows exactly which country i would be visiting and how long i would be away. On each occasion of my travel i phoned and advised Halifax but more than that, i specifically asked them if it would be possible for me to use my debit card in that country. On each occasion, the Halifax said there was no problem and i could use my debit card there. On the last occasion i met with my account manager on 18 Nov and explained quite specifically that i shall be visiting this country and shall definitely be using my debit card there. he told me that there was absolutely no problem. Whilst i was away on 08 Dec. my account was closed by the Halifax I found this out by chance because someone gave me some money which my partner tried to pay into my account. She was unable to credit my account when she asked the bank, she was told that my account was closed down because i used my debit card in a sanctioned country. As soon as i learnt of this, i phoned Halifax and spoke with a manager there. I explained my situation and explained that i have to pay a hotel bill and i needed to use my debit card. I explained that i advised the Halifax etc. but the key thing was i needed to pay my hotel bill. The manager said he will see what he can do and will call me back. He never kept his promise. I had to settle the bill in cash which my relatives in the country lent me. Had i not been able to pay the hotel bill i would be in prison now. This country is pretty strict. I had banked with the Halifax for 20 years. I have not defaulted on my account. rarely do i go over my credit limit. i returned to UK over the weekend. i have no idea what to do. Will some one please advise me.? What can I do? How can i get my account re-instated? How do i claim compensation against the Halifax? this is rather urgent because, i now have no bank account. (I am trying to see if i can open an account with another bank) but these things take time. Already, my standing orders are effected. please advise me on what i can do thank you Wrecked.
  16. Hello, I've been having issues with the balances on my Natwest account for a few months now and wondered whether anyone else is. I keep a tight track on my accounts and use the iPhone app to make sure I don't go overdrawn (by transferring money in and out between Natwest accounts), yet on quite a few occasions my balance has shown as overdrawn. When I query this with the bank they confirm I'm overdrawn and won't accept that I can't be as I ensure I cover every purchase before making it. I don't touch the account and 24 hours later the balance shows as back in credit. Very tiresome but not much I can do. This morning my account shows as balance of 0.00. I've transferred money in and the balance remains at 0.00 So, I live chat Natwest who tell me there's "so many transactions on the account" (there are 6) it takes time for it to update. They also tell me it's in credit but I just can't see it yet. When I attempt to use my card it tells me there's insufficient funds in the account. The account balance on both the iPhone app and Online banking still says 0.00 Now, Natwest tell me there's a negative balance - it's changed in the last 5 minutes - and I know the account will sort itself out in 24-48 hours and will be in credit without me doing anything about it! Sorry for the longwinded story but is anyone else having these problems? I can't understand how a bank can deny there's an issue when one day they're telling me I'm overdrawn and it's fine the next, without any intervention from me. It's also really really tiresome but I know I'm lucky as I have another current account I can use- what would happen to a person that didn't?1 So, is anyone else having problems with their balance like this? Natwest refuse to accept there are any issues. Thanks,

Daniel Head can’t take credit, move banks or even secure a new mobile contract because his bank mistakenly put a fraud flag against his name and refused to remove it Daniel Head has worked hard to build up a strong financial base and an excellent credit rating over the years. He has never fallen into debt or suffered financial difficulties. But he can’t take out credit, move banks or even secure a mobile phone contract because Barclays (LSE: BARC.L - news) , his bank for 12 years, mistakenly put a fraud flag against his name and refuses to remove it.   18. Well now having issues with BT i was unable to pay the outstanding bill of £123.89 therefore i called BT regarding the issue. Within 24hrs my services were cancelled and they added fees and sent another bill which was £432.25. I called them again only to told they have now passed the debt onto CD UK Ltd and for this action they added 25% to the outstanding amount which as of today is £616.76. This is a complete joke but how can i sort it out without getting robbed blind by BT or this firm CD UK. They are now texting my works mobile and emailing directly to my works email as well so getting very fed up as they are not willing to discuss the debt and only ask for the full amount

This lady accompanied her mother to her local bank, where they signed papers so that on her death (they were told by the bank) there would not be any problem accessing her account. They also went to another bank and were told exactly the same thing. (all they would have to do is produce the power of attorney on her death) her mother has since died. However on approaching the banks (obviously she needed money for funeral expenses etc;) she was told that the bank had frozen the account and taken back the debit card she held. The answer she was given was that the bank was right to freeze the account—and wrong to advise her that she could use her mother’s account after her death. They stated that a straightforward power of attorney ceases to have any effect when the person who dies. At this point, it is the executors who have control of the deceased’s assets. My question is this is there a different’s between a power of attorney and a lasting power of attorney? and would a lasting power of attorney have allowed this lady to continue drawing on this account?
  20. Halifax is imposing a fee of £1 a day from arranged overdrafts of £0.01 to £1,999 as from 1st Dec 2015. No interest rate is charged. So if one has an arranged overdraft of £100 and goes overdrawn by £0.10, a fee of £1 will be charged and by 100 days, this £0.10 becomes a unarranged overdraft for which a fee of £5.00 is faced. Is this imposing excessive charges or treating customers unfairly??
  21. Hello All, I'm not sure where to ask this question so move it if it's in the wrong place. I have a defaulted account with Capital One (last payment 1/10/10) it has now been bough by Cabot and the have re defaulted it from 1/11/15. Is the correct and ok to do? I know Cabot are diddley so want to be sure? Surely if it was already default, they can't re default it?? Thank you for your help
  22. Hi everyone im quite desperate. I just made my new account at barclays less than 2 weeks ago with the switch service and yesterday i got a letter where they say my account is gonna be closed on 18th jan, 2016. The letters date is 17th nov. Also i recieved another letter with the date of 20th nov, which says my switch process has been successfully completed from my old bank (santander) to the new barclays account. I called them a lot of times but nobody could give me a proper reason why they want to close my account. Some said, ( also in the letter says) the bank made a review on my account and thats why, and in the letter says i broke thr terms and rules of agreement. But how? I didnt do anything. I mean until the 17th i havent even used my card. I requested a pin change on the 17th because i entered it incorrectly too many times.one day before that i called them and asked if i can transfer my money from santander to barclays without waiting for the switch process to be done. They said yes, it was on 16th. I paid in one check on 19th. Nothing else happened. Any chance that its just a mistake letter? Help me pls what can i do?
  23. Hi, I was hoping to find a little advice on what to do with my defaulted accounts. I have 4 defaulted accounts that were passed to debt collection agencies after I lost my job and buried my head in the sand. I have been paying a token amount to the agencies to stop the letter. The defaults are as follows: Bank Account: £1083 - Defaulted 21/06/2013 Bank Account: £1399 - Defaulted 27/06/2014 Phone Contract: £420 - Defaulted 05/03/2013 Student Credit Card: £415 - Defaulted 27/08/2013 Total Amount: £3316 Experian Credit score: 502 - Very poor Recently I have had some good fortune and I able to pay these debts in full but I am confused as to whether I should or not. The questions I have are: 1.Will paying the debt in full mean it changes the default date and pushes me back in terms of getting a clear credit rating? 2.If I pay the debts in full am I able to improve my credit score within the next 5-6 years ready for when the defaults drop off my account or is there nothing I can do until they do? 3.When is it likely I could be accepted for a mortgage and are there any steps I can take that will help? I'd appreciate any help you guys can throw at me.
  24. Afternoon . Looking to see if anyone has had any success with the HBOS in regards to the ultimate reward packaged bank account . I opened one in 2009 and have noticed that i was paying for a card protection policy that would pay out up to £75000 if there was any fraudulent acitivy on my card after it was reported missing . My question is . as this card proection insurance was of no value (the banks having to already cover such fraud ) would including it in a package of benefits/insurances mean that the entire package was missold . Since the onus is on the banks to check that the products they where selling was suiitable . any replies much appreciated regards
  25. My Dad is 75 years old and in a conversation with him the other day he told me that Nat West were closing his account. He said it was one of those where he paid a monthly fee but never got anything out of it, he said he'd never used any services that it offered and when I asked how long he'd had it and why he'd taken it, he said that he'd had it probably 20 years (although his memory is a little hazy) and he said he hadn't asked for it, they just told him he was getting it.....I want to try to claim back his monthly PBA fees, should I start with a SAR request and take it from there? If so, which SAR letter do I use? Any help would be greatly appreciated.
