  1. Hi. I have 2 small debts (from telecoms companies), caused by my own silly oversight at the end of contracts. The Lowell one originally came from o2 (for £42), and I recently settled this in full. The T Mobile £20) one I about to settle, but I am going to use repayment as a leverage for having the default removed. These are rather low amounts, so I was wondering what my chances are of having them removed, by either cajoling or threatening them with legal action if they can't prove the defaults were served correctly. A copy of my letter (I've changed it slightly to suit each instance) is below: As I said in the letter, these are for such small amounts and have an adverse effect on my credit file, when reality I manage to pay debts totalling Circa 15k with very little problem (and I am in fact reducing my debt levels each month). I also read that Lowells routinely removed the entry completely from credit files on full payment. Their letter to may certainly didn't say that, so is this true, or am I going to have to fight to get it removed.

  3. Lowell has issued me with a county court claim for an amount left on an old debt. They state they purchased this debt from Halifax earlier in 2013. I have another thread open in relation to the court case, access to info etc. I have just accessed my credit report (experian). It shows two entries for the same loan. 1. It is recorded as Lender: halifax. Balance: '£xxx and Status: Default. Default date is 11/02/2011. This has not been updated since 2012, which makes sense if they sold it on. It is also in my married name. 2. Lowell Portfolio. Balance: £xxx (slightly different amount) Status: Default date is 16/02/2011. It is in my maiden name. Can there be two defaults for the same debt? It reads like I have two loans, both of which I have defaulted on, when it's the same loan and there is nothing to link the two. I get that Lowell are now the owners and therefore are going to be adding their input onto my credit file, but how should this be recorded, to show that there are not TWO defaults (different amounts, different default dates would suggest to a third party that I had two loans at the same time, defaulted on them both rather than one loan balance being sold to another company). Is this wrong, and if so, how do I go about getting it amended? Thank you

I have just been reading through 'the credit reference agency explained' section on the experian website and noticed that under the section 'what is credit reference information?' and the sub section 'credit account information' it explains that lenders can only share your information with your permission and that you would normally give this permission when you sign the initial agreement when excepting the terms and conditions etc. This has lead me to wonder, if I have an account which is now marked as defaulted 8 (agreement ended) would this not mean that the permission I gave ended when the agreement was ended? I have nothing from the bank that says the agreement has ended, I am just going on what is stated on my experian credit report. Hopefully this all makes sense, any thoughts from somebody more qualified than myself would be much appreciated. Many thanks, from a first time poster.
  5. I am posting this on behalf of a friends son. He is looking to get a mortgage in the summer and had obtained his credit report file from equifax. However, this shows some very small debt from 2011 which was satisfied in 2013. However Lowell were involved and they have reported the same default on his credit file and its settlement but some 6 months later. Therefore, it looks like a duplicate entry but one from the original creditor and the other from Lowell. (1) Is that permitted? (2) Will either of them get dropped off his credit file or will it be the usual 6 year rule? (3) How can he improve his credit file in respect to both these defaults? Can he write to equifax to have a note put on his file or will financial institutes realise it's the same original debt? (4) How will creditors view occasional missed payments to other accounts (over 12 months ago though) Any guidance to improve credit scoring would be appreciated to pass on. Thanks in advance Shelley
  6. Can some one please explain this? As I understand – in 2011 Jan-March has late payments between 3-4 and April put on a Default. Is this normal? Thought you need to have 8 late payments. 2010 has late payments as being in April, July, Aug, Oct, Nov and December. 2011 – Jan (4), Feb (3), March (4) April (D) 2010 – Jan-March (Green), April (1) May-June Green, July (1) Aug (2) Sep (Green) Oct (1) Nov (2) Dec (3) However, according to my records, this is not the case. In 2010 missed in April, July, Oct and Nov. Paid in Dec. I have paid twice in May to catch up the missing one on April. 2011 – missed – Jan, March, and although paid in April it went to May. Had a ‘D’ in April. I don’t understand this?
  7. Hi I have just looked at my credit file (Experian) to find four defaults One default is with Mbna credit card which I settled and now shows satisfied and dated 30/11/2010. The second default is with Arrow which is for the same amount and date as the Mbna account, surely you can not have two defaults from two companies for the same account. The Mbna account is full of information about payments and dates. The Arrow information consists of 5 lines with no information only that the default balance is exactly that of Mbna! If I pay off the other defaults will that improve my credit score or just not bother and stick it out for upto six years. And lastly after six years your defaults are removed from the Experian list (and the other dcas) do you still have to pay the outstanding amounts of the Defaults
  8. When I became ill a few years ago I ended up defaulting on a number of debts and stupidly stuck my head in the sand. Lowell ended up buying a few of my debts and the first I knew of it was when I was handed a stat demand in respect of one of the debts on my doorstep. I have entered into a payment plan on that and the SD was cancelled. MY PROBLEM One of the debts which was Barclaycard (not the above one) can not be enforced as there is no CCA and the account was opened in 1999. Lowell have admitted in writing that they do not hold the CCA, Although Lowell purchased the debt there are two defaults in respect of it on my credit report - one being Barclaycard and one being Lowell. Surely having the same debt defaulted twice on my credit file is wrong? There is however a note on my credit report next to the Barclaycard debt saying "Satisfied" in the balance column. Furthermore, the amount reported is incorrect and Barclaycard admitted that the statements don't tally to the balance they were collecting. Having looked at this document from the ICO posted in another thread regarding defaults.   9. Hi all, hope I'm posting in the correct place? I need some help about an old debt with Barclays. I had just bee made redundant and explained this to Barclays at the time and asked the m not to put any more charges on my account as it was crippling me financially. They continued to add charges on to the tune of £530. Anyway I changed bank accounts and got myself sorted out again. I got a few letters demanding money from Barclays, but wrote back saying that I wasnt going to pay their unlawful charges and if they wanted their money they were going to have to take me to court. I heard nothing more untill.................................................... Several years later I had a letter from lowells demanding this money. I was getting several calls a day from them and despite blocking their calls they would use another number. Finally managed to get hold of them and gave them an ear bashing as I work nights and calls every 20 minutes in the day was continously waking me up. They have finally stopped calling thank god. However on checking my credit record today, which is 960, I have noticed that Lowells have added a default on this debt. Barclays had defaulted it on 25/06/2008 but now Lowells have put on a default on the same debt for 03/12/13. I dothey dont really understand about defaults but had thought that they drop of your file after 6 years. But surely if Lowells keep adding defaults this will stay on my file forever. Sorry for being long winded but can Lowells keep adding defaults?
  10. Hi, Just after a bit of advice to see if anything can be done. Here is the history. Moved out of a property on the 11/06/11 - Rang to confirm moving out (no record of call by Scottish Power) As it turns out they have me down as transferring supply electric in June and gas in July. (This must of been the new tenants and means I actually got billed on my final bills for part of their usage?) They have told me they sent reminders and defaults to the original address and finally defaulted it in Oct and Nov. (Didn't get the letters I had moved out) Chased at my new address for the electric debt in March/April 2012, realised I had an amount outstanding and paid the DCA. Didn't realise at the time that the gas was outstanding (thought it was all one account) So my main question really is do I have a leg to stand on getting them removed? I have been emailing SP but they have said no error has been made by SP so it can't be removed. I have tried to argue that I told them I moved hence me not getting the reminders, I have also argued the defaulted amounts are incorrect because of the dates. They told me it wouldn't make much difference to the amount and I would still have a debt. Any help please
  11. Hi, I have 2 defaulted accounts that are owned by Lowells, one is statute barred but the other one has some months to run. They have sent me a letter for the one that is now statute barred saying if I don't pay soon it will be passed on to someone else and if I don't pay them they could try to get me a CCJ. I could send them the statute barred letter but I am worried if I do it will make them pursue the other one which isn't statute barred. The one that is barred is for £1,000 and the other one is for £2,900. I recently got a couple of bad credit credit cards and on the letter Lowell's had said after looking at my recent financial activity on my credit file they believe I am in a position to pay. Any ideas on how I should handle this situation? Thanks Andy

Hello. for the past couple of years my credit score has not been very good.a thing that annoys me is this. i still have 2 defaults showing to "british gas" one for £180 another for £259.the debt for £180 was sent to "avantis" i contacted avantis after receiving a letter they said if i paid it on that day they would half the amount so i said ok.and i paid £90 with my debit card. and never heard from them again. though the £180 still shows on my credit report - owed to british gas. some time ago i received another letter from avantis, asking me for the £259 british gas had sent this to them also. i said to avantis i would not pay anything to them,and i would contact british gas and pay them back direct to them. when i spoke to british gas,they told me i did not owe them anything as they had sent it to avantis, and they had no record of my accounts with them anymore. since then i have never heard back from avantis after telling them i was going to pay british gas not them as i also said to him at avantis "take me to court" i didnt care. the £259 still shows on my credit score as a default to british gas even though they have now washed there hands of it i would like to know how i am able to take these defaults from my credit score ? any help would be much appreciated.

  14. Hi I am hoping someone can shed some light on my issue. I have been on a DMP with CCCS (Step Change) since December 2009. Of the original eight creditors five applied defaults. They were applied on the following dates 05/01/2010, 09/02/2010, 07/12/2011, 09/03/2012 and 26/11/2012. I am due to complete my DMP in the middle of 2014 and my concern is that if defaults stay for 6 years then those added in 2012 will not fall off till 2018:jaw:. Does anyone know if there are any rules on when defaults should be applied, all creditors received DMP payments from Dec 2009 and have done so every month since. I just feel a bit cheesed off that this will effect me for almost 9 years rather than 6, this is not because I want to access more credit but I will need to remortgage as my fixed deal ends in Dec 2014.   15. This is the first time I have used the site so please bare with me. I have searched and read through a lot of succesful cases on here but unfortunately I have not been so lucky and I'm looking for any advice that might help me turn this around. I have 3 Negative markers against my credit report. 2 defaults and an arrangement to pay marker. My first default is by Hutchison 3G for £12.00. I had problems from day 1 with 3G. I had taken out one of those internet dongles back in 2008 and it was basically useless, it was replaced countless times by 3 and resulted in me refusing to pay for a service I wasnt receiving for a small period of time. Although I didnt want to I did continue paying as I didnt want to end up with bad credit but having thought the account was closed and settled, I find the default for just £12.00 registered against me. I have written a polite and apologetic letter to 3G explaining I'm looking to apply for a mortgage, financial problems it is causing for my family, that it's such a small amount and the adverse effect it is having etc. 3G have written back a tiny 1 paragraph letter basically saying it is a true reflection of how the account was managed and they wont be removing the default. My second default is with T-Mobile. I moved home and did not realise I had one final payment left on my contract. The outstanding balance was £57.17. This appeared on my credit report, I contacted T-Mobile who advised the debt had been passed to a DCA and they could not accept payment but passed me the DCA details. I contacted the DCA who advised the settlement figure was £45 which I paid immediately. I then find a default registered against me by T-Mobile for £7.17! I called T-Mobile who said they don't know why I was told to only pay £45 and this time they were prepared to accept the remaining £7.17 directly. Similar letter (as the 3G one) to T-Mobile who have responded advising as the DCA told me to pay £45, despite the default being registered by T-Mobile, to take my issue up direct with the DCA, who can't do anything as they didnt register the default. T-Mobile are just advising there is nothing they can do. Finally, HFC bank have registered an "arrangement to pay" marker against me. I never needed an arrangement to pay for the account and never agreed to one. My payments remained the same every month apart from 1 late payment until I settled the account early. Again, similar letter to HFC but they just flat out dont respond. Sorry it is a bit of a rant I just wanted to be clear about my situation. Any advice would be greatly appreciated.
  16. Hi Just a quickie (sorry, I should probably know the answer to this but have forgotten). I have the same account on my credit file from both Barclays and Lowell, although they have slightly different reference numbers, default dates and amounts they are in fact the same account. Who should I contact to challenge these, Barclays, Lowell, or both? If it is one or the other rather than both, is that organisation responsible for informing the other organisation to correct their records or do I have to do this? Thanks again, Andrew
  17. Should a company reduce the balance showing on your credit file even if it is defaulted? I have one company that is reducing the balance after each payment but another which seems to be refusing to do so. It's been defaulted since Feb 2013 and hasn't gone to a DCA yet.
  18. Hello All, I was wondering if someone could help me. I have a number of Defaults on my file of which are now satisfied. I understand that these can possibly be removed by the company involved but they usually would not do this or would charge a fee. I was wondering if anyone may have a template of a letter I could send the companies concerned. Also if someone could possibly tell me the legal aspects surrounding satisfied defaults and removal. I understand that they are supposed to stay on my file for 6 years. However when I have paid off some of my debts the company have removed the default and marked as satisfied. I am a little confused!   19. Hi guys, I have been attempting to deal with this but getting nowhere fast! I'm sure that these DCAs drag their feet deliberately, hoping people will pay up to clean their records up. There are two issues here but I figured they're so similar that I may as well keep them in one thread. Since I got my credit files for the first time ever in May, there has been a default registered in my name by Cabot Financial at a previous address. The account was opened after I left the address and it's for around £250 for a JD Williams group debt. I've sent address history proof back in May and have brought this up with Equifax and Experian more than once (Cabot just come back and say it's correct). I've written several letters, getting nowhere. They've written to me this week asking for my address history so they can complete their investigation (AGAIN). They've also moved the default from my previous address to my current address. I know for a fact that they have no CCA as I never signed one (obvs). - Are they allowed to move the default to my current address? - What are the implications of them doing so? - What next steps would folk advise? - Does anyone have experience of reaching a satisfactory resolution in a similar instance? Secondly, three weeks ago, another default appeared on my credit files for the first time. Its for £300 to Littlewoods and is held by Arrow Global. This is in a slightly different name to mine and has a different date of birth. Weirdly, the address is a uni hall of residence that I lived in in 2005/2006 and the date is 2008! I've sent a copy of my driving licence and proof that I lived elsewhere in 2008 but they're dragging their feet too! - Any advice on this one? - Surely they're breaking some law by reporting this as mine? I've sent off a CCA request to both of these this week, and have demanded the removal of both accounts. I'm not hopeful though. Any thoughts?
  20. Hi im just wondering if any one could help me or give me some advise, i recently checked my credit report (because i was going to apply for a mortgage). I noticed that British Gas have issued 2 defaults onto my account 1 for electric and 1 for Gas. These defaults have been issued on a property i used to live at, The defaults were issued 14/05/2011 and the accounts were started on 20/01/2009.. My wife and i separated and i left the family home late 2008 and i notified British Gas of this. I have had no letters from them and i certainly didn't receive and letters stating they was issuing defaults (which by law they have to 'Consumer Credit Act 1974') I have emailed British gas regarding this matter requesting the removal of these defaults and they replied by asking for the account numbers to the accounts, because they couldn't find no accounts under my name and address. I emailed them back stating the accounts were not mine so i would not have the account numbers, i sent them a copy of my credit report to show the defaults. So far they have not replied. If anymore has been in this situation and has any advise on how i can get these defeats removed i would be grateful
  21. Not sure where to start with this...but am in the process of getting my affairs in order. I am awaiting various SAR replies, CCA replies, some PPI claims and at some point some charges claims. I am trying to do things in a sensible order now rather than going off half-cocked! Had some very useful advice from DX that made me look at things in a different way but moving on from that i'm trying to consider some of the next moves I may need make, and i'm trying to get my head around what the law says. Firstly I should point out currently my debts are being managed through the CCCs and I have one CCJ i will be paying for a VERY long time. This CCJ also carries a Charging order on my property - but i'm staying put so no worries there! Most of my defaults are three or so years old and I am paying nominal amounts on them. I suspect of the three non-ccj debts that have been sold on two of them will not be able to provide a valid CCA. One of these debts for some reason doesn't have a default against it but shows as an arrangement to pay on my credit file every month. Is this allowed/legal/acceptable as they bought it with this arrangement in place? I've seen estoppel mentioned but I don't know if it applies to me? If i understand things correctly this DCA can register a default on my account if i were to stop paying - and this will be the case until such time as i have paid this debt in full or come to a full and final figure? With regards to the other debts if i just pay for the next three years and then stop on the basis for example that the debt is unenforceable i cannot be punished on a CRA by any means ie second defaults can't be registered, i cannot be taken to court, etc as i will have already had the default registered on the account. Hope this is making sense. Would welcome any input - especially on the legal side of things. Hx
  22. Apologies in advance if my post is not in correct forum. My question is a general one in regards to default notices. Everytime a DCA transfers or sells my unsecured debts on will a new default appear on my credit file? Will these default run for 6 years? Having recently checked my credit rating on Noddle my debts have all had default notices registered in the names of the new DCA's. The debts are 4 years old mainly credit cards. Despite trying to do the right thing and pay off my debts, feel like throwing in the towel. Any advice will be gratefully received. Graham B
  23. Hello; I am hoping that someone will be able to help us here as i am currently getting mixed replies from various other websites. My Wife and I have just started applying for mortgages. When we retrieved our credit reports from Credit Expert and Noddle we notice a large number of Defaults (6) and 1 CCJ on my wifes report. there are 4 related to Lowell that were for: 1. £571 - has been passed to fredericksons and we believe is now the CCJ, as the CCJ is for the same amount. Lowell have refused to talk to me about this and have told me to speak directly to Fredericksons 2. £159.84 for Littlewoods, £718 for Great Universal. 3. £26.27 for Orange. I paid this today just to get rid of it. The points raised at number 2 seemed odd to my wife and I. I requested a copy of the Original default Notice but lowell said they do not have that and that we should contact Shop Direct who they told us where the originators of the debt. My wife contact them and they said they had no record of my Wife's details. My wife then contacted Great Universal who were able to locate my wifes details. They have said they have no details on their system regarding the accounts. My wife asked them for the original default notices and they have referred my wife to their debt collection department, but they will not be open until Monday. We have set up payment agreements with Lowell for these for now for £30 a month (£15 on each account). I need advice regarding: a. Should we be paying this if the original creditor has no information? b. Can we get these defaults removed from her credit history? :???::???::???::???::???:

Hi CAG, I have been a lurker for some time now and seen some great threads on here and great advice, seems like Brigadier is the man :_ Anyway I need some major help, the girlfriend is dropping hints to live together and get a place. My credit is terrible I cannot even get an Aqua, Vanquis card or even that Smile card formerly known as Rise, so I need some major help so I can get things sorted. I am in a strange position that I earn a very good wage now, however this makes no difference as my credit is awful due to mishandling of finances when young or in and out of work. I know I have no one but to blame but myself, however I am now in a much better place financially and want to stop my past ruining my future. My credit score on the credit expert site is 96! Yes 96! I know the score means jack, but regardless that is shocking. I have 3 defaults and 4 ccjs. BCW Group PLC Account Type: Home Credit Started: 21/05/2010 Current Balance: £620 Default Date: 14/02/2011 Default Balance: £620 Everything Everywhere Account Type: Communications FCS Flag: FCS Disconnected Started: 29/05/2009 Current Balance: £128 Default Date: 24/01/2010 Default Balance: £128 Motormile Finance UK Ltd Account Type: Mail order Started: 12/09/2008 Current Balance: £195 Default Date: 01/12/2012 Default Balance: £195 So annoying that the amounts for these defaults are pretty low, but its only been recently that my financial position has changed. What can I do to get myself in a better position, I can’t get credit to show that I can keep up with repayments. Any help would be greatly received.
  25. Hi guys, I am looking for some advice on defaults on your credit file: 1. If you have a default on your credit file with an outstanding balance, even if you are paying this monthly, will a lender be able to see that you are maintaining monthly payments while there is an outstanding balance? And even after the balance has been brought to zero, do they just look at the fack that it is a defaulted credit agreement? is it better to try and clear the balance as quickly as possible if i can while in default, or will the fact that I have maintained monthly payments during the default help my rating any? 2. I am aware that a default drops off your credit file after 6 years, but is this 6 years from the date the default was logged, or 6 years after the balance has been paid off? 3. Are the answers to both questions above the same for a CCJ? 4. If I have a debt on my credit file and i'm offered a settlement figure, and this is logged as part satisfied, how badly will this affect my credit rating? Am i better to pay the full balance so that it shows as satisfied?? Thanks.
