  1. Hi Just received the attached today 12th July. I was back in the car 4 minutes before the parking expired I was unaware that there were cameras up and was loitering near the exit waiting for the family to catch up. I thought as I was in the car out of the space that there wouldn't be a problem as I wasn't aware as I say there were cameras on the entrance/exit. I presume i'll have to pay this now, i'll need to pay in installments as my only source of income is my ESA so can't afford even the £60 discounted figure. There is signage up in the car park but I didn't see mention of anything to do with ANPR cameras anywhere, as it was a pub car park with a ticket machine I assumed it'd just be the pub enforcing it. Any suggestions gratefully received, thanks
  2. Hi Everyone, Can you please help me as I got a Parking Charge notice while I was shopping in Asda with my son who is 1. I didn’t have change for the ticket machine and by the time I sorted my son out who was kicking up a stink about the trolley I forgot to go and get the ticket. After I came out I realized I had received the ticket stuck to my window. I have approached the Store Manager who said they have nothing to do with the parking as its not owned by them (which is a load of rubbish) I also asked him for the details of the land owner and he said he does not have that information (again another fob off) then said he sees me there all the time so I must be aware that I need to buy a ticket!!!! Ok I’m a regular and you just fob me off - so much for customer appreciation!!! I have not received anything in the mail yet as it’s not 14 days since this - what is my next step? I do have the till receipt that matches the Parking Notice. Thank you so much in advance

  4. Hello, Once again I need some advice. I parked at the Red Lion car park in Fareham Hampshire on 2nd January 2017. I purchased a ticket for four hours and did not stay over that time. I received a parking charge notice from Parking Eye with a fine of £60.00 for parking for 4 hours and 11 minutes. I did not see it but a camera photographed me going in and out of the car park. The timings were 12.32.10 going in and 16.43.51 leaving. I purchased my ticket at 12.43. I found a space, parked up and waited for a friend to arrive and paid. I have appealed, which of course was not upheld. It seems I am being penalised for 11.5 minutes despite buying a ticket and leaving within the four hours I purchased. The 'fine' is now up to £100. I really feel frustrated and do not want to pay anything. Any advice would be appreciated. Mandy
  5. Hi all will be glad of any assistance. Have today received a PCN done by ANPR from PE for parking near a doctors surgery to collect an emergency prescription. Was there 18 mins. Says £100 or £60 if paid within 14 days etc, usual old rubbish. The timings appear to be in line, 'offence' was on 13/3, received today 25/3. Is my first step to appeal to PE on any grounds I choose eg. the driver did not notice any signs so no contract had been formed, wait for them to decline this appeal and then ask for a POPLA code so that I can appeal on GPEOL? thank you Bob
  6. Visiting Pwyhelli recently when the car was parked in the Home and Bargain car Park while we shopped. We are not from the area. My 4yr old son became ill, first a bout of vomit then made a mess in his trousers. We sought refuge in a local pub to clean him up. My partner had to go and buy new clothes for him. Firstly, I was unaware of the private nature of the car park. I had been there 12 months before in the same car park and didn't notice, I didnt notice this time either. Secondly, I was unaware we had a time limit for its use. We had shopped in Hoem Bargains, I sadly don't have the receipt now. Anyway, Ive had a PCN through the post yesterday The registered keeper wasn't the driver. Here is the summary as requested. For tickets received through the post (Notice to Keeper) please answer the following questions. 1 Date of the infringement - 13/04/2016 2 Date on the NTK - 19/04/2016 3 Date received - 23/04/2016 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? - Yes 5 Is there any photographic evidence of the event? - Yes, 2 photographs. 6 Have you appealed? - No. Have you had a response? N/A 7 Who is the parking company? - Parking Eye. Appeals Body BPA, POPLA are on the letter. Shall the registered keeper ignore, appear or make an offer of reduced payment. I am aware of the BEAVIS hearing ct and his that has had an effect on these charges etc. Date of reduced penalty (£50) to be paid by is 03/05/2016 BO54COL
  7. Just received another lovely one of these parking charge notices' for parking 36 minutes to visit a friend in a hotel for coffee.... Despicable and disgusting, What should I do in this case.
  8. Hi all Looking for some advise with regards to PNC This is on behalf of a friend. He parked in the Auldi car park to do a shop. What he did not do was punch in his reg number. He was there a total of 29 mins (according to PE) He has now received a Notice to Owner, an invoice for £70.00 reduced if paid quickly. He said he is going to appeal. any advise would be gratefully appreciated. Leakie
  9. My wife has today received a PCN from Parking Eye stating that a car registered in her name was in a motorway services car park for over 11 hours! This has come about because the driver has entered the services area via the service road, at 7:07 to access the motorway, they have therefore not parked at all. they have then entered the services again at 18:32 and left via the service road. Looking at the photos it would appear the 1st one is of the rear of the car and the 2nd one is of the front, I would have expected that the 1st should be the front, entering and the 2 the rear, leaving. What is the best course of action with this, I could prove, with witnesses that the car was not in the carpark for that long, as it was 70 miles away on a construction site. would I be best to ask PE which cameras the photos are from or just point out that the car couldn't have been there and I have witnesses to refute the photos.   10. My partner has recently received several letters from PE demanding money as usual with all sorts of threats included. However they seem a bit vague when it comes to stating the actual reason for their invoice. "By either not purchasing the appropriate parking time or by remaining at the car park longer than permitted in accordance with the T&Cs set out in the signage, the parking charge is now payable". Do I write back and ask which term has been broken and ask that if they wish to pursue then send me details so that I can dispute it, or tell them to do one. I guess that we are not yet at the stage of asking for a POPLA number.
  11. Hi, I received a parking charge notice on the 4th August, about an over stay in a 'free' retail park called Rheidol Retail Park in Aberystwth. The date of the this happened was 22/07/16. I overstayed according to them by 23 minutes. It was pouring down, and i had the wife and my three young kids with me, so they stayed in the shop and i went and got the car, the whole thing took longer than expected, which helped us be late out! Its my wife car, but i was driving. I wrote back appealing, but from my wife as the registered owner, not the driver. They requested evidence of purchase, but we have no receipts, only bank a statement of purchase from a store in that retail park. To compound the issue, the bank statement says a different day, but as we were on holiday there and left the day before the bank statement i guess its just a delayed payment. Anyway, got the POPLA appeal number now, so was hoping for a little advice on how to word it? I can't really check the carpark for signs or anything as its quite a distance away. I was also thinking if i let it go as far as court, i guess i would have to go back near the car park it happened in? What do you think my charges of a successful appeal? The Mrs would rather i just pay i think, but hate paying cowboys for nothing. Many thanks.

  13. 28/07/16 My company received a parking charge notice (dated 27/07/16) for £100 reduced to £60 if paid within 14 days. Included photo evidence of me entering private car park in my company car at Thistle Hotels - The Quay Poole time stamped arrival time 09.28 and departure time 12.01 It refers to the signage and to Protection of Freedoms Act 2104 The date of event was 02/07/16 Date issued was 27/07/16 It stated reason for charge as either not purchasing the appropriate parking time or by remaining at car park longer than permitted, in accordance with t's and c's and so was not clear what the breach was for. I remembered that I had encountered problems with the pay for parking phone line and so assumed it must have been because the payment had not gone through and therefore I hadn't paid for parking the vehicle. I immediately wrote to Parking Eye (dated 28/07/16) and appealed on that basis. Parking Eye response was unsuccessful. The response now stated that it was because I had not paid the correct amount for the time parked and provided an appeals reference for POPLA. With the new information I did further research and discovered via the Pay for Parking web site that I had paid for 2 hours parking commencing 9.52 so in actual fact I was only 8 minutes over 2 hours when I left the parking site at 12.01. The time between entering the site 9.28 and the payment going through 9.52 was taken up with finding a space, going to the payment machine to read terms, taking down phone number and site ref for pay for parking, returning to car and then making 4 phone calls to pay for parking because I first had to enter new debit card details and then there was something wrong and the payment would not go through ( I have print screen from call logs on my phone that day showing calls in my attempts to pay for parking at 9.40, 9.44, and 2 at 9.51) In conclusion I was delayed in making payment due to issues with the parking payment system, I did pay for 2 hours, I was 8 mins over (I am allowed 10 mins over) I am therefore not in breach of contract. Once I realised this I made a second attempt to appeal with Parking Eye via the website, due to time limits, I didn't receive a response to this appeal, and I had subsequently now missed the timescale to appeal via POPLA. I received a further notice to pay and then a court claim was received sometime after 24th October. I have sent an acknowledgement of service via the money claim website so I can further defend the claim. I would be most grateful for any advise on the best approach with regards to the defence I put forward.
  14. I have received a county court claim from Parking Eye and this has now been passed onto the local county court. I have a reply to complete as I have contested their claim. When the car was parked I had to wait for an auction house to open so that I could collect an item. The car arrived at about 8:30 and the auction huse opened at 9:00. the car was then moved to the entrance to put the item, a very large smart board into the car and it would not fit ... so much so it got stuck in the doorway and this took us over the hour by about 10 minutes but reading above the cart was not parked all of that time in one place. Parking Eye have decided to pursue me the owner for the claim but they do not say nor do they indicate who the driver was, they are just assuming I was the driver. Can anyone give me any ideas of what I might use as my defense in court? or even if I should contact PE prior to the hearing, which hasn't been decided yet. If this is a new thread can someone please move it to one for me please?
  15. Hi, I recently lost an appeal via POPLA for a PCN. I never received a reminder with regards to the PCN having to be paid (I do have issues with mail in my flat, so things occasionally get lost etc). The original cost would have been £80. I now have a letter from Debt Recovery Plus stating that I owe £160. When I go back to the PCN website to pay the charge, it states it has been passed onto debt recovery. I know in the past the advise has been to ignore. However, a friend of mine did this continually and eventually had bailiffs round clamping cars etc. I have appealed tons of tickets and won via POPLA so am a bit lost at this stage. Is my only option now to pay the £160 to DRP? Thanks in advance.
  16. Can someone please give me some advice on what to do next? I parked in a Parking Eye carpark and paid the appropriate fee. I left before my time was up. I then received a fine and it appears I only entered half my car number rather than the full one. It's a small carpark so it's perfectly obvious that no one else parked there with that combination of letters at those exact times. I've since checked and there IS a sign (set very high above normal eye level when using the machine) saying that I should enter the full number, but it's not a carpark I've used before so I didn't notice. I appealed to Parking Eye who offered to reduce the fee to £20, then I appealed to POPLA and this has been turned down. Could someone suggest my next move. Should I just pay up - the fee is now in full again? It seems so unfair as I paid for the time I was there and they aren't suggesting otherwise. Can someone really "fine" me in some enforceable way for not entering my car number properly?
  17. I've noticed the Police waiting around in the car park at our local Supermarket. It strikes me that parking enforcement ANPR cameras could be a useful source of intelligence. Does anyone know if this is being done? is there a Data Protection Act issue?
  18. I have used this hotel fairly often for many years for business meeting when i surprisingly received a parking eye fine after a visit in february this year. I used the cat park for 30mins as my meeting was cancelled and I bought a coffee but apparently i never gave my registration number to reception on leaving? There is no ticket machine and literally no signage back in feb. I never knew they had introduced parking restrictions on their carparks? I went to the hotel again after ignoring the letter and spoke with the staff on reception - they too me that they had loads of complaints and that they had now had to outsource the appeals to a 3rd party company and could i deal with them. I noticed (took a photo) that they have now put an A frame sign outside the main doors telling to give your registration to the hotel on leaving and it is a free carpark for hotel guests and users of their facilities. Their staff said that they introduced new parking rules back in October 2015?, because so many people were dropping off their cars all day / week and going on holiday etc? I was only their 30mis and their photo shows it. Q. has anyone else put this one to bed recently or have any wording that i can put in a letter to appeal it. I don't want to ignore this one as I'm furious!!
  19. Something i spotted recently, but thought i would test peoples level of observation of everyday life. Clues. Something you see in supermarkets and cupboards at home. They can be very convenient, particulary to elderly. There are now fewer of them, but have you noticed They begin with the letter R. What is your guess ?

Yes “On the 20 May 2016 vehicle ‘reg correct’ entered the Marriott Huntington car park at 11:18:00 and departed at 13:36:24 on the 20 May 2016 May 2016. The signage, which is clearly displayed at the entrance to and throughout the car park, states that this is private land, the car park is managed by Parking Eye Ltd, as a permit only / paid parking car park, what parking tariffs apply and the parking charge applicable without the appropriate permit or payment of the appropriate tariff when parking, along with other terms and conditions of the car park by which those who park in the car park agree to be bound. By either not purchasing the appropriate parking time or parking without a valid permit, in accordance with the terms and conditions set out in the signage, the Parking Charge is now payable to Parking Eye Ltd (as the Creditor). You are notified under paragraph 9(2) (b) of schedule 4 of the Protection of Freedoms Act 2012 that the driver of the motor vehicle is required to pay this parking charge in full. As we do not know the driver's name or current postal address, if you were not the driver at the time, you should tell us the name and current postal address of the driver and pass this notice to them. You are warned that if, after 29 days from the date given (which is presumed to be the second working day after the Date Issued) the parking charge has not been paid in full and we do not know both the name and current address of the driver, we have the right to recover any unpaid part of the parking charge from you. This warning is given to you under paragraph 9 (2) (f) of Schedule 4 of the Protection of Freedoms Act 2012 and subject to our complying with the applicable conditions under Schedule 4 of that Act. Should you provide an incorrect address for service, we will pursue you for any Parking Charge amount that remains unpaid. Should you identify someone who denies they were the driver, we will pursue you for any Parking Charge amount that remains unpaid” 5) Is there any photographic evidence of the event? Yes 6) Have you appealed? Not directly to Parking Eye. I contacted the owner of the land Marriott Hotels on the 08/06/2016 and they contacted Parking Eye confirming I was a guest at a meeting and requested the charge be cancelled. Have you had a response? No 7 Who is the parking company? Parking Eye For either option, does it say which appeals body they operate under: Independent Appeals Service (POPLA) If you have received any other correspondence, please mention it here I received a further notice from Parking Eye on the 30th June stating the charge had now gone from £65 up to £100. And I had/have 14 days to pay it from the 30th June I assume. The Marriott Hotel advised me I didn’t need to contact Parking Eye as they would deal with it. After the second letter I contacted the Marriott again and they again emailed Parking Eye asking them to cancel the parking ticket. I am seeking advice on whether I should contact Parking Eye directly, what have other people experienced when the landowner attempts to cancel the parking charge? I am in the wrong in terms of the parking ticket I missed the multiple signs (new arrangement with Parking Eye and I just didn’t realise) Thank you for your assistance. Audrey

Dear All, My daughter back in May received 2 Parking charge notices from parking eye for her car being parked at Charnock Richard Services on the m6 north, she checked the dates when her car was parked and being that i am the only other person to drive her car and plus the fact she rarely drives on the motorway it was clear that it was in fact me driving the car at the time, when she called parking eye she gave them my details to which i do not have a problem with. Now i have the 2 parking charges and they are asking me to pay £100 for each of these or £60 each if i pay within the 14 days of this order being sent to me, i spoke to parking eye this afternoon and they have said it has been put on hold for 14 days to allow me to appeal and after that they will pursue it further, i have seen a few appeals have been won by not clear signage and parking eye not being the landowner etc i am wondering if this is the case and how do i go about it. I would really appreciate it if anybody could help me with this.
  22. My Uncle and Auntie parked their vehicle on Cheetham Street, Rochdale end of April and paid for 1 hour parking. Returned to their vehicle after 1 hour, by time they went past ANPR camera the time had elapsed by 2 minutes. Received a ticket through the post for payment of £100 which they will reduce to £60 if paid within 14 days. Auntie was with disabled husband at the time of the incident and this is why they were slightly over the 1 hour mark. Any advice would be gratefully appreciated. Thanks
  23. I received a claim no form on thurday from parking eye for 175 pounds. I drove into a car park in Liverpool city centre around 4am to pick my nephew up from one of the clubs. the car park was partially full and the available spaces were by the entrance where there are few youths lurking around I drove around instead hoping I will find a space that is lit and open or maybe they would leave. Neither of those happened so I left the car park after 11 minutes (didn't get out of my car throughout). Two weeks later I received a letter from Parking eye requesting 100 pounds or 60 pounds if I pay within 2weeks I wrote to them explaining the circumstances but had no response and I could not find a number to ring them on (the only number on the ticket is an automated pay line). I had the claims in the post on Thursday from them requesting 175 pounds . Could some one advise me on how to defend the claim please??

Hi Guys im completely new to all this and not sure what to do with this notice i recently visited a shopping complex not in my home town never saw or noticed any parking signs or meters (any obvious ones) and now i am expected to pay this fine £50 by 27th march or £85 thereafter what should i do any advice would be much appreciated im worried if i ignore it something bad will happen i am also the owner of the car my dad being the registered keeper so he received the letter thanks in advance
  25. Hi All, sorry to trouble you. I just don't understand this. We went to drop off some family guests (who were from overseas) that had been staying with us to Leonardo Hotel Near Heathrow. The entrance to the hotel is a via a private drive to the rear. We helped them with their luggage, helped them check-in - at no point did the staff ask us whether we had a car or any charges for waiting. The check-in took over 15mins, we then helped them with their luggage to their rooms and said our good-byes and left the hotel. Received a PCN just a over a week later stating we had stayed 40mins and charge is £100 discounted to £60 if paid within 14 days. I rang the hotel, the unfriendly staff went on the defensive, saying there are 19 signs all round the hotel, in the lift etc. How does a hotel expect guests to be dropped off - just park up and throw the luggage out and wave out the car window as we speed off in fear of getting a parking charge. This is really below the belt behaviour. The hotel sent a short abrupt email stating that I had to call parking eye to deal with any issues - the number they gave me is the payment tel number which only deals with payments. Please could you advise what is the best way to do deal with this. I would normally ignore these type of letters, but I understand Parking Eye typically takes people to the court. Thank you.
