  1. Hi everyone, been searching through the forums looking for answers to my debt worries, my head is swimming with information. My story starts approx six years ago when due to ill health of my partner I gave up work to look after her, unable to feed herself or do just the basic things that you and I take for granted, our lives changed rapidly for ever and with this came the debt worries so I was able to freeze the interest six years ago and begun paying the nominal £1.00 for each debt every month. Slowly but surely this year most of our creditors have dropped off the credit files with me having just two left that come off in May 2018, and my partner has just one left. Could you advise on this: 1.My partner's credit file shows just one creditor left on her file but there is no default date, therefore, I assume it will stay there for ever unless settled. it is shown as being owned by a DCA. and not the original creditor. How do I proceed to get it removed? 2. Assuming that all the creditors are gone from our credit files ie all older than six years do we continue to pay the £1.00 for ever to the DCA's or can I stop, I have never missed the payments with the DCA's are the debts un-enforceable now? we have no CCJ or been to court I presume because of our circumstances. I thank you in advance for your help.
  2. Can any Southwest Water customer legally be issued a debt demand and then be taken straight to Court for a CCJ with no defence ? Southwest Water debt letters and their CCJs again, they seem to be the bane of people's lives. Hi, to save starting a new thread I'll use this for Southwest Water "debt", which looks to be a Southwest Water Christmas [problem] . An elderly member of my family lives in a retirement complex, and received a demand for a Southwest Water debt, with a County Court claim (leading to a CCJ) just before Christmas 2017 (dirty trick really, there was no time to defend it). She's usually very good but she's somehow upset these 'people'. It seems she received a Southwest Water demand letter for over £200 which apparently was for the year. I know she's always paid her bill at the Post Office, so the SWW demand and the resultant CCJ are a mystery. Today the Court letter came and she's now got a CCJ for six years; obviously she admitted the "debt" either to save herself trouble or out of some sense of duty. The same trick was played on a neighbour last year, just before Christmas. My conclusion is to beware.
  3. Not my debt fraud hat trick I have been reading some of the past posts and found them very helpful. But I would like some help with my own problem set out below About five years ago the payday loan company Wonga sent me a letter claiming I owed them money. It turned out someone had used my name to take out a loan. With the help of my bank and a representative from Wonga it was established that they did not have my banking details and had not taken any money out of my account. I was asked to contact the police by Wonga to report an identity fraud. The police said because I had not lost anything to the fraudster it did not warrant a crime number but the incident would be logged. Although I ‘am sure I would not have thrown the letters away, I cannot find them. Early this year I was contacted by B W Legal representing PRAC financial, claiming they had acquired a debt from Instant cash loans ltd. T/A Payday Express. I owed them £850.80 No other details about the loan were in the demand. I ignored their letters as I have never had any Payday loans in my life. I have never had any letters or any contact with Payday Express. It turns out when they threatened me with court action the details in the letter of claim i.e. the date the agreement was signed coincided with the time of the I.D. fraud with Wonga. The 26th of November 2012. In June I received a letter from Moriarty law representing Motormile finance Limited (MMF). They claimed I owe them £468.87 from a debt they acquired from Lending Stream Limited, again no information on the debt. I sent a prove it letter and a supposedly copy of the agreement with my name and address on it arrived, The date the loan was taken out is the same as the other loan 26th November 2012. I have not lost any money but the threats from the debt collection agencies to take me to court and wreck my credit rating have made life in the past months stressful and unpleasant. How many other loans have been taken out in my name? I do not know Thanks d.bick
  4. Hello all, Friend of mine asked if I can check something for him. Is his debt written off after 6 years? For example letter had arrived today from DCA and debt last payment he made was on 01 Jan 2012. That when he made last payment. Does DCA 'reset's almost 6 years period of time? Thank you!
  5. Hi All, After many years of stressful negotiations, hard work and lots of help from people on here - I have had a clean Credit File for the past two years. All of my old Debts are off and I have been able to move on with my life credit wise(ly). There are a couple of accounts still active on which I am just paying a token amount of £1 on. I wont go into the details, but basically I'm going to stop paying the token amount - my total Debts add up to about £7k over 5 or six accounts and the amounts vary from £200 to £2k. Basically, I'm just going to stop paying them. They have been getting paid for around 10 years and really, I want to put it all behind me for good and move on. My worry is, if I stop paying them - although they are off my Credit Account, can they reappear in the form of a CCJ etc if the DCA brings action against me? I'm not asking for a morally opinionated answer, but rather a can they come back to haunt me ? Thanks in advance!. Scotty
  6. Over the past two years i've racked up an incredible amount of debt, it reached as much as £60k last Christmas but this has now come down to c£50k. I have a gambling problem which is where all this debt comes from and which is why its so hard to shift. The pressures of this debt, personal relationships and job insecurity have started me feeling anxiety and stress related symptoms, i don't want to over-egg this but going to the GP recently i realised that things had to change. As you can imagine the largest problem i have is being reliable with any substantial sum of money in my account. I'm currently living at home with parents and need to move out by March/April, i'm finding this difficult for budgeting purposes as i don't know how much its going to cost me in the future and i'm already struggling. My Debts are as follows:- Sainsburies Loan - c£11k Halifax Card - £9k IHG/Barclaycard - £4.5k Virgin/MBNA Card - £4.5k Nationwide Card - £4.5k Amex Card - £3k Currys/Creation - £2k Onstride Finance - £2k 118 Money - £1.9k Marbles - £1.2k Paypal - £1k Very - £700 In order to make ends meet i've also taken out several phone contracts to sell the handset, this means that i have about £150 pcm expenditure on line rentals across 5 contracts. Current salary brings in about £2490 per month, minimum repayments for all of these are approximately £1900. So if i was continuing to live at home and if i was able to not fritter away my entire pay packet within 7 hours of it hitting my bank account then i could get by. Unfortunately neither of these are true. I'm considering making a change to my working situation resulting in less hours and a higher pension payment (thankfully money i can't access to waste) which would bring my new salary to c£1800 per month, out of that i would estimate £800pcm for rent and bills, £450 for day to day expenses. So i can't work out whether i can put myself through the mass defaulting stage, i don't know if i can bear the constant calls, i don't know how easy it will be to get a place to rent with a wrecked credit file, i don't know what to do right now. I'm currently asking the gaming company for a partial refund of my recent deposits (After i've self excluded), if that provides a decent return i can keep going with the regular payments for a bit longer but its no long term fix. My dream is to own my own home, trying desperately to work out how i feel about pushing that out another 6-7 years. Also wondering if i should leave open the Halifax account or pay separately as its still on a balance transfer offer and presume it would be good to have one high value account with history when looking to get a mortgage down the line... Bit of a stream of thoughts there but i'm really at a crossroads, mostly 0/1 months behind and its about to hit the fan.

Hi, Sorry I don't know a whole lot about this but I have suddenly had three old debts pop up from different debt collection companies threatening me with further action etc. It seems to have happened as I made an inquiry with a PPI company a few months ago but didn't bother going any further and I am now wondering if that has opened me up to all of this. I think these three debts are statute barred as I have not made any contact whatsoever or made any payments or acknowledged the debts for at least 7 years, maybe longer but knowing how sly some of these companies can be, I wouldn't put it past them to fake an acknowledgement or some form of "contact" and so it worries me about emailing them or writing to them and stating that these are statute barred debts. I am worried that they may try to trick me. How can I prove that I have not made any contact for all of these years? They could easily just say oh yes you have...I don't understand. Can anyone please give me some advice on how I can stop these writing to me and making threats or maybe give me the best wording to put in an email? As saying "you can not enforce this is as it is statute barred" is in itself admitting to the debt I suppose. Also, there is no doubt it is at the very least 7 years since any contact was made.   8. Please can you tell me the best way to deal with Store Card Debts? I have two which I have defaulted on. John Lewis and M&S. These cards were both originally taken out pre 1997. I cant find any of my paperwork pre this date. I have been paying a minimum amount each month of a £1 for the last 5 years and they are both pressing me at the moment to send them an Income and Expenditure form which personally I feel is none of their business. What should I do? I presume if I stop paying them anything they will send straight to their solicitors? Amounts outstanding are around £5K on each I do not have an income at the moment Thank you

Debts to hand: HSBC Loan 4,408 Sainsbury Loan 22,271 MBNA 6,453 Overdraft 5,000 Barclays 3,400 Never defaulted historic I have now cancelled all DD and moved some funds to a neutral bank account. Overdraft already sent first message of daily fines etc etc. I have been doing my research and had already applied to SC DMP plan. After further reading I intend to delay this for 4 months to allow one a emergency egg to build and two allow some room for some of these lenders to default. Am in a position where I could be saving 1k a month while not paying fee's . Most of the debts are less then 5 years old I don't think the consumer credit requests will help much. one cc is 2005 I will issue them all with consumer requests in the next day or so. LI will also send a letter over the next few days advising of difficulty, asking for interest to be stopped and to have some speedy defaults. I will outline a 4 month window and that am working with SC in this matter. Ideally I want to get into a position where they all default to stop this AR stuff I have heard of stretching this out for 13 years. Hope to freeze this interest off fairly quickly I will also put in my not to make this journey by mail no phone calls thanks you etc. All my debts are unsecured, I live with my partner whom mortgages this house. We are not financially linked. Trying to get in a position where these debts go to the debt collectors for F & F down the road. Thanks for hearing rambles I think I have come up with the best option atm. I reviewed IVA or bankruptcy but felt this route could be the best one if all lenders can default within 6 months so this isnt stretched out more then 6 yearrs
  10. Hello. At the moment i have five credit cards totaling £7500. most are balance transfer cards and some are coming to the end of the offer. oldest card is about 3 years. (MBNA) i am finding it difficult to keep up payments (not currently working) with the cards and usually end up robbing peter to pay paul. i have a disposable income of £80 a month and at the moment card payments total £110 which will rise after christmas due to interest being added on mbna card MBNA i owe £4000. currently pay £45. i also have another mbna card with a 0 balance what i would like help with is, would i be better off using my other mbna card to clear the other £3500 debt and just then deal with mbna? instead of multiple agencies. ? don't want to fall behind with payments but i dont know what else i can do thank you
  11. eon are using LCS ( debt collector) to chase for Limited company debt, company no longer trading - Dissolved in February 2016 eon have changed the name on correspondence from "XXX Limited co" to ( Directors name T/A XXX ) i wrote back to LCS stating LTD company is separate legal entity - and that they cannot simply assign the debt to the previous director. I also asked for copy of any agreements, signed documents, copies of any bills etc as i believe the bills will have xxx ltd ( Not TA) Is this Practice legal - surely there is an illegal re-assignment attempt here - what about VAT ?? they cant retrospectively go back and change names on invoices and reassign the vat .... Now i have a CCBC claim form for the above I have filed an AOS stating i will defend complete claim. Any help or advice welcome

Hi All, i have 3 debts Capquest are writing to be about - Student loan (old style) £4000 - Overdraft £1000 - Orange bill from 2005?! for £380 firstly i sent them a template on here 'i dont acknowldge...' CCA request, nothing yet more letters, i recently sent them a 'prove it' style - They finally replied. - Student loan letter they have not responded to? Shall i send a letter again? I did request a CCA from Erudio and they sent me pieces of this - Overdraft response was very generic: 'We have been advised by 'bank' that section 74 of the CCA 1974 provides that an overdraft on a current account will not fall within the documentation requirements of the CCA. Therefore we are not providing a copy agreement for the above' Doesnt leave me with a very good idea of anything right? - Mobile phone bill - they replied with the following: '- This debt relates to Orange..... - Account was taken out in 2007 and purchased by Arrow global in 2010 - The account defaulted in 2008' Am i right in that this debt should no longer be active. Firstly im NOT aware of it at all, they have show no CCA or proof, and isnt it statute barred now? Still on my credit file. My uncle has been kind enough to lend me money so i would settle, but first off i dont know who the hell Capquest are and they are not responding accordingly to me. Any advice is appreciated Many thanks

Hi again This is my second thread in regards to an ongoing problem Unfortunately my mum has been left with debts that she has no idea about from her marriage which has broken down These debts are with PayPlan at the moment who are paying all creditors each month with a lower monthly repayment and 0% interest. This plan was set up between her and my dad when they were together as she could not manage her repayments She has now asked PayPlan to send her a summary of such debts which are in her name. On the summary it states that 4 debts are to Barclays and 1 to LINK. The references suggest that 1 is a loan that we know about (see my other thread). http://www.consumeractiongroup.co.uk/forum/showthread.php?479075-Barclays-Personal-Loan It looks like another is a current account as they said it was in 'joint' names and I know joint loans/credit cards do not exist. The reference is 5082XXXXXXXXX which also suggests it's a current account because the sort code of our area is 20-50-82 so they've missed out the '20'. The only thing that doesn't make sense is the fact it is followed by 9 numbers instead of 8 so we cannot use it as an account number. The other 2 seem to be credit cards that have reference numbers on there. We went into branch today and the member of staff could see the loan that we know about and some closed credit cards which do not match the reference numbers for the outstanding debts. He could not find any other accounts in her name. PayPlan have confirmed that the LINK debt was a Barclaycard so I assume that because the other 4 debts are still displaying 'Barclays' rather than a debt collector the debts are still with Barclays. Am I right in assuming this? Obviously we know that the 1 loan is still with Barclays as they could find it on their systems, but nothing else. So as you can see I've done a bit of digging already and ultimately want to make sense of it all because my mum is clueless as to why there's so much debt in her name on this 'plan'. They claim this is her section of the plan they had between them, as these debts are apparently in her name. I want to identify each debt and also see proof that these are actually hers to pay. As you can imagine this can seem like an impossible task when only 1 can be found on their systems. The LINK debt will have to be dealt with by LINK as far as I know. Any advice to tackle this would be greatly appreciated.
  14. Hi all I am after some advice. I am currently on a DMP through Step Change and I have been paying £422 a month for about 3 months now. I am due to inherit some money so I want advice on paying the debts or ‘settling them’ as I have seen in previous posts. Full and final is what I have seen crop up a lot. The balances are as follows; £27,814.00 – Sainsburys Loan showing as ‘1 month late’ on my credit report £2,265.00 – Halifax Overdraft £2,028.13 – Halifax Credit Card £3,826.00 – MBNA Credit Card showing as ‘1 month late’ on my credit report I have seen posts about offering 20% to each firm, can someone point me in the right direction for templates ect. or advise what I they recommend I should do. If I can get them all settled and get myself off the DMP how long will my credit file be effected for? Thanks, Sam
  15. At the beginning of last year, after my wife lost some disabilty benefits, we ended up getting into debt, mostly small but included a credit card just over £3k. My wife has since managed to get back on top with all but two, and I will shortly be in a position to clear most of mine, apart from the credit card. If I was to clear some of these debts by offering a settlement of (say) 50% and (say) offer a grand as settlement of the credit card would this be a detriment on my credit rating? We will be moving to private rented accommodation in September and want our credit rating to be as healthy as possible.
  16. Hi Caggers I have spent a long time reading through old posts and have a headache! My situation is thus. I have approximately 80k of old CC and OD debt mainly on accounts started 2000 to 2006. some possibly a bit later. I fell into arrears etc in 2010 as a victim of the 2008 crash! ( I held on as long as I could) all of these debts are now off my credit rating file except for one which is with cabot from a Barclaycard that was taken out in 2000 and should have defaulted in 2010 along with the others which barclaycard have sold and closed and cabot is still marking my file as up to date with a £1 payment I have been paying various credit card companies direct and some through DCA's (Cabot CDUK Moorcroft PRA etc.) between £1 and £5 a month for the last 7 years. They don't hound me and seem to renew my arrangements automatically every 6 months, (they send me a letter which i ignore and then another saying they will continue the arrangement) The issue is I would like to remove this debt from my neck as although it is not strangling me it is weighing me down and I am not in a position to pay it off. I could possibly offer about 10 -12% as a F&F settlement with the help of some family members, but wanted advice on whether I would be better of CCAing anyone first and using that as a bargaining tool? about 25k of the debt is a Barclays overdraft, there is one santander loan and the rest are CC's My mortgage (Current and up to date) is also with santander - would this harm that.   17. Hi All, I'm looking for some advice regarding my debts because frankly I'm an idiot and don't know where else to turn. My situation is so: I have £10k or so left on an unsecured Natwest Loan which I originally took out back in 2015 but have rescheduled a few times, I'm pretty sure it's supposed to run for at least another 4 years at around £300 a month. I also have £1900 on a 0% credit card which doesn't run out till September 2019. I will however pay £300 or so off this next month. I also have phone and tablet contracts which run to about £960. I move to Canada at the end of August to start a doctorate, they are giving me enough scholarships to cover my fees and have about £10k afterwards. I'm intending to look for a part time job over there and can work up to 20 hours a week during term or any amount of hours during the summer. I originally was in a job where I earned £26k pre-tax so going from that to £10k even living as a student will make it impossible to cover my debts. I want to find some way of paying my debts off and definitely want to avoid bankruptcy, an IVA or anything of the like as if I wanted to stay in Canada the immigration authorities would, from what I understand, take a very dim view of it. I've spoken to a debt charity who have said they probably could help but are only willing to speak to me properly after I've finished my job on the 20th of July. I would like to try and sort something out before then so I can stop worrying and beating myself about my idiotic credit habits! It'll also the last thing I need when added to the stress of having somewhere to live in Canada etc...etc... Many thanks in advance for any advice anyone can give me
  18. Hi. Long story short. I have outstanding debts with HMRC going back to 2005, mostly due to not filing my SA returns. Most of it is fines and assumptions of my earnings, even though I probably haven't earned more than £5-8000 a year since the first year. We've lived hand to mouth since then, and hidden from our responsibilities, and the debt is now over £9000. I accept that due to me burying my head in the sand, it is entirely my own fault. My question is this. I am about to take one of my private pensions as a lump sum (around £40k) and I need to know whether HMRC will help themselves to everything they say I owe, before I'm paid out. I realise that I will be taxed at the emergency rate, and that they may well keep the overpayment to clear my debt, but that wouldn't cover it all. Can they take any more to cover the balance owed? Thanks in advance for any advice.
  19. My father made 4 separate CCA requests for 4 different debts being pursued by Cabot. For each of them he has received the attached response which states that they are unable to provide the info for the moment and will continue to pursue the original lender for the information. They say the account will 'remain on hold' but are 'still obliged to repay the outstanding balance'. We wish to settle this matter and are willing to make a percentage payment to clear the debt. I am tempted to write back a letter as in this post http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/266261-calder-financial-offer-clear-2.html#post3017541 . What does everyone think is the best way to settle these debts without prolonging the matter too much (my father is dealing with 17 creditors at the moment!)? cabot.pdf
  20. Hi All. I've an old statute barred debt with a credit card with Bank of Scotland / HBOS and I'm sure that I was sold PPI as part of this. Last contact was 2007, so we're talking well over statute barred timescales. The question is - should I put in a PPI claim, or will this end up being swallowed by HBOS ( the remainder of the debt was in fact charges and interest and I told them I wasn't paying that, as it was unfair - I'd paid off what I owed them as the capital amount).   21. Hi, My partner has run up 2 credit card debts. He found himself out of work in December and has now just become employed again. I am thinking it might be best for him to write to them asking them to freeze the interest and accept a monthly payment that he can afford. I have the letter from the templates, but cannot seem to find a template for a financial statement to send to them. Can anyone point me in the right direction of where I can find said template please? Thankyou

Probably a common story my daughter is over twenty thousand pounds in debt, lived with a bloke who made promises after promise, had a child with him then finally saw the light but had kept mum & dad in the dark as it was too embarrasing so too late. She organised a dmp with step change now lloyds are saying their agreement only lasted six months, and want to increase her payments, she earns just over 16k before tax but rent is 695.00 food etc on top so bank of mum and dad have stepped in to buy food and clothes. told my wife and I to take custody of her daughter now I feel I must step in and see what if anything I can do, not impressed with Lloyds because they are threatening baliffs etc, but she owns nothing, tv in her house is a loner from me, bike she rides to work is her sisters, no sky etc, laptop loaner as well. they just do not seem to comprehend you can not get blood from a stone. She works believe it or not for an fca company and states if she gets a ccj etc she will lose her job which is why she did a dip. Can any one advise me what I could do for her, I was going to write to Lloyds and say you are causing her extreme distress and can not get blood from a stone but feel sure there must be someithing more formal I could write. They are aware of her circumstances and frankly I feel that they trapped her into this cycle by offering overdrafts to pay loans they knew she could not afford. it is not the banks fault however, it is the waste of space she called a boyfriend who sat on his arse whilst I helped pay the rent etc even after his child was born, not going to see her homeless after all. She was an idiot to fall for his lies but now I have to try and fix things as best I can so any advise would be welcome. :mad2:
  23. Hi there. Total newbie here. Any advice greatly appreciated!! I got into debt a few years ago. Payday loans the lot (multiple - it's embarrassing. I was a young stupid single Mum). Now in a decent job with teenage kids. Went into a DMP with Debt-line who then were sold to Lawrence Charlton. Have been paying £130 a month dutifully since 2013. Although the charges went up significantly when Lawrence Charlton took over I felt safe so kept on with it and owe about £18k to my creditors now. Lawrence Charlton are stopping all DMPs and said I should transfer to Payplan. OK, except they are offering an alternative too; solicitor advice regarding writing off debts that have been bought by a second party (which is most of them) as they "may not be enforceable". hang on a minute, have I been paying companies which I didn't need to for years? Can't I sort this myself? Or Should I just be responsible and set up a DMP with Payplan instead?? SO confused!!
  24. Morning All, I have been battling with Lowell for a few days now I am looking for a bit of advice. I'm not at all clued up on legal jargon so I'm not sure what to do next. In a nutshell, I'm a teacher just starting to think about buying a house. I've always paid off any contracts that I have and cancelled them under the 30 day grace period respectfully. Upon looking at my credit rating I noticed that it was horrendously low (503) I checked through Noddle why this was the case and Lowell have been defaulting two supposed debts... I have emailed Lowell asking what the debts are for the email states: Account Number Original Client Original Client Reference Current Balance Initial Contact Date 25* Three Mobile 9* £20.08 29th April 2013 15* Orange 7* £65.11 30th December 2013 The former Three Mobile account was opened on the 2nd April 2008. The client last receive payment for this on the 1st April 2011 for £20.08. The number associated with this is 0* the tariff was Broadband 5Gb (18/24 months). The balance is made up entirely of airtime debt. The former Orange account was opened on the 28th April 2009. The client last receive payment for this on the 7th March 2012 for £31.96. The balance is made up entirely of airtime debt. As you can see from the dates I have cancelled the contracts well over the 24months (I held them both for almost 3 years!) So when I cancelled I rung up and told them. I'm assuming they continued to bill me for an extra month. I asked for evidence of the Notice of Assignment. He has just forwarded two letters, not letter headed I might add with some glaring mistakes... This is the Orange letter: Dear Mr McGirr We hereby give notice of the assignment of the debt due to us (trading as "Orange") from you in respect of the balance of £65.11 outstanding on your account. On «ClientClRegdate» your account was sold to Lowell Portfolio I Ltd. It is essential that all future payments, correspondence or queries regarding this account be directed to Lowell Portfolio I Ltd quoting reference 1*. Contact Address: Enterprise House 1 Apex View Leeds LS11 9BH You'll notice the "On > as part of the letter... The second letter that was linked to the three account had the wrong address, four doors down. What are my next steps? I want this removed for my credit rating ASAP. it's 2008 !!!   25. Hi all not been on here for many years but i hope im asking in the right forum, if not please move Ive got a DMP had it for several years slowly steadily paying my debts off . The thing is my dad owns a few houses and to offset any inheritance tax he's thinking of putting a house in my name, now if he does and i sell the house ill have x amount in my bank and if my creditors see it they will want or even might want their share. I want to put the money into a project that will earn more money which means i can pay my creditors off when it suits me Now my question is: can i put my dads or someone elses bank details on the conveyancing form so the money will not go into my own bank account? Or is it a legal requirement that the house owner has to put their own bank details for any monies to be paid into? thanks
