  1. Cabot have been chasing me for a debt on a BOS credit card from 10 years ago. I've been ignoring the letters and they've now said my account has now been "reviewed for legal action". How should I respond to the letter?

  3. hi all, I have a ccj with Cabot for over £7000 which I have been paying regularly for atleast the past 10yrs. i have started receiving letters from them stating:- "We need your attention - potential legal action", "your credit file indicates that your situation may have changed", The ccj relates to a loan from Bank of Scotland, my situation has not changed, my only income is carers allowance (all other benefits go direct to disabled wife). i do have other debts and pay them off at the same rates per month £5 each, at least one of these debts is held by cabot. at the bottom of the letter there is a brief explanation of what legal action could mean but that refers to a ccj. any thoughts on this would be gratefully recieved sorry if this post is a bit rambling volac123
  4. Hi, I'm typing this from a tablet so it will be to the point. I got several texts from this company trying to bluff me into ringing them so I googled them, saw what they did and decided to ignore them. Next arrived 2 letters saying that I owed them £24,000 for an account they bought from HBOS! I've never had any accounts with HBOS and I do not know what the heck is going on! I've read that these parasites are in the business of phishing for debts etc. What can I do? Is there a letter I can sent them to get them to feck off? Thanks! Norm
  5. Paypal-Does anyone have any problems with them.On Ebay or any other site. I say this because in the last 4 weeks on Ebay my Paypal account has slowly closed on me. Only able to access it at strange times of the day,say 12 midnight or perhaps as i get up early 4 or 5 am. Then a few weeks ago i could not access at all. Usually it says DNS server cannot be found,but everything else in the world can be found. So i am selling on ebay and receiving payments paying postage but cannot access my Paypal account. So really for myself Paypal has turned into a great big savings account with no interest. I personally now have lost all faith in Paypal and looking for an alternative. This might cost me sales but all my eggs are never put in one basket.Just in case. Now this morning at 4-30 by some miracle i managed to access Paypal,i am honoured to have received this privilege.I will send them a letter thanking them. Due to the way things have been going i withdrew my hard earned money and transferred it into my bank whom i have much more faith in. This is what i have been checking each day as my frustration grew.Check it out if you feel so inclined. See what some are saying here and there.And of course is it accurate. This account limitation will affect your ability to: Send or receive money Withdraw money Also, you won't be able to: Remove any bank accounts Remove credit cards Close your account Charming,clearly they are the powerful ones and can do what they want at any time. I am invited to go to the resolution centre and say what has happened. If i manage ever to sign in again. Why i withdraw my money instead of leaving it in their hands. Anyway i just wondered what anyone else thinks of Paypal lately. And what are the real alternatives to Paypal when on ebay etc. Thanks Tawnyowl.
  6. I have a few debts with Robbers Way and I want them cleared off. Really fed up to back teeth of dealing with them. A friend of mine will kindly borrow me the money and I would sooner pay her than these vultures. Debts I have is an overdraft which Santander closed back in 2010. I have been on a repayment plan offering them £5 ever since. Paid each month and on time. Current balance around £1,200 A credit card which is about £300.00 again similar arrangement. Now what do I offer them? I am on benefits.....I did offer £100.00 and told me NO before. Is there any formula i could use to determine what I pay and ask for help off my friend for. I do want to keep it low as possible but I want these now off my back. Any advice on what to offer...and if they reject it what to do>?
  7. I've done some reading but it's hard finding the answer. Since private companies can't fine you, what realistically happens if you just ignore them? Do they have any mechanism for forcing payment? I understand they could sue under contract law, but what are the odds of that?
  8. Hi everyone I received this hand delivered letter today from Debt Management Services LTD. They say they are acting on behalf of Bradford and Bingley, I had a mortgage with them over 21 years ago and my house was repossessed. I have made payments on the account over the years but not anything in the last 4 years. The letter says they want to discuss any problems I may be having with the outstanding account. In order to bring my account upto date they want me to contact them. I can't find out much about them on the net, are they debt collectors or bailiffs ? Any help or info would be greatly appreciated, thanks.
  9. Around a year or two ago the an underground ditch drain pipe started to leak and come up after some heavy rain, my parents who were living here at the time called the council to get it fixed. The council then dug up the drain but left it as an open ditch on our land, without asking us first... (we would have said no) The council refuse to correct the damage done, and say we must pay to repair it ourselves or pay them to do it. We never asked them to dig up the ditch. They did that on there own accord. Do we have any legal backing to force them to correct the damage done? And can this work be classed as criminal damage as it was done without our blessing?

So, I was an irresponsible student who racked up some defaults for a small amount of 2500 I am in a position to settle these debts now, but many of them are very close to being statute barred, my main query is, if I was to settle these debt, how long until I would expect to see an improvement in my credit file?
  11. I've had an issue with a PCN going on for a little while. Essentially I got no ticket on my vehicle and no communication from the LA, the first I heard of it was when the TEC sent the order for recovery I completed a witness statement which was accepted, then the same thing happened again. Again I completed a witness statement which was accepted, this time the LA said they wouldn't accept it and would continue to pursure for recovery under the order (which had been cancelled!) After I challenged the legality of this, they eventually issued an NTO. I raised representations which were rejected so I took it to the TPT. At the hearing my appeal was upheld and the TPT confirmed in writing that they had directed the council to cancel the ticket. I am well aware that the council is aware of the hearing since they send a bundle to it and I've had no communication from them in over a year (the hearing took a long time). The council has now ignored the hearing outcome and sent out a charge certificate on what is now a cancelled PCN! There can be no claim of 'crossing with post' as this has been sent 5 weeks after the hearing. I've already fired off an email demanding they withdraw it, but this is now the second time the council has acted what I believe to be illegally. What's the best way forward if they ignore my email and escalate it to the TEC again? Is there any action I can take based on the actions they've already taken?
  12. I was wondering if anyone who has, or has had, a mortgage with DB Mortgages has managed to get approval from them to port their mortgage? If so when was this, what were the circumstances, i.e. buying new house or downsizing, and what were the criteria that they insisted upon. Also how long did the process take and were their any 'pitfalls' along the way? I am asking as it something they say they do and which I would like to do with my mortgage with them. I am looking to downsize house, release some equity and with some of it pay a lump off the current outstanding balance, not increase the term but reduce the mortgage size by 30%. Dealing with them is never straightforward so thought would ask the users for experiences! Thank you
  13. Hey there I was wondering about this for some time. If a debt is sold on to another company does that debt have to be paid? I am presently trying to claim back PPI from a loan I took out some years ago. The short story is that I bought a house and then purchased british gas boiler insurance on their initial visit they conned me into getting a new boiler installed. We could not afford to buy one they offered a loan but I was refused because I was medically retired due to an injury and my only income was a pension and benefits. The BG guy then tried another company in my wife's name and even though she had no income as she was caring for me she got the all clear and her income was what I got lol. Didn't make sense but hey we got the loan The trouble was that we had to agree to pay PPI otherwise we would not get the loan so we were misold the PPI. After a short time we got ourselves into a lot of debt and could not pay this loan. We were eventually taken to County Court and a CCJ was issued against my wife (loan was only in her name). We could not keep up payments so along with bailiffs etc it ended up as a Charging order against our property. A few years later we moved home and the debt was paid in full. That is the background story lol. My wife made a complaint to British Gas about the PPI but we had no information as we didn't have a clue and stress was through the roof etc etc. We didn't keep records and kept burying our heads in the sand. The guy from BG who was investigating the claim wrote back to us saying that he contacted the loan company but they had no records so he could not proceed any further with the complaint ... . Right cop out!! I have since got a lot more information and have sent it to him so he should be able to do some digging. My question isn't about the PPI thing as that is ongoing and we were clearly misold it My question is that the debt was sold on to another company and we ended up paying them the full wack which was over £5,000. Was it lawful for a company that purchased a debt to make a charging order and make us pay the full amount?? Is there any way I can claim back the money I paid to the collection agency that bought the debt now that it has been paid in full. The company was Aktiv Kapital. I see that people are getting off paying debt to these companies so was wondering what the score is?? Thanx for any help in advance
  14. Hello everyone, Credit card- Citi with Cabot Financial Europe. I am paying to Clarity (online payment via their website) which I guess has been employed by Cabot to take the payments of £1 since 2013. Noddle is updated by Cabot on regular basis showing –£1 each month. Information on Noddle: Account start date 07/2007, opening balance £1436, default balance £1436 ,date of default 06/2010. Between 2010 and 2013 I was paying more than £1 a month so the current balance is down to around £590. The last letter I have received from them is a confirmation of arrangement for £1 a month with Clarity. I called Citi years ago to ask them for more information regarding the debt and about Clarity. They could not find anything in my name with their bank and explained they do not have credit card department anymore as they no longer offer any credit cards and as far as they are aware I don’t owe them anything. They could not give me any information about PPI either.. .They never wrote to me to explain that they ‘sold’ my debt as far as I remember. I sent them CCA request as advised by the helpful people here. They have received my change of address letter and the CCA on Friday 8th of January, 2016 - I can confirm that because I sent it Recorded. This morning they called me but I did not answer. T hey left a voice mail asking me to call them back. I did not provide them with my telephone number on the change of address letter or the CCA request (only address but I guess they have my telephone number from previous contact with them back in 2012-2013). Should I call them or ignore? Why are they calling me?! Anybody with similar experience?
  15. I moved into my new flat in June 2015. I called up the TV License people to say I don't need one, which they said is fine, and I just need to call up every 2 years to remind them. I know it's BS and I don't even need to call them, but I thought I would anyway to see what happens. I've now got a generic letter with "Unlicensed property" in bold across the top, and a threat to pay up before 6th of Jan 2016 or they will pass my address to "Bromley Enforcement Division" for "investigation". The letter even says if I don't need one, then to let them know, and they will send someone to check. Why should I have to notify them a second time within 6 months?
  16. Hi, I cancelled my direct debit after the 12 month contract, received a swift letter from harlands stating I need to setup the Direct Debit otherwise I'll face a £25.00 administration fee. I was writing them a letter with the following (template used): I refer to your letter of 09/12/2015. My agreement with Xercise4Less was for a minimum of 12 months. The first payment was for the amount of £34.99 (joining fee + first monthly payment), dated 02/11/2014. The remaining payments were taken on the 2nd of every month up to and including 02/11/2015 with one additional monthly payment of £14.99 after the agreed minimum contract period, taken 02/12/2015. I cancelled my Direct Debit mandate on 07/12/2015 and this was adequate notice of my cancellation of the agreement, as per the case of The OFT v Ashbourne Mgt Services Ltd in 2011. I now realise I should have paid one further month's fee for the notice period and am willing to offer you £14.99 now. If you confirm in writing within 14 days that you'll accept £14.99 in full settlement of all amounts due, I will pay it promptly. If you fail to accept my offer within 14 days, or if you demand any administration or cancellation fees (unlawful penalties), my offer will be withdrawn and I may ignore further demands from you and/or CRS. Such demands may be reported to Trading Standards. Yours faithfully, However, I can't find my W-number in my email folders to add to the letter, just the reference number from the letter they sent regarding reinstating my Direct Debit. Should I just use the reference number quoted on the letter or? Additionally, what legal leverage do I hold on the situation? Thanks

  18. I need to serve a section 8 notice, I'm on the premises & can open the door to allow them to serve the tenants notice. The residence is a private residential address. I'm already staying on the premises, & I can open the door from the inside, & allow the bailiff in to serve notice. Is this legal? The tricky part is, I dont have a tenancy agreement to prove I live on the property, but I can prove I'm the landlord. & the tenants still have a tenancy contract AST on the property. Basically can the tenants claim forced entry, or something, if I allow a bailiff entry to serve notice?
  19. We bought a used car, part exchange on 1st November. We bought a 2006, VW golf, priced at £2695 for £2200 and the rest px for our MG ZR. We were told that there was a one month warranty with it, but were given no paperwork to this effect. Within half an hour of leaving the garage, the emissions light had come on so we immediately took it back. We were informed it was likely to be a filter problem, he made a phone call to a local auto shop so we could collect something to put in the fuel tank and we were advised that driving it in in a high gear between 2 & 3,000 revs for about 8 miles, this would clear it. Having done this, the light didn't go off and they told us to go back to the dealer, which we did on the Monday. We turned up there to be told that it would need to be left for an hour, someone would need to fit a Lambda sensor and to bring it back the following Thursday, which again we did. This time my partner was told that it would have to be left until the Saturday, it would take longer than an hour as the electrics would have to be reset as well. My partner explained this wasn't convenient, he needed the car for work and it was agreed that he would drop it in the following morning (Friday), on the proviso that it would be ready for collection at the end of the day. This meant he could see about getting a work colleague to go with him when he dropped it off, and then take him to collect it at the end of the day. After sitting in morning rush hour traffic for over half an hour to get to the garage (5 miles from his work) they had to turn back as they had to be at work. He informed the dealer, and asked if the mobile engineer/electrician could attend his workplace instead to do the repairs. Later he rang to say the mobile engineer only covered Halifax, and wouldn't come out to my partner's place of work in Brighouse, 5 miles away! Instead it was arranged that he would collect the car from my partner's place of work on the Monday, and return it to him the same day. My partner texted to find out what time he'd be collecting the car, and got a response saying 10-11. He also let the dealer know that the airbag light had also come on reporting an airbag fault on the dashboard. My partner received a phone call asking if he could instead bring the VW back and he would give him a refund. My partner asked why, and was told that the coolant light on the MG had come on, it took a while to start, and when it did, blue smoke was coming out of the back. It was agreed that he would return the MG to my partner at work on the Tuesday morning and bring cash to refund us the car (he obviously couldn't bring his card machine!). We thought that the problem with the MG was likely to be due to him having had it sat on the forecourt since we left it and it being a very cold morning. Monday night my partner enquired to find out what time the MG would be returned and confirm he would pay us in cash. On Tuesday morning my partner received a text reneging on this agreement (contract break?) saying that he wasn't going to drive the MG as it had problems and he didn't want to break down, and that he would transfer the money by card when the VW was returned. However our car is up for sale on their website, and today was reduced in price, with comments saying it is a good drive etc etc. We felt that he was not playing fair, kept changing the goal posts and now implied that there were major faults with our car and so sought to find out what the problem was with the VW to consider our situation for getting the VW fixed, as per the original agreement. My partner took the VW to a VW dealer to get an exact breakdown on the faults. What he was saying was the fault was incorrect; there is no problem with the filter or the sensor. They diagnosed problems with EGR Valve and Hose, Glow Lamps and airbag the tracking needs sorting and two of the tyres are borderline illegal, the other two at 3%. We had looked on the MOT at time of purchase it having only been done in September and nothing was stated about the wheels needing changing. So assume he has changed in the meantime and we won't really have a claim there, we should have noticed it before purchase. We have been told that we're looking at over £1k to get it fixed with them (without the price of the tyres), so have booked it into an independent garage, where the hourly rate isn't the £100ph as per the VW garage, but until they have checked out the full extent, cannot advise on the labour cost. They have confirmed the parts will be the same price as will be VW parts. We informed the dealer of this, explaining it had to be booked in urgently for safety and the cost of doing so, and invited him to come to an agreement for paying the repairs or part of. He has straight out refused this, saying that it's a good car and doesn't need that much work doing on it(!!). Yet we have a report saying that it does. He simply keeps saying about a refund, no further mention of our MG. He has previously been given the chance to repair it, but didn't sort it. We explained that the parts are on now order and, again asked how much he was prepared to pay, as our car was still under warranty but he hadn't fixed it as previously arranged. How do we stand at getting him to pay at least some of the bill through small claims, if he won't settle when the work is done? Further, their advert explicitly stated that it had a full service history, which he also told us, but going through the log book when we got home it only has one until 2012. I understand a lot of people are probably thinking we should get our money back and walk away, but how do we know that they have not been the cause of the problems with our car, as it had been fine up until we sold it, and had had a 21 point service a few weeks prior. Also, it's about the principle that he'll put it back on the forecourt for someone else to go through the same thing with, as is likely to happen with the MG if he's saying it's broken, but is still advertising it for sale. Looking on a reviews page, seems that we've not been the only ones to be given a shoddy response when it comes to fixing faults and someone else is also reporting him to Trading Standards. Help!!!
  20. nb. subject should be freeholder not leaseholder Hi, in a nutshell we are trying to get information on ground rent owed to freeholder and monies we believe owed to my partner (leaseholder) from the freeholder and not sure what action to take next. Here's the timeline and more information: Dec 2013 Roof of my partner and her then husband (we'll call him Gru) leaks resulting in exterior and interior damage to property Freeholder refuses to make insurance claim as behind on ground rent despite not providing my partner and Gru with required invoices for ground rent Decision made to have work carried out by partner and Gru and pay contractors directly March 2014 Up to date on ground rent Freeholder makes insurance claim Insurance payout agreed by Gru and paid to freeholder - £975 Insurance payout not forwarded on. Not chased due to personal circumstance including partner not living at home. At some point a verbal agreement on paying ground rent was reached with Gru while he resided at the property which my partner was not party to. Still no invoices from freeholder for ground rent. My partner moved back into the property in February 2015 and Gru moved out. May 2015 Letter hand delivered to freeholder (he's local) requesting payment of insurance money June 2015 Second letter sent to freeholder, same as above August 2015 LBA sent to leaseholder threatening court action September 24th 2015 Email sent to leaseholder in last ditch effort to stave off court action September 25th 2015 Reply from freeholder intimating an amicable solution regards offsetting ground rent and insurance payout October 12th 2015 Chased freeholder for information October 19th 2015 Chased freeholder again for information October 19th 2015 Freeholder replied advising still looking for some of the information October 20th 2015 Polite confirmation What action should we take next? I'm aware it's good to show effort to mediate before jumping in with court action and freeholder has shown his desire to counter-sue for ground rent, even though he appears unable or unwilling to provide us with information on how much we owe for ground rent. Not even sure if he can hold onto the insurance money in lieu of ground rent. Any help and advice greatly appreciated. Thanks, Kris

  22. The council has recently put double yellow lines down near me. Do they need a TRO to be able to enforce them, by issuing a parking ticket? If so, how do I find out if a TRO is in place? Is there somewhere on the internet where I can search for them? Thanks
  23. Hi, Apologies as its my first Post. I wrote to BOS regarding a PPI claim on a mortage from them dating back to 1995, the only info on my mortgage account No was found on a letter to them just before I transferred it to Standard Life in 1999. I had mentioned the address of the "Mortgaged" property and the number in me enquiry. They responded with a letter saying it was an unverified Account No and wanted more Info. I called them up and had the runaround, but was eventually told by a chap to contact Section 77, Completion Center, Premier House, Chester and they would carryout a search for a £1? Does this place exit? And what else can I give to BOS? Many Thanks
  24. I am receiving nuisance sales calls from 02 on my mobile phone number. I have been rung up repeatedly every day sometimes twice a day and its getting a bit beyond the joke. Each time they ring I tell them where to go politely. I received yet another sales call from them again 5 minutes ago. Where can I go to stop nuisance calls on my mobile number?
  25. Wonga... Should I contact them.... Took various loans over 2010/11 All loans were repaid but quickly built up resulting in me been unable to repay the last loan... This was defaulted in May 2011 by Wonga... Balance £1734 this was updated March 2014 balance still the same. This last loan was for £800 the rest would be the interest added over time..... During the period I was under a DMP with then named cccs. Owing little over 23k to different banks/cc/loans. Now repaying debts under a self debt management... Hearing all the news about Wonga I was wondering whether it was worth now contacting Wonga to ask whether this debt was written off or whether the amount is still owed. Contacting them wont make much difference to my credit file as already defaults on the file, although some do drop off shortly under the 6 year limit. What's peoples thoughts on me contacting Wonga to make enquires on this loan ? Is it worth writing to them to see what's what.......
