  1. Hi there. My husband is trying to claim ppi from Littlewoods/shop direct. He has received a letter from then saying he did have ppi with cover plus. Start date was in 1994. It was fully paid. The thing is, they have enclosed a claim form from the FOS. Why would they do this? Many thanks
  2. I am looking for some advice with respect to a PPI refund and compensation in connection with a former Endeaour loan. I had a compensation refund in 2015 which was based on premiums I had paid from 2002 - 2013. But I did not know if it had been calculated properly because although I had requested that the PPI be cancelled in 2013 all my loan account statements from Endeavour/HSBC and subsequently Sancopia Portfolio showed premium payments . I then spent 3 years trying to find out how HSBC reached their compensation figure and which premium payments were used for the calculation. Finally after escalating it to an FCA case I was sent the HSBC spreadsheet for the calculation which did not include any premiums from 2013 - 2015. HSBC say that the premiums from 2013 - 2015 were reversed and they have sent the FCA a screenshot form their internal systems which show that the premiums were reversed and refunded. FCA say they are satisfied that 8 of the 15 payments have been reversed. What I would advice on is whether this is correct if they are still showing on the loan account statement i.e if there is no corresponding reduction of the loan account to reflect these reversals. As a result of this long running issue, I have the internal HSBC PPI compensation spreadsheet with all formulas. I am more than happy it with the CAG if it can help others succeed with their claims. Advice would be much appreciated.
  3. Hi all As I prepare to challenge failed FOS claims I thought I would ask if anyone has done this successfully and can share their experiences and statement of truth. FOS determined that they could not handle an Amex complaint because PPI started before the regulations started, because I ticked the PPI box with Cap1 then I needed PPI, and finally currently that a PPI form Egg (Canada Square) sent them contining neither yes or no I want PPI meant that I wanted it... Finally I would like to claim for the time I have spent putting together my claim... would this be acceptable to the court??? ANY help advice would be gratefully received, thanks
  4. Hi I recently had a successful PPI claim with MBNA. I have received a 50% payout but as it was a joint loan, 50% is owed to my late wife. Initially, MBNA refused to pay me her share until I provided a Grant of Probate or Letters of Administration. After explaining I have neither, they eventually said they will accept documents from a Court or a Solicitor confirming that no Will, Letter of Administration or Grant of Probate was ever made. My wife had next to nothing in assets when she died so, as I understand it from the gov.uk website, I didn’t need to apply for Probate as, in the circumstances, I inherited everything. I can’t understand why MBNA will not just accept our marriage certificate and my wife’s death certificate as sufficient evidence and pay out. That was all the evidence I needed to provide at the time of my wife’s death when dealing with her bank accounts. (They were different banks, not MBNA). The amount owed is only around £400 so the cost of applying for Probate or Letters of Administration would make it all pointless. I assume the cost of obtaining documents from a solicitor confirming no Will, Letter of Administration or Grant of Probate was ever made would also be prohibitive. I was wondering is there any way I could fight this and get MBNA to pay out with just the marriage and death certificates as evidence. Any help or advice would be really appreciated. Maybe someone else has had a similar experience?
  5. I made a PPI claim online for an old Littlewoods account. I have a few questions. The account was opened in 2010 and sold to a DCA in about 2012/13. I paid very little directly to Littlewoods and very little again to the DCA. On and off etc. I'm not even totally sure I had PPI and the claim was made more in hope than expectation, but does it matter how old the account is and whether or not it remains unpaid? How long should I expect to wait until I hear something? I didn't even get an email receipt of the claim when I made it about a week ago. If anyone has made a claim like this recently would love to hear your experience
  6. Hi Guys Need your help and advice. I had some old loans with PPI sold by welcome, for which I both was able to claim my PPI! Not just we were told that we had to take those policies as our credit history in the uk was almost non existent, to be able to get the loans! This loans were taken with my ex partner, which now is trying to claim, but they saying that the policy was only to cover the 1st named person, whcih was me, however we both clearly remember that we disclose to sales person my serious liver condition, and we were assured that we were both cover, as stated verbally and as he didn't crossed the i/we wording which he said was to show that we were both covered, Back then this in 2000 our english understanding was not the best and the guy not just spoke 1000 miles an hour as he had a strong accent, he even had the "face to add " a health care product for which he knew at least me I would not be ever able to make a claim! We have the original paperwork which show both our names, the ppi premium-together with healthcare product which we were told was a part of the PPI, and it clearly shows the we not crossed, so I believe that not just serve as proof that the otherwise stated, is in place- I mean we were both covered, as proof that he stated this verbally! We should never been forced to buy those products due to my pre medical conditions, as also this should had never been as a condition to get the loan?! My question, W as my ex partner is trying to get her refund, because she also paid for the loan and her name was in the agreement, does aviva ( underwriter for 1st ppi) and welcome are correct when saying that only me was cover, as technically in the agreement- the we wording was not crossed and left untouched and back then we disclosed my health conditions and were assured by salesperson that was not a problem and that both of us were covered by the ppi, am I correct in my line of thinking and she is entitled to a valid claim, as CAB advisor told her that she had a strong mis selling case? Thanks
  7. Hi I've received my sar back from MBNA but it never included my payment history I called them and they say they no longer have them I was hoping to check if I had any ppi to come back they also my sold account onto arrow global who then obtained a ccj how can they do this if they have no record of my last payment on the old MBNA credit card as it could of been statute barred
  8. Good Morning all! i hope all is well! Has anyone here claimed for PPI with Vanquis? I no longer have the account as i paid it off and closed it as the % was horrendous but it did increase my credit score from 325 to 850! Any advice would be greatly received Thanks in advanced Graham
  9. Hi guys, Hope you can help me with this please I had a call from assist claim management about ppi claim I gave them some details over the phone they came back to me after a week asking me to sign a letter of authority because they found 5 accounts eligible for ppi claim. i signed the LOA for them in may 2018. in September I came back from holiday I found over 10 letters from them some asking me to sign a questionner and a new LOA AND some of them threatening me with a bailiff or pay à fees of £300 for each account which make a total of £1500. the letters were all sent between 23 July and 10 August I came back home the 3rd of September a week later I received a letter from a bailiff asking for £375 x 5. i called them explained to them what happened they asked me to sign a LOA I said I’ve already signed one they told me it was invalid because I added some stuff with pen on them. i said if it’s invalid why are you threatened me with bailiff and I decided not to sign anything and do the claim my self. they send me new LOA AND A QUESTIONNAIRE to sign and they join a letter of T&C and one of the clause clearly saying I have 14 days to cancel. i did sign a new LOA AND THE QUESTIONNAIRE SEND IT THEN A WEEK LATER I’ve send an email to them to cancel the contract as stated in the T&C. the next day they send me email rejecting the cancellation because I’ve signed a LOA in may even it’s invalid. Today I received a letter from a bailiff again asking me to pay my debts to ACM. Hope I was clear enough if you want more info please ask me. Can you advise me please
  10. Hi I have made a claim against DFS for PPI, in the midst of being unwell and major works taking place at my home, I had misplaced the reply until today whilst clearing up from the building works. I realise that I don't have much time to challenge this response as it was sent in May. Is this worth challenging? Thanks! DFS letter.pdf

  14. Greetings, this is my first post and Im hoping that I may find some help Im divorced from my wife and a while back she randomly rang me to ask if I had received a cheque? I managed to find out that she had employed the use of the claimsguys company and they found a PPI on a joint loan we had years ago, her cheque was for just shy of £20k, she had rung them and they confirmed that this was her 50% and not the entire settlement I rang barclays bank that the loan was with and they went through it with me, explaining that yes indeed the had applied and then been awarded 50% of the total claim, there was a 22K policy applied, and the total sum awarded was £39673.80 the problem Im now running into with them is that they keep telling me different things, 1 call resulted in me being told that they simply had to issue a cheque for my half and to wait for it, then another call I was told that the case was closed latest news is that her claim was upheld and she awarded 50% of the settlement, but I wouldnt be receiving my half?? what do I do to fight this?? its a serious amount of money, more than I earn in a year and as a now single parent it would change my life many thanks edit to add her claims company have rerally tried to get her to tell me to contact them, but I found out that she lost over £7000 in fees OUCH.. if I can sort this without them, I would be far happier
  15. Hi all, newbie here. Firstly, sorry this is a bit long, but I could do with some advice. I've used all your excellent advice to start a claim with M&S for mis-sold PPI. I took out a store card with them back in 1998, which was changed to a credit card in 2003 when they stopped offering store cards. Store card customers were pre-approved. I took out the store card in store at the sales counter with just the normal sales person there, and I took out the PPI on the card at the same time. I chose to do this deliberately. I wasn't given any advice about whether this was appropriate for me by the staff member, and to be honest, it wouldn't have occurred to me to ask whether the insurance was even suitable for me. I was 28 with three kids under 5 and rushed off my feet! When I took out the policy I wasn't working as I was at home with three small children. M&S send out a policy review every year, but this year was the first year I actually checked it - I've never done it before because I didn't realise I needed to as far as PPI was concerned, and to be honest, they send these out in an envelope that looks like it's just marketing materials rather than actually anything important, while I don't remember looking closely at one of these "statements" before, often I expect I've just chucked them out unopened. My statements all say that there is important information enclosed on the envelope so I always keep and open them, but not the other stuff. I assumed, naively and stupidly apparently, that because I'd taken the insurance out, it would therefore have been suitable for my needs. It just didn't occur to me that it wouldn't - after all, every other insurance I'd dealt with at that point, car, house, etc, was fit for purpose. But anyway, the annual review certificate I got this year says on the front "employment status - not working". When I checked the policy details, it said that if I was working less than 16 hours a week, I wouldn't be covered. So all this time, I've not actually been covered. If I'd been asked whether I was working at the time of taking out the card, I would have told them I wasn't. I've never thought to check since about whether I was mis-sold as I assumed that because I'd taken it out myself I wouldn't have a claim, but a friend advised me to look at the mis-selling criteria and I'm sure I have a case. I wrote to M&S back in July explaining that I thought I'd been mis-sold because the policy clearly wasn't suitable for me as it wouldn't have paid out if I'd made a claim, and although I'd chosen to take it out, no attempt had been made to explain it to me, and it was made clear that taking out the insurance would help my application. I had no reason to doubt the sales-person's honesty or integrity - this was 1997, after all, way before any sort of scandal about mis-selling, and at the height of the consumer credit boom. So, fast forward to today, when I phone M&S after getting 4 texts from them on Friday telling me to contact them urgently. I spoke to a nice man who said that there was a letter on the way, but he would tell me what the letter said. They've rejected my complaint because they said I ticked the boxes on the forms, which I did, (and which I told them I did, I've always said that I chose to take it out), that their staff member wouldn't have given me financial advice when I took the store card out (which surely they should have done if they were selling me a financial product?), that I also took out the PPI when they changed my store card to a credit card, and that in the years since I have had ample opportunity to check the terms and conditions of the insurance. I have obviously had the opportunity to do so, and that I didn't is my own fault, but I really had no reason to suspect I needed to. As far as I was concerned I was paying my premiums every month and I was covered if anything happened. They also say that the terms and conditions were on both the credit agreements and that therefore I knew what I was agreeing to and that any error is mine and nothing to do with them. They're sending me copies of the original agreements, but apart from the commission part, which they're paying me for, they've refused my claim. There were periods in the last 20 years where I was working more than 16 hours a week, but it wasn't for more than about 5 years in total, but at the time I took out the insurance I wasn't working, and at the time the card was changed over I wasn't either. Part of me feels like an enormous idiot for not checking the terms and conditions sooner, but honestly, it just didn't occur to me that I would have been mis-sold something so long ago, or that I could even have a claim, because I made a choice to be responsible and to take out the insurance myself. I just left it to run and run in the background because once it was there I didn't feel that I needed to check it again. And I feel that they rely on you doing that, but to then use it against me to refuse my claim just makes me angry. I've also sent them an SAR asking for copies of all the agreements and the terms and conditions that would have been in place at the time, along with copies of missing statements so I can plug it all into a spreadsheet and work out what I think they owe me. However, while I strongly feel that I was mis-sold this PPI, am I actually right? I don't want to accept this from them, I feel I'm at least due my premiums back for a policy I couldn't have claimed on, regardless of anything else. But am I right to fight this (it feels to me like they're just trying it on, to be honest, to see if I'll give in if they're nasty enough) with M&S? I'm happy to take it all the way, if necessary, as this has become more about the principle now than the money, so it's off to the Ombudsman if I don't get any joy from M&S, but am I just kidding myself here that I've got any way of winning this? I am stubborn and angry and quite prepared to make a fuss about this, but I just need to know if I actually have a leg to stand on before putting all the effort in - I'm not well and don't have much energy to spare so I like to make sure it's worth expending before I start.... I'd appreciate any help or advice anyone has, this is all a bit of a minefield! Thanks in advance
  16. I cannot believe how useless FOS is: Investigator ruled against me because I must have accepted an online question that I wanted PPI: he sent me screenshots of questions re PPI but not my screenshots since i never seen them before. my gdpr did not contain them, my cca regulated agreement contained nothing about ppi… he says fos is not interested in cca agreement or what is in gdpr … cca is a matter for fca.. not fos disgraceful appalling service... i feel a need to complain about this investigator i have sent an email complaining about the fos guy essentially he has assumed that i saw an online form and replied i did want ppi… but he has not offered any evidence that i was offered or even accepted or declined
  17. Hi i recently made a PPI claim to Car Giant. First of all they said they could find no record of me taking out PPI. But i found the documentation so they had to admit i had it. I filled in the complaint form and received a letter within days. However they are saying they wont admit i was mis sold it as the manager in charge at the time has since left. But they will refund the full amount but will not pay the interest. The total amount i paid is about £1800.00 over ten years ago. Surely by offering me this they are admitting responsibility. And surely i should receive the interest on top. I would be grateful if anyone can advise me if i should dispute this.
  18. Hi guys A quick question... I am trying to find out all the agreements numbers from pre 2010 loans I had- personal and business accounts( because for i.e black horse only says it can only go back 8 yeras), I tried through a normal credit report-experian - i see the loan history but no agreements numbers, i tried a full SRA from equifax which i got today, but no agreements numbers, i did request full SRA from the banks which i am hoping it will give me reference/ agreements numbers on the statements but if not what can I do? Is there any other way, because it seems a very easy way for lenders to get away with paying back PPI?!! Sorry guys is there anyone that can advice me please? I am going to get this info through my banks SRA request? where I will be able to see in the statements the direct debits reference numbers? Or for i.e in the case of black horse do they have to provide me with all loans details for loans taken out pre-2010? Thanks
  19. Hi, this is my first post, please be gentle:smile: I submitted a request to HSBC in relation to PPI that I am certain I had with HFC Bank for two items of computer equipment that were purchased in 1995 and 1997, as I believe PPI was automatically added as a pre-tick? The total amount of both repayments were in excess of £5k HSBC came back negative and asked in their reply whether I had copies of the agreements, number etc. which I don't! I then did a SAR request to Dixons (PC World) which verified that I had both of these agreements with HFC Bank, although they could not give me any agreement numbers? I do have copies of bank statements which cover both of these transactions, which show HFC Bank as the recipient of the direct debit. My questions are as follows; Should I do a SAR request to HFC Bank to see what other paperwork they have, or should it be sent to HSBC, if so to where, and what other paperwork would they want from me? copy of driving licence, utility Bill etc. At the back of my mind I think that I also had some dealings with Beneficial Finance and Hamilton, all now HSBC. Can I do one SAR for all three given that they are all in the same group? Any advice you can give me is appreciated.
  20. Hi all...some advice needed. I originally put a ppi claim in against barclaycard in 2011 using a claims company which after about 2yrs was rejected. Fast forward to 2016 and I received a letter from barclaycard stating they were reopening my case. They asked me to go online to their site and reapply.. Which I did with no reply. I went back online last week and reapplied again. Received letter Monday saying they were sorry that I had to reapply online again and they would look into it straightaway. Received letter today rejecting my claim as the policy started in 1996 and ended in 2001 and seeing as I applied by post they didn't give me any advice on it. I made my own decision whether I required the the policy and could have benefited from this. Has anyone had any success after receiving one of these letters from barclaycard and if so what should I do now... Oh and they state I carnt make a plevin claim as the policy Was signed for before April 2007 but closed before 2008
  21. I have just had a reply from MBNA saying I am not eligible for any redress as I was declared bankrupt, this is not the case as I was in an I.V.A. which is now completed. Also the debt is now run by Max Recovery, what are the options?
  22. Hi has anyone had any success with claiming money back for the mis-sale of PPI through the Next Directory Store card. I have been told by NEXT that I have paid £1, 130 PPI since 1991. I have made a claim via the PA(GI) ltd , outcome expected next week, but have not seen any successful claims on any forums. Any success stories would be appreciated. Thanks
  23. Hello I know I had taken out loans when younger to buy car /bike but was long ago 1989 to 1994 No longer find any paper work I had made note occasional in my diary those years when needed and put them on to outlook on computer Some of the events 02/05/1990 Mercantile £4K , 5yrs protected £127.84 Premium £17.10 16/02/1992 £9,500 7/1/1992 £2500 , 4yrs £133month I even have the dates that contacted bank about my direct debits dates when i took the loan paperwork into Manchester My notes state I even had letter from their solicitor when had few issues but made no note who they were I eventually paid all loans off several years later I found out that Mercantile was taken over by Barclays So I filed for complaint on 11 July 2018 this year with my old address, dob , and the 3 dates referring to the loans I have received letter 3 days later after calling them by phone with 4 ppi references to use instead of complaint reference. Cannot find any loan under my name , address , dob Sorry with finding your account we cannot investigate so my complaint is closed. Called them today and explained my outlook notes , they have asked for that list to be sent. Stated that they only keep records 6yrs , so am curious how do I make claim and prove when i have all these dates if internal records are just 6yrs. Am I correct to assume that successful claims seems to be actual statement or loan account details Even call credit group checks don't have my old original address Do I give up ? What else can I try , I feel sending my list in wont help if they cant even find my name and address Help and info appreciated
  24. A few months ago I enquired about PPI on some old Egg Loans I had in the early 2000's. This morning I had a letter from Canada Square with their decision. On one policy did not have any PPI on it but the other 2 did and they have upheld my complaint. It says the total redress is £4,256.55 but that out of that amount I am only getting £2,168.60 because of a Final Loan adjustment £1,849.17 is going to a company called Arrow Global Receivables who my loan was transferred to in 2011. There is also a deduction of £2,365 listed as "Less any previous rebate paid" I was never paid any other rebate but perhaps this is something to do with my not paying off the full initial loan after entering the trustdeed? To be clear I took out the loan in 2002, and increased it twice in the following year to about £11,000 total. I then entered into a protected trustdeed in early 2006 which this loan was included in. The trustdeed was finished in 2009 and I had no idea that the loan account was still open. I will attach a pdf of relevent info from the decision letter. I know I am lucky to be getting anything at all given that I have been in a trustdeed but I just want to check that the amounts seem right and that them taking the other money off is right and fair. Thank you for your help! Also to let you know I did send a SAR to Canada SQ at the start of June but they didn't accept my inital change of address ID and then didn't get back to me for almost a month so the sar info will take longer to recieve. Should hopefully get it in a few weeks. A trustdeed advisor (not my former trustee) has told me that she doesn't think that the payment to Arrow should be made considering I have completed a trustdeed. She has advised me to call them to make it clear I have been in a trustdeed and get a reason for why this payment is being made to Arrow. I am a bit worried about calling them and discussing the trustdeed in case it affects my chances of getting any payment at all. At the same time it is a lot of money to lose if the payment to Arrow is in error. egg letter.pdf
  25. In 2012 I entered a Protected Trust Deed. The reason for the TD was quite simple the RBS wanted to get a decree for a loan in arrears but not defaulted, which would have allowed them to apply to get a unsecured loan converted to a secured loan on our house and then push for enforcing against the house. This was straight from RBS lawyers at the time. So the trustee gave us a letter for the court which stopped that. But end result was a 5 year protected trust deed. Before we got to that stage we did attempt to claim for any mis-sold ppi we had with RBS to be told we had none. Our Total debt to RBS was approx. £15,500... Fast forward a couple of years. I was discharge form 5 and no PPI was found by the trustee (standard procedure to check).. Funny thing was they found PPI for my wife with RBS .. I was now fully discharge form 6 also. The bank sent a letter to my wife saying they who could only pay out 50% because it was in joint names with someone else... only person that could be is me.. Now as I'm fully discharge and trustee have stated they are not interested in any PPI which is in my name. I asked RBS to recheck using the account number on the Wife letter. Low and behold they have found 4 accounts totalling over £17,000 worth of PPI not including interest dating back to 2004 and 2008 and onwards on car loans, personal loans etc most of it was front loaded onto the loans etc. with the resulting extra interest. The PPI is enough to have easily cleared the original debt to RBS. I don't know if they will refund it but that's a different story.. but they did on the wifes 50% as both of us where working and both our employer had sickness policy's in place 6 month full wages then 6 months half wages. Surely getting told you don't have it when you did must surely be a big no no. If the point of a PPI reclaim is to put the person back to the position they would have been if the PPI was never sold. Or if they had allowed us to claim on the PPI we would never have been in the Trust deed in the first place. Now how would you proceed. Thanks Ed
