  1. Hi all, We moved out of our house in Jan and have received our full deposit back. Our ex-landlord is now asking for £60 due to damages. Has she got the right to ask for this? She said she should have taken it out of the deposit...is it not just tough that she didn't?! Thanks in advance!
  2. Hello helping another friend with their problem. They have received letters from Robinson Way stating that they have had no response to their letters asking for payment relating to two debts that they had purchased and if she does not respond in 14 days they will take legal action. Now this is the first letter they have received regarding this and all tho she does/did have some debts some 5/6 years ago these letters do not state which debts these are. I will refrain from ringing them to ask relevant questions but was looking to write to them asking for the following: Previous Owner, Account Number, Total Amount, Date of Default, Last Payment Date, Amount of Last Payment, Who Was the Payment made Too, How Was This Payment Made and Where was this Payment Made. Do these questions sound ok?, obviously I will format the letter with correctly but just spaced as such to save over posting. Regards
  3. Dear All, We recently started to receive letters from Lowell asking us to pay 487 for a 3 mobile phone contract. The contract was terminated in 2009 and the last payment was made via direct debit on the 29/12/2009, the first letter from lowell was received in november 2015. We were at the end of the contract at the time and they gave us the option to upgrade but we refused as we wanted to change provider , then the telephone line of that three phone was cut (from their end) and that was that. We never heard from three until we started getting these letters from lowells saying that we have to pay 487 GBP for early termination charges plus monthly fees, no idea where they got these figures from but sure we do not owe that money and no one from three has ever asked for it. I have always replied in writing and recorded delivery and asked to prove the debt , they sent a statement that doesn't make any sense to me, I never acknowledged this debt in my last letter I mentioned that the last payment was made by direct debit over 6 years ago, however they just replied saying that a default notice was placed in June 2006 so the debt is enforceable until june 2016. I find this so strange and I'm stuck. My husband and I are about to apply for UK citizenship and scared that a court order might ruin things. We never had any problems with debts, got our mortgage approved in 2011 and never fallen in arrears. This is upsetting me now. I'm really sorry for the rant. Hi all, I was wondering if anyone can give me some advice, my dad took finance out with a company called Motonovo finance in July 2015 he paid £500 pound deposit and paid a double payment the month after taking the finance out with Motonovo. All payments have been on time and are up to date the payments get payed 21st of every month. Last month December 2015 my dad was working and has his own van which he is fully comp on, I was in the middle of moving house so he said I could lend his car to help me out doing me a favour. I insured the car in my name on the Friday 10th December 10am. Two days later on Sunday night at midnight I got stopped by police for no insurance I advised the police I had insured the car on Friday and phoned my mum who confirmed to police I had took the insurance out on the day I had said. The car was filled with all my belongings as I was in the middle of moving house. I begged for them to let me go in the following morning with the proof but they dismissed what I had said and compounded the car As you can imagine I was really upset a week or so before Christmas an also as the car was filled with all my stuff and I had done nothing wrong . I was crying so my brother rang the police and made a complaint about the police as they was very intimating towards me when I was stopped it was pitch black and they had pressed the panick button all police came from no where there wasn't any female offices there just all male cracking joke and laughing whiles I was crying I got treated disguising a young female on my own. The following morning I rang my insurance and they confirmed I was insured and informed me that it was harsh what had happened as police know it can take up to 7 days to show on the police data base. My policy got sent to me by email and I had printed it out to take to the police to show them I was insured, I then rang the police and they said take it up with Motonovo we haven't got the car no more my dad then rang moto novo who said the police had the car and had been in touch with Motonovo to inform them I had been the police station and could not provide the documents I needed to so not to release the car to us we was confused with this as we had been told not to bother going the police station as they never had the car. I then sent the proof over to Motonovo showing the car was insured at the time it was taken from police. We got told to take it up with the police this went on for days and days police refused to release the car even though Motonovo didn't have a problem with the car being released at this time. Motonovo recovered the car we then spoke to the manger in the recoveries at Motonovo who said if we could get the police to confirm the car was insured they would release the car either though the proof had been sent to show it was he wanted the police to confirm. I then went on to get in touch with the police man who had took the car who confirmed to me he had looked it up and the car was insured and legal to be on the road at the time it was taken, he refused to put it in wrighting but said he was speak to Motonovo direct. I then rang moto novo who then said they want full settlement due to the terms and conditions being broke because my dad wasn't on the insurance policy they took another payment on the 21st of December all payments have been on time and they have had a payment whiles having the car. The car should never of been took in the first place also there are no missing psyments on the account but they are refusing to release the car I think this is completely unfair on my dad he's a honest hard working man who had provided for his family all his life , they are saying they will sell the car at auction then he will have to pay whatever remains so not only has the car been took unfairly and payments are up to date he will be in debt with them. if anyone has any information on what we can do thatvwould be grate thank you for reading this and I look forward to hearing back sorry if there is any spelling mistakes also in advance ha thanks again, Lois.
  5. My bedroom walls are being water damaged and progessively getting worse and worse, the plaster is now falling off in sections. I've had a builder come out to lool and they have told me the adjoining roof of the house next door is damaged and thats how the water is coming into my bedroom. The insurance surveyor came out to look and sent the report to the insurance company (time of writing its now been 4 weeks) after me having to daily chase up the insurance company I have now been told, they will pay to repair the water damage to the interior of my house BUT they want me to first some find the contact details of the landlord that owns the empty property next door, before they fix the water damge (because the neighbour has to fix his roof, to stop the water coming into my house) The insurance company is telling me to contact the council and tell them the neighbours roof is damaged and water is coming through the neighbours house and damaging my walls. The only thing I have found on the land registry is the names of the 3 people that own the empty house next door which is in a bad state, they are no other details like phone number, so i can't ring the owner of the house next door and ask him to repair his roof and once thats repaired the insurance will will then repair the my bedroom walls. It looks like my insurance is asking me to do their work and find the owner or they just want to drag this on and in the mean time my house is being damaged with water whenever it rains because of the next door neighbours house roof which needs to get fixed to stop water coming into my house. What can I do, I can't sleep in the bedroom anymore because all the walls are damp and wet. Is it not the insurance jobs to locate the owner of the house next door and ask them to repair his roof? then the insurance can repair my house? please help me, i feel like crying
  6. My partner and I live in a 1 bed flat in a house conversion. Our bedroom is above the kitchen/living area of the problem tenants below us. For about 2 years we have been complaining to the landlords about the noise from these tenants. They run a loud extractor fan at all hours of the day and night, bang doors and cupboards, shout at each other and their kids. Now they have a crying baby!! The walls are paper thin to the point where the heating cannot keep the room warm at all. The landlords have written them multiple "warning" letters and had one meeting with them, where they agreed to keep the noise down. This didn't happen. We kept complaining so there was a meeting between us and these tenants, which they denied making the noises. Again it didn't change. I then wrote a formal complaint, in which they reply was saying we are now alleging the noises are happening, even though in the past we have provided recordings of their noise! They also said if we agree to have the landlords come around and do a sound test (which involved one person in our room and one below shouting and banging doors). It clearly to them failed. They have now organised their building contractors to come around to investigate further - but their solution was a bead of silicone around the skirting boards?? This is yet to happen but will not solve the issue. Are we within our rights now to start formally telling the landlords that we are withholding rent payments until this problem is fixed?? It's reached a point where my partner now sleeps on the couch in our living area because the noise is just too much. The other issue is parts of our flat and the building are i believe not up to fire safety standard. By the way the landlords own the entire building. When we first moved in the building inspector and the boss builder did an inspection. The large window in our bedroom needed to be replaced - it was classed as a fire escape and should remain completely open to roll out of. But it just keeps shutting. The builder was told to replace it. Also our front door should have a furry seal around the edge, but didn't and again, should have been installed. To this day, 2 and a half years later, they have still not been corrected. Are the landlords in breach of our contract and fire safety standards?? Could we ask for a rent reduction perhaps?? And should we seek some form of legal advice?? We are at a loss here - the landlords do nothing and the only time you really here from them is to do with rent payments. We are contracted until mid 2107, and couldn't afford to move now, unless the landlords gave us our full deposit back before we moved out - not going to happen! If anyone has any sort of advice, it would be greatly appreciated. Or any more elaboration about anything i have written, please leave a post. THANK YOU!!!!
  7. Rather than face the humiliation of the DWP contacting my employer with a Direct Earnings Attachment, they accepted my proposal of £100 per month direct debit repayment plan. I have been paying this for 12 months and have never missed a payment. I have just received a letter asking me to call them as they want to consider an increase in my current payment plan. Can they pressure me with the threat of a DEA through my employer again if I refuse to agree to an increase? This debt is from 1997 and I know lots of people say it, but I know I was repaying this back then, I was called in to the social security office and new claim forms showing the deduction were completed. I was still on benefits when the overpayment came to light, and remained so until 2000. I have never been out of work since. Then 2014 and the Welfare Reform bill rolled out the DWP bully methods of collecting old debts. Guilty, with no access to records to prove your Innocence. Even letters from my local MP produced no way forward to dispute the alleged debt. There is nowhere to turn for help. Can anyone here help in answer my query: Can the DW force a Direct Earnings Attachment if I refuse to increase the direct debit of £100 per month that they already extract from me?

Here's a brief guide to the sorts of information posters here will be looking for to help give you prompt and accurate answers to any questions you may have. You may not know, or be unsure about, some of the things listed. That's OK, but the more information you can give the better. Not every question will be relevant to everyone, of course - this is just a general guide. Take care to post nothing that will allow you to be identified in the "real world". Which benefit are you claiming? For example, Jobseekers Allowance, Employment and Support Allowance, Child Tax Credits etc. If you're unsure, please let us know the basic reason why you're claiming: are you out of work, sick, looking after someone full time etc. If you know whether your benefit is contributory or income based please tell us, as the rules for each type can be very different. If you're not currently claiming a benefit but are enquiring about what might be available in your circumstances, many of the questions listed here will still be relevant. Please also see the questions in the section below. If your query relates to non-receipt of a payment you expected, when did you expect the payment? If you have contacted the DWP or other paying agency regarding this, what explanation (if any) did they give? If your benefit has stopped because of an adverse outcome decision, have you requested a reconsideration or appeal? Examples of adverse outcome decisions: You are claiming ESA because you are sick. The DWP has determined that you are fit for work. You are claiming JSA because you are looking for work. The Jobcentre has decided that you are not doing enough to find work. You make a claim for a Personal Independence Payment because you have a disability that means you need extra assistance in getting around. The DWP has rejected your claim for benefit because it says your needs do not qualify; or the DWP has made you an award at a lower rate but you believe you should qualify for a higher one. Where do you live? We don't need your street address or hometown or anything like that. At the very least, please tell us whether you are in England, Wales, Scotland or Northern Ireland, as there are some small differences in the way benefits are processed. This is especially relevant if you are in Northern Ireland. If your question relates to Housing Benefit or Council Tax Benefit, it might be helpful if you felt able to say which council area you live in, but if you'd rather not, we fully understand. If you currently live outside the UK and are enquiring about benefits available to non-residents or to returning expats, please let us know. If you are not a UK citizen, please tell us your status. For example, are you a citizen of another EU country? Do you have Indefinite Leave to Remain? Or some other immigration status? Do you have a partner? This means someone (of the same or opposite sex) to whom you are married, or with whom you live as if you were married. If you do have a partner, does he or she work or have any other source of income? Do you currently work? If so, how many hours per week? Have you worked and paid National Insurance Contributions (sometimes called "stamp") in the last few years? Do you own the place you live? If you rent, do you rent from the council, a housing association, or a private landlord? Is your landlord a close relative? Are you fit for work and looking for work? Are you unable to work because of illness or disability? Do you have savings over £6000? Over £16,000? Do you have any disabilities? Do you have any children? If so, how old are they? Are you a lone parent? Do you care for anyone for more than 35 hours per week? Does anyone care for you for more than 35 hours per week? Again, if you're unable or unwilling to answer all of these questions, that's fine. Just tell us as much as you can.

Hi guys Need some help my partner is on esa wrag and i start getting training as barber (non paid) in shop in November 2014 which i told benefit people and they asked written letter which i sent them. After few months job centre people sent letter saying that they over paid to my partner due i was working, i sent the letter through cab and told them that i was getting training and it was not paid. I even rang them but they still insist the employer should have paid for the training, the shop owner does not need any more worker but he was kind to me giving equipment and chair for learning, it was me who requested that i want to learn here and shop keeper gave me a favour giving free training. From April 2015 i start working there as self employed in the same shop and working 15 hours a week and earning about £50+ a week. Since i told job centre i am working 15 hours they stopped my partner's esa money and we are waiting for their decision, now we received another letter again and they asking us to pay back £1500 the period when i was getting training. I made cab appointment but its in next month and benefit people want to take the money out end of this month. Benefit people want the money back which i never received as learner and they keep saying that you should ask your employer he should have paid you
  10. Hi all. I was assaulted at work little over a month ago, this was entirely the fault of my employer as they didn't take the required steps to ensure staff safety. Despite many complaints from the team. I haven't been to work since and have been signed off with work related stress. My employers haven't contacted me at all during this time and the meeting is at my request follow contact that I made with HR. I don't want to return to work. I want them to to pay me off to leave, obviously signing away any rights to a claim for PI or anything else. How likely is this?
  11. Hello - I'm hoping you can help me out regarding a parcel I've sent with Hermes. The item arrived damaged (technically, all that arrived was a noticeably empty box) - and so was rejected by the recipient. I've contacted Hermes (who hadn't bothered to tell me that it had been rejected), who have said I need to pay for the return delivery to be able to obtain a photograph of the item to claim for it as a damaged item. Is this correct? Should I have to pay for return delivery for an item they've damaged/lost? Thanks Sam
  12. Hi there, I am hoping to get some advice. I purchased a car using finance from Barclays Partner Finance at the middle of last year. At the start of this year I was expecting a bonus from work and stupidly overspent over the festive period. T he bonus didn't materialise until the end of March and I missed 2 payments as I had to juggle my finances and at the time, the car payments seemed the lower priority. In March I was sent a letter which said I needed to clear the arrears within 14 days or they would issue a default notice. This took me quite nicely up to pay day when I was receiving my bonus. However, rather stupidly, I tried re-arranging some of my debt to reduce charges etc which meant I was 5 days late making the payment. I did try calling them on the number provided which was an automated system which told me I was £570 in arrears (3 months - another one must of been added on early as it wasn't due until April). There was an option to let them know you were intending to pay which I selected and entered the date that I would be making the payment. I then made the payment on this date bringing the account back in order. Yesterday, I returned home to find a letter from a solicitors telling me that they were acting on behalf of Barclays and that they want the full outstanding balance of £11,117 paid or they will recover the car. It states that I have 2 options, pay in full or surrender the car. It states that they will begin court proceedings to repossess the car if I do not contact them by the 17th. I tried phoning Barclays to explain that I thought the account was brought back in line but was told it was showing as closed, and that the department I wanted to speak to was now closed. I also went through the automated system which said my account owed 2 payments (it should only be 1 - this months). I have the money to pay the 1/2 outstanding payments and my finances have returned back to normal. I would rather not give back the car but I do not know if that is any longer an option? I have not been able to speak to the solicitors as they are only open when I am at work. I live in Scotland and have NOT paid over 1/3 of the total HP loan since it was taken out. Any help or advice is most appreciated!!
  13. Hi all. Im on JSA. Was asked to make UJM account to search for work and make log, all is good. Last time i was in the JCP to sign my coach has told me that i MUST bring in my user name and password so they can access my account. I previously gave them my email for the account so they can check im doing my bit as per job seeker agreement which i have no problem with at all. This request for username and password is not wrote on my most recent JSA agreement i note! Its just, im not sure they should be asking for my username and password. I thought that was private? my password I have this coach recorded saying this in audio file also as i dot trust DWP at all due to the things happened in past. Should i ignore this request? To me it just sounds wrong but i dont want a benefit sanction. TIA
  14. Hi all again, Been awhile since I've been on here, hospitals don't have the best of wifi's. I sent Natwest a SAR for my dad so we can have a look at doing his package account. They sent back a letter not long after asking what information he wanted. I'll upload the letter so everyone can see I'm not sure what to post back. I used the SAR from the library. Thanks Andrew

In my local paper the council are reminding people that due to the roll out of Universal Credit,and the way it is paid, our rents will go 4 weeks into arrears, they are hoping that people affected pay small amount each week from now until December when UC will be rolled out in my area to offset those arrears. There is an option to have UC paid in advance to cover the change over, this advance will be recovered over a 6 month period. If that's right then I will be £75 short on the first 6 payments of UC if I choose to have the advanced payment, which is quite a large proportion of my benefit IMO. It is though they have taken 4 weeks from the future plonked it into the present and said we dont pay benefit for the future so what we will do is loan you the money to get by, but we want it back before the future has arrived, they will soon clock on that they could take 3 months from the future and borrow us all the shortfall if they rolled out UC payments on a quarterly basis saving the government zillions. IDS I salute your accounting wizardry.
  16. Hi, firstly, my partner and I, along with our child have lived in this house since 2011 and in this street since 2006. Last year I applied for his secondary school place and was awarded the school of our choice, the school is 250 metres or so from our front door (one of the reasons that we moved to this street in 2006). Last week I received a letter from the LEA Admissions officer telling me that I had to prove where i lived in October last year, they want 5 pieces of paper, 2 of which are A V5 document , I dont own a car, my partner buy s and insures our cars, also, proof of receipt of CB and or Tax Credit, we receive neither of these. I cannot ring them until Monday, but this sounds very strange, part of the letter states that he is not necessarily doubting where I live or where our son lives, actually, that is precisely what it sounds like to me. Whilst we have nothing to hide and have not made a fraudulent application, I cannot provide them with something that I do not possess, does anyone have any advice please.
  17. Hello all, I have just received a letter from the DWP asking me to contact them regarding my repayment plan for an overpayment. After much hassle and failure to get them to write off the overpayment due to extremely low income I finally agreed to pay them £1 per month which they accepted and have been paying that for the past 6 months. I received this letter on Saturday..undated by the way...asking me to review with intent to increase my payment. I have been on ESA for the past 4 months and have the dreaded ATOS medical on February 19 and as we all know how they operate I doubt I will be on ESA after that even though my gp says different and that if they do fail me he will certainly back me to the hilt in an appeal. He was genuinely surprised that given my condition such a thing would happen when I told him I was very worried about the outcome as the worry is making my health/condition worse. How do I go about handling this? If I do lose out on the esa then the £1 has to stay in place as I cannot afford any more. As I understand it during the mandatory reconsideration period (however long that takes)I do not get paid so still could not afford more and same goes for the reduced rate you get during appeal. Can I insist that the current agreement stay as it is for the time being? I am not sure if they can force me to pay more or not.

The claim was made November 2013 and he was finally placed in the support group in September 2014. We received a letter today titled Notification of Office Interview. I thought with him being placed in the support group that they could not harrass him. I can't upload he letter so I will typr it out below: An office interview has been arranged We would like you to attend an interview at: xxxxxx with xxxx. What to do if you cannot keep this appointment: If you cannot keep this appointment, or wish to report any changes in your circumstances, please contact me on xxxx. Why it is essential that you attend this interview This interview has been arranged because your circumstances may have changed and we need to ensure your payments are correct. Following this interview, we can arrange for you to see a Work Coach at the Jobcentre. They will be able to support you in considering your options for returning to or starting work. They can help with; Training to get the right job Work taster or work experience Discuss permitted work and how that can help you The best way to search and look for work What you need to bring to the interview Passport Driving license Photo ID AND Last 3 months bank statements. When you arrive at xxxx Jobcentre you will need to take a seat etc etc.... Do I have to take my son to this interview? My son is autistic and he can not cope with these kind of situations. Hi everyone Just looking for some advice really Rented a property for four years Me and the missus decided to move We no longer had any contact details for the landlord so we contacted the estate agents through email The said just email over a months notice that were leaving and they would forward it to the landlord We moved out on Friday not hearing anything from the landlord Having not heard anything from them in the four years we lived there I assumed they had retired abroad This evening my parents receive a ****ty phone call from the landlord saying we had left the property without giving notice and that we owe them a months rent (My parents where guarantors) The landlord left a contact number so I text saying I had given notice with the estate agents and they said they would contact them as I no longer had contact details for them The landlord has come back with that because I didn't give a months notice I will need to pay rent for another month until January fifth. My response has been that I used all reasonable means to give notice and would be happy to provide all email correspondants with the estate agents. She is insisting that I owe another month. So where do I stand please?
  22. I have had an ongoing claim with Jet2 for compensation following a fight delay in Feb 2011. There are six family members in the group, my wife and I, and four children under 16. I am the lead passenger and paid for the flights and the booking was made using my Jet2 account. It was a technical fault and they have been using the “unexpected circumstances” excuse since 2011, and most recently said they were waiting the outcome of their appeal to the Supreme Court which they said would affect the outcome of my claim. When the Supreme Court refused permission for them to appeal, I wrote again asking for the full amount plus interest. They have now asked me to submit a separate claim for each individual or they won’t consider them. This is the first time since I first claimed in 2011 that they have made such a request. After my initial claim, they made a partial pay-out for our allocated seats booking-fee, all on the same claim. So they have the all the passenger details and they have even partially paid out on the claim. I am inclined just to go straight to the County Court now because they are obviously just time-wasting. In my most recent letter, I said that if they did not inform me within 14 days of how and when they are going to compensate me, I would pursue the matter in the court. Am I now justified in taking them to court? Is it reasonable of me to expect a reply in two weeks after an almost four year on-going case ? Their normal reply time is six to eight weeks. If I don’t submit the claims again individually, would they be able to use that as reason for not paying if I go to County Court? Many Thanks

On CWP and 2 weeks ago, we were all taken into a room and asked our details and what jobs we would like, next day the advisor contacted me and said please forward c.v via email as I have a driving job for you. Great I thought as I forwarded my c.v , I added a cheeky p.s of please would you fund my 35 hrs CPC periodic traning then ? So I may legally drive as this is now required since 10th September 2014 for over 3.5t drivers. I again repeated the request to career advisor 1 week later 'in centre' and got your WP advisor will contact you shortly - that was 5 days ago.... Seems they only like to collect in the bonuses and not pay out for training!! As I'm a recovery driver and even the small recovery trucks are around 4.2 tonnes unladen, I thought I had a valid and reasonable request... and she never did give me any details of this supposed job!
  24. british gas repeatedly ask me for my date of birth, as if they need it for 'security'. if they need security you should ask to set a password for the account security. you do not have to give your date of birth. i always refuse to give my birthdate as it's inappropriate to request it and private info. another utility company refused to supply me when i refused to give my birthdate and disconnected the call. is this breaching some sort of regulation?
  25. My wife and I are the leaseholder of a flat in a block of six(since April 2006). My local council is Broxtowe Borough. Every year we have had bills for maintenance of some sort ranging from several lino tiles in the foyer to wall insulation. Some bills have been a few hundred whilst the dearest was over £4,000.00......... ....fast forward to around 15-16 months ago when the council decided to replace the old wooden entrance door(front and rear), with new steel security doors and security key. Their reason for the replacement was that these would add security to the tenants and stop any tom,dick,and harry coming in...WRONG!!!. The doors are continually wedged open with kitchen utensils, bucket filled with sand, house brick, pieces of wood etc..... ...I contacted the council over a year ago telling them about the situation and stressed that we would not be paying for the doors as they are no more secure than the ones that were replaced. We heard nothing more for a long time until today we received a bill for £342.59 for replacement of front and rear entrance doors. I have video and photographic proof of the doors being wedged open on various days and at different times of the day,both in daylight and darkness.... .....My questions is, do I have a good enough case to refuse to pay the demand based on the evidence I have?. The last thing I want is for the council to take me to court and I end up with a bill for several thousand. The doors are only as secure as the tenants who close them behind them and that is probably never. Incidentally,my wife and I purchased a house in february, moved in to it in June and rented the flat from July. I went there mid week to get some car items from the outside store and the so called security was wedged open then, so it is still happening. I don't mind paying for replacement doors if they are being used properly, but they aren't. Any help , especially legal wise, law wise would be greatly appreciated.
