  6. It's the statutory maximum fee payable for such a request which the lender is entitled to receive so it should always be sent, just in case. The lender may accept it, or decline at their discretion ... If the account is closed and the credit agreement no longer running, then the lender is not obliged to comply with the request, and other methods of obtaining the information will need to be employed ... HTH

  8. Thank you pet Happy New Year to you too. The claim is in process, expecting another pay out this week. I have to admit that although it's taken a long time (since September ), I have been well looked after. It's just the mess and work that gets you down. As for the job front, keep watching I await an update on your news ...

  12. Received a letter from BISL on 5 December stating that " The policy was set up via the internet [...]. When processing the application on-line, the box for PPI is automatically ticked and if the product is not required, the tick needs to be removed." ete, etc. Well folks, this is contrary to guidelines and industry regulations; if I am truly opting in then the box should NOT be 'pre-populated' ... tut tut BISL. A letter will be on its way ...

Almost sorted now, thank goodness, having learned an awful lot in the process, about insurance claims .

  16. Thanks for this point of law PT; I'll use this in POC if and when I need to. I understand what Bridle and UK are saying but I still feel that responses like these from DJs are less likely to happen than favourable ones to Claimant's well presented and argued claims. It will most certainly NOT put me off going to court. Well said HH and well said aa too ... 8)
  17. I think I suggested earlier that you check out the T&Cs if you have them for the HFC loan to verify the cancellation details. If you believe that this product has been mis-sold (this is your wife's loan?) then you will be starting afresh with the process of letters. You will want this product cancelled and a reduction accordingly in your payments with return of however much the premiums are and the interest attached to these.
  18. This is Dyanomo's Witness Statement .... let's have a play with it Is this OK with you D? 1. I, the Claimant, am a litigant in person in this case. 2. I make this Witness Statement in support of my claim against the Defendant for the refund of mis-sold Payment Protection Insurance and interest thereon, levied to my loan by the Defendant bank. 3. I make this Witness Statement from information and facts within my knowledge and which I believe to be true. 4. I signed a Personal Loan agreement with the Defendant on Date. (CRT1) 5. The employee of the Defendant talked me through Payment Protection Insurance. I informed the employee I was in stable employment in an industry where redundancy is unheard of. My employer also offers a death in service benefit and sickness policy of such a generosity that any insurance would be wholly unnecessary. (CRT2) 6. The Defendant’s employee informed me that although the paperwork featured the word “optional” this would not apply in my case. The Payment Protect Insurance boxes had been prepopulated with a cross indicating my acceptence. I requested the word “optional” to be removed from the documents. This was not and apparently could not be executed. I was informed that the Payment Protection Insurance would be a condition of the Loan, hence the prepopulated cross. Removing the word “optional” would void the Loan Agreement. I felt I had no choice but to sign the Loan Agreement. The loan agreement paperwork showeed that despite my opting out of the PPI, PPI had been added to the loan amont, which was against my express request. 8. I, the Claimant did not at any point fill out an Income Protection Needs Form. However, I was asked questions about my transport habits, previous accidents in my car, if I was a smoker, a drinker and family history of cancer. 9. I did not sign a Needs and Benefit form and I was not asked about my personal medical history. 10. I had a pre-existing medical condition for Asthma and back problems. (CRT 3) 11. On Date I wrote to the Defendant, setting out the nature of my complaint and requesting that the Defendant refund the mis-sold insurance and interest. (CRT 4) 12. Upon unsatisfactory response from the Defendant, Date I again wrote to the Defendant requesting a refund of said charges and advising I would file a claim should I not receive a satisfactory response. 13. Upon a further unsatisfactory response from the Defendant, on 1st February 2008 I filed a claim at Portsmouth County Court for the return of the charges levied by the Defendant, as particularised and details in the Particulars of Claim. 14. The Defendant acknowledged service of claim on Date. 15. The Defendant filed its defence on Date. 16. The Defendant maintains the insurance was optional, but at no time did they inform me of this. 17. There is, in fact, no requirement to take Payment Protection Insurance with the Defendant’s Bank and here I had been misrepresented and there had been concealment aimed at increasing revenue through PPI commissions. 18. The fact that HFC have already been fined by the FSA for the mis-selling of Payment Protection Insurance only adds weight to the fact that I was mis-representd and mis-sold PPI also. (CRT 5) 19. In answer to point 12 of the Defendant’s defence, I was not aware I was under any legal duty to bring the attention of a pre-existing medical condition to the Defendant. At no point was I asked my personal medical history. In fact the only medical question I was asked was about the family history of Cancer. I did not at any point make a false declaration. Summray 20. The Claimant asserts that the Defendant mis-sold the insurance. This is something that many of the Defendant’s customers must be suffering. Indeed the FSA have shown that the PPI is very often mis-sold, and in the case of the Defendant, has awarded a fine. The OFT and FSA have been very concerned over the behaviour of the financial institutions with respect to PPIs. As such most financial institutions are now refunding mis-sold PPIs. Where this has not been repaid, there are many cases where either the FOS of County Court, have ruled in favour of the Claimant. 21. Mention the Competition Commission report and FSA's TCF here ... STATEMENT OF TRUTH 21. I, the Claimant, believe the facts stated within this Witness Statament to be true I have played about with this in an attempt to suit your own case. Have a go yourself, adding bits that are relevant and appropriate ... Please note that there will be items that are not of relevance to your case!
  19. They are obliged to send you a Benefits and Needs document that is specific to your circumstances and not generic. They should also issue you with a keyfacts document ... Lovin' your Judge BTW ... he rocks!
