  2. Got to protect myself from them coming at me for costs after I discontinue C.. If they don't play ball I'll pay the hearing fee and go after them for the full amount plus all costs...
  3. I've had a letter from Tameside County Court today asking for The £110 Court Fee by..xX.X..Xx... Hearing date now set for 4th April.. Tameside C ounty Court. So, if I don't get my cheque by the deadline stated in todays letter, the Court Fee will be paid and the FULL amount will sought PLUS full costs.... Todays letter was sent 1st Recorded before the 12 noon deadline..
  4. Upon receipt of my letter of acceptance a cheque will be issued along with a Notice of Discontinuance to sign and serve on both the defendant and the court.
  5. I think that given the original charges were £184, I'm going to take their dirty money and run... ;-)
  6. I simply lost my copy of the agreement and did a CCA request in 2008, and got to digging it out over the weekend..

  8. I now believe that they have had no right to charge interest on this account from day 1 !! New letter being typed!
  9. I have also just found their response to my CCA request back in 2008, and it is no more than a copy of a Priority application form and is un-executed... Edit: It is actually an agreement, as the terms and conditions are headed CCA 1974... But is not executed..

  12. Hi everyone.... Hope we're all well over the Christmas and New Year celebrations now, and everyone is well.. I've now had from Northampton, an Allocation Notice to Tameside (MY) County County Court. I'm about to strat writing a letter to DLA Piper requiring disclosure from Aqua of how much it actually costs them to apply the default charge on a statement in the fully automated process etc.... Is there is a CPR that applies in making this formal request..? Thanks much...

  14. My initial thought is to respond directly to DLA, including the Detailed claim that I already have, as they seem to indicate that they want it?? And to copy that to the court.... And to get the N180 off by Special Delivery, what's the fee with the N180 is it £40 ? I do notice too that they've invited me to discontinue with a promise of no costs, what do you guys think ??
  15. And this from DLA...... Both arrived on Saturday, which leaves me to believe that Royal Mail has been sitting on them..
