  2. I am quite happy for them to make money from my money in a current account. I don't view this aspect as a rip-off. For them to then charge me ontop of this would be unreasonable in my opinion.
  3. Lizzy, are you saying you requested interest before raising a court claim? For anyone else reading, Section 69 interest CANNOT be added before you raise your claim in court. Well done on your achievement Lizzy and good luck to Flowerofsarum.
  4. Actually all current accounts in credit are paid for by the customer depositing their money with the bank. The bank can use their money to obtain interest for themselves. When I am in credit with the bank they make money from my funds. I refuse to pay them a penny for maintaining my account. When I go over any overdraft limit I refuse to pay any more than the correct penalty charge for my breach of contract and not a penny more.

  6. I've received my first bill from BT and there is a payment processing fee on it. Excuse me but what payment have they processed or am I being billed in advance for not having set up a direct debit with them!!

  8. If the LBA hasn't been signed for, then you've no proof it was received. I would advise that you send another LBA. Did your Letter Before Action state that you would be taking them to court? If so, why the change of mind? Which interest are you claiming? The interest they charged you on the penalty charges? You can't claim section 69 interest without raising a court claim.
  9. Please explain further. If you have no income then you won't be taxed is what I see, but you may need to clarify what you mean.
  10. I'd also make a complaint to the ICO if I were you immediately. My judge seemed disinterested in the bits of missing info I had from Natwest and told me she was unable to issue any penalty etc, and that I would have to take it to the ICO. I'm not sure she was correct here, and am extremely interested in how your case goes and what your judge comes up with. Definitely turn up and fight your corner. You'll probably find a solicitor from Next turns up, humbly apologetic and with great promises to rectify the situation, which the judge will allow as in my case. Make sure you receive absolutely everything you are entitled to receive before you close the case. Good luck.

  12. It would depend on the wording of the Fob off letter, but it is in your best interests to show that you have done all you can. Send a new LBA highting updated figures. Then show no mercy and take them to court if they do not pay. Good luck to your brother.

  16. Personally I'd accept nothing less than the total refund plus court costs plus the 8% you have now added to the claim. You are entitled to it all.
  17. A refund will reduce the balance that is due on your card. Unfortunately it does not normally count towards the minimum payment due when the statement is then issued. Hope that helps.

  19. It could be that you've a setting preventing them opening. Sounds techy to me - have you a pop up blocker or something you could temporarily turn off? Alternatively try my Chambers if you have no luck. I hope you will post your thread in your Bank's forum. Good luck with your claims.

  21. I haven't, but I believe that the banks will do anything they please. You could always fight as this would be retaliatory action, and a judge has awarded in favour once before for the consumer in a similar circumstance. Post your story in the HSBC forum, and you will get a lot of advice there. Have a good read around the site too. Good luck.

Have a check through what you have sent to the court and what CAG advise to send. It will all be detailed in the libraries and FAQs here http://www.consumeractiongroup.co.uk/forum/#libraries-bank-charges-materials It may just be that you have not been specific enough. Each charge must be detailed and arrive at a total which matches your claim. You may have done everything, but best to check. Good luck.
