  5. Download speed is certainly important. but upload speeds can be really snail like by comparison. typically 2.5kb on a 1 meg connection with most providers. They rely on the belief that people wil only download - not upload. Some suppliers do offer a better speed but not by much Hope this helps J

  8. Right the day for the preliminary hearing finally arrived, armed with two large folders and numerous printouts of CAG threads I atteded court. At five minutes to go the same solicitor apperaed with a big smile on his face, obvioously regarding me as a long lost friend. He was very pleased to offer me a settlement of abot 60% of the claim and took some pleasure in telling me that LTSB won a case the other day. I must watch too much daytime TV, I thought for a moment and said No Deal. After a bit of half hearted haggling guess what -- yes he settled for the full amount. Date of issue of MCOL 17 June 2006 settled 18 June 2007 As I said at the start of this thread this story is not typical dont let it put any one off - It can only happen to me J

  10. It striks me that the reason this site works so welll is that people rely on other members, be they mods or "just" ordinary members. The advice and guidance given is free and everyone is pulling in the same direction. However if we get a Trouble maker who either cannot abide by the rules or has malicous intent then they must be dealt with for the good of the site - so we can all eat garlic and hug trees in peace. J
  11. The court bundle is'nt as daunting as it may seem, read the sticky on the subject. If you do it you probably wont need it but if you dont you sure as heck will. [problem] seem to be contesting claims that they think are not prepared to go to court so dont give them that impression. J

  13. Lloyd are being inconsistant in what they settle and what they fight. I have a case ongoing for over a year now for £700 that they are defending to the hilt. see "it can only happen to me" in this forum J
  14. Yes did your SAR state all data, if so they must retrieve the info from their microfiche system. they will have it some where. Push the issue Lloyds seem to be saying that they dont have things more and more it may be a tactic Good luck J
  15. If there is no contract in existence then your ex employer is guilty of "slamming" your telephone account, that is taking it away from your existing supplier without your knowledge. Report it to OFCOM. Has your ex employer sent you bills to cover the amount that they are claiming? As regards the DCA simply dispute the account and asthe account seems to be a credit acccount serve them with a cca. This will mean that if they are unable to produce a copy of the original agreement it is unenforable J

Hoooray My friend has received a cheque from the ratbags They really are b******ds I have been to the county court offfice on several occasions recently and they are regularly seeking charging orders on people Its so far over the top that I doubt if its legal Thanks for your help spotnot Lets see what happens J

TES Tomterm8 I owe you a very large pint Thanks I have t think about this now, the loan account that they cannot produce the agreement for is paid in full, I am reclaiming the charges for late payment of installments. So the loan itself may be gone, but what about the interest on it? Advice any one Thanks John
  18. The 14 days are up I.N.D are now in default. It seems likely that they will be difficult to wring the cash out of so bailiffs dont seem to be an option. any advice would be welcomed. J
  19. They probably will use it to counterclaim against you but If you are paying a reasonable amount they will not want tha judje to award them £1 a week. I would say go for it but be prepared J

  22. Thanks for the support nic. One thing has been niggling away at my tiny mind. I yhink that I am correct in thinking that if a bank (or anyone for that matter) lies to a court in evidence or a statement it is a serious criminal matter. The witness statement of the branch manager states very clearly that The policy of the bank is to destroy all contractual document after 6 years, therefore as the loan in question was taken out in 1998 the documents were destroyed in 2004. The same information is repeated in a letter from [problem]. If this statement is true then all contracts and contracts with the bank would be destroyed after 6 years -- I dont think so I have checked the statement and this is exactly what was said Any thoughts any one J
