Preliminary letter went yesterday.
The fun starts here!
still awaiting data for loan account,
Has anyone else had to wait longer for loan account info?
MODERATED please keep to the one thread when updating
I received a huge wadge of documents from Cap1 today, extracted the ones I needed and sent the preliminary letter this afternoon.
A curious fact: although I thought Cap 1 had closed the account and sold the debt, (which is paid) the statements cover all the payments made to the collection agency and still show a credit limit and amount available to spend !!! all I need is a card!
we will see what happens next

I sent my DPA letter to CAp 1 on the 10th of may and received the data today
so I would guess that yours is due this week.
Times do seem to be getting longer, due no doubt to the sheer volume of mail that the banks are getting these days. No doubt they will claim that its our own fault for bombarding them with claims.

0870 numbers are available at no cost to the "owner" and will yield 3p per minute from day one. Thet can sit alongside your normal number and the revenue can be credited to your phone bill, if you play your cards right you can wind up with a zero cost phone service. I'm heading that way

well I finally got the statements (well most of them anyway) An odd thing, the covering letter refered to 6 years, I only asked for 5.
The spreasdsheet works really well Thanks Vampira
The request for repayment has been posted today, I await the standard letter
I posted the DPA letter and a cheque for £10 on May 10th - so far the silence is deafening.
I also noticed that they have not cashed the cheque as of todays date.
Is this a delaying tactic, I believe that I have read somewhere that the 40 days starts when the cheque is cashed??

I had a similar problem with NTL and the account being "frozen". I found that if you talk to a supervisor in credit control - not the person who answers the phone
They can access your account and alter service packages.
You do have to insist that you talk to a supervisor however - they dont like putting you through.
Another tack I took with NTL was a phone call to the regulator that worked almost instantly.
Good luck
NTL are one of the worst that I have come accross

I sorted a similar situation out for my mother in law with Powergen recently and got a monthly reduction and refund. This does appear to be standard practise in the industry these days particularly when the utilities are dealing with the more vulnerable sections of the community
Thanks for the support every one I think that lookingforinfo and Jonni are on the right track when they say that most of us are claiming for charges that we have already paid. The point is that I have not paid these charges- that is why Nationwide closed the account.
Therefore the "debt" that they sold is not lawful and cannot be colleceed by Nationwide let alone sold to a third party who have even less claim than Nationwide.
If Nationwide repay me the charges and I then pay all or some of them to a collection agency I am in effect still paying the charges but to a third party.
Surely it is up to Nationwide to recall the account and take the third party out of the loop?
Help, my heads hurting again.
An obscure thought came to me recently and is realy doing its best to drive me into a state of gibbering Lunacy, (not difficult I know)
Nationwide defaulted my flex account for £500 without any warning or (as far as I can see) paperwork.
They then sold the debt to a recovery outfit (Morecroft's)
This "debt" consists of charges which we all now know are illegal. If Nationwide repay these charges the theory was I would pay the debt recovery outfit.
But- If Morecrofts are attemping to recover an "illegal" debt this must be irrecoverable so can I refuse payment?
If you take it back one step do Nationwide have any right to sell a debt which consists of illegal charges?
This seems open up the vista of a whole new ball game
Help please before the men inwhite coats arrive.
I was defaulted by Lloyds TSB for £300 (all charges) I am just in the process of sending the DPA letter and I expect that I shall be claiming around £6-700.
does this help?
I understand that there is some movement by OFCOM to introduce a true "National rate" numbering scheme starting with the figures 03. so 0870 numbers will be seen more clearly as the rip off that they really are
Lloyds Tsb bad debted a loan account after I paid the agreed amount but refused to pay them over £300 for letters and penalties for non payment on the specified date although I asked them on several occasions to move the date. The loan agreement made no mention of any specific date.
I have since been contacted by debt collectors. Can I reclaim the money from Lloyds TSB to pay the debt collectors, or is there a better way?
