  1. ok now its interesting - sent off to both capital one and equidebt requesting copy of cca- recieved refund of my £1 from equidebt -and a copy of my cca from heatons not capital one tonight i rang capital one to arrange paying them directly only to be told they have sold the debt on to equidebt a while ago and i had to contact them regarding payment does this mean that heatons are doing something naughty?

  3. i have not actually spoken to anybody as i had the court summonses waiting for me when i got home- so i fired a letter off to them basically saying that i would like a full breakdown of the costs and a copy of all statements etc - and also that if they do not provide the relevent items i shall be sending a SAR- this i will do on friday as due to past experience with this lot i shall not get a reply within a reasonable period anyway- lets not forget though these jokers can summons you to a CRIMINAL court as easy as they are!!! surely its not right
  4. the court summons clearly says council costs and the small print then explains about the court costs being added- my council are deseverdly proud of their reputation for having one of the lowest outstanding council tax debt in the country- they just do not care
  5. i have started paying my council tax by direct debit on the 28th of the month after a couple of months due to tax credit problems (their error) a direct debit was refused the council cancelled the direct debit agreement i continued paying but made payments by the 14th of the month (two weeks earlier than being payed before!!) so i am never more than TWO weeks in arrears- taking pay date from the first of the month i got two reminders saying i was behind with payments after i had sent the cheque for those months today TEN days into a new month i have recieved a court summons inviting me to meet them on the 26th of october in court- only under their conditions though- excuses such as i cannot afford it will not be allowed etc You bet i will be - they have added £36 cost incurred by themselves- court fees added later! now after a fortnight of spending all my spare time looking at this forum i think i have found the achilles heel of my councils thinking it is goliath- and its minions will do as it says- they think they can do as the banks do and give out financial penaltys when they like!!! i have delivered by hand a request of the breakdown of their costs as this also means i am disputing the amount owed i am also eligible to appear in court to give my defence!
  6. but surely the key word that the council themselves are so proud of is service- if they are not providing it either whole or in part then they surely are not keeping their end of the bargain- my local council has one of the highest recovery rates in the country "its off to court and deductions from wages for you matey" even after june of the tax year!!!
  7. ah yes but you try to ring and you are informed that your call is being transferred to equidebt- same postal address as well!!!
  8. i have received a letter from heatons asking me to ring equidebt as i am now eligible for a reduction (against a ccj!!!!!!) i am sending a cca request to both capital one and equidebt. i have also written to heatons requesting that i pay the money direct to capital ones offices in nottingham as it is more convenient- requesting that any objections to this are made by capital one- this should hopefully show who now owns the debt!

  10. i have spent the last couple of days reading items on this site and i wonder if anybody could give me some guidance to the following- i have been through the usual capital one process, charges -debt collection agency etc, until finally it was passed to heatons who i now understand are a debt recovery agency and the debt has probably been sold on- i was given a ccj by heatons last year due to a silly mistake i made on the court papers ( i was honest and admitted i owed the money) so i currently pay heatons - does this mean that if they have bought the debt and i have no credit agreement with them they have falsly obtained a court judgement against me? if so how do i sort it out- obviously i shall then start chasing capital one for the charges as well!!!
