  2. Ok, the plot thickens. I wasn't able to speak to anyone at the court. I followed the link in your website to MCOL and it takes me to a screen I had never seen. When I try to login it asks me for my government gateway user ID, I never had one. So I tried the recovery process and it says that "There is no Government Gateway user ID associated with my email address". When I submitted the claim the user ID was my email and I setup a password. Do they have 2 parallel websites???
  3. Ok, thanks, I was told it's 14 days for payment. However, in my husband mcol there's another claim, 2 years old which the defendant paid, but it's got the exact same page as mine, no enforcement link and it's been like that since judgement. I've been on hold with the court for 45 minutes for clarification but no answer yet.

  6. I have done that but it takes me to an information page, no way to start enforcement. If I login to mcol it asks questions for a new claim. I'm truly lost, don't know what to do.
  7. Help! Mcol is asking for the particulars of claim. Am I on the wrong page??? What do I write there? Something like this: Judgement was issued by the County Court on 04th May 2023. To date Defendant failed to make payment. Or something else?
  8. Ok, thanks. I don't think there's any chance they'll pay up without enforcement, so I have decided to go ahead. From your link I see there are a few options: a warrant of control an attachment of earnings order a third-party debt order a charging order Forget about the charging order for obvious reasons. Being a company, can I apply for an attachment of earnings or third party debt order? Or is the warrant of control the safest bet, considering it's around £350 all inclusive?
  9. Even if they pay immediately after, so before they're notified? For example, I enforce today and they pay tomorrow morning without knowing that I have enforced. Do they still get to pay the enforcement fees?
  10. Gonna do it today. One question: what happens if they pay after I start enforcement? Do I lose the enforcement fee?

  12. Don't know, probably because one of the tricks used by shady companies is the "working days" rather than calendar days. So I got into the habit of specifying all the times.

  14. Ok, I called the county court and the judgement was issued last week, they sent it to me via email. Now, do I: 1. Contact the company and tell them to pay? 2. Instruct county court bailiffs? 3. Transfer the case to high court bailiffs for enforcement? These are the 3 options I found online. Thanks!
  15. Ok, thanks. Can they claim that it is dvla fault for the delay? For example, can they say that they immediately requested the keeper's details and dvla took 3 weeks to disclose them? Would that be an excuse that the court might accept or it doesn't matter what, they must comply with pofa?
  16. Trying to learn here, please bear with me. So their argument would be that there's a sign at the car park entrance, although not readable from inside a car. I read in the BPA rules that they have to warn the drivers on entry that there are t&c for parking. Then they need to put sufficient signs with t&c around the car park so one could decide whether to park or not. Is their failure in the fact that there should be a sign on entry stating that there are t&c or something else? Because the only readable sign is the blue one saying customers car park, 4 hours free. On a different subject, they've not mentioned pofa in their ticket, does this mean that they're not going to rely on that if it goes to court? (They're out of time 14 days). If not, what would they rely on to extract money from the registered keeper? One last question: am I right in thinking that because this is a civil matter I do not have any legal obligations to disclose the driver's identity? Thanks

  18. I don't think so. My husband issued a mcol last November exactly as I did but for a non delivered item. He got the same message on mcol and 2-3 days later he received a letter confirming the default judgement.
  19. Hi, my husband made a dashcam video of the car park. If you notice, as you enter and park, there's one sign on the left with their t&c, too small to read from the car. This is facing out, so you enter, park and go to any of the retails near the road (pizza hut, burger king, taxi controller and a grill restaurant) and you won't see any of their t&c signs.   21. Still nothing from county court in today's mail. On mcol it says not to contact them, but it's been 2 weeks now. 2 bank holidays though. What do you think?
