  1. Just to be clear: it's free to park for 4 hours, no way to pay after this period. You either leave or use an ipad in one of the shops to extend the staying. They have a no return within 2 hours policy. Never mind if one parks a car for 10 minutes and then another 10 minutes within 2 hours, they want money. But if one leaves the car for 4 hours they're ok. Where's their loss? Car park is always almost empty.
  2. @Nicky Boy Hi, I don't understand why it doesn't comply. Section 8(2)(b) says: inform the keeper that the driver is required to pay parking charges in respect of the specified period of parking and that the parking charges have not been paid in full; That's what it says on page 2 of the invoice under "Protection of Freedom Act" Am I having a blonde moment?

  4. I don't remember why there are 2 visits. Could've been one by me, one by husband or any other combination. Forget about a valid reason. Last time we couldn't find the landowner. It would appear that the land belongs to a university and there are a few retails on there. Burger king, pizza hut, bingo, ten pin and cinema. We all use that car park to pick up/drop off kids from the 3 schools around there. Although schools tell you to park there, they have no agreement with the landowner; explored this avenue last time. So, what's the difference now that they've mentioned PoFA? Also, if my calculation is correct, the letter is one day late past the 14 days, correct?

This time Protection of Freedom Act 2012 is mentioned. Details: 1 Date of the infringement 21/11/2023 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 31/11/2023 (this is the date issued, but infringement is 21/11/2023) see scanned file 3 Date received 06/12/2023 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [Y/N?] Yes 5 Is there any photographic evidence of the event? Yes, very grainy 6 Have you appealed? [Y/N?] post up your appeal] No. Is the advice still to ignore unless they send a letter of claim? Have you had a response? [Y/N?] post it up N/A 7 Who is the parking company? Parkingeye 8. Where exactly [carpark name and town] Leisure West Complex, Feltham For either option, does it say which appeals body they operate under. Popla This is it really.   6. My previous ccj was satisfied within the 30 days. I don't know if they have others. Strangely all mail from tribunal and courts are never received by them (so they say). But even more strangely, they receive mail when the game is up and they need to pay. Can they restart the process in any way by claiming that they didn't receive the mail?
  7. I can't because I still work for them. I've been careful not to give too much away in case they come across this.
  8. Hi everyone, following my complaint to the court, I received an update. In summary the bailiffs have tried to contact the company by phone and letter, but were unsuccessful. They're going to visit the premises in the next 10 days. So, let's wait and see. Thanks for your advice, it worked.

  10. Yes, I have applied for the execution via mcol and paid the fee. I also received a letter confirming the warrant number. It's been too long and nobody replies to my emails. Telephone lines are unattended as said. I don't know what to do.
  11. Hi, I've sent several emails to the court to get an update on the execution of this warrant, but I received no reply. I do receive the automatic reply saying that they will reply in 10 days. Phone line keeps on hold for ever, the other day I kept it going for 3 and half hour, no answer. What can I do?
  12. Hi, sorry for the delay in replying. No, they haven't paid yet. I sent an email to the court but they haven't replied yet. Their phone line keeps on hold for hours, tried twice and gave up.
  13. Yes, I know. It's just nice that they'll have to pay. Someone's head will roll for having ignored the claim, and they deserve it.

  16. Good morning everyone. I haven't heard anything since I received the letter confirming that the warrant has been passed to my local court. I read online that the bailiffs will write to the defendant and give 7 days to pay and if they don't, after 15 working days from when the warrant was issued they'll visit their premises. Is this correct? Thanks
  17. Yep! Lots of fun I bet they'll run to their solicitor and find a loophole to suspend the judgement and restart the process. After all royal mail shreds all mail that comes from courts accordingly to them
  18. Hi everyone, yesterday I applied for a warrant (£83). The judgement was issued on 27/07/2023 and they didn't pay anything. They didn't respond to any court communication, so most likely they will claim that once again they didn't receive anything. I wrote to them once questioning how bizarrely royal mail selected important mail addressed to them and shredded it. They said they would've complained to royal mail about it My understanding is that the ccj will now stay on record because they didn't satisfy it within a month, is this correct? And I know the consequences for an individual with a ccj on records, but what happens to companies? Do they get bad credit rating and have any sort of trouble? I hope so. Thanks
  19. @Emmzzi That would only happen in a company run by people with common sense. Let's not forget who we're dealing with here.
  20. Why not? Genuinely, I knew they would never release those documents otherwise the ET claim would've been totally lost for them. Now, as my husband anticipated, they would either leave me alone or start messing me about with change of shifts again. In that case, this time I will not agree to anything, continue my shifts and when they sack me take them to ET with a much stronger case.
  21. BTW, I agreed with my husband to sent an email to the tribunal to withdraw the claim, considering the legal advice we received.
  22. They have a mix of paper and digital files. I will ask for their personnel data storage policy, but from a company that doesn't even have a social media policy, I don't expect anything positive. I tried to take my own notes and I was accused of secretly recording the meeting because they were too accurate. I'm sure some of you think I'm making this all up, but rest assured that it's all true, I swear on my kids life.
  23. Thanks everyone. I expect an email in the next few days inviting me to a meeting to discuss this. Considering the runaround they subjected me to and the fact that minutes never match what's said (they claimed i agreed to things when in fact i totally disagreed), I'm only going to attend if they allow my husband to be present as a translator and supporter. They'll never allow that again. The only time they let my husband attend a meeting he made mince of them. When he asked for the hand written notes at the end of the meeting they refused and he threw the book at them in the form of acas guidelines. They weren't pleased!
  24. Well, the 2 main points are: 1. They claim that when I showed them my passport (did this twice), they took a copy, marked as "original seen" and sent to hr. Then hr shreds these copies, but there's no trace or note that this has happened or that hr ever received the copies. Also, in the first disclosure they sent me a copy of a previous expired passport, so it doesn't look like they shred them. They've denied sending this passport copy, but the disclosure is on a .zip file, so they can't really deny it. Now they've asked for my passport again, so it looks like they lost the last 2 copies. 2. They insist in saying that they were not passed any document regarding my flexible working agreement when they took over under TUPE. After the first ccj they disclosed a rosta that I was doing in 2017, before the fwa. I asked many times how they knew what shifts I (and everyone else) was doing at point of TUPE transfer but they refused to answer. Basically they want to avoid admitting that I've been doing fixed shifts since late 2017. These are the 2 things that I think are not compliant with dpa. What do you think?
