  1. Wow, thank you so much for detailed reply BankFodder! Understood, I will not take the warranty repairs and leave the car outside of my house for time being. I was also confused when both companies told me I have no rights, but thinking about it no wonder with finance company not wanting to take a hit. I have in fact just spoke with Black Horse and advised them what you just told me to do. They have advised me that they have this logged on system and that I want to reject the car. However, the man on the phone has advised me that the vehicle still needs to be inspected and report given to them before they can proceed further. I have advised them that I would be happy to do that as long as the vehicle is not being repaired under the warranty and that only inspection is carried out. Does that sound correct? Should I let recovery vehicle take my car to the garage? Yes indeed it is correct dealer! I will get on with the letter now. May you please advise if I should send the letter to both companies via email or physical letters and get paid postage receipts? Thanks
  2. Sorry, I didn't know how to edit the post. I have just spoken with finance department at Black Horse Trading. I explained the problems to them and advised that I want to reject the vehicle. They advised me that this cannot be done. They must take the vehicle to authorized garage on Thursday 17th of June and confirm what the problem is before they can help. They will arrange for recovery truck to move the car to garage. They will try to resolve the issue for me afterwards. How would I protect myself before it goes onto the recovery truck in case damage is caused? However, I am still not confident with the car and I believe I will have further problems down the line. I want to hand it back. They didn't really care that I have kids to take around to school and I have no means to do so until the car is back. They cannot provide courtesy car. Sounds like this will be a lengthy process to say the least.. Thanks
  3. Hi guys, I have purchased used vehicle on finance, on 1st of June 2021 from Big Motoring World (Audi A7 - 2016 plate). On 7th of June I noticed a vibration on wheel and noise on passenger front side when braking. I logged the problem on warranty app that comes with the car (3 months). I took the car to local independent garage on 9th of June. They advised me that brake discs are slightly warped, and disc pads needs replacing. Invoice and diagnostics sent off to BMW warranty team. They are not happy with the price quoted and asked me to take the car to Halfords auto center. This is fine and I am happy to do that. However a real problem started this morning 11th of June. I heard a loud whistling noise coming from under bonnet when I accelerate. I suspected this was a turbo noise. I took the car to local independent garage and been confirmed that the turbo is gone. Been advised not to drive the car. I called BMW warranty department and they have given me details of approved Audi dealer. The garage gave me appointment to diagnose next week Thursday 17th of June. I am no longer happy with this, meaning I will have no vehicle for at least a week and have no way of getting my family around. I thought about the issues that are occurring within the first week and I decided that for peace of mind I would like to hand the car back. I suspect it will cost me arm and leg if I do decide to keep the car. I called BMW after sales team and advised them that I would like to reject the car and return it back. They have advised me that they don't offer that option and that is not possible to do so. Now, I thought under consumer rights I have 14 days to cancel this? I have paid 3000 pounds deposit and remaining is on finance. What are my options here? What can I do? Any suggestions please? Anyone has had anything similar happen? I am on the line to speak with the financing company to see what they tell me and what my options are. Many thanks for any suggestions.
  4. Good morning, Hoping you all are well. After 6 months of silence, I have received two letters (Notice of Debt Recovery) from DCBL that they have been instructed to collect the outstanding balance of 170 quid for unpaid parking charge. First contravention dated 15/09/2020 at Hallsville Quarter London - Basement. Overstayed by 44 minutes. Second contravention dated 25/10/2020 at exact same car park. Overstayed by 29 mins 29 seconds, even though on the claim letter it says - Time in Car Park 1 hour 30 minutes. I have sent snotty letters for both contraventions, but have had no response. The first contravention dated 15/09/2020 is on this post. Not sure if I have to post the second contravention as another post. Please can someone give me advise on what to do next?   5. Hi, I am in need for some advise please. I’ve been working for company over 12 years. Have been on furlough from March until end of October. At the end of October company announced that the building I was working at will no longer be operating and it’s being given back to landlord. I have been put on garden leave with 12 weeks notice period until 18th January 2020. I heard from some of employees that the company will be going to administration. The question is they are trying to sell contracts from online business to potential buyer. If they do buy, does it still mean the company can go into administration? Does that mean I will have to claim money for redundancy from the goverment? the problem is that no questions are being answered and no updates being given. Simple response such as we will be in touch nearer the end. What should my options be to ensure I am somehow protected after all the years I’ve spent with them? I know a lot of other employees are being paid redundancies as they move. Thanks

  13. Hi there, There was no changes to my vehicle, I've had it for 5 years and my address is correct with DVLA. I have done the following directly with the manager of Morrisons and the gym, however have had no response at all. Should I be preparing for the worse, and if so what can I do? Thanks

  15. Hi CGA, Here for some help again please.. Been issued with PCN for overstaying in the gym by 44 minutes, total 2 hours 44 minutes. Usually get 2 hours for free, and longer if I punch in my car registration at the gym which I forgot to do. Is there anything that I can do to fight this?   17. Hey guys, Update: I have done as Eric suggested, however have had no response yet from courts. Good news is that I received a letter from CEL last night and it states that the claimant discontinues proceedings for the whole of this claim! Looks like they got a bit scared of the bill I will double check with courts today to ensure this is true. Again, this is 2/2 cases I have won against CEL with CAG help!!!! Thank you to everyone involved and I have one more to fight!
  18. I just phoned up the courts and was told that it can only be postponed by filling out form N244, paying 100 quid and if the claimant agrees they can change the date, otherwise its 250 quid. Does that sound right?
  19. Unfortunately at the time my work did not require me to travel, until 2 weeks ago I will try to ring the courts tomorrow to see if they can change the hearing date.
  20. District Judge has considered the statements of case and directions questionnaire filed and allocated the claim to the small claims track on 13th January 2020 for 1 hour. Claimant has by 16th December 2019 pay the court trial fee or file a properly completed application, otherwise the claim will be struck out with effect from 16th December. I have a few questions if possible to get an answer from anyone please. The following directions apply to this claim: 1. It says that each party must deliver to the other party and to the court office copies of all documents on which that party intends to rely at the hearing no later than fourteen days before the hearing. My understanding this will my witness statement, images of the parking area, out of time sent NTK documents. Is this correct? What else am I not thinking about? 2. I have to leave country for important work trip from 10th to 19th of January 2020. Is there anything I can do to postpone this case since its booked for 13th January? Thanks!
  21. Thank you Andy/DX. I should have called them to check myself, sorry for wasting your time. It was indeed court error. My N180 was received on the same day as the letter got sent out. No need to send it again :) Thanks and I will be putting my time in preparations to this case.
  22. Good morning, I have received a letter on Tuesday dated 26 Oct that my case has been transferred to my chosen court for allocation and judge will allocate the claim and give directions. Now, last night I have received a letter form courts also dated 26 Oct that says following: The defendant, you have been sent notice of proposed allocation to track which specified the date by which you were required to return the directions questionnaire. You have failed to file the directions questionairre with the CCBC by the date specified in the notice. IT IS ORDERED THAT The defendant must file the questionnaire on or before 7 days from service of this order with CCBC via post, via document exchange, or via email @... If the defendant does not comply with this notice your defence/counterclaim will automatically be struck out without further order of the court, subject to the claimant having complied with this order, the claimant will be at liberty to enter judgement. Right... so I have sent out the questionnaire, but I guess it never arrived, or it arrived late (I have proof of sending receipts). Now my question is today is 31st, and I have 2 more days for letter to reach courts. I will send this out first class special delivery today. Would that be the correct thing to do, or its best to send them via an email and explain that I was on holiday, thus my questionnaire was not delivered in time due to letter arriving while I was away, or is there another option that is faster I do not know about? Can someone please help me? Thanks
