  5. Hi guys, I'm back again for advice. Only this time it's for my partner, and not me. A wage overpayment was made and unnoticed for a while. Then the work stopped and they realised the error and chased payment. A reasonable payment plan offer was made, bearing in mind my partner's unemployed status, and it was rejected by them. Nothing was heard for a while and then a letter dropped through the letterbox from Northampton Courts making a claim. What to do now? We have never faced this before. Please can someone help. Thanks.
  6. UPDATE : Just had a letter from the DCA after I sent them the letter Brigadier supplied, asking them to furnish the banking details re the supposed payment I made and disputing the SB status. In it they say that they maintain that the debt is not SB, but have failed to provide any proof of the so called payment. They then go onto to say that even if it was SB it would still be payable. They are willing to accept a discounted offer if I contact them ASAP. Does this letter even warrant a response? Thanks.

  8. No Brigadier. The reply from Lowell was after my SB letter in the beginning. Have sent your letter to Capquest. Awaiting Robinson Ways investigation outcome. And as above Lowell has agreed with SB.
  9. UPDATE : Had another reply from yet a different DCA (Lowell). This one has stated that after investigating the matter, they agree that the Statute of Limitations applies. They have closed the account and I will no longer be sent any letters etc. Hmmmm. The plot thickens!
  10. Sorry for being thick, but do I send this to the DCA in question, or a regulatory body, or both? And do all the XXXXX's represent the name of the DCA? Thanks for your help Brigadier.

  12. UPDATE : Another day, another response letter. A different DCA has sent me a letter stating "they are investigating my claims regarding SB and they are putting on hold any collection attempts until further notice". Hmmmm.

  15. Yes, they provided a date which means according to them, my SB doesn't come into effect for about 2 or so months. Does that sound a bit fishy? Thanks.
  16. Well, as I said above, I have not at any time made a CCA/SAR application. So what's the next step? Send a letter asking for proof, or just wait for them to send me proof? Thanks.

  18. Hi Bazooka Boo. I have a thread elsewhere that details all of the debt collection agencies that were chasing me. 'Sick of Debt ....' Long story short, I had some defaults and a CCJ on my CRA file BUT, these have all expired and been removed. The DCA in question is Crapquest. Should I just ignore them until they provide proof or should I send the above letter? Thank you for helping me. I honestly don't know what I'd do without you guys.
  19. Just had a letter back after sending out an SB notification letter. In it they claim the debt is still valid as I am just short of the 6 year period. Why? Because allegedly I made a £1 payment! Seriously???? Is there a follow up template letter for this sort of nonsense? Thank you.
