Eviction
pocketstapler replied to victoria2's topic in Residential and Commercial lettings/Freehold issues
You won't have to go back to court if you keep to the terms of the suspended order. If you fail then the lender may apply to execute the order, but you will have the chance to ask for the order to be suspended again using court form N244 -
No.....But DO NOT pay for advice...It's all available for free.

You will need to fill in N244 to vary the terms of original suspended order. Would also help if you complete a full Financial Statement & a Debtlist. Both these can be sourced from National Debtline, CAB or Stepchange.

Kensington will seek enforcement of eviction at court. You MUST attend and make your case with a renewed offer of Mortgage plus £x per month. The Judge will suspend the order again on said terms if he deems your offer viable. You should seek help from your local Money Advice Centre or Citizens Advice Bureau immediately. If none local contact National Debtline ( Just Google them for contact details. All provide free help. Contact them ASAP> Good Luck.

You MUST go to the Court Hearing. If there is a Free Duty Adviser in court speak to them - they will negotiate & represent you in court usually. If not go into the hearing yourself equipped with a financial statement (U can download one free from CAB or National Debtline) and your reasonable offer of repayment (i.e. Current Mortgage plus £x per month off the arrears - also the date you can make first payment) Unless the Judge is a bit loopy your offer will be accepted. Also if no Free Adviser in court ask the usher to point out the Bank's solicitor and put your offer to them - Often he will agree terms before the hearing - don't be bullied or feel intimidated, if they don't agree to your reasonable offer just put it to the District Judge in the hearing. If your offer is reasonable given your circumstances 99.9% of Judges will allow it. Good Luck

Have to say ...........There is Very rarely any mileage to be had from ANY form of dialogue with a bailiff! Also have never known bailiffs to try and recover any charges if the debt is paid directly to the Council. Even if Council refuses to negotiate make payments to them anyway, not to bailiff. DO seek advice from CAB etc
-
You do NOT have to pay either...........disabled bays outside residential properties are NOT enforceable.............contact your local council

Yep - Usual procedure. There should be a duty solicitor in court when you attend - make sure you ask to see him when you book in at court. Representation will be free. Good luck m8

IS/HB + expected windfall/what happens to my claim?
pocketstapler replied to Henry_Lloyd's topic in Benefits and HMRC
You may be able to keep your benefits if you have essential house repairs etc.........but seek advice regarding 'deprecation of capital' first from CAB or other advice agency. -

It seems u r getting some rather dubious advice here. If u r unsure what to do next phone CAB or other advice agency for help and advice. -
Be VERY careful ............if the lender tries to repossess from your landlord u will have no rights and will be evicted without notice . Monitor your mail for letters from lender so u know whats happening.Seek free advice from CAB National Debtline etc

Contact your local Council and ask for the 'Tenancy Relations Officer' - They can advise you & can talk to your landlord on your behalf - If landlord is non compliant they have the power to prosecute him/her. Good Luck

Search locally for Carers organisations such as Care for the Carers for advice & support. Local CAB or Council will be able to tell you of local ones. -

NEVER give personal details to unidentified callers. DWP do visit in some circumstances but would normally write. Best wait & see if you get a letter or you could callthem to find out if call was genuine or a [problem]. -
lots of old debt - thinking of a DRO?
pocketstapler replied to parker181's topic in Debt management and Debt self-help
Typical Wescot tactics. Don't phone, they will only try to bully you. Send them a letter explaining when you will pay. Unlikely that they will send a doorstep collector (Who won't be a bailiff, just someone working on commission for what they collect) but if they do just give them a copy of the letter and shut the door. You will prob get letters threatening all sorts every week - usually empty threats designed to scare you into paying immediately. Speak to National Debtline for advice if you are still worried - It's charity org so advice will be free. Good Luck- 18 replies

Debt Managment Ltd sending txt to my phone
pocketstapler replied to Nishikigoi's topic in Debt Collection Agencies
Ambulance. Chasers....NEVER. respond as you will get bombarded with marketing texts E=Nishikigoi;3869681]I've been going through the DCA's as they have popped up and with CRA requests etc they have pretty much all given up. A while ago I dumped our land line number when we swapped from BT to Virgin and did the same with the mobile so it's been peaceful! Just keeping an eye on my credit file (via deal from bank with travel/mobile insurance for a good price BTW) and it's just a case of watching them drop into the SB abyss over the next few months, lord know I tried to get this sorted with the original creditors but that was like pushing water uphill so I have no issues with the situation. However on a pretty new mobile number (couple of years old) I just got a txt from Debt Managment Ltd, I'm not going to call just wondered if they are chasing and got my number or are they just one of the PPI ambulance chasers?
