  2. Don't think I have proof of the payment as it was made via a postal order.
  3. I made a mistake. I looked at the letter again and it states that Vanquis advised that they have no record of receiving a Data Subject Access Request (DSAR) from me. It is confirmed that a Section 78 request for copy documents was made; this was sent to me on 31st October 2011. If I wish to request a DSAR at this point, I would need to make a application in writing direct to Vanquis enclosing the current fee of £10.00. What confuses me is that it took them 4 months to tell me, and if I never made the request then why did Vanquis ring me asking what the Subject Acces Request was for. I have paid my £10 and not received anything. Is it too late to complain to the ombudsman? P.S. it's not the first time Vanquis has lied!

I received a letter from Lowell today after not having anything off them for over 4 months since I sent Lowell a letter stating that I had SAR'd Vanquis Bank back in Oct 2011 but not had any sort of reply. In the letter I received today from Lowell, they state that Vanquis Bank sent my SAR to me on 31st October 2011 and that if I want to SAR Vanquis Bank then I need to send Vanquis Bank £10 within 14 days. I have not received the SAR. Do they send the SAR out where someone needs to sign for it? Why has it taken over 4 months for Lowell to tell me this? What should I do next? I have already paid £10 for a SAR that I never received.

After not hearing from them since they placed my account on hold on 28th November 2011, I received a letter today from a Mackenzie Hall stating that "Despite repeated requests for payment your overdue account with out client still remains outstanding. Accordingly, we may now have no other alternative than to advise our client to take such further action as may be appropriate." I have not had any other letters from 1st Credit or Vanquis. Anyone got any ideas what to do now? I was thinking of sending them a letter along the lines of that I sent Vanquis a SAR on 10th Oct 2011 and a further letter on 20th Oct 2011, and the last letter I got from 1st Credit was on 28th November 2011 them placing my account on hold. I am still waiting for my SAR, even though I have paid the statutory amount of £10 to Vanquis.
  6. Hi I did try lol, but nothing jumped out at me. It was a application made online, and if I had seen a printed document I would have noticed it (urgo I only saw it when I had a printed copy of my original credit agreement). Do you think that the wrong sex makes the original agreement unforcable?

  9. Not really, but 1st credit started contacting me at my works address, and it has been over 2 months since I originally sent the SAR to Vanquis Bank
  10. Will that be everything? The fact that 1st Credit never followed correct procedures as well? Can you download it now? I zipped it up

I received this end of last week as the result of me sending a letter to 1st Credit stating that I am waiting to hear back from Vanquis Bank regarding a SAR that I issued to Vanquis Bank, I also enclosed both the letters I sent to Vanquis Bank. What happens if Vanquis Bank does not respond to the SAR? I originally requested the SAR on 10th October 2011, then a followup letter on 20th October 2011.   12. Remember there were 2 Accounts that were passed to Lowell. I have already Stat Barred the other one (that's just under £1000) and they have accepted it is and closed the account. I will send the exact letter to them that is based on a letter in the CAG Library. Best get it sent tomorrow
  13. Last payment was made on the account on 13th October 2005, as it's 6 years + 1 month do you think enough time has passed to declare it stat barred?

  17. Scanned Credit Agreement - Edited.pdfHi Please find it attached. I had the flu last week so was off work. In their letter, that I received last Monday (8 days ago) said that I had to contact their office within 14 days to arrange payment. They are again sending me text messages and emails asking me to contact them. In fact in a text I received yesterday says "1st Credit are now dealing with your account balance of £xxxxxxx in relation to VANQUIS BANK. Please call us on xxxxxx quoting ref xxxxx" - This confused me as I know they are and They know that I know. Even if they wanted me to contact them within 14 days from the date of the letter, then that would be this Friday. I have not heard back from Vanquis regarding the SAR, that was sent on the 10th October 2011 and a futher letter on the 20th October 2011 asking them to return the Postal Order so I can amend the "PayTo" field. What should I say to 1st Credit now?
  18. Got the copy of the CCA (but it has me down as a female), not had a reply from Vanquis yet. What's next?
  19. Hi My partner and her family have always had loans with Provident, which is collected at her sisters house. A few weeks ago my partner received a letter stating that she was in arrears by £120 and to pay it immediately to catch up, any problems then to talk to the collector but the main thing was to carry on paying. The issue they were having was the number of different collectors that kept coming, I think it was about 4 in total that changed every week or so. She has only missed 1 payment, and she spoke to a doorstep collector who agreed that if she had missed then it is usually caught up the week after - as she wants to clear it as soon as possible. But she is still 1 week behind. This guy said that because of the different collectors and that their printouts didnt match up with the loan book that is left at her mums, he will arrange to get the arrears written off. Next thing she knows that his manager is at our house trying to sort it out, but in the meantime to continue to pay. He also changed the day back to the Monday even though Provident agreed that they all got collected on a Tuesday. He wanted a payment to be made on her debit or credit card, which my partner declinded. Another doorstep collector turned up at our house yesterday for the money and she explained that she hadn't been out and can she come back tomorrow when she collects everyone elses. The collector said that her area manager - the on that was out last week that wanted a debit card payment - wasn't bothered about anyone elses, just her payment and that she wasn't supposed to leave until she got the money. He said that if she cannot pay then to take her debit card details and he can take the payment, she also offered to goto the bank for her to take the cash out and then she can change her pin number tomorrow. Obviously she declined both. As her and the kids were ill, she arranged for her mum to pay and she would pay her back today. Now when the collector turned up today for everyone elses, she explained something to my partner which she is confused about. Last thing I knew was that her loan book was taken away by this manager. Has anyone else had problems with Provident and any ideas how to sort this out? I am tempted to send a letter to Provident head office outlining a complaint of harassment and things not being done even though they were promised. Any idea of a letter to write?

I also got ANOTHER credit card statement from Vanquis saying that I still have a credit limit and my minimum payment due is £1,297.26 It says, where the transactions are normally, that "Please make sure you leave enough time for your payment to reach your accoubt by the payment date shown above" then "Your details have been passed to 1st Credit limited to recover the outstanding debt. Please contact them directly on ... With any queries" Not had any separate letters or saying that the debt has been transferred to 1st Credit
  21. Had a letter from 1st Credit saying: The document you have requested is retained by our client. We will therefore advise then of your request and arrange for the document to be sent to you as soon as possible. Should your request also include the below documents, please be advised of the following: Deed of Assignment - we would refer you to Section 136 of the Law of Property Act 1925 which provides that the debtor is notified of the assignment of the debt in writing and not a copy of the Deed itself. Copy statements - there is a charge for this information. On receipt of the copy agreement we would expect you to contact this office immediately to arrange settlement of the debt. Is this good?
