  3. 5.3 Off-street car parks The Blue Badge scheme does not apply to off-street car parks whether local authority or privately owned. • Advisory spaces are marked out for the use of disabled people, but they are not enforceable and there is no legal sanction to prevent other people using them.   5. I did post up a document from the House of Commons library where it clearly stated that disabled bays on private land are advisory bays only and cannot be enforced upon. If you look at my previous posts you will find it.
  6. Plain and simple answer. If you fail to check your allowance and go over the limit its your error. Try to get more through customs and get caught again your error. If you flaunt the rules and get caught it's your mistake. This is what 'random' searches are for. They already know you have too much before you reclaim your bag. I would travel to Amsterdam about 60 or so times a year, I would be stopped almost every time. Did it bother me? No! Why was I there? As a courier I would drop off/pick up aircraft parts for clients from Schipol Airport. Just because the destination was Amsterdam most would think drugs! You'd be wrong in my case. Getting stopped at the BORDER is what customs do get used to it and don't break the law and hope to get away with it then complain!!! Sorry to the OP and others but that's it plain and simple... Don't like it? Don't do it!!
  7. Change in circumstances can take upto 12 weeks in some cases. Keep your LL informed and up to date, if need be call to Council weekly for an update too. If you take or send any new information to the LA it pays to get a receipt for your documents, this could help you if something goes wrong.

  12. Were you stopped for the offence at the time? Please be aware that the Police are now training civilians to speed watch their communities. It may have been one of these.
  13. Well my battle with VF has ended well for me because I fought tooth and nail to win. I got my negative markers removed and an added bonus of all markers removed. I haven't heard from Very Fudged (VF) FOR SOME MONTHS NOW. 9 months or there abouts before I kick them in to touch for ever and NEVER TO return...
  14. The PCN is invalid it's the wrong offence code for the bay. Not only that these bays are NOT covered by the order as no plate is displayed. The correct code should have been 40. If at all. Have a read of my attachment above. These are known by a different name and you should continue with your appeal to all levels...
  15. First of all stop looking for the Judge you will find a whole heap of hurt. Do not go down this route any further please. Why not post up a redacted copy to view of what you have so far? I had an A4 box of information to sift and only 3 days to complete and write an appeal statement. The result was I was exhausted.. But the ends justified the result. Take a break and consider asking a professional to assist you, we can advise to a point without having the evidence in front of us all of it, it appears you do not have all the required information either, please request the next appeal then politely ask for an adjournment. State you need to acquire further evidence to support your appeal this will normally be granted. Lets leave it for tonight and pick up in the morning when you are more alert? Mike

  17. Fletch have you considered a SAR to the Health service? Its by a long way the best way to get all of your information. Due to unforeseen circumstances (hack) it may take a little longer. To give you an idea, the advisor that tried to appeal in a case recently had all the information but had laid out the appeal totally different to what would have worked, I advised on that one and the appeal was won. Trust me my friend it is all in the details and the words and gestures' used! These forms you fill in are designed to help you fail in getting your claim because the answers given are easy to totally misunderstand. To give you an example. Example. Do you need any aids to assist you to cook? No. In my case Yes! Why do you need an aid? I have had a stroke and I have a weakness on the right side of my body, my grip is affected. When cooking I use a saucepan, I have to use one that has a rubberised handle so I do not burn my hands on the handle it also helps me to grasp the handle better, I have burnt my hands often in the past. It is a safer pan to use to prevent harm to myself. I am also supervised when learning to cook. This is just one question that gives you an idea on how you can wrongly answer it. By answering No you have shut down any chance of getting the help you need. It's not about lying it's being honest and fully understanding what is actually required to complete a task often and in a safe manner.

  19. Rather than make a new claim have you considered a change of circumstances' with better prepared reports from those that care or guide you, this includes GPs Hospital Consultants and the like?   22. Starting at link one, I am aware of this case and used it to my advantage in a recent successful appeal for a claimant, I remember this one well because the appellant was initialised as MM (my initials) Can you please list the issues you are trying to resolve in more detail?
  23. Given your appeal is now quite old, is it still current? Have you made any changes in your circumstances on any part of your claim thus far or since you initial appeal?
  24. The quick and simple answer to your situation is to complete and submit a change of circumstances, give details of your new issues and then see what they say. The DWP then have to reassess your criteria for your benefit, again if you disagree with the decision you can start the process again and appeal, you can also include the errors of fact given in previous appeals and the like. An example of what I mean is already contained in what you have said above, given you transfer your issued meds to your own packs means you struggle to make sure you take the correct medication at the correct time and with the correct foods or not. It would help to see the decision but you will need to depersonalize it before posting. Secondly did you scan your PiP application to your hard drive as a backup? The reason for this is obvious as you can revisit it at anytime, if not you must do this from now on. The education statement is really a non starter and can be sorted with a simple correction letter with proof this will assist you more.. I have a few more questions to ask but will wait to read your response. Mike
  25. Nystagmite I too have issues communicating at a normal level in the real world. Unless I can spend hours/days/weeks and sometimes months studying a response, 'live' conversations on standard topics crucify me big time,, but when allowed to study for a time I can deal with it. Probably like you I get very confused very quickly then turn mean, because I cannot be fully understood properly.... Here we can take time that others can do instantly, this is why it is difficult for us and I hate to use this word 'normal' people take it for granted that we too are 'normal' but sadly we are not... citizenB: I fully agree with what you say, one day I can do a thing easily then the next I cannot, that is the long and short of it. Simply put if the DWP continue to assume that every condition is written down and EVERYONE is affected the same way then things will continue to deteriorate for the claimant. We are not a book that states this IS what it is we are individuals and different as are our disabilities.... Simply put how can we prove a negative?
