  4. thanks ims, - Cotractual interest based on fact that they made a profit adding charges to my account - And limitation act: (a)the action is based upon the fraud of the defendant;
  5. Hi ims, Well as always, I struggled with the section 32 (1) of the limitation act 1980 - customers can claim charges going back more than six years. Cap1 colicitor said that I have no reason to chase this as- -Cap1 already returned some charges (I nver signed anything) -That I will never prove that Cap1 was acting in fraud and limitation act does not appy to my case. lasek
  6. Hello, So I just returned from pre hearing. Was scheduled for 15 minutes and it toke 30... Well capital one said tot he juddge that judge should rule out my claim on pre hearing saying that I will never succeed with my claim and I'm really time waster. They said that they paid all muy charges back and I should forget about the charges that are 6 years old. Very sad day for mu as I was eaten by cap1 and the judge. Judge decided to strike out my claim. Can appeal agains the decision!? Is it worth it? Thx Lasek

  8. Hello all, I have a question and perhaps can someone help me? The company that I work for has their HQ in Canada and UK. Most of work I do remotely (I work in my home for them) and I asked them if I can relocate and work in one of the EU countries. I aproached my managment (Senior director and my manager) and asked them if this will be fine with them and they said yes they dont see any problems + they are happy with my work and etc. However when I aproached my HR dept. I was told that this is impossible as they need to have physical office? Does legislation require a physical offices etc? Does anyone has any ideas? Many thanks in advance, lasek
  9. Hi Jamberson, Thank you for your response. Well I just like to know the answers. Answer kind of - "Buy CCTV and watch it your car is not really a polite answer". Dont you agree? I'm also not suggesting anything. I only said "Gold Mine" as they will make a profit of it at the end of the day.. and I as a resident will pay for it. For broken window and clamp charges. I asked simply why should be penilised. We are paying them monies already for looking after our car park... They should at least see difrence between a car with no permit and a car where somebody smashed windows. Removed radio, removed tax disc and their permit.. It will be better to park my car on the road and that's it. At least I wont be charged with £125 for lak of permit and 325£ additional cost for car removal and perhaps leave car open so maybe criminals will do less damage. We should have rights.. at least when you victim already why CES is making you a double victim?!   10. I hope all you well. CES is about to conquer our car park from 25th of November. The list of rules is long one but fair enough. I rang them this afternoon to ask following questions. - What will happen if during a night, somebody broke into my car and steal road tax, parking permit etc... Guess what they answer was: - You will get clamp! I asked him again (whoever it was he refused to provide a name over the phone) why they will clamp me if they can clearly see that somebody did damaged to the car and cleary its a crime scene now.. Of course I got my anwer... - You should buy CCTV and watch your car 24h. Well then he hang up and that was it. I'm so upset. This is clerly gold mine for them and Housing Association. How on earth they can do this! What shall I do?! Can they touch my car once somebody did the damaged to it? Please advise... lasek

  13. Well my point is: I have contacted them so many times and I asked them to provide me with permit. They simply ignored me. They new that I need to go away etc. I know this is odd but when you talked to someone and ask for permits on 4 occasions??? and you never got one, who's fault is it?   15. Hello folks, Very good friend of mine asked if you could perhaps help. Let me summarise the facts for you: For the last two years I have been purchasing Visitor Parking Permits for parking my vehicle. As I was running out of Visitor Parking Permits, two weeks ago, I ordered more parking permits to CES I didn't receive the permits in the next two weeks, so I called CES and I asked them for a dispensation code, as I was travelling abroad and I didn't want to leave the vehicle without the permits. CES refused to give me any code, stating that they could not verify my identity and people were abusing the use of dispensation codes. Yesterday I returned to the UK and discovered the vehicle had been towed away. I recovered the vehicle paying £545 How we dispute this charge as I think it is unfair. The only reason my vehicle didn't show valid parking permit was because CES failed to deliver them to me. As CES is contracted by East Homes, I would like I have already contacted them and here is their resposne from East Homes: > > Dear XXXXXXXX > > I write to update you on this matter.   16. Hello friends, I just rang Bow County Court. I was just asking for updates etc. They recived all my paper work + allocation form back in June. This case is now in hands of Mr Judge. He will decide and notify me if there will be hearing or not. Feeling very nervous about it.. lasek

Dear all, Just recived a letter dated as 27th June, 2011 from Lewisham Parking Services, __________________________________________________________________________________________________ Dear Mr L, 27th June, 2011 Vehicle Registration number: XXXXXXX Penalty Charge Number: LMXXXXXXXX Amount outstanding: £120.00 I write to confirm that Lewisham Council has recived your representation regarding the above penalty charge notice (PCN). The Parking Representation Unit is investigating your comments and we will repy to you directly. The charge has been put on hold until we send you a letter explaining our decision. If we need any further information from you to help us reach decision, we will contact you. Each PCN is investigated individually. If you recive any letters or notices regarding this or any other PCN9s), please do not igonre them. We currently have a backlog of cases waiting to be considered. Because of this it may take longer to deal with your case then normal. Steps are being taken to reduce waiting time and I apologise in advance for any delay in adressing your case. Any delay in our response will not affect your statuary rights.
