  1. Cheers - forgot to mention that letter was out last week. Let's see now and wait. Well - funny enough I had this reply from them today Dear xxxxxx, As previously advised, the information you received is what was identified in our search of your account on our systems. If you would like to discuss the outstanding balance you can contact our customer services team on 0333 300 3333 who will be happy to assist. Kind Regards, Zara Rai Data Protection Office -------------------------------------------------------------- So Zara Rai gave me a phone number to contact them and to ASK them why those charges has occurred... what a great response to SAR request. You paid for data - you have no data.. and at the end they tell you - contact customer service Doh.. Hi there, Anybody? Shall I send them last email and if no good response then log a complaint on ICO? thanks
  2. Thanks Bazooka Boo, Would you be so kind and help me prepare letter to them? So this is what I made of so far _________________________________________ Dear Sir or Madam, Consumer Rights Act 2015 - / can I use this? / On xx/xx/xx you did reply to me and you provided some details about my account However there is still missing importnat data as how the charges occurded, why me service was not terminated when I asked for. According to the law, I am entitled to have this information with reasonable time given. I would like you to internally and properly investigate what happend to this account. Please respond to my complaint and complete the work in the next 14 days. If you fail to respond/remedy in this time, I will have no option but to consider taking the matter further. Yours faithfully ______________________________________________________ Thank yo!
  3. Hi and thanks for a reply. I asked for SAR I guess this is what they provided me with. But it's still not clear how the all charges occurred. Why they did not close the account when I wrote to them and I asked to close it and terminate the service. just want to close this mater with them and move on. The only info I have is journal from calls between them and me, and vat invoices.
  4. So they were quick and replied with a very nice way...... Dear....... Thank you for your email and I’m sorry your unhappy with the response given. In relation to your request for a copy of your agreement, we have already advised that we operate a ‘paperless’ contract system and we can’t supply you with a signed copy of your contract. If you want details of your contract terms you can view these on directly on our website at www.three.co.uk/Terms_Conditions. Just to explain, any actions taken by staff on your account are logged on the interaction notes that you have received. The information you’ve received is what was identified in our search of your account on our systems. Kind Regards, xxx Data Protection Office hello all, anybody any ideas?
  5. Hi folks! I hope you had nice weekend and thanks for looking into this. So I see your comments and you both suggest to reply back to Three and ask them to investigate case manually. Do we have on CAG such a template so I can forward on to Three and Lowell? Thanks!
  6. Thanks, and what you suggest I shall write to Three?
  7. thanks unclebulgaria67!, but I think they should provide evidence how the numbers worked out. Now I'm confused as not sure what next steps should I take.
  8. Hey unclebulgaria67! I just found in the pile of paper work from Three, a 2 page screen print out from what it looks to me is their revenue software, again with dates, payment amounts, credit, debit, aged classification and balance that it shows : £146.50. as a final balance. So still missing evidence of £388.06 that I suspect its a termination of the contract penalty? This bring us to my earlier post and a reply from Three: ___________________________________________________________________________ Thanks for getting in touch. I’ve looked into your concerns and you’ve said you sent us a letter asking to cancel the account, but I’m afraid we did not receive it. The minimum term contract end date on your account was 6th July 2013 and not February 2012 as you’ve suggested. You cancelled your direct debiticon on 3rd February, after which, we called 10 times and left voicemails for you. We also sent you a letter to say the account needed to be paid. Another 18 voicemails we left for you up until 18th March and more letters were also sent during that period. The debt was then passed to collection agencies and was eventually sold to Lowell in January 2015. As such, the related default will remain on your credit file, as it is an accurate representation of how your account was managed. If you wish to make any payment towards the balance owing, please contact Lowell. __________________________________________________________ I'm glad it worked out for your relatives. Lowell does a 'great' job making profits I guess..
  9. Hey BazookaBoo, thank you for a prompt reply. Yes there was some missing bits and pieces from my end to confirm my identity I believe they are still in 40 days. So what we missing here? Contact details I think. I don't see from any the of the documents a word of saying contarct started from: and suppos to finish end date etc etc. Please correct me if I'm wrong? The print out from excel interaction looks to me like a copy journal between Three and Me. There is a date, contact method, contact reason and comments. So for example: Interaction: 11/07/2012 Contact Method: SMS Contact Reason - Offline Comments: Billing incident My friends from lowlifes gave me an week of silence. So I won't hear from them until 11/03/2016. I wonder how I can politely tell lowlifes to stop contacting me after 11/03/2016. Using argument that this issue is now between me and Three? Cheers and Happy Friday to all!
  10. Hi ya, I went trough the package I got from '3' and read trough so many pages. Anyway.. no sign of contract but just a statement as: "Three operates a 'paperless' contract system and we are exempt, under Consumer Credit (Exempt Agreements) Order 1989, from the need for a signed agreement to be obtained in order for our customer contracts to be in binding law." They are also saying that they did not found any voice calls recording from me to Three and they are not governed by the Consumer Credit Act 1974 and therefore they don't have a statment of account, default notice or deed of assignment in relation to the debt. So I have at the moment: - Letter now with a above statement. - Print out from Excel interaction related to account. - Payment history ( From 06/02/2010 to 11/08/2012). - Billing copies. So the outstanding debt was £146.50. There is no information how they calculated this to £534.56 The difference is of £388.06 but again no word how this figure appeared on final debt. Uuughhhh.... not sure what to do next, any suggestion I would appreciate. anybody?
  11. Hello there! I got a recorded letter - nice package. So I need to look into this, but I'm not sure what I look for? Details of that contract was due to expire? I never signup contract to remind. Also my good 'friends' from Lowell 'kindly' stopped collection actions for next 1 days. Cheers, l
  12. OK, but how about the utility bills? I rent a place at the moment trough a friend. I do all stuff online now. Still I need to provide those? Would just EU ID cover their request? Thank you again for help. l
  13. Hello and Happy New Year! So I got the letter back. The asking for photo copies of ID's, proof of address lol! Well see below! http://postimg.org/image/yw0wx1315/
  14. Not in hand.. I see next action then is : begin 3's lethargic complaints procedure, and send them a SARicon (£10) and get all of the information they have regarding this account. got ya!
  15. Hey BazookaBoo - If I never signup contract. I think they sold me service over the phone!
  16. So they replied Thanks for getting in touch. I’ve looked into your concerns and you’ve said you sent us a letter asking to cancel the account, but I’m afraid we did not receive it. The minimum term contract end date on your account was 6th July 2013 and not February 2012 as you’ve suggested. If you wish to make any payment towards the balance owing, please contact Lowell. Thanks
  17. It all went quiet until recently I got an email from Wonga as this was my original creditor with an information that account is closed and they don't need me to pay this back. Also DC contacted me saying this is the same case so. Bye bye MMF and Wonga for ever...
  18. hey Bazooka Boo and fkofilee, Many thanks for quick replies. So I guess the best option is to sent an email to MD Team - thanks for the details of email address fkofilee. Is there any template I shall use or just explain what happens years ago? What happens if they reject my statment as saying we never got that letter. That what is worries me again. But as per Bazooka Boo 3 was always 'great' in comms to their existing and ex customers. Cheers, l
  19. Hi fkofilee. Thank you for prompt reply. Well I was looking for copy of it but sadly I can't find it. I even mailed this by recorded letter. I guess this is going to be a very problematic case. The contract was 2 years contract and just about to finish. Hence my letter to 3 for a termination of the services and not extending contract for future.
  20. Hello all, I'm having some problems and I hope someone can help. Here are some more details. Letter from Lowell when I tried to dispute the debt. **************************************************************************************************** Current Balance: £534.56 This account was opened on the 6th February 2010 and the mobile number on the account was ‘xxx xxx xxx’. The last payment made to Three Mobile was on the 2nd Febuary 2012 for the amount of £65.78. This acount then became defaulted on the 11th July 2012. As payments have previously been made to this account, this is considered acknowledgement for this debt. Furthermore, the email address associated with this account is also the email address you are currently emailing us from. As you can appreciate, with the information that we hold, we do believe this to be your account. Please can you confirm how you would like to proceed with this account? If you find that you are currently facing financial difficulty and would like to seek free debt advice about this, then you can contact one of the below organisations: • StepChange Debt Charity (formerly CCCS): For debt advice throughout the UK, phone 0800 138 1111 or visit http://www.stepchange.org • National Debtline: If you live in England, Wales or Scotland, phone 0808 808 4000 or visit http://www.nationaldebtline.co.uk for debt advice and information. **************************************************************************************************** As I had some financial issues I have decided to terminate this contract as I was with them for about 2 years. I wrote to 3 back in 2012 (around Jan or Feb) explaining that I won't carry on any further contracts as I'm going to cheaper mobile solutions etc. I never got reply or even a phone call until recently I got the letter from Lowell demanding payment of over £500. I looked into my credit file and they put a default as: Account Opened 6 February 20106 February 2010 Default Date 11 July 2012 Default Balance £176 So I guess regardless my letter this contract was still running? For obvious reason I canceled DD with them as well. Any help would be appreciated. Thank you, l
  21. Thank you Markie1973 How I can refuse to pay all their radicolus charges? Hello - any ideas?
  22. Good morning all, I toke a pay day loan. Due to some financial issues I was not able to repay it on time and 400£ turned to be now 880£. This debt was sold to the MMF. Anyway I don't wont to avoid this debt and I'm willing to pay this all back but I don't have 880£ and I think the charges they put on this account are not fair. Also when I tried to enter into payment plan with the pay day loan lender they never agreed to my offer and they never supplied me with any statments or letters that I asked for. Please does any one have any ideas? Also as MMF was calling my work employer I reported this to ICO, OFT and FOS. Hence this I recived letter this morning: *************************************************************************** Thank you for your recent letter dated, regarding your account with us. I understand you have decided to revoke your doorstep licence. However you have not provided MMF with an alternative form of contact or made an offer of payments to clear your debt with MMF. Please complete and return enclosed Direct Debit Form. Alternatively, please contact us on 0800 9961103 and quote reference M to arrange a repayment plan for the outstanding balance, or to discuss a settlement. Our collections department is available between 8am and 8pm Monday to Thursday, 8am to 6pm Friday and 9am to 2pm Saturday. ***************************************************************************
