You say the following: "Once I had some cash I acknowledged all creditors that contacted me within the 6 year period." How did you acknowledged all creditors, if you done it within the six year period in writing would that not stop it from being statute barred? Regards to all

Hello just to say I was awarded the SDP back in November 2014 and it was back dated to when I was awarded ESA in 2012 and I was pleased to see over £5000 paid into my account. I discovered the SDP by accident, DWP did not award it to me automatically I had to apply for it. Of course things may have changed from the time I got it regarding the back dating time. Have to love the comment at 36.28 where the lady says she will call the police and the response is "well call the police then, their here to assist us" Sadly the above comment is becoming truer by the day. Regards to all

Hello my last payment on the debt claimed by Hoist was November 2010, it has now disappeared from my credit report so any response to further court action and I can now state it is statute barred. Regards to all -

I fully understand that submitting the form is specific to the person/ goods concerned but surely there must be a specific way in what the form should contain, I would like to see the way it should be set out. Regards to all

I am curious, is it not a part 85 form is a standard letter submitted outlining the complaint but containing a standard format, i.e date time and complaint, if so would this not be a template letter recognize by a court ? I for one would like to see how one is set out, whether this is here or in a discussion thread. Regards

Sorry Db but the same can be said about this site quite a few times I have logged on to find posts deleted for no obvious reason. Maybe it's best to stick to posing legal facts and not highlight what is happening on another site. Regards to all

Unfortunately we can discuss what rights a person has to prevent an EA entering but the EA/EO won't necessary mean that they will adhere to the rules as I witnessed a couple of weeks ago where an EA turned up at one of my neighbors for CT and proceeded to try and enter a bedroom window that was open using a telescopic ladder to gain entry. I was about to point out the fact that I thought that what they were doing was no longer allowed, no window a entry and open doors only, that's when I decided to retreat into my shell as a few of the other neighbors recorded them trying and then politely (well with encouragement ) removed them from the building. They have been reported to the police for attempted burglary, unsure as to what stage it is at as I have not been around home for a while but will update when and able. Regards to all

CCA sent 2 yrs ago, no response; now getting letters

Hello from what I have read from this site is that is very very rare that if you do a Full and Final agreement it will only ever show as settled, never removed so stays on your CRA regardless. Regards -

Hi all yes I do have a thread but was just curious about why they issued a claim when not compliant with my CCA request as it was mentioned here, sorry to have hijacked it. http://www.consumeractiongroup.co.uk/forum/showthread.php?445482-Hoist-Cohen-claimform-Ex-Santander-CC&p=4942236#post4942236 Regards to all. -
Hoist/Cohen claimform - Ex Santander CC***Claim Discontinued***
daverules replied to daverules's topic in Legal Successes
Hello re:http://www.consumeractiongroup.co.uk/forum/showthread.php?469865-Robinson-Way-Hoist-portfolio2-chasing-old-Barclaycard-debt&p=4949357#post4949357 curious about the lack of CCA means can not proceed to court. I did a CCA request in May 2015 to RW after being contacted by Cohen saying they would issue a claim against me but once I requested the CCA Cohen informed me that they were aware of my request and it was on hold. RW then wrote to me stating that they did not have the CCA and would request it from the OC. I received a letter each month to inform me that they were still waiting for the OC to supply said CCA and account was still on hold. After about seven months of these letters I then started to receive repayment with discount letters and final a large reduced settlement figure, I ignored all requests to contact them. Move on to may this year and RW started writing again stating that if I did not pay they would be requesting that Cohen begin legal proceedings. Sure enough the clain came through and I am defending it but was just curious as to what you said, as have many others have is " If they can't then the debt is unenforceable and they may not pursue further" so am curious why they are taking me to court even after I requested the CCA again this year. Regards to all.
