  1. This is taken from another Bazooka Boo post but I think is most relevant, answer the following: Certainly more info needed please. Who is the Original Creditor (OC) When was this taken out? When did you last pay anything toward it? What is the amount owed? Has it been terminated? (the agreement) And regarding the "partial settlement" I took a partial settlement with a DCA and sure enough the balance became zero, but that was only zero to that particular DCA, the remaining monies were then chased by another DCA so unless it's Full and Final in writing I would not trust them.
  2. Like yourself, I am not adverse to baiting them and will be paying nothing.
  3. UPDATE Received a letter from Lowells today responding to my Prove It Letter to them, they have placed their collections procedures on hold and have contacted O2 to request an explanation and will get back to me once they have responded. So now I wait.
  4. It's correct, you need to send a SAR to the OC for the information along with a £10.. postal order.
  5. CCA request is £1.00 , use a Postal Order, ensure it's crossed, don't sign it and write on it To Be Used For CCA Request Only
  6. No worries, just thought I may missed a price increase and was going to update my What To Do About Debts Folder.
  7. Others will be along to advise, in the meantime can you provide more info on what the debt is related to and the history involved with it. Do not sent that IE back to them, the have no right to see or ask for it and as you are on benefits you will no doubt only have to pay £1 per month, if anything at all depending on the history. As I say, do nothing til you post what the history is and await the valuable advice that will come this way.
  8. People will reply soon enough but while you wait it would be good if you could provide more information regarding the debt, i,e is it credit card, loan or other and history of the debt then they can respond with the appropriate help.
  9. Yes it does, one of the main reasons they make the discount offer. You see it as a great saving but in reality it does not need to be paid...they fleece you.
  10. Does it say Barclaycard account number just account number? If it's just account number it may be the number Lowlife have assigned to you.
  11. That seems strange as when an item is sent RD or SD the paperwork that's filled in you have to put a return address on it in case of non delivery.
  12. Just an update, had a call from Lowell's last week wanting to discuss how I wanted to make the payment, yea as if I allowed the call to go ahead as I have just purchased Trucall and had just taken my happy pills so was in a teasing mood. The gentleman in question wanted to know my telephone numbers and if I owned my own home, well happy pills or no happy pills I refused to answer any of his questions and only replied that I do not owe a debt and to send me proof of alleged debt and he kept insisting they had but all they had sent was an amount they claimed I owed with no breakdown or what it was for. He finally he hung up Got an email from them asking me to pay the alleged debt as they can see no reason for me not to, replied to that email with the Prove It Letter. Received a letter today from Red Debt Collections agency as they have been asked to collect on behalf of Lowell Portfolio and to call them to make payment, I hope they are holding their breath while waiting for me to call. I now await their next call, cant wait.
  13. Make sure you write on the PO "to be used for SAR only" and don't put a signature
  14. How can they apply doorstep charges when OFT rules and regulations clearly state that you can only visit me at my home if you make an appointment and seeing as no appointment has been made there can be no charges.
  15. I am sure there will be people along that can give you some advice on this but in the meantime while your waiting perhaps you could put some paragraphs in to your post, this will make it easier on the eye to read. Hope you get your problem resolved.
  16. Hi there, around two years ago I ended my contract with O2 but after 6 months of doing so they sent me a letter saying I owed monies and this was my final bill, I wrote back telling them I disagreed with this and I owed nothing. From that period I had to deal with 3 DCA's all trying to collect on behalf of O2 with varying different amounts of what i was supposed to owe, I asked each DCA I was dealing with at the time to send me proof and breakdown of this supposed bill and the first two were unable too so went on there merry way while the third did attempt to offer some thing in the way of 3 lots of account statements that ranged from me owing £62, £38 and £0, nothing related to the £79 that was quoted I owed from their demands and certainly different figures each time depending on what DCA I was speaking to at the time. Spoke with last DCA and sent them off with a flea in their ear and that was last I heard for over a year. Seems now Lowell have sent me two letters in the same envelope both dated 23/2/2012 and received on 27/2/2012, one supposedly from O2 saying that they had sold the debt to Lowell’s and any contact with regards to the debt should be directed to them, I say supposedly because of the poor quality paper it was printed on and the fact that it was sent in the same envelope as the Lowell letter advising me of Assignment of debt. I have had no formal notification from O2 apart from the letter that Lowell’s sent me and so do not recognise their right to try and collect on a debt that has never been proved. Letter from Lowell stated that if i do not pay in full or setup a repayment plan in 5 days they will instruct their debt collection agency Red to collect on their behalf. I now await further communication from these idiot's and look forward to telling them where to go.
  17. Hi, thank you for your replies, i am unable to find my statments at this time, think they are in the loft but I will see what turns up regarding the CCA and then look for them and possibly SAR them as well. Cheers....
  18. Hi there, a week ago I recieved a letter from Fredkinsons saying thaey have been instructed to collect on behalf of Santander relating to a credit card for the sum of £4k+ and advising me that I can pay them via debit card, credit card or cheque, I have had not had time to deal with this as was having health issues relating to a long term illness. Today I recieved another letter dated 02 sep 11 from them containing the following: LETTER BEFORE ACTION THIS DEBT MUST BE PAID IN FULL TO THESE OFFICES WITHIN THE NEXT 7 DAYS OTHERWISE WE WILL TAKE IMMEDIATE ACTION. Should it be necessary to issue proceedings in the County Court (or Sheriff Court as may be appropiate), further additional costs will be added to the balance outstanding. This then shows the following costs that will be added...Court Fees £85.00 and Solicitor Costs £80. Then contains the following.... If a Judgment or Decree remains unsatisfied a bailiff or sheriff officer may be instructed to recover assets to discharge the outstanding dept. Judgment debts are registered by the Court. Now I have read enough on this site to know not to call them tho to be honest I have no qualms about doing so as I don't scare or cave in easily, have had some serious health problems over the past 11 years and demands for money is nothing compared to them. .however, I digress. I believe the card was taken out in 2005/2006 but cant recall what year to be presise but certainly one of those years. Payments were being made until some time last year when they were then stopped due to lack of funds and other concerns. I will be sending off a CCA to Freds this week and report back with any developments, in the meantime any advice or information is greatly recieved. Thank you in advance
  19. Thank you all for the quick replies ,help and support. CCA request going off to them by registered post this afternoon. Cheers
  20. Hi there, I had a credit card with Santander for some years and have kept up with the payments but only the payments as due to being ill over the past seven years with several illnessess I have been unable to work so defaulted on the card. I was unable to deal with this, part burry head in sand and dealing with hospital sttuff and now I owe nearly £5000, £4000 being the credit and £1000 being the charges. End of january I recieved a letter from 1st Credit saying, (this was the first letter from them) "Client: Santander Cards LTD Debt: xxxxx Client Account Number: xxxxxxxxxxx Our records show that the above amount remains outstanding. If you do not make contact we will concider pssing your details to a local Doorstep Debt Collector. This individual would visit your address to confirm that you are still resident and prepare a Pre-Legal report. We appreciate that you may not want a personal visit. I will therefore delay the visit for three days drom the date of this letter to allow you time to settle your debt. Please send your payment blah bla blah DO NOT UNDERESTIMATE THE SERIOUSNESS OF THIS MATTER. Ok no one visited and five days later I recieved the following: "Client: Santander Cards LTD Debt: xxxxx Client Account Number: xxxxxxxxxxx The above amount remains outstanding. We may now take legal proceedings against you and if succesful it may result in- Substantial Legal Costs; -entry of your name in the Register of Judgments, Orders and Fines, which may make it difficult to obtain Credit in the future. Continued failure to make payment could result in enforcement action such as;- -An application to your employer for an attachment of earnings;- -Seizure of your assets by a County Court Bailiff. PLEASE TAKE THIS FINAL OPPORTUNITY TO MAKE CONTACT, TELEPHONE BLA BLA BLA Well not working and only been able to eat and live due to others buying me food, I have no income so what should my next step be please... many thanks for all and any advice.
  21. Hi there, F ive months ago I was in hospital for a month and when I was discharged and returned home I found som letters from BT that they were cutting me off due to non payment of £74.48, upon trying the phone I had indeed been cut off, I rang the BT automated payment system and paid the full out standing amount. I allowed a couple of working days to ensure that the payment had been recieved by BT and it had so I contacted BT regarding the reinstatment of the line and was adived this could not be done as the line had been ceased and therefore would have to setup a new account with a new number and I did so. Was advised of my new number along with mt account number and that she had now removed all referance to me regarding the old account number. Recieved a letter today from DCA on behalf of their client BT, for sum of £42.88, I checked online and could see all my payments for the last 3 months were up to date and no money owed. Had no communication with or from BT regarding outstanding final payment from time of new account being opened and to this day. Contacted the DCA and questioned them as to what it was for. they gave me an account number for my old number and the sum owed was £34.30 plus £8.58 that BT added for refering it to the DCA. The DCA requested that I pay them now along with providing them with my contact numbers, I refused on both accounts informing them I would be contacting BT regarding this matter. Rang BT who refused to speak with me as it has been passed to the DCA. Rang the DCA and informed them that I am writting to BT disputing the bill and they should take note of this, was informed it makes no differance if I dispute the bill at all they would continue chasing payment and that as wriiten on the letter I recieved that could involve me recieving a CCJ, an attachment of earnings or The Balliff visiting my home. Where do I go from here plz? Many thanks
