  1. How wrong is the reg ? obvious or a badly written character ?
  2. Did the ticket have a sticky label or portion to affix it to a windscreen ? If not you need to appeal the NTO, which gets rubber stamped then appeal to adjudication stating the ticket was displayed correctly upon leaving the vheicle and it must have fluttered as they offer no way of affix it permanently, that a car is not air tight, if it was the glass would break when it was sunny.
  3. Before ANY advice is issued on this, are you prepared to attend court and plead not guilty ? That is if excell dont throw the towel at the last minute.
  4. Issue a private summons at the magistrates court for : taking without owners consent. Name both the parking company and landlord on the summons. File as : Contrary to Theft Act 1968 section c60 s 12 [NAMED DEFENDANTS] did wilfully remove and take the vehicle without owners consent . Then Sue for hire car charges on top. They will Poo themselves when the summons hits the door mat.

  12. Unfortunately, the PCN did leave a gap for appeal but as representations have been made about a faulty ticket machine it's shot the op in the foot . Time observed are 15:02 and issued at 15:03 had this had been known before you made your first appeal, the old I was at the machine getting a ticket would have sufficed.   14. No it does not, you are only reading the section you want to read. What the OP has are two consecutive tickets, neither with an expiry time that gives a valid ticket for parking. 50 of the same ticket would not help. No ticket for valid time = PCN. No loss ? please do not confuse, a PPC with a local authority ticket, if this is not paid, or appealed via adjudication the next step will be bailiffs with a tow truck. The OP needs to post up the elusive bit of evidence, the ticket ! ASAP please. Advice will be issued further upon examination of the PCN ticket affixed to the car..
  15. You have no grounds for appeal, you had no valid ticket. If the machine was faulty, you should have moved the car to another car park, purchased a ticket and taken the matter up elsewhere. No valid ticket has very little defence. Your only chance is to post up the PCN both sides and see if it has an error.
  16. Having EXTREME confusion, working out what you have got ? Please describe this letter by transcribing it out minus your details. Describe the paper it is on and any stamps or marks upon it, any dates, the lot. Once I can work out what you have I will help you crucify these sharks in a way they will never forget. The counter claim we put in will bankrupt them.

Private parking tickets work by Impersonating authority, it starts with the sticky wallet on the screen with threats that it is an offence for unauthorised persons to remove, from the off the doubt is cast in to your mind that they may actually have some authority, they dont have ANY. They impersonate authority characters such as parking authorities, debt collectors, solicitors all in a crude attempt to fool you in to paying what is an invitation to pay a private invoice, they back this up with threats of court action. The simple truth is the charge is a unlawful penalty and they would loose in court on that defence. Only really stupid PPC's attempt court and even then most will throw in the towel if a defence is presented of unlawful penalty. You can safely Ignore them, they will huff and puff and vanish. I was a leading poster on MSE until was banned for exposing the site on parking was been moderated by the wife of a PPC owner. They could resist me saving motorists money no more. You can safely trust my advice on this matter as countless thousands have on the forum that sought to ban me.
  18. they are collection agents, I can charge you £200 for reading this and ask a collection agent to pester you, would you take it seriously ? The whole show is an impersonation of authority [problem], the calls are from spotty teenagers on minimum wage, rude and vulgar abuse using some fine anglo saxon English words will halt the calls immediately.
  19. Basically YES, but you will need to drag them to adjudication. They are well known for not sending a case when challenged on the time on the ticket. Many now put 3 times on the ticket, seen or observed from and to and time issued, Leeds only have one, they can not use pocket books, it has to be on the ticket, without this they can not prove the vehicle was observed to be breaking the contravention.

You are most likely covered for purposes of the road traffic act, which is all you need: Contact a motoring solicitor, you will need a specialist who understands the insurance bond certificate and the road traffic act. Insurance can NOT be retrospectively cancelled at road side by the police or insurance companies "fascione vs West Yorkshire police" With the correct solicitor to pull up the clerk of court, you should be cleared, however you may need to appeal the magistrates decision as they have a tendency to ignore the law.
  21. Pulling up the insurance company is just wasting time and effort. Insurance is by way of "bond" you are issued a certificate of that bond and only what is written upon that certificate is valid. You are deemed to have inspected and accepted the conditions printed on the certificate, it can not be retrospectively corrected based upon "but they said" The court will take a plea, you have two choices, guilty or not guilty, if you choose not guilty the clerk of the court will request you produce the bonded certificate of insurance. You either have one or you don't. If you don't and have pleaded not guilty, the Magistrates will add a loading to the punishment. IMO : You will receive 8 points and a £450 fine plus full costs for pleading not guilty and been found so . This offence is absolute liability for private motorists. If you have third party cover it will be written upon your certificate as so. No certificate = guilty. End of story.
  22. A loss explained : if when you parked someone had to write a cheque for £100 or open the cash box and pay out £100, that is a loss. Anything else is a illegal penalty. You can not "invent" losses or claim business expenses spent on the speculation someone might park on your land and you need security to stop them. The charge is a bunch of well known [problem] artists trying it on, ignore them, ignore all the silly threats.
  23. You need to cancel the card as soon as possible, the hire company will hit you again and again. PPC are well known to target hire cars on sight as they know its good easy money, they can even spot block registrations from of hire cras. Start with the bank by reporting the charge as an un authorised transaction, you will need to get round the layers of monkeys to the organ grinders.
  24. Leeds tickets used to only have 1 time on the ticket. It should have time observed and time issued, they had a error on the machines and it only printed one time. Leeds are well renowned for not offering any evidence to adjudication as they dont want the ticket pulling up on the time issues. Check to see if the tickets are still the same, with only one time.
  25. You will have to wait for the summons or re-send the requested paper work correctly and very quickly.
