    The main headline is that Credit Card companies are ripping us off. I'm sure that is only the opinion of the OFT though. Which? magazines Doug Taylor, recommends the small claims track. The underlying theme is the bump to other financial institutions. £300 million is the price quoted. Dave

  4. It was also mentioned on BBC news this morning 0718 HRS, with one of the editors of Which magazine and some wally from a bank. Which are encouraging people to follow the step by step guide in their online mag to take banks to court to recover charges. Not very informative compared with this site, but they are interested in people who have taken court action to get in touch. Hopefully this will generate more publicity. Cheers Dave.

Dear Mr Hoar, Furthur to my letter dated 15th feb 06,requesting the return of all charges made on this account in the last 6 years within 7 days of reciept of the aforementioned letter by way of a personal cheque. Due to your refusal to my request,(in your letter dated 16/2/06),and having had 7 days to return all charges, I unfortunately have no other alternative but to pursue this matter within the County Courts. Was that the same letter you sent? I know its not. They send intimidating letters to scare people. Bully Boy tactics do not work on people who know their rights. We have the law on our side.
  10. Section F, Hearing, on the Allocation Questionaire says "Are there any days within the next four months when you, an expert witness or a witness will not be able to attend court for the hearing" Dave
  11. No Mate , 6th April was the date I had to return the allocation questionaire. The hearing date could be anything up to 4 months away. I will let you all know Cheers Dave

  13. Went into the court to get a mislaid defence. 1. The Defendant admits that the Claimant holds a current account, known as a "FlexAccount" with the Defendant, as stated in the Particulars of Claim. 2. The Defendant's account is currently overdrawn in the sum of £341.12. The Defendant is entitled to set off any liability it may have to the Claimant against the Claimant's liability to repay the overdraft. 3.Furthur and in the alternative, any charges debited to the Claimant's accounts have been debited in accordance with the contract made between the Claimant and the Defendant in relation to the account. The FlexAccount Terms and Conditions that apply to the Claimant's account state: "17. We will debit your FlexAccount with: i) .................... ii) Any charges and/or interest that you have to pay from time to time" 4. The Claimant has been regularley advised of the amount of charges that would be debited to his account in respect of : unauthorised overdrafts; transactions unpaid due to insufficient cleared funds; and card misuse. 5. The Defendant, therefore, denies that the Claimant is entitled to repayment of the charges , as claimed, or at all. blah blah facts true Chas Palma Ham I have picked, so far, TWELVE faults relevant to my case.   15. From the Court, "The defendant has filed a defence, a copy of which is enclosed with this notice. An allocation questionnaire is also enclosed which contains notes for guidance on how to complete it. blah blah by the 6th April" No defence attatched. I will have to nip in tomorrow Cheers Dave

LONG LETTER FOLLOWS Thank you for taking the time to write to us about the charges we've added to your accounts.I understand you feel these are punitive in nature and unfair.I'm sorry for any upset we've caused and I'd like to explain why we've added them. In your credit agreements, which you signed before we opened your accounts, you agreed to pay our fees.To explain, we add an overlimit fee of £20, if your account goes over you agreed credit limit. Anda late payment fee of £20 if your payment is late. I understand you believe these charges are unfair, and the Office of Fair Trading has investigated this.However, our fees are in line with the fees that other banks and financial institutions charge. I can see you have a VISA account and a MasterCard account.Looking at your MasterCard account, we needed a payment to reach your account on 23 February and because we didn't receive one,we would have automatically added a late payment charge.However, to avoid this charge I've cleared the payment we needed, so we wouldn't charge you.Unfortunately,because you've spent over your agreed credit limit by £2.78, we've added on an overlimit fee.But to help,I've refunded this as a gesture of goodwill.You'll see this refund on your 28 February statement.Because your account is overlimit, please make a payment straight away to avoid furthur charges. Looking at your VISA account, I can see you haven't paid your payments on time and haven't paid enough to bring your account up to date.Because of this, we've automatically added the charges to your account each month. You may want to consider setting up blah blah blah I'm afraid we won't refund all the charges we've added because they are correct.However ,as a gesture of goodwill,I've refunded one late payment and one overlimit charge totalling £40. You'll see this ammount on your 5 March statement. Blafh blah blah 1 They agree they they have upset me Signed up?
