  9. I'm subbing as well as I would be interested to know the outcome of this. I had a nationwide basic flex account that was defaulted in 2007 from charges on top of charges to the tune of £272. I now have the pleasure of westcot Credit services harrasing me for the debt. I tried in the past to get them to refund them and I think they have me like £70 back and refused the rest. I'd love to get it sorted as I'm re mortgaging soon, i should start my own thread.
  10. Hey Michael, Thanks for your reply. I decided what i would do is senda letter to Mr Udy saying that I appreciated the response to my inital letter and remind him that clock is ticking and that if i do not receive a satisfactory response by the deadline I will write another lba. Lots of posts today saying people are getting results for C1, well done all!! Fingers crossed for me!! Ta for now Tom
  11. HI Guys, Thought it was time to start a thread on my claim against capital one. So i sent off a Data Protection Act without mentioning the £10 fee to see what would happen. received a reply back stating that they would be happy to comly with my request if i returned payment of £10. However after tidying out our spare room I found all my old statements and sent off a letter stating that i no longer required this but thanks Ms Blunt for her reply. So i worked out the capital one has taken £213.47 in charges on my account, but i never let the account default. So wrote a lba to them asking for charges back giving them 14 days to respond. This morning i received a reply from them stating: Thank you for writing to us about your account. Its going to take a while to look into your situation and come back with a detailed response. We'll do everything we can to get an answer to you within four weeks of this letter. If for some reason our investigations take longer than four weeks, we'll contact you to tell you why. etc tect Mr Robert Udy (Busy man isn't he!!) So they've acknowledged it(in a manner) I remember reading someone where in the capital one forum that someone els ehad received a response like this but i can't remember the action they took after this. My thoughts are that i should send a letter to Mr Udy thanking him for his reply bt reminding him that the clock is ticking and they have one week left to reply to lba. Or should i not rock the boat and wait for 4 weeks for them to write back? Decision decisions!! Ta all Tom

  13. hey All, i am in the middle of filling out forms 1a AND 1b and scotia's post is really helpful with this. i just want to know about section 4. Claim(form of decree or other order sought) For this scotia says to enter a long the lines of: The pursuer calims from the defender the sum of £xxx.xx with interest on that sum at the rate of 8% annually. For the sum do you enter the figure without interest ie in my case £182.79 or the figure with interest, £189.49? Silly question probably but just want to double check Thanks Tom
