  8. Well I have received the DPA request from Citi Cards and sent all the LBA letters with no joy so its time for some court action again. I am however in a little bit of a muddle. While checking back on how long I had held this credit card with Citi I remembered that I also had a revolving credit account also with them many years ago. I also obtained the DPA information for this account also and forwarded LBA letters to cover this account. Now that its time to submit the claim/s do I submit one for each account or can I do one for both accounts? advice please? Disneyman
  9. Hi all I suspect that they are trying to hide there charges from you. I have made a DPA request from them and unfortunately I had been a good boy and had no problem whatsoever in getting copies of statements from them (indeed they have been the quickest to respond). I can only suggest that if you have been charged alot then they are attempting to put up the barracades. Im still pretty miffed at them though as there charging me horendous interest at the Mo but there is little I can do about it as they are abiding by the T&C.

  11. I have today received my DPA from Cetelem. On it are several collection fees amounting to some £200 this is straight forward enough. (Those of you who are unaware of my circumstances must understand that I am currently with a DMC and they have negotioated with all of my creditors to establish fixed repayments of my debts). Also on the statement is "Payment in advance: Litigation £483.73". This appears to be rather a high fee to be charged and the wording Litigation to me means legal action, this "charge" however was made in Dec last year and to date no legal action has been taken against me. Also on the statement is "fees Litigation £100". Can anyone shine any light on these charges prior to me sending LBA letters out as I would really like to know if I would be in the clear in claiming for this charge. If this is a charge "as we know them" could this rank as the highest in the group maybe we should start a tally on the highest ever charge??? By the way the account is basically a HP agreement with currys which Halifax cetelem underwrited.
  12. Sent DPA request on 21 March 06 to there London address as I have several months statements missing so need to ensure I get the full amount.
  13. Hi Fifi, Yes you can claim funds back. Im with a DMC and have lodged claims with all creditors who refuse to tow the line. ie those who are still making charges or interest to the account or indeed those who decide to take legal action. I understand that it is a little like walking on egg shells. Those who have sold the debts onto a Debt Collection Agency I feel are most vulnerable given that they no longer control the account which gives you scope to run riot with them as they can no longer hurt you. I would also speak to your Debt Management company and explain to them that they are still making charges against you. You could also write directly to the creditor again explaining your position and requesting that they return the fees (keep a copy of all letters) this then looks better for you should the matter wind up in court. You can then show the judge the correspondance which has been made to/from the creditor. If you can show that you have done everything which is possible while in your current situation he/she is likely to be in your favour.
